RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL
OF THE CITY OF ROCHESTER, MINN.,_ July 6, 1942
Minutew of a regular meeting of the Common Council of the City of Roch-
ester, Minnesota, held in the Council Chambers, in the City Hall, in said City, of
iJuly 6th, 1942.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being present: Lemmon, Fryer, Hanson, Mrachek, Nass, and Yaeg
Absent: Alderman Williams, because of illness.
Upon motion by Fryer, second by Hanson, the minutes of the meeting of
June 19, 1942, were approved.
A communication from the Rochester Fire Department Relief Association
requesting the approval of a $2500.00 loan on a farm in Fillmore County to Wilberi
McHenry, and also a $1200.00 loan on his home in the City, was read, and President
ILemmon ordered that same be placed on file.
The recommendation of the Finance Committee that the Common Council
approve the granting of the loans to Mr. Wilbert McHenry was read, and upon motion
by Mrachek, second by Nass, the same was accepted and ordered placed on file.
A communication from the Police Civil Service Commission stating that
Axel W. Moberg, B. Seth Green, and Hyatt D. Frost has been appointed as acting
Patrolmen without previous experience to fill the vacancies in the Police Depart-
ment caused by S.J.Porter, Guy E. Barnes, and James J. Macken, Jr., entering the
armed forces of the United States, was read, and upon motion by Fryer, second by
Mrachek, the appointments were approved and ordered placed on file.
The Mayor's emergency order given to the City Clerk for the purchase of
one car load of gasoline was read, and upon motion by Mrachek, second by Fryer,
the said action was approved.
A communication from the Board of Park Commissioners calling the atten-
tion of the Common Council to a condition in Cascade Creek at Eleventh Avenue
Northwest which has reduced the waterway clearance at the bridge, was read, and
President Lemmon ordered that same be placed on file.
The City Engineer's specification and estimate of cost for nine overhead
doors at the City Warehouse were read, and upon motion by Mrachek, second by Han-
son, the matter was referred to the Street and Alley Committee and the Public
Grounds Committee for report at the next meeting.
Resolutions adopted by the Commissioners of the Sinking Fund transferriz
$7000.00 from Code 5 to Code 13 of the Sinking Fund to make same available for II

for the purchase of Township of Featherstone Road and Bridge bonds for the Elec-
tric Light Depreciation Reserve investments, were read, and upon motion by Mrachek,
second.by Hanson, the actionsof the Board were approved.
A resolution adopted by the Public Utility Board requesting the Common
Council to authorize the establishment of a Sinking Fund for Electric Department
Extensions was read, and President Lemmon .ordered same placed on file.
The -request of the Board of Park Commissioners that the Common Council
approve an increase in salaries of two Life Guards of $5.00 each per month, and
the swimming coach of $10.00 per month for the months of July and August, was read,
and upon motion by Hanson, second by Nass, the matter was referred to the Finance
Committee with power to act.
A communication. from H. N. Tompkins, Chief of Police, advising that the
Police Civil Service Commission had certified Hyatt Frost, Axel Moberg, and B.
Seth Green for service as Patrolmen without previous experience, they to serve
temporarily in the absence of S.J.Porter, Guy Ee Barnes, and James J.Macken, Jr.,,
was read, and ordered placed on file.
A communi-cation from the Painters Local No. 681 of Roch-ester, Minnesota If
opposing the painting of the City Fire Hall being done by City Firemen, was read,
land upon motion by Yaeger, second by Fryer, the matter was referred to the Fire
Committee with power to- act.
The report of the Street and Alley Committee, the Mayor, the City Engi
eer, and the City Attorney, who were appointed to meet with the newly organized
Flood Control Committee to make an investigation of the damages along Cascade
Creek in the north part of the City, was read, and the following recommendations
were made: The construction of a new bridge on Eighth Avenue Northwest; the re-
moval of trees and widening of the channel of the creek just south of -the Seventh
Street Northwest bridge; that certain gas lines and sanitary sewer pipes .which are
lhung under the Seventh Street Bridge be.raised to the level of the floor; that th
riverbed north of the Fourteenth Street bridge should be cleared; and -that a fu
lure election be held and amendment made to the present charter establishing a.
Planning Board.
Upon motion by Hanson, second by Nass, the report of the Committee was
accepted and the City Clerk was instructed to send a copy to Mr. Pike, President
of the Flood Control Committee, and the Street and Alley Committee were instructe
to continue with the work which they can legally do with the finances available
at this time. s
It was further recommended'by the Committee that plans and specifications
be prepared for a bridge on Eighth Avenue Northwest, and upon -motion by Fryer, I4

