PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., October 5, 1942 Minutes of a regular meeting of the Common Council of the City of Roch- ester, Minnesota, held in the Council Chambers in the City Hall, in said City, on ctober 5, 1942. President Lemmon called the meeting to order at 2:00 o'clock P.M:, the following members being present: Lemmon, Fryer, Hanson, Kennedy, Mrachek, Nass, 3.nd Yaeger. Absent: none. Upon motion by Hanson, second by Mrachek, the minutes of the meeting of September 21,. 1942, were approved. Mr. John Clement appeared before the Common Council and stated that a drainage ditch through his property had been closed, and asked that the Council have the City Engineer's Department open same. President Lemmon referred the natter to the Street and Alley Committee, the City Engineer, and the City Attorney for investigation and.report. The City Engineer's request that $5000.00 be appropriated from the treet and Alley Fund, for -use of the Street and Alley Committee was read, and resident Lemmon ordered that same be placed on file. The request of Donald P. Buske that he be granted a leave of absence froi is dutmes as regular fireman while serving in the armed forces of the United Stat! as read, and upon motion by Fryer, second by Nass, the request was granted and rdered placed on file. The Mayor's appointment of Albert T. Swenson and Francis I. Christopher on as special policemen, was read, and'upon motion by Mrachek, second by Hanson, ame was approved. A letter transmitting a report on the financial affairs of the City of ochester, by the Public Examiner, was read, and upon motion by Mrachek, second by ryer, the report was accepted and ordered placed on file. A communication addressed to- Mr. Knute Olson, City Assessor, from the ttorney General, advising that the matter of the appeal to the Board of Tax Appea: f th=e Village of Hibbing involving the Benedictine Sisters Benevolent Association, as been set for hearing on October 23, 1942, was read, and upon motion by Mrachek, econd by Nass the City Assessor was authorized to attend the hearing at City Ex- ens e. A letter from H. N. Tompkins, Chief of Police, advising that Lavern C. Lini ad been certified by the Police Commission as a member of the Police Department, ffective October 1, 1942, was read, and upon motion by Fryer, second by Hanson, he xg�g same was approved. The application of John LeRoy Stewart for the position of Assistant stodian was read, and same was ordered placed on file. �s, 67 5 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN.,- October 5, 1942 A copy of a resolution passed by the Board of Park Commissioners, that the Common Council provide for the policing of Rochester Parks, during the months of May, June, July, August and September and that they provide funds to pay such salary, was read and President Lemmon referred same to the Mayor, the Chief of Police and the Police Committee. A communication from the League of Minnesota Municipalities urging that everything possible be done to promote the passage of .the Constitutional Amend- ments at the coming election, was read, and the City Clerk was instructed to take up the matter of distributing pamphlets regarding the amendments with the Secretar; of the Public Utility Department. A copy of a letter addressed to the Mayor asking that the City of Roch- ester make arrangements for a League Regional Conference to be held on October 27,1 1942, was read, and upon motion by Fryer, second by Hanson, the Mayor was author- ized to make all necessary frrangements for the meeting. An agreement between the State of Minnesota apd the City of Rochester for the maintenance of trunk highways within the corporate limits of said City was read, and upon motion by Fryer, second by Hanson, the Mayor and City Clerk were authorized to execute said agreement. Upon motion by Mrachek, second by Hansonrthe Mayor and City Clerk were authorized to execute a renewal of a lease for a certain part of the Chicago & Northwestern Railway Company's Station Grounds to be used exclusively as a site for a pump house. A petition that the Common Council require the Rochester Bus Line to provide bus service in the area south of Fourth Street Southwest and on Fourth Street Southwest as extended and west of Nigrth Avenue Southwest, was read. This, matter had previously been referred to a committee consisting of Aldermen Yaeger, Kennedy and Hanson, who submitted the following report: "We, the undersigned Committee appointed by the Alderman-at-Larggy, wish to make the following report in regard to additional bus ser- vice on Fourth Street Southwest to Fourteenth Avenue Southwest, in the City. We had a meeting with Mr. George Trenholm of the Rochester Bus Line, Inc., on September 30, and he explained that it was impossible to give additional service because of the following ruling: Office of Defense Transportation Local Transport Division as of April 17, 1942. Their 47 of their Twelve Point statement of policies reads as follows: Extension of existing bus routes and inauguration of new routes being made only to places of defense employment, and military and naval establishments or to meet similar situations where failure to provide such as additional service, will have a definitely unfavorable effect on war effort. President Lemmon referred the matter to the same committee, the Mayor and the City Attorney for further