Minutes of an adjour-ned regular meeting of the Common Council of the
(City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
!sans, City on June 18, 1942.
President Lemmon called the. -meeting to order at 7:30 o'clock P.M., the
Ifollowing members being present: Lemmon, Fryer, Hanson, Mrachek, Nass, and Yaeger
Absent: Williams, because of illness.
Upon motion by Fryer, second by Hanson•, the minutes of the meetings of
(June 1st, and June 8th., 1942, were approved.
President Lemmon stated this as being the time and place set for a hear-
ing on the construction of a curb and gutter on Seventh Street Southwest from
Fifth Avenue to Seventh Avenue Southwest and on Sixth Avenue Southwest from Sixth
(Street to Seventh. Stre.et Southwest. There was no one present wishing to be heard.)
President Lemmon stated this as being the time and place set for re-
ceiving and opening bids for the construction of a curb and gutter o•n Seventh
Street Southwest from Fifth Avenue to Seventh Avenue Southwest, and on Sixth Avenue
Southwest from Sixth Street to Seventh Street Southwest. The bids of.'C.C.Pagen-
hart in the amount of $2272.50 and H.T.Earle in the amount of $1523.25.were each
read and President Lemmon referred same to the Street and Alley Committee and the
City Engineer for tabulation and recommendation.
Mr. George C. Henke appeared before the_ Council and asked when the new
road laid out on the North line of the City Limits, would be graded. President
ILemmon referred the matter to the Street and Alley Committee for report at the
(meeting of July 6, 1942.
A petition requesting the removal of an old'dam North of the bridge on
Fourteenth S.treet Northwest and that other debris which now obstructs the flow of
the water of Cascade creek within the city limits be removed and the said channel
cleared, signed by 147. residents of the North part of the City, was read. Mr..
Howard Sanborn and Mr. Earl Pike, representing the signers of the petition, re-
quest ed that a survey of the Cascade creek be made as soon as possible, and that
any improvements which woud.d eliminate flood damage, be made.- Mr. Wilber, of the
Wilber Baggage & Transfer Co., also recommended that certain changes be made in tY
(sewer system in the flood area.
President Lemmon referred the matter to. -the Street and Alley Committee,
(the City .Engineer,.and the City Attorney -to make a survey and study of the area
damaged by the.flood water as to what could be done Vo improve the situation in
case. of floods in the future.
The application for a leave of absence from his duties on the Rochester
(Fire Department for the duration of the war of B,A.Rosenthal was read, and upon

A communication from A.F.Aufenthie regarding the assessment against his
roperty for a"sanitary sewer and watermain was read, and upon motion -,by Fryer,
second by Mrachek, the City Attorney and City Clerk were requested to draw a reso-1
lution re -assessing the sanitary sewer and watermain to Mr. Aufenthie under the
new descriptions of his property as requested in his communication.
:A letter from Mr. Leo A. Hennum protesting the licensing of soft drink
and confection machines was read, and upon motion by Yaeger., second by Fryer, the
matter of issuing licenses for vending machines was deferred and the City Attorne
was requested to make a report on a recent ruling concerning the legality of
licensing such machines.
The recommendation of the Board of Zoning that Mr. J. W. Lindeen be per-
mitted to operate his Maytag Appliance Shop at No. 407 Ninth Avenue Southeast for
the duration of the war, subject to cancellation at any time for abuse of the
.privilege, was read, and upon_ motion by Mrachek, second by Fryer, the recommendatil'on
was approved.
A copy of a resolution adopted by. the Public. Utility Board requesting
that the Common Council authorize the said Board to enter into a contract in the
sum of $4,791.25 with the Fullerton Lumber Company for furnishing 310 Western
Red Cedar Poles, was read, and President Lemmon ordered.same placed on file.
A copy of a resolution adopted by the Public Utility Board requesting
that the Common Council authorize the said Board to enter into contract for the
purchase of 10,000 tons of.coal screenings as follows.: Walter Bledsoe & Company,
7,000 tons; Sahara Coal Company, 2,000 tons; and Sterling Midland Coal Company,
1,000 tons; was read and President Lemmon ordered same placed on file:
A petition to the Common Council that the delivery of milk or cream be
not permi.tted before seven o'clock in the forenoon was read,' and President-*Lemmon