The application of Everett C. Godfrey for a permit to place and maintain

A certificate of Insurance issued by the Hartford Accident and Indemnity
Company covering the Rochester Chamber of Commerce, the City of Rochester. Minnes-
ota,'and the United States Fireworks Company, was read, and upon motion by Mrachek
second by Hanson, same'was approved and ordered placed on file.
The officiai bonds of ' Hyatt D. Frost and Richard Towey,' each in the sum
of $500.00, and of Edwin Lahmers, Leo Mayon, and Orrin Peck, each in the sum of
$1000.00 with the Fidelity and Casualty Company of New York as surety; the contrac

The report of the City Weighmaster for the month of June, 1942, shww'ing
222 private loads wiighed and receipts of $22.26, was read, and President Lemmon
referred same *to the Finance Committee.

The reports of the Clerk of the Municipal Sourt for the week ending
June 20, 1942, showing criminal fines and costs collected $305.60, civil fees re-.
ceived $11.10, and conciliation court fees $2.50; for the week ending June 27,194 2
showing criminal fines and costs collected $578.75, civil fees received $9.30, and
conciliation court fees $5.50; and for the week ending July 3, 1942, showing crim-
inal fines and costs collected $115.40, civil fees received $9.00, and conciliatio
court fees $2.00, were each read, and having been previously approved by the City
Attorney, President Lemmon ordered that same be placed on file.
The City Engineer's Trial Balance Sheet for June, 1942, was read, and
President Lemmon ordered that same be placed on file.
The report of expenditures from the City Engineer's payroll for the
month of June, 1942, was read, and same was ordered placed on file.
The following claims were read and upon motion by Yaeger, second by Frye
the Mayor and City Clerk were authorized and directed to draw warrants upon the

Alderman Fryer introduced a resolution appropriating $200.75 from the
General Fund and ordering payment made to Sam Larson and Herbert Willcox, Attorney,
for settlement of claim, which was read.

Upon motion by Fryer, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $3000.00 from the
General Fund and ordering payment made to the Street and Alley Fund for expense
due to repairing of flood damage, which was read.
Upon motion by Hanson, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $245.80 from the

ial printing and publishing, which was read.
Upon motion by Mrachek, second by Nass that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Fryer introduced a resolution appropriating $1093.39 from the

General Fund and ordering payment made to Union Asphalts & Roadoils, Inc., for
two 'cars of road oil, which was read.
Upon motion by Nass, second by Yaeger that the said resolution be

Alderman Hanson introduced a resolution appropriating $1217.40 from the
General Fund, $970.75 from the Street and Alley Fund, and $78.25 from the Sewer

Fund, and ordering payment made to the Street and Alley Fund for use of equipment

during June, 1942, which was read.
Upon motion by Fryer, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Hanson introduced a resolution appropriating $586.76 from the
General Fund and $?47.78 from the Street and Alley Fund and ordering payment made
to Morse Brothers for truck•rental and sand, which was read.
Upon motion by

read, and all voting in favor thereof, President Lemmon declared the said resolu-
tion duly passed and adopted.
Alderman_Hanson introduced a resolution appropriating P334-91 from the,
General Fund, $2.00 from the Street & Alley Fund,•$23.40 from the Fire Protection
Fund, and $2900.79 from the Lighting Fund and ordering payment made to City of
(Rochester, Public Utilities for light and water used, which was read.
Upon motion by Fryer, second by Yaeger that,the said resolution be
adopted as read, and.all.voting in favor thereof, President Lemmon declared the
s,ai,d resolution duly passed and adopted.
Alderman Yaeger introduced a resolution -appropriating $245.50 from the
Street and Alley Fund and ordering payment made to,Gordon S. Johnson Estate, for
use of bulldozer and tractor in filling in washouts, which was read. -
Upon motion by Hanson, second by Fryer that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
°Alderman Mrachek introduced a resolution appropriating $567..00 from the
Street and Alley Fund and ordering payment made to Quarry Products Co., for fill
used at various flood washouts, which was read.
Upon motion by Mrachek, second.by Nasd that the said resolution be
adopted.as read, and all voting in favor thereof, President Lemmon declared the
said -resolution duly passed and adopted.,
Alderman Mrachek introduced a resolution appropriating $2599.74 from th
Park.Improvement Fund and ordering payment made to the Mayo-Trust.Fund for payrol
for last half of June, 1942, which was read.
Upon motion by,Yaeger, second by Nass that the said resolution be
adopted as read, and all noting in favor thereof, President Lemmon declared the
said resolution duly passed.and adopted.
Alderman Mrachek introduced.a resolution appropriating:,$202.68 from the
Park.Improvement Fund and $122.95 from the Lighting Fund and ordering,payment mad
to City of Rochester, Public Utilities, for light and water used, which was.read.
Upon motion by Fryer, -second by Hanson that the said„resolution be
adopted as read, and all voting in favor thereof, -President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass introduced a resolution appropriating $5$9.70_from the