investigation. (referred same to the Finance Committee. The City Engineer's Trial Balance for September, 1942, was read and jordered placed on file. The report, of Expenditures from the City Engineer's payroll for Septem- lber, 1942, was read and same was ordered placed on file. The, report of the Street and Alley Committee on the condition_ of Fif teen1th- Avenue Southwest between Second and Third Streets Southwest, that it is not pos- sible to fill the said street to a higher grade.or to place fill on -private prop- erty, was read, and upon motion by Nass, second by Hanson, the report was approve and ordered placed on file. The report of the Committee on the Cascade Creek: flood control, that th Common Council has no.legal right to move any houses from the flooded area, but can clean the channel (after obtaining easements from the property owners) as far as Tenth Street Northwest, but no further until the present siphon is lowered and lengthened, and that the rip -rapping of banks should be done by individual prop- erty owners, was read and upon motion by Hanson, second by 1-4rachek, the report was approved and ordered placed on file. ' The reports of the Clerk of the Municipal Court for the week ending September 26, 1942, showing criminal fines and costs collected $299.95, civil fee received•$3.70, and conciliation court fees $3.50; and for the week ending Octobe 3, 1942, showing criminal fines and costs collected $597.50, civil fees received $4.35, and conciliation court fees $2.00, were each read, and having been previous Ily approved by the City Attorney, President Lemmo-n ordered that same be placed on Ifile. The application for transfer of "On Sale" Liquor License #133 from Arthur Glasenapp to Cora Glasenapp was read, and upon motion by Mrachek, second Fryer, the .transfer was granted. The application for transfer of "Off Sale" Liquor License from Chris IMargellos to Chris Margellos and Gene Huey was read, and upon motion by Nass, (second by Fryer, the transfer was approved. The application of St. Ma.ryls Hospital for a license to sell soft drinks was read, and upon motion by Hanson, second by Nass, the license was granted.. The application of the Thrifty Cut Rate Drug Store for a license to, sell (cigarettes at retail wa-s read, a.nd upon motion by Hanson, second by Fryer, the 1license was granted. The license bonds of. George H. Popple.and the Hankee Heating Company, each in the .sum, of $1000.00 with the.- National Surety Corporation and the St. Paul M-ercury Indemnity Company respectively as surety, and of Gene F. Huey and Chris Margellos in the sum of $1000.00 with the Western Surety Company as surety, and the official bond of_Albert T. Swenson in the sum ,of $1000.00 with the Fidelity and Casualty Company of New York as surety, were each read, and upon.motion by Fryer, second by Hanson, the.bonds were approved, the surety.thereon accepted and sai►e, were ordered placed on file. Alderman Hanson introduced a resolution granting two public dance permit to the V.F.W. Whitlock -Sonnenberg Post, which was read. Upon motion by Fryer, second by Mrachek that the said resolution be adopted as read, and all -voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Hanson introduced a resolution appropriating $326.80from the General Fund, $2.00 from the Street and Alley Fund, $14.85,from the Fire Protectio Fund, and $3297.00 from ,the Lighting Fund and ordering.payment made to the City of Rochester, Public Utilities, for light and water used, which was read. Upon rgotion by Yaeger,.second by Nass that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution.appropriating $459.06 from the Street and Alley Fund and -ordering payment made to Morse Bros., for sand,.gra.vel and labor, which was read. Upon motion by Nass, second by Mrachek.that the said resolution be adopted as read, and all voting -in favor thereof, President Lemmon declared the said resolution duly passed and adopted.. Alderman Mrachek introduced a resolution appropriating $231.26 from the Street and Alley Fund and $40.00 from the Park Improvement Fund -and ordering pay- ment made to Herbert G. Knopp for Insurance, which was read. Upon motion by Mrachek, second by Yaeger that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. . Alderman Yaeger introduced a resolution appropriating $507.27 from the Permanent Improvement Revolving Fund and ordering payment.made to H. T. Earle for curb and gutter in Seventh Street and Sixth Avenue Southwest, which was read. Upon motion by Mrachek, second by Kennedy, the matter of installing acoustical insulation in Rooms 1 and 9 in the City Hall, was left with the Cus- ,todian and the Public Grounds Committee with power to act. The matter of making certain repairs on the fire hall building was brought to the attention of the Common Council by.Alderman Hanson. Upon motion by Fryer, second by Kennedy, the matter was left in the hands of the Public Grounds Committee with power to act. Upon motion by Fryer, second by Kennedy the matter of constructing a sewer siphon under .Cascade creek was left in the hands of the Sewer Committee with power to act. Upon motion by Mrachek, second by Nass the City Attorney was instructed to draft a new ordinance covering the licensing of vending machine-s. Upon motion by Fryer, second by •Hanson, the City Clerk was instructed• Ito request the various City departments to submit their tax budgets for the coming [year.
