HomeMy WebLinkAbout06-01-1942605 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., June 1, 1942 Minutes of a regular meeting of the Common Council of the City of IRochester,'Minnesota, held in the Council Chambers in the City Hall, in said City,j Ion June 1, 1942. President Lemmon called the meeting to order at 2:OO o'clock P.M., the following members being present: Lemmon, Fryer, Hanson, Mrachek, Nass and Yaeger. Absent: Alderman Williams,.due to illness. Upon motion by Fryer, second by Hanson, the minutes of the meeting of IMay 19, 1942, were approved. President Lemmon stated this as being the time and place set for a hear- ing on the construction of a curb and gutter on Seventh Street Southwest from Fift Avenue to Seventh Avenue Southwest and on Sixth Avenue Southwest from Sixth Stree to Seventh Street Southwest. There was 'no one present wishing to be heard. President Lemmon stated this as being the time and place set for recei ing and opening bids for the furnishing of all labor and material necessary for tr rewiring of four airiators and one new exhaust fan at the Sewage Disposal Plant. The bids of the Foster Electric Company in the amount of $390.00; Nietz Electric Company in the amount of $166.00; and H & Fi Electric Company in the amount of $260.00, were each read and President Lemmon referred the same to the Sewer Com- mit.tee and the City Engineer for tabulation and recommendation. The request of the City Engineer that $3000.00 be appropriated from the (General -Fund and $5000.00 from the Street and Alley Fund for use of the Street and Alley Committee, was read, and same was ordered placed on file. The City Engineer's estimate of cost of constructing a curb and gutter Ion Seventh Street Southwest from Fifth Avenue to Seventh Avenue Southwest and on 'Sixth Avenue Southwest from Sixth Street to Seventh Street Southwest was read, and President Lemmon ordered same placed on file. A copy of a resolution adopted by the Commissioners of the Sinking Fund appropriating $12,000.00 from the Sinking Fund for the June 1st, 1942 maturity of (City of`Rochester 20 Trunk Line Surface Drainage Bonds was read, and upon motion by Fryer, second by Hanson,' the action of the Sinking Fund Commissioners was appr&ved. The request of Guy E. Barnes that he be granted a leave of absence from the'Police Department of the City of Rochester, Minnesota, effective June 15, 1942 and continuing for the duration of the war and six months thereafter, was 'read, and upon motion by Fryer, second by Hanson, the leave of absence was granted'as requested. The request of Gerald L. The Mayor's appointment of Leo Mayou, Orrin Peck and Edwin Lahmers as i special policemen for duty at the Waters Conley Company was read, and upon motion � 1by Mrachek, second by Fryer, the Mayor's appointments.were approved. If A requeat by the Rochester Fire Department Relief Association that the (Common Council approve the purchase of a $750.00 Defense Bond maturing at $1000.0 jfor investment of money belonging to their Association was read, and upon motion 1by Yaeger, second.by Fryer, the action of the Rochester Fire Department Relief jAssociation was approved. A protest presented by Mr. L. W. Schultz, signed by 223 residents of 1the City, against -the amendment to the present Milk Ordinance which Nould prohibi jthe delivery of milk in the residential districts of the City before 7:00 o'clock A.M. was read, and President Lemmon ordered same placed'on file. A remonstrance against the construction of sidewalks on 92 Avenue South east was read and ordered placed on file. Thd report of the Street and Alley Committee and the City Engineer that (the matter of drainage o8 Fifteenth Avenue and Fourth Street Northeast has been (taken care of, was read, and President Lemmon ordered same placed on file. The recommendation of the Street and Alley Committee and the City Engineer that a sidewalk be constructed as soon as possible on the west side of JLot 1, Block 6, Elm Park addition was read, and same was ordered placed on file. The recommendation of the Sprinkling and Water Committee and the City Engineer that the oiling of all streets be continued, was read, and President Lemmon ordered same placed.on file. The report of the Street and Alley Committee and the City Engineer that the oiling of First Avenue Southeast and 10i Street Southeast n6ar Mr: Munkholm's 1propefty, will be taken care of through the cooperation of Mr. A.A.Urness, was !read, and President Lemmon'ordered same placed on file. The recommendation of the Sewer Committee and the City Engineer that the contract for the wiring at the Sewage Disposal Plant be awarded to the Nietz (Electric Company for the amount of $166.00,was read, -and upon