ordered. same placed on fill.
A communication from the League of Minnesota Municipalities regarding
its pamphlet entitled• "War Emergency & Civilian Defense Suggestions foi- Minnesota
Municipalities" was read, and same was ordered placed -on file.
The recommendation of the Street and Alley Committee and the City Engin-
eer that the contract for the construction of curb and gutter on Seventh Street
Southwest from Fifth Avenue to Seventh Avenue Southwest and on Sixth Avenue South-
west from Sixth Street to Seventh Street Southwest be awareded to H.T.Earle, was
read, and upon motion by Mrachek, se,condby Yaeger, the recommendation was approve

and the Chief of Police have inspected the coping on the City Hall Building and

have found same to be in need of re -calking, was read, and upon motion by Mrachek,
second by Fryer, the matter was left in the hands of the above Committee with
power to act.
The report of the Public Grounds Committee and the Chief of Police that
they and a xxxpx representative from the Barrett Roofing Company have inspected
the roof of the City Hall Building and have found same to be in good condition,
was read, and President Lemmon ordered same placed on file.
The City Engineer's Trial balance. sheet for the month of May, 1942, was
read, and upon motion by Wass, second by Ranson, same was accepted and ordered
placed on file.
The statement of expenditures and receipts in the Park Improvement Fund',
during the period ended on May 31,.1942 was read, and President Lemmon ordered
that same be placed on file.
The reports of the Clerk of the Municipal Court for the week ending
June 6, 1942, showing criminal fines and costs collected $99.00, wivil fees re-
ceived $9.30, and conciliation court fees $7.50; and for the week ending June 13,
1942, snowing criminal fines and costs.collected $170.90, civil fees received
$3.60, and conciliation court fees $5,00, were each read, and having been prev-
iously approved by the City Attorney, President Lemmon ordered that same be
placed on file.
The application of Ben Zimdars for a Journeyman Electrician's License
was read, and upon motion by Fryer, second by Hanson, the license was granted.
The applications of Mrs. Marie Stortz, Joseph W. Leiferman, Claude Darst
and the Samaritan Hotel for license to sell cigarettes were each read, and upon
motion by Fryer, second by Hass, the licenses were granted.
The application of Harry J. Wernecke for transfer of cigarette license
No. 94 from 922 North Broadway to 15 Seventh Avenue Northwest, was read, and upon
motion by Wass, second by Mrachek, the transfer was granted.
The application of Kenneth Silker for license to operate a public
automobile camp was yead, and upon motion by Wass, second by.Yaeger, the license
was granted.
The application of F,F.Hilmer for an Auctioneer's License was read, and
upon motion by Yaeger, second by Fryer, the license was granted.
The applications of Agnes Krom and Joseph W. Leiferman for license to
sell soft drinks, were each read, and upon motion by Hanson, second by Mrachek,
the licenses were granted.
The application for transfer of 3.2 "Off Sale" license No. 725 and 3.2
"On Sale" license No. 419 from J.W.Finn to H.E. Lipscomb was read, and upon motion

by Yaeger, second by Fryer, the transfer was approved.
Applications for license to operate a vending machine -of the Canteen
Co. of Whitehall (14), Oscar Dornack, Postier & Eggers, Samaritan Hotel, T.M.
McDonnell (2), George Moore, Burnham's Standard Service, Jefferson Transp. Co.,
and M..Brodie Co. (12) were read and action on same was deferred.
The License Bonds of L. A. Kepp with the Fidelity & Casualty. Co. of New
York as surety, F.F.Hilmer with the National Surety Corp: as surety, and Morris
Friedell with the State Automobile insurance Association as surety, each in the
sum of $1000.00; the Official bonds of Chester R. Fellows, Harold M. Fitzpatrick,
Orville L. Rowland, Merlin C. Mewhorter, Andrew J. McCrudden, Irvin J. Renning,
Arnold C. Anderson, Carl J. Briese, Wm. P. Bennyhoff, Albert K. Thompson, Dallas
P. Nield, Joseph L. McDermott and Eugene M. Bronson, each in the sum of $500.00,
Eldin L. Holtorf in the sum of $1000.00, all with .the St. Paul Indemnity Company
of St. Paul as surety and Ralph W. Sanders, in the sum of $500.00.with the Westerr.
Surety Company as surety were each read, and,upon-motion by'Mrachek, second by
Nass, the bonds were approved, the surety thereon accepted, and i-t was ordered
that same be placed on file.
Upon motion by Fryer, second by Hanson, the City Clerk was authorized
to- return the continuation or renewal certificates of Harold M. Fitzpatrick,
Orville L. Rowland, Merlin C. Mewhorter, Andrew J. McCrudden, Irvin J. Renning,
Arnold C. Anderson, Carl J. Briese, Wm. P. Bennyhoff, Albert K. Thompson, Dallas
P. Ni eld, Joseph L. McDermott, Eugene M. Bronson and Eldin L. Ho 1 torf , and the
official bond of Frank E. Roth whose resignation as Justice of the Peace has been
accepted.
The following claims were read, and upon motion by Yaeger, second by
Fryer, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants on the City Treasurer and make payments accordingly:

