regular meeting
of the Common Council of the
City of Rochester, Minnesota, held
in the Council
Chambers, in the City Hall, in
said City on October 19, 1942.

President Lemmon called
the meeting to
order at 7:30 o'clock P.ih., the
following members being present:
Lemmon, Fryer,
Hanson, Kennedy, Mrachek, Nass,
and Yeager. Absent: none.
Upon motion by Fryer, second by Yaeger, the minutes of the meeting of
October 5, 1942, were approved.
President Lemmon stated this as being the time and glace set for a hear-
ing on the petition for the vacation of the alley East of Block 3, Flather's
Addition, from Lot 12 through Lot 31. There was no one present wishing to be
heard.
• President Lemmon stated this as being the time and place set for a hear-
ing on the levying of special assessments for the construction -of a curb and Butte:
in Seventh Street Southwest, from Fifth Avenue to Seventh Avenue Southwest, and in

Sixth Avenue Southwest from Sixth Street to Seventh Street Southwest. There was n
ne present wishing to be heard.
Mr. Arthur and Mr. Helmuth Brehmer appeared at the Council meeting and
requested that the construction of a sidewalk on Seventh Street Southwest be post -I
ooned until next year.
Upon motion by Fryer, second by Kennedy, Mr. Arthur and Mr. Helmuth
Brehmer were requested to sign an agreement that they would have said walk con -
strutted by July 1, 1943.
Mr. Da -we Crockett appeared at the Council' meeting in regard to the insta� -
lation of Christmas Street lighting for the 1942 season.
Upon motion by Mrachek, second by Nass, the matter of erecting the Christ-
mas Street decorations was left in the hands of the Lighting Committee to prepare
pecifications.
Judge Burt Elliott Eaton asked permission to attend the 32nd National
afety Convention to be held at Chicago, October 27-25-29, 1942.
Upon motion by Fryer, second by Hanson, his request was granted to atten
the said Convention at City expense.
Mr. M. W. Alexander appeared before the Council and requested that he be
ermitted to make sewer and water connection to his residence according to the
rovisions of the old Plumbing Code due. to the fact that he had started his house
efore the new Plumbing Code was adopted.
Upon motion by. Mrachek, second by Hanson, the matter was left in the
ands of the Building.Inspector and the City Attorney.

The request of Ralph F. Books for leave of absence from the Police
,Department of the City of Rochester -for the period of his enlistment in the armed
!forces of the United States was read, and upon motion by Fryer, second by Mrachek
!the request was granted and President Lemmon ordered that same be,placed on file
A notice of termination of lease No. 7309 covering certain real estate
in the City of Rochester owned by the Chicago Great Western. Railroad Company was
read and upon motion by Fryer, second by Kennedy, the same was accepted and the
City Clerk was instructed to notify the Chicago Great Western Railroad Company of!
the action taken by the Common Council.
A copy of a resblution adopted by the Sinking Fund Commission on Octobe
S, 1942 appropriating $50,000.00 from the Sinking Fund for the purchase of
$25,0.00.00 2% Treasury Bonds of 1950-52, and $25,000.00 12% Treasury Notes, Serie
B-1946, was read, and upon motion by Mrachek, second by Fryer, the action of the
Board was approved, and ordered placed on file.
The request of Harold M. Fitzpatrick for leave of absence from the
Police Department of the City of Rochester, commencing October 16, 1942 and ter-
minating within a reasonable time after being discharged from service in the arine
forces of the United States was read, and upon motion"by Fryer, second by Hanson,
the request was granted, and President Lemmon ordered that same be placed on file
A request by the Board of Public Health and Welfare that the Common
Council approve the appointment of Mrs. Clara Eyrich as stenographer in that
department, was read and upon motion by Fryer, second by Hanson, the request was
granted and same was ordered to be placed on file.
The recommendation '6f the Street and Alley Committee, the City Attorne
and the City Engineer, that the opening of the,ditch between 810 Fifteenth Avenue)
Southeast and the property South of that number is primarily a private matter and
and that the City is in no way involved, was read and the City Clerk was instructed
to notify Mr. John Clement of the decision of the Council.
The recommendation of the Street and Alley Committee and the City

