Minutes of an adjourned.regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall in
said City on September 21, 1942.
President Lemmon called the meeting to order at 7:30 o'clock,P.M., the
followinig members being present: Lemmon, Fryer, Hanson, Kennedy, Mrachek, Nass
and Yaeger. Absent: none.
Upon motion by Fryer, second by Hanson, the minutes of the meeting of.
September S, 1942, were approved.
The request of the Chriijty Obiecht-Company for permission to show three
nights in Rochester, starting October 2, 1942, was read, and upon motion by Nass,
second by Yaeger, permission was granted.
The following -co -pies of resolutions passed by the Public Utility Board
were read, and President Lemmon ordered that same be placed on file:
"Be it and it is hereby resolved by the Public Utility Board of the
City of Rochester, Minnesota, that the Honl Common Council be and is
hereby requested to authorize -the -said Board to enter into a contract
with the WATER TOWER PAINT AND REPAIR COMPANY for the furnishing of
all of the necessary labor, materials, tools and equipment for the
1. Cleaning and painting of the interior shell of the steel stand-
pipe located at St. Marys Park in accordance with specifications
on file at a contract price of three hundred thirty four dollars,
($334.00).
2. The construction of a new wood roof over the said steel stand-.
pipe in accordance with plans and specifications on file, at a
contract price of five hundred forty three dollars ($543.00):, the
said Water Tower Paint and Repair Company being the lowest respon-
sible bidder."
"Be it and it is hereby resolved by the Public Utility Board of the
City of Rochester, Minnesota, that the Hon. Common Council be and
is hereby requested to authorize the said Board to enter into a
contract with Martin Paulson for the furnishing, in accordance
with plans and specifications, of. all of the necessary labor, mater-
ials, tools and equipment for the installation of a sewer connection
to the east standpipe and elevated water tower at St. Mary's Park
involving approximately 570 lineal feet of sewer with appurtenances
for a contract price of fourteen hundred seventy nine dollars and
forty three cents ($1479.43)."
The following resolutions passed by the Sinking Fund Commissionwere
read: That the sum of $49,590.00 be and the said sum is.hereby appropriated from
the Sinking Fund, Code 23, and ordered paid to the First National Bank of Roches-
ter,Minnesota, for the purchase of six United States Savings Bonds, Defense Ser-
ies F (issue price $7,400.00 each) and seven United States Savings Bonds, Defense
Series F (issue price $740.00 each), the same being purchased for the Electric
Light Depreciation Reserve investments. That the.sum of $25,000.00 be and the
said sum is hereby appropriated from the Sinking Fund, Code 23, and ordered paid
to the Federal Reserve Bank of Minneapolis, Minnesota, for the purchase of
$25,000.00, lL% Treasury Notes, Series C-1945, the same being purchased for the
Electric Light Depreciation Reserve investments.

- Upon motion by Fryer, second by Hanson, the action of the Sinking Fund
lCommissioners was approved.
The reports.of the Clerk of the Municipal Court for the.week ending
September•5, 1942; showing criminal fines and costs collected $455.40, civil fees
received $7.35, and conciliation court fees $6.25; for the week ending September
12, �1942, showing -criminal fines and _costs .collected $495.60, civil fees received
$9.95, and conciliation court fees $3.00; and for the week ending September 19,
1942, showing.criminal fines and costs collected $675.20, civil fees received
$2.05, and conciliation court fees $3.50, were each read, and having been previous
ly approved by the City Attorney, President Lemmon ordered that same be placed on
ile.
The statement of.expenditures.and receipts in the Park Improvement_Fund
or the month of September, 1942, was read and ordered placed on file.
A recommendation by the committee appointed to study the regulation_of
truck traffic in -the City of Rochester, that the.Committee_meet with the. County
Commissioners and representatives of the Minnesota State Highway Department to
discuss certain changes in the intersection at -Seventh Street Northwest and High-
way 52,.was read and President Lemmon ordered that same be placed on file.
The recommendation of the Public Grounds_Committee that an extra painter
be employed by the -City to assistain finishing outside work this fall, he to_be
under the supervision -of the Public Grounds Committee and.Heads of Departments
or Chairman of . the Committees, was read.
A Rpax motion was made by Fryer, second by Mrachek that the report be
accepted and the.recommendation be carried out as soon as.possible. _
The application of Eivind G.-Larson for the temporary appointment as
assistant. custodian of the City Hall Building was read, and same was referred to
the Custodian.
The recommendation of the -Street and Alley Committee that proceedings
be started to vacate Fourth.Street,Northwest from Eighth Avenue Northwest to
Eleventh Avenue Northwest was read, and upon motion by Nass, second by Yaeger, th
report was accepted and ordered placed on file.
The reports of the Street and Alley Committee -.that -they had investigated
the report that there was a broken curb in the 900 block on Seventh Avenue South -
found
west and/that it was causing no damage to the public; that -the condition of the
alley between Sixth and Seventh Streets Northwest, and West of Broadway, could be
corrected by.placing a small amount of gravel on same; that the condition caused
by dirt being washed down on Sixth Street and Twelfth Avenue Southwest could prob-
ably be corrected by placing black top in the street where the sidewalk.crosses-