Upon motion by Hanson, second by Mrachek that the•said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Naas introduced a -resolution -appropriating $530.00 from the
Permanent Improvement Revolving Fund and ordering payment made to the First Nation
al Bank for July 1st, 1942 maturity of interest on bonds, which was read.
Upon motion by Mrachek, second by Kass that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Naas introduced a resolution appropriating $4412.50-from the
jInterest Fund and ordering payment made to the First National Bank of Rochester,
lfor July 1st, 1942 maturity of interest on light and water bonds, which was read.
Upon motion by Yaeger, second, by Fryer. that- the said resoluution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Ald.erman Kass introduced a resolution appropriating $1194.35 from the
lInterest Fund and ordering payment made to the Sinking Fund for correction of erro
l in transfer of funds, which was read.
Upon motion by Mrachek, second by Naas that the said resolution be
ladopted as read, and all voting in favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $296.45.from the
Sewage Disposal Plant Fund -and ordering payment made to the Sewer Fund for new
I ventilating fan at Plant, which was read. -
Upon motion by Fryer, second by Hanson that the said resolution be
;adopted• -as read, and all voting in favor thereof,- President Lemmon declared -the
said resolution duly passed and adopted.
Alderman Yaeger introduced 'a resolution authorizing the Public Utility
(Board to establish a .Sinking Fund for Electric Department Extensions, which was
read. .
Upon motion by Hanson, second-by'Nass that the said resolution be
(-adopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted..
The following petition signed by 36 residents in the Southeast part of
Rochester, was read and referred!to the Sewer Committee and the City Engineer for
report at the meeting of July 20, 1942: "We the undersigned, residents of South -

Upon motion by Fryer, second by Mrachek, the Mayor's appointments, were

of the City Hall were very much in need of painting, and upon motion -by Fryer,
second by Mrachek, the painting of same was authorized.
Alderman Mrachek stated that William Dieckoff had requested that the
assessment for a sewer in front of his property on Fifth Avenue Southwest, between
Seventh and Eighth Streets Southwest, be cancelled. A motion that the assessment
for said sewer be not changed was made by Hanson, seconded by Nass, and carried
by all voting in favor thereof.
An Ordinance entitled "An Ordinance regulating the installation, const
tion and maintenance of plumbing, plumbing fixtures, private sewers and sewer
connections within the City of Rochester, Minnesota" same being Ordinance No. 433.1

Upon motion by Mrachek., second by Naas, that the said Ordinance be
ladopted as read, and upon roll call all voting in favor thereof, President Lemmonl
(declared the said Ordinance duly passed and adopted.
An Ordinance entitled "An Ordinance to regulate the production, transport
tation, processing, handling, sampling, -examination, grading, labeling, regrading,,
and sale of milk or milk. products; the inspection of dairy herds, dairies, and
milk plants; the issuing and revocation of permits to milk producers and distrib-
utors; the placarding of restaurants and other establishments serving milk or
milk products; and the fixing of penalties," same being Ordinance No. 535, was
given its second reading.
Upon motion by Mrachek, second by Fryer, and all voting in favor thereoA,
(the rules were suspended and the said Ordinance was given its third and final
reading.
Attorney A.H.Clemens representing the milk dealers in favor of not deli
•ering milk before 7:00 olclock A.M., spoke briefly, and Attorney James Spillane,
Irepresenting Mr. Schultz who wished to continue delivering milk before 7:00 o'clo
IA.M., protested the passage of an Ordinance which would not permit delivery before