Engineer that Invoice No. 42-E,.,dated October 1, 1942 in the sum of $3.65 be paid;
by. Mr. F. F. Holloway, was read and the same was referred to the City Attorney.
The application of Paul C. Smith for a Drivers License was read, and
upon motion by. Hanson, second by Kennedy, was referred to the License Committee
with Power to act.
The applications of Josephine L. Kaiserlick and Gertie Nelson for License
to sell Soft Drinks were read and upon motion by Fryer, second by Yaeger, the
licenses were granted.

. The application of Alfred Banick for a Permit to Place and Maintain a.
Sign was read and upon motion by Mrachek, second by Fryer, the permit was gra.nted.1
The application of Josephine L. Kaiserlick for a transfer of her
Cigarette License No. 30 to No.. 12, Zecond Street Southeast, was read and upon
otion by Mrachek, second by Yaeger, the transfer was approved.
The reportsof the Clerk of the Municipal Court for the week ending
ctober 3, 1942 showing criminal fines and .costs .collected $333.05, civil fees

The official .bonds of Lavern C. Lind in.the amount of $500:00 ,with ,the

Cott N..Jenkins in the amount of $1,.000.00 with the Fidelity and Casualty Company
f New York as surety, were each read, and upon motion by Fryer, second by Hanson,

Upon motion by Mrachek, second by Fryer, that the said resolution be
adopted as read, and all voting in°favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $972.65 from the
General Fund and ordering payment made' to the Street and Alley Fund, which was

Upon motion by Mrachek, second by Yaeger, that the said resolution be
adopted as read, .and all voting in favor thereof, President Lemmon declared the
said resolution duly passed.and adopted.
Alderman Fryer introduced a resolution appropriating $1,721:59 from the
.General Fund and ordering payment made to the State of Minnesota, Department of
Public.Examiner, which was read.

Upon motion by Yaeger, second by Fryer, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the -1
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $1,097.63 from t
General Fund and ordering payment made to Universal Motors, which was read.
Upon motion by Fryer, second by•Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly .passed'and adopted.
Alderman Hanson introduced a resolution appropriating $630.97 from the
Street and Alley Fund and ordering payment made to Street and Alley Fund, which
was read.
Upon motion by Yaeger, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted:
Alderman Hanson introduced a resolution appropriating $336.00 from the
Street and Alley Fund and ordering payment made to New Ulm Brick and Tile Company
which was read.
Upon motion by Fryer, second by Kennedy that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $209.83 from the
Street and Alley Fund and $104- 75 from the Sewer Fund and ordering payment made
to the Street and Alley Fund, which was read.
Upon motion by Yaeger, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $13,925.09 from
the Fire Protection Fund, Code 5 and ordering payment made to the Fire Protection
Fund, Code 4,. which was read.
Upon motion by Fryer, second by•Yaeger that the said resolution be
adopted as -read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $1,756.79 from
the Sewer Fund and ordering payment made to City of Rochester, Public Utility
Department, which was read.
Upon motion by Mrachek, second by Fryer that the said resolution be -
adopted as read, and all voting+in favor thereof, President Lemmon declared the.
said resolution -duly passed and adopted. -

Alderman Kennedy introduced a resolution appropriating $123.93 from the
(Street and Alley Fund and $159.50 from the Sewer Fund and ordering payment made
Ito the Red Wing Sewer Pipe Corporation, which was read.
Upon motion by Fryer, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Resolutions levying special assessments for sprinkling, flushing and/or
iling during the 1942 season were introduced, duly adopted, and ordered.placed
n file, and.made a part hereof, reference to which for more particulars are herel
nade.
Alderman Kennedy introduced a resolution ordering the hearing on the
levying of special assessments for sprinkling, flushing and/or oiling of streets
in the City of Rochester for the season of 1942, said hearing to be at 7:30 o'cloc
P.M. October 26, 1942, which was read.-
Upgn motion by Fryer, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution levying special assessments for
curb and gutter in Seventh Street Southwest from Fifth Avenue to Seventh Avenue
Southwest and in Sixth Avenue Southwest from Sixth Street to Seventh Street
Southwest, which was read.
Upon motion by Fryer, second by Yaeger tl�at the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $105.07 from -the
Street and Alley Fund, $139.67 from the Fire Protection Fund and $2.67 from the
Sewer Fund and ordering payment made to National Bushing and Parts, which was read

