HomeMy WebLinkAbout03-29-1977632 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA Adjourned Meeting No. 41 - March 29, 1977 Agenda Item A-1 C-1 E-1 President Postier called the meeting to order at 4:45 P.M., the following members being present: President Postier, Aldermen Allen, Gray, Larson, Powers, and Solinger, Alderman Strain was absent: Larson moved, Allen second to approve the Mayor's appointments to the Rochester Police Department of the following: William B. Anton to Assistant Chief 856 16th Street S. E..; and John Sibley to Captain of 1411 14th Avenue N. E. These appointments will be effecti; April 1, 1977. Ayes (6), Nays (0). Motion carried. Mayor Smekta noted that the Citizen's Management Study was being conducted the past few months, and no appointments were made while that study was being conducted. The Citizen's Management Study did recommend that the Rochester Police Department have two assistant chief's, and based on that recommendation, Mayor Smekta recommended the above. Larson moved, Gray second to approve the carry-over of the vacation for the following: Gerald Swanson, City Attorney be granted permissio to carry-over more than 120 hours of vacation, which is the maximum allowed by the City Policy. The Fire Chief was unable to use his vacation due to surgery, and the Library Director plans on using her accumulated vacation time as part of her maternity leave starting in May. Alderman Larson also included in the motion that the.:Personn Policy be adhered to as much as possible and that a letter be sent to department heads reminding them of this. Ayes (6); Nays(0). Motion carried. Wishing to be heard was Ole Eichten of 207 5th Avenue S. W. and urged the Council to approve the. hooking of the. Sewer .of the _. Robe rt Conway Property to the Willow Creek Sanitary Sewer. Wishing to be heard was Paul Finseth attorney with Dunlap law office 505 Marquett Bank Building and is the attorney for Robert Conway. He stated that he failed to see anything in the agreement to allow the City to make. the decision whether he hooks up or not, this should be referred to the County'-- Section 3 of the Agreement between the City of Rochester and the County of Olmsted regarding the Willow Creek Sewer -System says thus: Sec. 3. OPERATION OF SEWER SYSTEM - Sec. 3.01 - Connect- ions to Sewer System - No connection to the District System or to any subtrunk or lateral connected to the District System shall be made without prior issuance of a permit for such connection approved by the County and issued by the City, and the payment of any applicable permit fee or connection charge, or both. Whenever such a connection is desired, an application for the connection signed by the owner in a form satisfactory to the City shall be forwarded to the County and the City for their approval. The County and City shall apply the same standards for approval or disapproval as are applied to applications for similar projects located within the City. It is expressly understood by the County that in applying City standards an application may be disapproved by the City because the project is to be financed by special assessment, contrary to the E-2 lJ RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA Adjourned Meeting No. 41 - March 2.9. 1977 policy of the City governing similar projects located within the City If an application is approved the City may issue the permit upon collection of the fees .and charges due the County. The City shall approve or disapprove the connection within 20 days after receipt of the written application and supporting application, and failure to disapprove within such period shall constitute approval. Any such application shall be accompanied by plans and specifications upon which shall be shown the location, dimensions, depths and grades of any sewer or sewer system to be connected. The application shall also be accompanied by full information as to the areas, population, and developments to be served, zoning and any other information requested by the County or City as to the source, quantity and characteristics of the waste to be discharged, materials of construction, construction period, and method of financing the sewer or sewer system. All connections shall be subject to direct inspection by the City prior to the discharge of any waste into the District System. Any person who has been issued a permit for connection to the District System shall notify the City at least two (2) full working days prior to the commencement of any work authorized to be done by such permit. Section 3.02 - Discharges into Sewer System - The County shall by ordinance establish rules and regulations governing the use of the District System, prior to the discharge of any waste into it. Such ordinance, and any amendments thereto shall contain provisions of the type set forth in the attached Exhibit B, and shall be submitted to the City for its approval prior to adoption by the County. - Section 4.02 Cost of Use For the use of the City's sewer system and treatment work the County shall pay to the City on or before each January 15, April 15, July 15, and October 15, an amount equal to 50 percent of the amount which would have been collected by the City from the users of the District System for the preceding calendar quarter, if such users had been located in the City and subject to rates imposed by it. Attorney Finseth stated that it is a question of agreements the County does not want it all and neither does the City. President Postier stated that he is not against the Conway's using the Sewer System. Having no further discussion, Allen moved, Larson -second to approve the connect to the sewer system to the Robert Conway Property. Ayes (6), Nays (0). Motion carried. Having no further business, Larson moved, Gray second to adjourn the meeting. Ayes (6), Nays (0). Motion carried. er
