Absent: Alderman Powers. Strain moved, Allen second to adopt the prepared Resolutions No-108-7' 109-77 referring the petition on Grading and surfacing, storm sewers, underground drains and watermains on 8th Avenue S. E. from the north of Outlot A, Meadow Park 7th Subdivision to 223 feet north of the centerline of 20th Street S. E. ( Mayo Foundation ) and the Extension N.W. Sanitary Sewer Trunkmain to serve the Robert M. Conway property (Robert Dashow ) to the Public Services Department for the preparatioi of a feasibility report. Ayes (6), Nays (0). Motion carried. Gray moved, Strain second to' instruct the City Attorney to prepare the necessary contract for Section 8 Grant Program Administration for sixty (60) units of subsidized housing. Ayes (6), Nays (0). Motion carried. Allen moved, Gray second to approve the following licenses and bonds: Auctioneer's license from Lester L. Olson, Route # 3 Rochester, Minne� and a Dance Permit from Mary Mielke, 101 E. Center St. for the Sahara Club in the North Hall in the Mayo Civic Auditorium on March 12, 1977 and for an Auction permit from Wally Laumeyer of 7306 Cleve Ave. E. Inver Grove Heights, Minn. to be held at Ramada Inn on March 20, 1977. Ayes (6), Nays (0). Motion carried. Larson moved, Strain second to instruct the. City Clerk to advertise for bids for the season's supply of traffic, paint and an articulated motor grader for the Public Services Department. Bids will be open ket ":" Al on March 24, 1977. A�es (6), Nays (0).Motion carried. s olutions o. 109A-77 and 10913-7 Solinger moved, Gray second to adopt the prepared Resolutions No. 110-77 and 111-77 approving the 1977 and 1978 labor contracts with the Non -Exempt employees excluding employees of the Fire Department, Police Department, and the Public Utility Board. Resolution 111-77 is a Public Utility Resolution approving of the labor agreement with the Non -Exempt Employees Association pertaining to clerical and secretarial employees of the Public Utility Board effective for the year 1977 and subject to automatic renewal thereafter. Ayes (6); Nays (0). Motion carried. Allen moved, Larson second to approve the Application for approval of preliminary'plat of the Resubdivision.of Outlot A, Rolling Greens Second Replat. ( Located in the SW Corner of 10th Avenue and 37th St. N. W. subject to the zoning district change. Ayes (6), Nays (0). Motion carried. Larson moved, Gray second to approve the Proposed Zoning Ordinance amendments to the Agricultural District for the County of Olmsted. Ayes (6), Nays (0). Ayes (6), Nays (0). Motion carried. E-9 Removal of Parking on Both Sides of 3rd Avenue S. E. from 11 112 Street ( West Side ), Ilth St. ( East Side to 5th St. From 7:30 A.M. to 5:30 P.M. Monday Thru Saturday was discussed by the Council Paul Frutiger of 1111 3rd Avenue S. E. wished to be heard, and stated there is no reason for restricting the parking. He said they needed this. Larson moved, Strain second to table this until the Committee of the Whole where this would be discussed further. Ayes (6), Nays (0). Motion carried. E-10 Allen moved, Gray second to adopt the prepared Resolution No. 113-77 awarding the low bid of Doyle Conner Company of $66,471.41 for Intersection Improvements on 4th Avenue at 5th Street N. W. Ayes (6), Nays (0). Motion carried. E-11 Gray moved, Solinger second to adopt the prepared Resolution No. 114- instructing the City Clerk to advertise for bids on Project No. 7606 -0-76 J 8563 on Extension of Sanitary Sewer and Watermain to serve a portion of that part of the NE 1/4 Sec. 13, Rochester Township lying east of C.S.A.H. # 1 and south of Pinewood Road S. E. Bids will be opened at 11:00 A.M. April 6, 1977 Ayes (6), Nays (0). Motion carried E-12 Larson moved, Gray second to adopt the prepared Resolution No. 115-77 instructing the City Clerk to advertise for bids on Project No. 7602- 0-76 J 2109 Drainage Channel Improvements and Culvert Structures across 9th Avenue N. W. , plus Grading and Surfacing of 9th Avenue N. W. across the Parkway Area in Elton Hills North First Subdivision. Bids will be opened at 11:00 A.M. April 6, 1977 Ayes (6), Nays (0). Motion carried. E-13 Strain moved, Solinger second to adopt Resolution No. 116-77 instruct ing the City Clerk to advert ' ise for bids on Project No. 6460-77 J 2106 and Project No. 6301-1-76 J 2107 - Sanitary Sewer extension to serve the Public Service Department North Yard Vehicle,Storage and Maintenance Facility and Project No. 6301-1-76 J 2107 Storm Sewer extension in Ist Avenue N. E. from 6th to 7th Street N. E. Bids will be opened at 11:00 A.M. April 6, 1977. Ayes (6), Nays (0). Motion carried. E-14 Strain moved, Allen second to adopt Resolution No. 117-77 authorizing the Mayor and City Clerk to sign the proposal for Engineering Service Replat No. 2 and Replat No. 3, Sunrise Estates 2nd Subdivision and fo Sunrise Estates 3rd Subdivision. The proposals are wi-th Yaggy and Associates, Inc. Ayes (6), Nays (0). Motion carried. Ayes (6), Mays (0). Motion