Alderman Yaeger introduced a resolution appropriating ,$444- 75 from the
Street and Alley Fund and $157.00 from the Fire Protection Fund and ordering
payment made to Hayes Lucas Lumber. Co. , which was read.
Upon motion by Hanson, second by Fryer that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution granting.three Public Dance
ermits to VFW Whittlock Sonnenberg Post,.which was read.
Upon motion by Yaeger, second by Mrachek that the said resolution be

Alderman Yaeger introduced an Ordinance repealing an Ordinance entitle
"An Ordinance relating to and providing for the licensing and regulation.of any
machine or device vending soft drinks or confections, the operation of which
depends upon the insertion of a coin,' same being Ordinance No. 599, which was
given its first reading.
Upon motion by Fryer, second.by Yaeger, and all voting in favor thereof,
the rules were suspended and the Ordinance .was given its second reading.
Upon motion by Yaeger, second by Fryer, and all voting in favor thereof,
the rules were suspended and the Ordinance was given its third and final reading.
Upon motion by Mrachek, second by Yaeger that the said Ordinance be

adopted as read, and all voting in favor thereof, President Lemmon declared the
said Ordinance duly passed and adopted._
Alderman Yaeger introduced an Ordinance relating to and providing for
the licensing and regulation of any machine or device vending soft drinks or
confections, the operation of which de-oends upon the insertion of a coin, which
was given its first reading.
Upon motion by Fryer, second by Hanson, and all voting in favor thereo:
the rules were suspended and the Ordinance was given its second -reading.
Upon motion by Mrachek, second by Fryer, and all voting in favor there,
the,rules were suspended and the Ordinance was given its third and final reading.ii

Upon motion by Yaeger, second/Fryer, that the said Ordinance be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said Ordinance duly passed and adopted.
Upon motion by Fryer, second by Hanson, the City Clerk was instructed
to notify those who have paid a fee in excess of $1.00 to make claim for_ their
refund.
Alderman Yaeger introduced an Ordinance regulating speed of motor
vehicles within the limits of the City of Rochester, Minnesota, which was given
its first reading..
Upon motion by Hanson, second by Kennedy, and all voting in favor ther
of the rules were suspended and the Ordinance was given its second reading.
A letter from Mr. 0. H. Romadka, Chairman of the War Price and Ration-
ing Board 55, addressed to -Mayor Paul Grassle stating that the present quarters
did not afford sufficient space for the fuel, oil and gas rationing program and
requested that the City of Rochester parr additional rent in the sum of $55,00 per
month for room in the W. W. Lawler building and also pay expense of telephone
which would be approximately $5.75 per month.

Upon motion by Hanson, second by Kennedy, the request of the War
Rationing Board � temporarily granted and the matter left in the hands of the
Public Grounds Committee as to further plans for offices for the War Price Board.
Alderman Hanson recommended to the Common Council that the City purchas
additional land adjoining Lot No. 6 Northern Addition to the City of Rochester
and upon motion by Fryer, second by Hanson the matter was left in the hands of th
Public Grounds Committee and the City Engineer to make a.survey of the property
and ;a- recommendation as to how much ground might be needed.
The matter of painting the frames and gutter at the Sewer Disposal Plant
was brought to the attention of the Common Council by Alderman Hanson and upon
-motion by Fryer, second by Kennedy, the matter was referred to the Public Grounds
Committee and the Sewer Committee with poorer to act.
Upon motion by Kennedy, second by Mrachek, the meeting was adjourned
until 7; 30 o'clock P.M. October 26, 1942..