Twelfth -Avenue, and that the property owner directly East of this crossing be
notified to make some arrangement to prevent dirt from his.property washing onto
the crossing; -and that they found the Boulevard in front of the Edison School to
be higher -than the sidewalk and curb for a distance of -approximately 75 feet, but
that -the sidewalk was not lower than the curb, and the City Clerk was.instructed.
to nptify the School Board- tp lower the. Boulevard; were read and. upon motion by
Nass, second by Hanson, the reports were approved and ordered placed.on file.
The request of th.e Rochester Fire Department Relief Association that the
Common Council approve a loan -in the amount of $4500.00 on'the Ed Kelly farm in
High -Forest Township was read, and same was ordered placed on file.
Finance
The. recommendation of the/91rm- Committee that the above mentioned loan
on'the Ed -Kelly farm be not approved was read, and upon motion by Mrachek, second
by Hanson, ,the recommendation of .the Finance -Committee was approved.
The applications of -the Whitlock -Sonnenberg Post and William Shea for -
license to sell soft drinks were each read, -and upon motion by Hanson, second -by
Fryer, the licenses were granted.
The applications of Emil Nietz for a Master Electricians license and
an Electrical Contractors license were,read, and upon motion by Hanson; second
Nass, -the, licenses were granted,.
The application of,Lucas Kuglitsch for.license to sell cigarBbtes at
retail was read, and upon motion by Mrachek,. second by.Nass the license was grant) .
The official bonds, of ' Chester R. Fellows and.Francis H. Christopherson,
each in the sum of $1000,00 with the Fidelity and.Casualty Company of New York,
were each read and upon motion.by Mrachek, second by.Hanson, the bonds were approvled,
the surety thereon accepted and same were ordered placed on file.
The following claims were read, and upon motion by Yaeger, second by
Fryer, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants upon the City Treasurer and make payments accordingly:

Alderman Fryer introduced a resolution authorizing the Public Utility
((Board to enter into contract with Martin Paulson for the construction of a sewer
(connection to the East Standpipe and elevated water tower at St. Marys Park,
which wa,s read.
Upon motion by Yaeger, second by Nass that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Fryer introduced a resolution authorizing the Public Utility

