OF THE CITE' OF ROCHESTER, MINN., November 16, 1942
Minutes of an adjourned regular meeting of the Common Council of the City
of -Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
said City on November 16, 1942.
President-Lemmon called the meeting to order at 7:30 o!clock P. M.,
the following members being present: Lemmon, Fryer, Hanson, Kennedy, Mrachek,
Nass, and Yaeger. Absent: none.
Upon motion by Fryer, second by Hanson, the minutes of the meeting
of November '2, 1942, were approved.
President Lemmon stated this as being the time and place set for a
!hearing on the vacating of Fourth Street Northwest between Eleventh Avenue
Northwest and Ninth Avenue Northwest. Howard S. Sanborn and his attorney, A. J.
Furlow attended the hearing.
The appointment by the City Clerk of Miss Elfreda Reiter as second
stenographer and cl-erk of registration in "the office of the City Clerk to fill
the vacancy caused by the resignation of Mrs. Dagna Smith was read and upon
motion by Fryer, second by Nass, the appointment was approved.
A special bulletin on municipal salary and wage controls issued by the
League of Minnesota Municipalities was 'read and President Lemmon ordered that the
same be placed on file.
The resignation of Grayce L. Lee was read and upon motion by Mrachek,
second by Fryer, the same was accepted, effective November 30, 1942.
A letter from the Izaak Walton League of Rochester expressing their
appreciation to the Common Council for -granting permission to construct a drive-
way through park property to the cabin grounds was read and President Lemmon
ordered that same be placed on file.
Th`e City Engineer's Trial Balance Sheet for the month of' October, 1942,'
was read, and President Lemmon ordered that same be placed on file.
The report of expenditures from the City Engineer's payroll for the
month of October, 1942, was read, and same was ordered placed on file.
The report of receipts and expenditures by the Board of Park
Commissioners for the month of October, 1942', was read, and President Lemmon
ordered that same be placed on file.
'The report of the City Weighmaster for the month of October, 1942,
showing 975 private loads weighed and receipts of $87.50, was read, and Presidentl
Lemmon referred same to the Finance Committee.
The reports of the Clerk of the Municipal Court for the week ending
November 7, 1942, showing criminal fines and costs collected $2o4.60, civil fees
received, $3.90, and conciliation court fees $7.00; and for the week ending

November 14, 1942, showing criminal fines and.costs c6llected $293.00, civil fees
received $8.35,.and conciliation -court fees $5.00, were each read, and having bee:
previously approved by the City Attorney, President Lemmon ordered that same be
placed on file.
The application of.Edwin H. Brown for a Master Electrician's License-
was'read, and upon motion by Fryer; second by Nass, the license was granted.
The application of F.-W. Schuster-, Jr. for a license to sell soft
l drinks- was read, and upon motion by Nass, • second by Yaeger, the license -was grants
The application of F. W. Schuster, Jr. for a license to operate two
vending machines was read, and upon motion by Fryer, second by Hanson, the.
license was granted.
The application of E. H. Hill for a license to conduct an auction sale
lat 411 South.Broadway, was.read, and upon motion by Nass, second.by Kennedy, the
license was granted.

Alderman Fryer introduced a resolution appropriating $741,59 from the
General Fund and ordering.payment made to -the.Cities Service Oil Company which
was read.
Upon motion by Mrachek, second by Nass that the said resolution be
adopted as read, and all voting in favor thereof, -President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $54.8.0O,from the
Street and Alley Fund and ordering payment made to the Street and Alley.Fund,
which was read.
Upon motion by Fryer, second by Kennedy, tha.t the said resolution_ be
adopted as read, and all voting in favor thereof, Pr.esident Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution_appropriating $479.14 from_ the
Street & Alley Fund and ordering payment made to the General Fund, Code 29, which
was read.
Upon motion by Fryer, second by Kennedy, that the said resolution bo
adopted as read, and.all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass introduced a resolution appropriating $260.00 from the
Street & Alley Fund and ordering payment made to the Tuffibre Company, which was
read.
Upon motion by Nass, second by Yaeger, that the said resolution be
adopted as read, and_ all voting in favor .thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $292.50 from the
Street &. Alley Fund and ordering payment made to the General Fund, Code 20, which
was read.
Upon motion by Hanson, second by Mrachek, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $399.47 from the
Fire Protection Fund and ordering payment made to Fred Jorgenson, which was read.
Upon motion by Mrachek, second by Nass,' that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $690.70 from the
Sewer Fund and $3.55 from the Lighting Fund and ordering payment made to the City
lof Rochester, Public Utility Department, which was read.

adopted as read, and all voting in favor thereof, President Lemmon declared the -
said resolution duly passed and -adopted.
Alderman Kennedy introduced a resolution granting seven Public Dance
Permits to VFW Whitlock Sonnenberg Post, which was read.
Upon motion• by Fryer,, second by Hanson that.the said resolution be
adopted a-s read, and all voting -in favor thereof, President Lemmon declared the
said resolution duly -passed and adopted.
Alderman Hanson introduced a resolution vacating Fourth Street Northwest
from Eleventh Avenue Northwest to Ninth Avenue.Northwest, which was read.
Upon motion by Mrachek, second by Nass, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and,adopted.
Alderman Yaeger introduced a resolution levying taxes for the year of
1942 in the following amounts for the various funds, which was read:

Upon motion by Mrachek, second by Nass that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution levying taxes for the Board of
Education of School District No. 8 for the year of 1942, upon the taxable proper
of said School District, in the sum of $432,517.00, which was read.
Upon motion by Fryer, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
It was' brought to the attention of the Common Council by the building

inspector that the plans of the new Chicago Great Western Railway freight depot
did not conform to the provisions of the building code. The City Attorney stated
that in his opinion, it was not the intention when drafting the building code to
prevent the construction of a wood floor in that part of the building to be used
as an office, provided however, there is no basement under the part where a wood

floor is constructed.
Upon motion by Fryer, second by Hanson the City Attorney was
instructed to furnish the Building Inspector with a written opinion to that
effect.
Upon motion by Fryer, second by Hanson the meeting was adjourned.
