Minutes of an adjourned -'regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
said City on July 20, 19.E+2.
President Lemmon called the meeting to,order at 7:30 o'clock P.M., the•
following members being present: Lemmon, Fryer, Hanson, Mrachek, Nass and Yaeger.
Absent: Alderman Williams, because of illness.
Upon motion by Fryer, second by Hanson, the minutes of the meeting of
July 6; 1-942, were approved.
A petition that when further excavations be made south of Cascade Creek,
the dirt be used to fill in lowlands between Eleventh and Fourteenth Streets North
west on the Ease side of the present creek channel, signed by Charles Sanford,
William Hill, and Glen Chapman, was read and same was ordered placed on file.
A communication from T.A.Bender requesting that the channel of Cascade
Creek be excavated to the proper depth under the bridge on Eleventh Avenue North-
west, was read, and President Lemmon ordered same placed on file.
The request of Arthur A. Carroll that no action be taken at this time
on his petition to have certain lands annexed to the City of Rochester, was read,
and up6n motion by Mrachek,.second by Fryer, it was ordered that his petition be
returned to him.
An easement given to the City of Rochearter, Minnesota, by Henry J. Giese
and Myrtle A. Giese, his wife, for the right to construct and maintain a storm
sewer running.west from Tenth Avenue Southeast to Bear Creek, was read, and upon
motion by Fryer, second by Hanson, the City Clerk was instructed to file same
with the Register of Deeds.
A notice of claim by Mrs. Wm. L. Stanaway of damage to an automobile

owned by her caused by a limb falling from a tree on July 12, 1942, was read, and
upon motion by Fryer, second by Mrachek, sgme was referred to the City Attorney
for report on August 3, 1942.
The Mayor's appointment of Paul Schmidt as Special School Policeman for
duty at the Public Schools in the City of Rochester, Minnesota, was read, and
upon motion by Mrachek, second by Nass, the Mayor's appointment was approved.
A copy of a report covering the test conducted by the Fire Underwriters
Inspection Bureau on July 9, 1942, on the new 1000 Gallon Per Minute Seagrave
Pumj.er, was read, and upon motion by Mrachek, second by Nass, same was accepted
and ordered placed on file.
A copy of a resolution passed by the Board of Park Commissioners on
Jul 6 1 42 requesting that the Common Council permit the said y 9 q g p a d Board to turn
lover the Park Department payroll to the City Clerk on the first and fifteenth of

leach month, to have checks drawn on the City Treasury and charged directly to the
'Park Improvement Fund and to transfer the balance in the Mayo.Trust Fund, after
fall outstanding checks have been paid, to the Park Improvement Fund, was read, a
same was'ordered.placed on file.
j. A copy of, a resolution passed by.the Board of Park Commissioners on
July 16, 1942, petitioning the Common Council to authorize an accounting change
which would set up in the City Clerk's Books a fund to be known as the F.-E.
Williams Estate Trust Fund, separating same from the Park Improvement Fund, was
read, and upon motion by Fryer, second by Hanson the City Clerk was instructed to
set up a fund known as the F.E.Williams Estate Fund, upon receipt of the balance
belonging to said fund.
A copy of a resolution passed by the Board of Park Commissioners on
July 17, 1942, requesting the Common Council to authorize the purchase of a
triangular piece of land from Mrs. William Fitzgerald for annexation to Soldier's
Field Park was read, and upon motion by Nass, second by Yaeger, the City Clerk

was instructed to notify the�Board of Park Commissioners to determine the size
and price asked for the realestate which Mrs. Fitzgerald has offered for sale, a
submit same to the Common Council for final approval.
A communication transmitting to the Common Council a report by the
Committee on Recreation for the City of Rochester, under joint supervision of the
Board of Park Commissioners and the,Board of Education, and requesting payment of
a fee of $100.00 to Mr. Warren Goehrs for making a recreational survey, was read,
and upon motion by Fryer, second by Hanson, the sum of $100.00 was appropriated
from the General Fund for the payment of said fee.
The request of the City Engineer that $2000.00 be appropriated from the
Sewer Fund for use of the Sewer Committee was read, and same was ordered placed
on file.
The City. Engineers estimate of cost -of the construction of a storm
sewer in Second Avenue Northwest from Twelfth Street Northwest to Cascade Creek
was read, and.president Lemmon ordered that same be placed on file.
A communication from -the Board of Park Commissioners regarding.payment
of rental for tools owned by. John Mellor was read, and upon motion by Mrachek,
seco,nd'-by Fryer, the rental charge was approved and the communication ordered -
placed on file.

A report by the.Street and Alley Committee and the City Engineer that
they have hired Kris Nielson to clean Cascade Creek, was read, and same was
ordered placed on file.

A report by the Street and�Alley Committee and the City Engineer that
they had met with the Cascade Town Board in regards to the City and Town road
along .the northwest. city limits line, and that it was agreed to construct the roa
the Town Board to hire the grader and the City of Rochester to reimburse the said
Board for the Cityl,s share of the expense, was read, and President Lemmon ordered
that same be -placed on file.
The recommendation of the Insurance Committee that the sum of' $1977.63
be appropriated from the General Fund for the payment of insurance premiums on
Park buildings for 1940 and 1941, was read, and President Lemmon ordered that
same. be placed on file.

