Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City on May 19, 1942..
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
(following members being present: Lemmon, Fryer, Hanson, Mrachek, Nass and Yaeger,
Absent: Alderman Williams, due to illness.
Upon motion by'Fryer, second by Hanson, the minutes of the meeting of
May 4, 1942 were approved.
President Lemmon stated this as being the time and place set for a hear-
ing on the levying of special assessments for the cost of constructing a sanitary
sewer and watermairi in Fifteenth Avenue Southeast from Second Street Southeast to
32 Street Southeast. There was no one present wishing to be heard.
President Lemmon stated this as being.the time and place set for a hear-
ing on the sprinkling, flushing or treating with oil of streets, avenues and alle;
in the City of Rochester. The following protests were read: that First Street
Southeast between Thirteenth Avenue and Fifteenth Avenue Southeast be not oiled
or sprinkled; that Third Street Northeast from Eleventh Avenue Northeast, East,
be not oiled; and that Fifteenth Avenue Southeast from East Center Street to Sec-
ond Street Southeast be not oiled or sprinkled. Alderman Hanson stated that he
had had protests against the oiling of the alley between Fifth and Sixth Street
Southwest from Fourth Avenue to Fifth Avenue Southwest. The above mentioned pro-
tests were referred to the Sprinkling Committee for report at the next meeting.
A letter from the Firemen's Relief Association requesting approval of
the action of their Board in granting an additional loan in the amount of $475.80
to Hubert Vroman and also a loan of $300.00 to Ed Costello in addition to his
present loan, was read, and -President Lemmon referred same to the Finance Commi-
ttee.
The recommendation of the Finance Committee that the loans to Hubert
IVroman and Ed Costello be approved, was read, and upon motion by Mrachek, second
Jby Hanson, same was accepted and ordered placed on file.
The application of the Rochester Dairy Company for an easement to run
a sanitary sewer line across Lot 6, Block 102, Willson's Addition, to connect witr
the.sanitary sewer in Broadway was read, and upon motion by Mrachek, second by
Mass, the request of the Rochester Dairy Company was granted, and the Mayor and
City Clerk were authorized to execute an easement for the construction of a san-
litary sewer across the above described property.
A communication from the Schuster Realty Company stating that they were
interested in the purchase of a part of Lot 6 Block 102 Willson's, Addition, was

(read and President Lemmon referred the same to the Public Grounds Committee, the
Mayor and the City Engineer for report at the meeting on June 1, 1942.
A request by Mrs. C. J. Roseboom that,a storm sewer be constructed to
drain surface water at the corner of Fifteenth Avenue Northeast and Fourth Street
Northeast was read, and President Lemmon referred the matter to the Street and
Alley Committee and the City Engineer.
A notice from the League of Minnesota Municipalities that the annual
convention of the League will be held ,at Ely, Minnesota, on June 15, 16 and 17,
was read, and President•Lemmon ordered that same be placed on file.
A copy of a requisition..for care of Beverly Bradshaw in the Isolation
Department of St. Marys Hospital was read, and same was ordered placed on file.
A copy of a resolution adopted,by.the Commissioners of the Sinking Fund
appropriating $10,525.16 from the Sinking Fund for the purchase of $10,000.00
State of Minnesota Trunk Highway Bonds was read, and upon motion by Fryer, second
by Hanson, the action of the Sinking Fund Commissioners was approved.
A petition that a sidewalk be constructed on both sides of 92 Avenue
Southeast from Eleventh Street Southeast ,to Twelfth Street Southeast was read, ani
upon motion by Nass, second by Fryer, the.verbal recommendation of the Street and
Alley Committee that a sidewalk be built on both sides of 92 Avenue Southeast,
(was accepted.
A communication from the Board of Park Commissioners stating.that they
Thad entered into an ice contract for the arena at the Mayo Civic Auditorium for
Ithe period beginning June 29th to September 7,th, and that the arena would not be
available for any other activity. during that period, was read, and same was order(
Lplaced on file.
A.request by the Lindeen Maytag Company to move their appliance shop
Ito 4-07 Ninth Avenue Southeast, Rochester, Minnesota, for the duration of the War,
land a statement of acquiescence signed by seven residents in that locality, was
tread, and.upon motion by Mrachek, second by Fryer, -same was referred to the Zonin
(Board for report on June 1, 1942.
The report of the Finance Committee approving the reports of the Build-
ing and Plumbing Inspector, the Electrical Inspector, and the City Weighmaster
for the month of April, 1942, was read and same was ordered.'placed on file.
The recommendation of the Street and Alley Committee and the City Engin
leer that a sidewalk be construct on the .West side of Lot 1; Block 6, in Elm Park
Addition, was read. Mrs. Wentworth, owner of the above described real estate,
jappeared.at the Council meeting and stated that she was willing to have the side