Alderman Fryer introduced' a resolution granting a publi'c dance* permit
to the Whitlock -Sonnenberg Poet 41215, which was read.
Upon motion by Nass,-becond by Fryer that the said resolution be adopted
las read, and all voting in favor thereof, President Lemmoh declared the baid reso-
lution duly passed and adopted.
• A-lderman Hanson introduc-ed a resolution appropriating $1105.50 from the
General Fund and ordering payment made t'o the StTee't and Alley Fund for use of
equipment during August, 1942, which was read-.
Up -on motion by Mrachek, second by Nass 'tha-t the said resolution be
adopted as read, and 'all voting in favor thereof, -President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced•a resolution appropriating $540.25 from the
Street and Alley Fund and -ordering payment made to the General Fund, Code 31,•for
Insurance on trucks and equipment, which was reed.
Upon motion by Fryer, second by Hanson that the said resolution be
adopted .as read, and all voting in -favor thereof, Pre"sident Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a r•esolu'tion appropriating $490.00 from the
Street and Alley Fund and ordering payment made to th'e New Ulm Brick & Tile Yards
for culverts for Fourteenth Street Northeabt constructions, which was read.
Upon motion by Yaeger, ssecond by Fryer that the -said resolution be
adopted as read, and all voting in favor thereof, President*Lemmon declared the
said resolution duly passed and•adopted.
Alderman Kennedy introduced a resolution appropriating $539.30 from the
Street and Alley Fund and ordering payment made to the General Fund, Code 29, FOR
3955 gallons of gasoline from transports, which was read.
Upon motion by Hanson, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $663.00 from the
Street and Alley Fund and ordering payment made to the Street and Alley Fund for
use of equipment during August, 1942, which was read.
Upon motion by Fryer, second by Hanson that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $242.23 from the
Fire Protection Fund and ordering payment made to the 0-pie Sponge Company for
sponges and chamois skins, which was read.
Upon motion by Mrachek, second by Nass that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $350.54 from the
Park Improvement Fund and ordering payment made to the City of Rochester, Public
Utilities for water used, which was read.
Upon motion by Fryer, second by Hanson that the said resolution be
adopted asread, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $546. Sh from the
Park Improvement Fund and $163.35 from the Lighting Fund and ordering payment made
to City of Rochester, Public Utilities, for light and water used, which was read.
Upon motion by Hanson, second by Nass that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass introduced a resolution appropriating $565.53 from the
erman'ent I'mprovem'ent Revolving Fund and $534.07 from the Sewer Fund and ordering
ayment made to Wm. C. Fraser & Son for 5% retained on sewers and watermains con-
Istructed, which was read.
` Upon motion by Fryer, second by Hanson -that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
Isaid resolution duly passed and adopted.
Alderman Nass introduced a resolution appropriating $412.20 from the
General Fund and ordering payment made to C.F.Walde for concrete work at City
Hall and miscellaneous repairs at Dog Pound, which was read.
Upon motion by Mrachek, second by Nass that the said resolution be
(adopted as read, and all voting in favor thereof, President Lemmon declared the
Isaid resolution duly passed and adopted.
Alderman Yaeger introduced a resolution granting a public dance permit

Alderman Yaeger introduced a resolution appropriating $3689.42 from the
General Fund, Code 18, and ordering payment of $2761.77 to the General Fund, Code
9, and $926.25 to the General Fund, Code 6, to reimburse said codes for compensa
tion paid, which was read.
Upon motion by Fryer, second by Hanson that the said resolution be
adopted -as -read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced an Ordinance providing for civilian defense
and for protection and promotion of public safety, health, and welfare in the City
of Rochester, Minnesota, during war emergencies and -providing rules and regulation
governing blackouts, which was given its first reading.
Upon motion by Fryer, second by Mrachek, and all voting in favor thereof,
the rules were suspended and the Ordinance was given its second reading.
Upon motion by Hanson, second by Mrachek, and all voting in favor there
of, the rules were suspended and the Ordinance was given its third and final
reading.
Upon motion by Nass, second by Fryer that the said Ordinance be adopted'
as read, and all voting in favor thereof, President Lemmon declafed the said Ordirl
ance duly passed and adopted.
It was brought to the attention of the Common Council that residents
of Southwest Rochester wish to have bus service extended on certain streets and
additional trips made. President Lemmon appointed Aldermen J.A.Yaeger, A.A.Kenned
and H.V.Hanson as a Committee to contact Mr..Trenholm in regard to the extension
of bus service.
The matter of purchasing a police car was referred to the Mayor, .The
Police Committee and the Chief of Police for final action.
The Fire Committee, the Fire Chief and the City Attorney were appointed,
to investigate the matter of the removal of bulk stations in the City of Rochester
which are now considered fire hazards, and if it is deemed necessary that the same
be moved an Ordinance providing for the removal of same is to be drafted by the
said Committee.
City Attorney Desmond B. Hunt ruled that an expenditure by the Common
Council for the moving of a house or houses, in the Cascade Creek area, on the
grounds that it would eliminate the possibilities of future floods, would undoubtE
ly be determined to be spending public monies for private interests. If the pro-
ject proposed should be determined by experts on flood control to be absolutely
essential for the complete protection of a goodly sized portion of the City, then
perhaps the Supreme Court would rule it a proper expenditure. Under the present