A copy of a communication,from the Finance Committee to the Board of
Park Commissioners authorizing the payment of $5.00 per month for two Life Guards'
and $10.00 per month for the swimming.coach for the months of July and.August for
extra -ordinary services, was read, and upon motion by Mrachek, second by Nass,
same was approved.
The reports of the Building and Plumbing Inspector and -;the Electrical
Inspector for the month of June, 1942, showing fees for building permits issued
$11.000 fees for plumbing permits issued $3.00, and fees for electrical permits
$9..50,, were each read, and President Lemmon referred the same to the Finance
Committee.
The recommendation of the Fire.Committee that the Chevrolet Panel Truck
be cleaned by the Firemen and that sealed proposals for the painting of same.be
submitted to the Fire Committee, was read, and upon motion by.Mrachek, second by
Fryer the same was referred to the Fire Committee. with power to act..
The recommendation of the Public Grounds Committee and the Street and
Alley Committee that the Warehouse.doors be not changed at .this time but that
same, be repaired, also other minor repairs be made at this time to the building,
the roof be recoated, all outside wood surfaces be painted, that specifications
be drawn for the painting and that sealed proposals be submitted to the City
Engineer for the painting, -was read, and upon motion by Fryer , second_. by Mrachek,
[th.e report was accepted and the matter was referred. to the Public. Grounds. Committee
and the City.Engineer with power to act,.providing bids do not exceed $500.00..
The recommendation of the Fire Committee that the complaint of the...
Painters.Local Union -#681 regarding the painting of the interior of the Fire Sta-
tion be acted upon by the Common Council, was ordered placed on file.

The reports of the Clerk of the Municipal Court for the week ending
July 11, 1942*showing criminal fines and costs collected $321.90, civil fees -re-
ceived $9.95 and conciliation court fees $4.75, and for the week ending July 19,
1942 showing criminal fines and costs collected $374.60, civil fees received,
$12.79, and conciliation court fees $5.50, were each read, and having been prev-
iously approved by the City Attorney, President Lemmon ordered that same b'e
placed on file.
The application of Martin Paulson for a license to connect with sewers
and drains was read and upon motion by Fryer, second by Yaeger, the license was
granted--.
The application of Maass_& McAndrew Co. for a Plumber's license was rea
and upon motion by Fryer, 'second by Yaeger-, the license was granted.
The application of Amie LaFrance for a Driver's License" was -read, and
upon motion by Hanson, second by Mrachek; the license was granted.
The official bonds of B. Seth Green in- the sum of '$500.00 with the
Western Surety Company as surety; Axel Moberg in the sum of $500.00 with the
Fidelity & Casualty- Company of New York as surety-;' and Edward J.-Costello, 'in the
sum of .$2909.00 with the Maryland Casualty Company as surety; the license' -bonds
of Martin Paulson"with the Fidelity & Casualty Company'of New York as surety, and
Maass & McAndrew Company with the National -Sur'ety Corporation as - surety, each in
the sum of $1000.00, were each read, and upon motion by Fryer`, second by'Hansbn,
the said bonds were 'approved, the surety thereon accepted and it was' ordered'`that
same be placed on file-. '

Alderman Fryer introduced a resolution.granting three public dance per -

Alderman Fryer.introduced a resolution appropriating $749.53 from the
General Fund and .ordering .payment made to Cities Service Oil Co., for two trans-
ports of .gasoline, which was read.
Upon motion by Yaeger, second by Kass that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted. .
Alderman Fryer introduced aresolution appropriating $991.42 from the
General -Fund and.ordering payment made to Union Asphalt & Roadoils,-Inc., for4two
tank cars road oil, which was read.
.Upon votion.by Kass, second by Fryer, that the said resolution be
adopted as .read, an4 all voting in favor thereof, President Lemmon declared.the
said resolution duly passed and.adopted.
Alderman Hanson introduced a resolution appropriating

said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $2000.00 from the
Sewer Fund for use of the Sewer Committee, which was read.

Alderman Yaeger introduced a resolution reassessing special assessments

Alderman Mrachek introduced a resolution approving the transfer of the
Park Department payroll to the City- Clerk's office, which was read.
Upon motion by Fryer, second by -Yaeger that the said resolution be
jadopted asrread, and. all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $1977:63 from the
General Fudrd and ordering payment made to the General Fund, Code 31,•for Insurance
for 1940 and 1941 for Park Department, which•was read.
Upon motion by Yaeger, second by Hanson that the said resolution be
adopted.as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Upon.motion by Fryer, second. by Hanson, the City Engineer was instructed
to build a storm sewer..co_ntinuing west from the Van Atta paint shop to Cascade
Creek.
The matter of repairing the areaways around the basement windows in the
City Hall 34ilding was discussed, and upon motion"by Mrachek, second by Fryer, the
same -was refe.rr-ed- to the Public Grounds Committee and the Custodian,;. 'of. the City
Hall. .
Upon motion by Fryer,.`second by Naas the meeting was `adjourned.