walk constructed but would like to have it done later in the Fall. No action was

taken.on the matter as -the Committee -wished to confer -with the Post Master re--
garding mail deliveries before notifying Mrs. Wentworth'as to the date,the side-
Iwalk would have to be constructed.
The statement of expenditures and receipts by the Park Board -.during' the
month of April, 1942,•w6s read and same was ordered placed on file.
The City Engineer's trial balance -sheet for the month of April, 1942,'

was read, and President Lemmon ordered that same be placed on file,..
The. reports of the Clerk of the Municipal Court for' the week .ending
May 9, 1942, showing ciminal fines and costs collected $292:00,-civil fees re-
ceived $6.95, and: conciliation court fees $6.00, and for the week -ending May 16,
1942, showing caiminal fines and costs.collected $254.80, civil fees received
$4. 85, and' conciliation court fees $3.00, were each -read, `and having been- previous
ly approved by the,City Attorney, President Lemmon ordered that -same be placed on

The recommendation of the -Street and Alley Committee and the City Engi
leer that a curb and gutter be constructed on Seventh Street Southwest from Fifth
JAvenue to Seventh Avenue Southwest -and on Sixth Avenue Southwest from Sixth Streei
to,Seventh Street Southwest, was read, and upon motion by Hanson, second by Na.ss
the report was accepted.' for license
The application of Wm. W. Thompson/to operate a trailor camp at 118
Eighth Street Northeast was read, and upon motion by Mrachek, z'econd by Hanson,
the license was, -granted.
- Th-e applications of M. L. Bloom for two licenses to sell- cigarettes were
read, and upon motion by Hanson, -second by Fryer, the licenses were granted.
The application of Roy C. Emerson for a license to operate one -addition-
al pool table at 217 South Broadway was read, and upon motion by Nass, second by
lYaeger, the license was granted.
The applications for Permit to Place and Maintain a -Sign of the Vincent
IKling-Music Co., Candy House, Texaco Service Station, Norman Hotel, (2), and.the
Rochester -Athletic Club were each read, and -upon -motion by Fryer, second by Han-
son -thee Permits were granted. - -
The applications for licenwe to operate Vending Machines of Clyde Bloom,
Osman Service Station, Coca-Cola Bottling Company, -and -the Mayo Clinic (6), were
each read and upon motion by Hanson, second by Yaeger the licenses were granted.
The -applications for license to sell soft drinks of A.G.Do-lden,- Clyde
Bloom (2), Louis Schilling, Mayo .Clinic and Tri State Tel &'Tel Co., were each

to return the bond of Morris Friedell to.have same completed.

Alderman Mrachek introduced a resolution granting two public dance per-
mits to the Southern Minnesota Broadcasting Co., which was read.
Upon motion by Fryer, second by Hanson that the said resolution be

said resolution duly passed and adopted..
Alderman Mrachek introduced a resolution designating streets, avenues
and alleys to be sprinkled or oiled during 1942, which was read.
Upon motion by Hanson, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass A n:troduced a resolution levying special assessments for
a sanitary sewer and watermain in Fifteenth Avenue Southeast from Second Street
Southeast to 36 Street Southeast, which was read. .
Upon motion by Mrachek, second by Nass that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass in a resolution appropriating $337.15 from the
General Fund, and ordering payment made to the Rochester Post -Bulletin for offic-
ial printing, which was read.
Upon motion by Nass, second by Fryer that the said resolution be adopte
as read, and all voting in favor thereof, President Lemmon declared the said reso
lution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $554.67 from the
General Fund and ordering payment made to Union Asphalts &RRoadoils, Inc., for
one 10,000 gallon car of oil, which was read.
Upon motion by Yaeger, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted. -
Alderman Yaeger introduced'a resolution appropriating $369.08 from the
General Fund and ordering payment -made to E.A.Danewick for painting and decorating
interior of City Pound House, which was read.' a .