motion by Fryer, Isecond by Hanson, the recommendation was approved and same was ordered placed on file. The reports of the'Clerk of the Municipal Court for the week ending (May-23, 1942, showing criminal fines and costs collected $327.30, civil fee§ re- ceived $0.35, and conciliation court fees $4.25, and for the week ending May 29, RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROC,HESTER, MINN., June 1, 1942 607 t 1942, showing criminal fines and costs collected $82.90-, civil fees received $3.4d, and conciliation court fees $4.50, were each read, and having been previously approved by the -City Attorney, President Lemmon ordered that same be placed on f i. l e . The report of expenditures from the City Engineer's Payroll for the month of May, 1942, was.read and same was ordered placed on file. The reports of the Building and:Plumbing Inspector for the month of May, 1942, showing.fees for building permits issued $7.00, and fees for plumbing per- mits issued $7.50, and of the" Electrical Inspector for the month of May, 1942, Ishowing fees for electrical permits issued $1'0.75, were each read, -and President ILemmon referred the same to the Finance Committee. The report of- the City• Weighmaster for the month of May., 1942, showing 217 private loads weighed and receipts of $21.70,-was read, and -President Lemmon preferred same to the -Finance Committee. A recommendation by the Public Grounds Committee that the North 2 of I Lot '5, -and Lot 6,' East of the old Mill Reservation,' in Block 102 Willson's Addit- ion, be not sold at this time, was read, however, in the event that the Common Council determines to offer -the said real estate for- sale, the Committee further recommended that the property'be appraised by three appraisers and -then sold after advertisement for bids. Upon motion by Fryer, second by Mrachek-, the (committee recommendation was accepted and ordered placed on filer The Public Grounds Committee reported that the house at the City Dump Grounds had now been put in a state of good repair'and recommended that any ex- pense on this -property outside of the usual and ordinary wear and tear, should be charged to the occupant. The Committee further recommended that a lease between the City -of Rochester.and Darrell Sanford, iaho-now occupies the house, be entered into,containing these provisions: President Lemmon ordered that the communication be placed on file -and the City Clerk was requested to- send a copy' of the action taken by the Common Council to the Board of Public Health and -Welfare: A protest against the construction of'a curb and gutter on Fourth Avenu ! Southwest between Fourth and Fifth Street - Southwest by -Mrs. -Madge B.-,Knowlton, was read and same was ordered placed on file. The application of• William F. Hagedorn for a Plumber's license -was read, and upon -motion by Nass, second by Mrachek, the license was granted. The application of L.A.Kepp Co. for an Electrical -Contractor's License was read, and upon motion by Hanson, second by Nass, the license was.granted. ..The application of L.A.Kepp for a Master Electricians License was read, land upon motion by Mrachek, second by Nass, the license was granted. Rehling,/and Waters Conley Company were each read, and upon motion by Hanson, second by,Nass, the licenses were grantfed. The applications of Bach Music Company and Mortenson,Motor.Company (2) ,for permit to Place and Maintain a sign, were seach read, and upon motion by Hanson, second by Yaeger,.the permits.were granted. The applications of Helmer Rude, Don Arenz and Mrs. George Henke for license to sell cigarettes at xalAkil: retail, were each read, and upon motion by lHanson, second by Mrachek, the licenses were granted. The applications of Helmer Rude, Ben F. Rehling, Leo.A. Hennum, Mrs. George Henke, Mrs., Marie Stortz, and the Kahler Corporation (4), for license to sell soft drinks, were each read, and upon motion by Mrachek, second by Nass, the licenses were granted. The license bonds of Fellows Auction Company in the sum of $1000.00 with the National Surety Company as surety, and William Hagedorn in the sum of $1000.00 with.the Western Surety Company as surety, were read, and upon motion by Fryer,.second by Hanson, the bonds were approved, th-e surety thereon accepted and it was ordered that same be placed on file. Alderman Nass introduced a resolution appropriating $221.63 from the (Park Improvement Fund and ordering payment made to Schwarz Paints for paint, papei land other -supplies, which was read. Upon motion by Mrachek, second by Nass that the said resolution be (adopted as read, and all voting in favor'thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Nass introduced a resolution appropriating $1996.68 from the Public Health & Welfare Fund, Code 1, and'ordering payment made to the Public Health & Welfare Fund, Code 2 for transfer of funds, which was read. Upon motion by Hanson,�second by Mrachek that the said resolution be adopted. as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Nass introduced a resolution appropriating $2050.00 from the Interest Fund and ordering payment made t6 the First National Bank of Rochester, Minnesota, for June 1st, 1942, maturity of interest on City of Rochester Bonds, (which was read. Upon motion by Yaeger, second by Fryer that the said resolution be (adopted as read, and all voting in favor thereof,' President Lemmon declared the said resolution duly passed and adopted. 013 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, '-MINN., June 1,, 1942 • h • Alderman Yaeger introduced a resolution appropriating $327.85 from the General Fund and $12.10 from the Street and Alley Fund.and ordering payment made to Morse Bros., for sand and" truck rental, which was read. Upon motion by Fryer, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly -passed and adopted. Alderman Yaeger introduced a re.solution granting a public dance permit to Don Meighan and Mike Maloney, which was read. Upon motion by Mrachek, second .by Yaeger• that- the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the I.said.resolution duly passed and adopted. Alderman Fryer introduced a resolution insuring re -Instatement of city employees,to their former positions, upon their return, should they be called or volunteer in the armed forces of -the United States during the present war, which was read. t Upon motion by Nass, second by Mrachek that the said resolution be ad -opted as read,. and all voting in favor thereof', President Lemmon declared - the said resolution duly passed and adopted. - Alderman Yaeger introduced an Ordinance amending an -Ordinance entitled:, "An' Ordinance regulating the installation, construction and maintenance of plumb- ing, plumbing fixtures, private sewers and sewer connections within the City of Rochester, Minnesota," same being Ordinance No. 43.3, which was given its first Z reading. Upon motion by Mrachek, second -by Fryer and all voting in favor thereof the rules were suspended and the said Ordinance was given its second reading. Alderman Fryer introduced an Ordinance amending an Ordinance entitled, "An Ordinance to regulate the production, transportation, processing, handling, sampling, examination, grading, labeling, regrading, and sale of milk -or milk products; the inspection of dairy herds, dairies, and milk plants; the issuing a (revocation of permits to milk producers and distributors; the placarding of res- Itaurants and other establishments serving milk or milk products; and the fixing Iof penalties," same being Ordinance No- 535, which was given its first reading. Mayor Grassle recommended that a survey be made at this time to deter - Imine what improvements might be necessary and could be set up as post-war projects President Lemmon appointed the Council as a xkx committee of the whole to serve with the Mayor in making the survey and plans for future improvements. Mayor Grassle brought up the matter of changing the speed limits within the City of Rochester to 20 miles per hour, and also the matter of heavy trucks 6=4 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., June _1 , 1942 traveling on.certain streets within the City limits, and President Lemmon referred same to the Mayor, the Police Committee and the Chief. of Police. Mayor Grassle. stated that the, Waters Conley -Company would, have to con- struct a fence around their factory, and they requested permission to move the sidewalk on First Avenue Northwest so the fencing could be installed. Upon motion by Fryer, second by. Hanson the Waters Conley Company was granted permission to move the sidewalk, providing that same would be replaced in fits present location after the war. Chief of Police, H.N. Tompkins, brought to .the attention of the Common Council the matter.of repairs on,the roof of the police garage, and President Lemmon referred same to the Public Grounds Committee, the Building Inspector, and the Chief of Police. Chief of the Fire Department, C. E. Ginther, stated that the •69th Annual Convention of Fire Chiefs was to be held at Shakopee, Minnesota, June Sth, 9th, and loth, and asked for permission for himself and two members of the Department to attend. Upon motion .by Mrachek, second by Hanson, the Fire Chief and two mem- bers of the Department were given permission to attend.the Convention at the expense of the City. Upon motion by Fryer,second by Mrachek, $199.00 was appropriated for the Mayor's Contingent Fund.