carried. An Ordinance Relating to On -Sale Liquor Licenses; amending Rochester of Ordinances, Section 160.060 was given its second reading. Strain moved, Gray second to adopt the Ordinance as read. Ayes (5). Mays (1) Alderman Allen voting Nay. Motion carried. An Ordinance Relating to the Rochester Committee on' Urban Environment Repealing Ordinance Nos. 1464 and 1544 was given its second reading. Strain moved, Allen second to adopt the Ordinance as read. An Ordinance Relating to Sanitary Sewer System Charges and Assessment Amending Rochester Code of Ordinances 106.070 as amended by Ordinance No. 1843 and 1862 was given its second reading. Larson moved, Gray second to adopt the Ordinance as read. Ayes (6), Mays (0). Motion carried. Strain moved, Gray second to adopt Resolution No.118A-77 pertain-ing to the installation of storm sewer service to serve Golden Hills Addi. is approved and the Mayor and City Clerk are directed to sign said agreement. Ayes (6), Mays (0). Motion carried. -- Strain moved, Allen second to remove the Petition to amend the Land U Plan to indicate the area south of 37th Street N. W. and N.E. of the proposed West River Parkway as being best suited for Commercial Use from the table. Ayes (6), Mays (0). Motion carried. - After discussion by the Council, Larson moved, Strain second to appro this, subject to a conservation or buffer screen easement be provided on the North and East side of the new West River Parkway, West of the existing 3rd . Ayes (6), Mays (0). Motion carried, and the City Attor was instructed to prepare a resolution for adoption. Having no further business, Allen moved, Larson second to adjourn the meeting until 7:30 P.M. Ayes (6), Mays (0). Motion carried. A.Hearing on the Proposed Assessments for Concrete Sidewalk on 16th Street S. W. from T.H. 63 to Mayowood Road S. W. Project No. 6216- 3-76 J 8549. Having no one present that wished to be heard, Presiden Postier closed the hearing. Allen moved, Solinger second to adopt the prepared Resolution No. 119-77 accepting the assessments. Ayes (6). A Hearing on the Petition to change the zoning districting from M-1 ( Light Industrial ) to B-3 ( General Business ) on the property ' located southwest of Elton Hills Drive and North Broadway. Having no one present that wished to be heard, Strain moved, Gray second to .instruct the City Attorney to prepare an, Ordinance for adoption'. Ayes (6), Nays (0). Motion carried. A Hearing on the Petition to change the zoning Districting from R-1 ( Single Family ) to R-2 ( Low Density ) on the property located east of 19th Avenue N. W. and South of 37th Street N. W. HA'rold Payne� of:7995ier�,a La ' ne N. E. was present for any questions the Council may have. Nancy Vollertson of 3522 19th Avenue N. W. was present and opposed this project. She stated several neighbors were opposed to the project also. Mrs. L. Gerald Luttchens of 3528 19th Avenue N. W. was present and did not want rental units up. She was opposed to the project. Hunter Heath III of 1821 35th St. N. W. was opposed to the project. Having no one else that wished to be heard, Larson moved, Strain second to approve the peti-ti6n. Ayes (6), Nays (0). Motion carried. A Hearing on the Petition to vacate a Public Walkway Easement in Blocl 11 and 12, Sunrise Estates 2nd Subdivision. Having no one present thi wished to be heard, President Postier closed the hearing, Larson move( Gray second to instruct the City Attorney to prepare a resolution vacating the easement subject to the walkway easement be vacated and a new walkway.easement be redidicated on the replat. Ayes (6), Nays (0). Motion carried. A Hearing on the Application for Approval of the Final Plat for Crescent Park llth Sub. Having no one present that wished to be heard. President Postier closed the hearing. Allen moved, Strain second to adopt the prepared Resolution No. 121-77 approving the plat. Ayes (6), Nays (0). Motion carried. An Ordinance Rezoning Certain property and amending Ordinance No. 16 to R-4 High Density Residence District ( A.C. Gooding property ) 6th Avenue and 4th St. S. W. was given its second reading. Strain moved Larson second to adopt the ordinance as read. Ayes (6), Nays (0). Motion carried. An Ordinance Rezoning certain property to B-3 General Business District of Outlot 8 and Outlot 9 Northern Addition to the City (Minn. Federal ) was given its first reading. Larson moved, Gray second to adopt the prepared Resolution No. 122-77 approving an Owner Contract between the City of Rochester and McGhie and Betts, Inc. and entitled Grading and Surfacing in Elton Hills North First Subdivision ( Builders Land Company ) Ayes (6), Nays (0). Gray moved, Solinger second to adopt the prepared Resolution No. 123- 77 approving the Owner contract with Kruse Company and Leon Joy-6e-Con! ion Company for the construction of Street Grading and Surfacing, San - Sewer, Storm Sewer , Watermain Underground Drains, and Service Conneci stubbed into the Boulevard on 17 1/2 Street in Meadow Park 14th Sub.