President Lemmon announced the appointment of the following members of
the Common Council to serve on the Board of Equalization: Alderman Harold J.
Mrachek, Harry V. Hanson, and John A. Yaeger.
Upon motion by Nass, second by Fryer, the appointments to the Board of
Equalization were approved.
Alderman Fryer introduced a resolution authorizing the Public Utility
Board to enter into contract with the Walter Bledsoe & Co., Sahara Coal Co., and
the Sterling Midland Coal Company, which was read.
Upon motion by Yaeger, second. by Nass that the said resolution be.
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
.Alderman Fryer introduced a resolution authorizing the Public Utility
Board to enter into contract with the Fullerton Lumber Company, which was read.
Upon motion by Nass, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution.duly passed and adopted.
Alderman Mrachek introduced a resolution.accepting the bid of H.T.Earle
for the construction of a curb and gutter on Seventh Street Southwest from Fifth
Avenue to Seventh Avenue Southwest and on Sixth Avenue Southwest from Sixth Street
to Seventh Street Southwest, which was read. .
Ullon motion by Mrachek, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass introduced a resolution granting four public dance permits
to Michael P. Maloney, which was read.
Upon motion by Hanson, second by Fryer that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass introduced a resolution appropriating $1078.415 from the
General Fund and ordering payment made to the Street and Alley Fund for use of
equipment during May, 1942, which was read.
Upon motion by Fryer, second by Yaeger that the said resolution be

adopted as -read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $549.97 from the
General Fund and ordering payment made to Union Asphalt & Road Oils, Inc., for
9,727 gallons Road Oil, which waq read.
Upon motion by Hanson, second by Fryer that the said resolution be
adopted.as read, and.all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $254.75 from the
Street and Alley Fund and ordering payment made to Litho -print Company of New York,
Inc., for 137 maps printed, which was read.'
Upon motion by Fryer, se¢bnd.by Yaeger that the said resolution be
adopted as read, and all voting in'favor thereof, President Lemmon declared, the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $963.90 from the
Street and Alley Fund and ordering payment made to the Street -and Alley Fund for
use of equipment during May, 1942, which was read.
Upon motion by Yaeger, second by Nass that the said resolution be
adopted as read; and all voting in favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $599.91 from the
Street and Alley Fund and ordering payment made to the General Fund, Code 29, for
4296 gallongi of gasoline from Tank Car UTLX 76672, which was read.
Upon motion by Nass, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Manson introduced a resolution appropriating $1936.20 from the
Permanent Improvement Revolving Fund and ordering payment made to the General
Fund, Code 19, for portion of cost of widening North Broadway, which was read.
Upon motion by Fryer, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $2143.07 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payroll
for the last half of May, 1.942, which was read.
Upon motion by Fryer, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Mrachek introduced a resolution appropriating $2627.17 from th
Park Improvement Fund and ordering payment made to the Mayo Trust Fund for pay-
roll for first half of June, 1942, which was read.
Upon motion by Mrachek, second by Fryer that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
I Alderman Mrachek introduced a resolution rescinding the,resolution or-
dering the $14,000.Oo - 1%.Street Repair $ond issue, which was read.
UpQn motion.by Fryer, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed.and adopted.
Chief of Bdlice, Harry K. Tompkins, stated that the State Police Conven
'tion would-be held at Cloquet, Minnesota on.June 21st, 22nd,•and 23rd, and asked
1for permission to attend same. Upon motion by Fryer, second by Hanson,.the Chief'
of Police was.granted permission toaattend the State Convention at City expense.
Chief C. E. Ginther of the Fire Department, stated that he had received
word from the Seagrave.Company that the Pumper and Hose Car was not ready for
delivery, and he requested permission to go to the factory and drive same to
Rochester. Upon.motion by Nass,.second by Mrachek, Chief Ginther'.s request was
granted, his expenses to be -paid from City funds.
Upon motion by Fryer, second by Hanson, the City Clerk was instructed
to return the.certified check,of Mr. C. C.Pagenhart, submitted with his bid for
the construction of curb and gutter.
Upon motion by Mrachek, second by Fryer, the meeting adjourned.