Upon motion by Fryer, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $554.96 from the
General Fund and ordering payment made to Union Asphalts & Roadoils, Inc., for
9935 gallons of road oil, which was read.
Upon motion by Fryer, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $311.04 from the
General Fund, $0.25 from the Street and Alley Fund, and $13.88 from the Fire Pro-
tection Fund and ordering payment made to the Sherwin Williams Company for paints,
brushes, benzine, etc., which was read.
Upon motion by Fryer, 'second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $47.40 from the
Street and Alley Fund, $81.50 from the Fire Protection Fund, and $234- 35 from the
Sewer Fund and ordering payment made to Dodge Lumber & Fuel Co., for coal and 1
ber, which was read.
' Upon motion by Yaeger, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $300.00 from the
Fire Protection Fund and -ordering payment made to Clements Chevrolet Company for
1937 Chevrolet Panel Truck less trade-in, which was. read.
Upon motion by Hanson, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $2194.19 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrol:
for first half of May, 1942, which was read.
Upon motion by Mrachek, second by Nass that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $252.00 from the
Park Improvement Fund and ordering payment made to Bemel Bros. Auto Parts, for
1008 feet of pipe, which was read*

Upon motion by Nass, second by Mrachek that the said resoluiion'be
adopted as -read, and all voting in favor thereof,•President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $699.12 from the
Park Improvement Fund and $143.10 from the Lighting Fund and ordering payment made)
to City of*Rochester, Public Utilities for steam heat and water for Auditorium,'
which was read.
Upon motion by Yaeger, second by Fryer that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution ordering a first hearing on the
construction of a curb and gutter on Seventh Street Southwest from Fifth Avenue t
Seventh Avenue Southwest and on Sixth Avenue Southwest from Sixth Street to Seven
Street Southwest, said hearing to be on June 1st; 1942 at 2:00 'o' clock P. M. , whiebii

Upon motion by Hanson, second by Fryer that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
A communication from Lee M. Nelson, Superintendent of the City Electrici
Department, -addressed to Alderman John A Yaeger stating.that an order had been
received from the War Production Board that all present street and highway lightir
agreements between utilities and governmental bodies, as of May 6, i942, should
become inoperative; that extensions to present street and highway lighting systems

should be suspended; and that applications for priority assistance in obtaining
material for the above should not be made for the'duration of the war, was read,
land President Lemmon ordered that same be placed on file.

The recommendation of the Fire Committee that all fire equipment/be (i
painted in Fire Engine Red with lettering in.gold bronze or gold leaf, and stripe
in black, was read, and upon motion by Fryer, second by Mrachek, the recommendatio
was approved, and Fire Engine Red be specified for all new equipment.
Mr. A. H. Clemens, Attorney representing five of the milk dealers in the
City of Rochester, stated that on a previous date all had agreed to make no re-
tail deliveries to•the residential part of the town before 7:00 o'clock A.M. He
recommended that the present Ordinance be amended prohibiting the retail delivery
of milk to private residences before 7:00 o'clock A.M. Upon motion by Fryer,
second by Hanson, the City Attorney was instructed to draft an amendment to the
present Ordinance as requested by Mr. Clemens

i•complaints-on the conditions around the oil starage tanks belonging to the Fire -
Stone Company. on North Broadway, Standard Oil Company near Silver Lake, Rochester
iIce & Fuel Company near the Ice Plant and near the Chicago North Western Tracks,
Cities Service Oil Company on the Chicago Great Western Tracks, Pure Oil Company,
I.Shell Oil Company, and.the gas pumps belonging to the Home Oil Company on Fourth
Street Southwest between Broadway and First Avenue Southwest, was read, and upon
motion by Fryer, second by Mrachek the report was accepted and the Fire Warden
1,and the City Attorney were instructed to work out the matter of moving said equip
Iment with the owners, with the exception of the gas pumps located on Fourth Stree
Southwest.
Mayor Grassle stated that orders for increased war restrictions on good
and services can be expected. Upon motion by Yaeger, second by Fryer, the Counci
went on record as being in favor of cooperating with any war requests of the Pres
dent or Governor or.their agents..
A motion was'made by Mrachek, second by Hanson that the plans and
(specifications as submitted by the City Engineer for wiring at the City Bewage
IDisposal.Plant, be approved.
Alderman Fryer introduced a resolution adopting specifications and es-
timate of cost and ordering bids for the wiring at the City Sewage Disposal Plant,
said bids to be received and opened at 2:00 o'clock P.M. June 1, 1942, which was
I read.
Upon motion by Fryer, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the.
(said resolution duly passed and adopted.
Upon motion by Yaeger, second by Fryer, the meeting was adjourned.
