Alderman Allen arrived at 7:40 P.M. Absent: None. Powers moved, Duffy second'to approve the minutes of the January 7, 1980 meeting. Ayes (6), Nays (0). Motion carried. B-1 A Hearing on the application for a Planned Unit Development ( Final, Plan ) by Samaritan Bethany, Inc. for a Nursing Home West of Assisi. Heights. L.E.Bliese Administrator'of the Samaritan Bethany was presen and urged the Council to approve this. He stated the neighbors were in favor of the project. Having no one else present that wished to bi heard, President Postier closed the hearing. Larson moved, Strain second to adopt Resolution No. 31-80 approving the application with the revisions as recommended by the Planning Staff. Ayes (6), Nays (0).°Motion carried. B-2 A Hearing on the Council initiated petition'to change the Zoning District from PUD-I-10 ( Methodist Hospital ) to B-3 General Commerci on Lots 9-12 ( inclusive, Block 51, Original Plat of the City of Rochester. Having no one present that wished to be heard, President Postier closed the hearing. Powers moved, Solinger second to approve the change and instruct the City Attorney to prepare an Ordinance making the change. Ayes (4), Nays (0). Aldermen Duffy and Larson abstained. Motion carried. B-3 A Hearing on the Levy of Previously deferred assessments to Lot 1, Sunrise View Subdivision/ Project 6354-B J 8060 Construction of a Storm Sewer in Bel. Air Subdivision. Having no one present that wishe( to be heard, President Postier closed the hearing. Duffy.,Moved, Solinger second to adopt'Resolution No. 32=80 approving the assessmen- Ayes (6), Nays (0). B-4 A Hearing on the Levy of Previously Deferred Assessment to Lot 1, Sunrise View Subdivision/Project 5903 and 5903-60 J 8058 Construction of a sanitary sewer, watermain, storm sewer and service connections grading and surfacing in Rolling Greens 2nd Addition. Having no one present that wished to be heard,.Powers moved, Strain second to adopt Resolution No. 33-80 approving the assessment. Ayes (7), Nay..s (0). Motion carried. B-5 A Hearing on the Levy of Previously Deferred Assessment to Lot 1, Sunrise View Sub./ Project No. 5622 J 8059 - construction of a trunk line sanitary sewer in the south 1/2 of the NW 1/4 of Sec.22, T107N R14W, through the S 1/2 of the NE 1/4 of Sec. 22 and through the NW 1/4 of Sec. 23, T107N R 14W to the-48 inch trunk line sanitary sewer at the Rochester Sewage Treatment Plant in the NW 1/4 of the NE 1/4 of Sec..23 ( referred to as IBM Trunkline.). Powers moved, Larson second to adopt Resolution No. 34-80 accepting the assessment. Ayes (7), Nays (0). Motion carried. A Hea Oing on the Levy of Connection Charge to Lot 1, Sunrise View Sub. Project 5717 - J 8066 - Construction of a water tower to be loc- ated on the east side of 18th Avenue N. W. approx. 1250 feet north of the present City limits together with the necessary trunk line to con said water tower with the City system in 18th Avenue N. W. Having no one present that wished to be heard, President Postier closed the hearing. Powers moved, Solinger second to adopt Resolution No. 35-80 approving the project. Ayes (7), Nays (0). Motion carried. Duffy moved, Allen second to table the Request to Transfer the On - Sale Intoxicating Liquor license received from Thomas.G. Murphy toy Dooley`Inc. at 1201 Eastgate Road S. E.. The license was and is assigned to Donald Jacobsen fortthe premise known as Happy Warrior. This was tabled until April 1, 1980. Ayes (7), Nays (0). Motion carries E-2 Powers moved, Strain second to approve the Recommended Amended Allocation for the Year VI Community Development Block Grant in the amount of $736,000 as follows: 1. Group Home for Assoc. of Retarded Children $6 2,,OOa, 2. Facility for Alcoholics/Cronin House $66,400.; 3. Hiawatha Children's Home $58,-300. 4. Group Home for the Mentally Retarded Thomas House $69,300.; 5. Bear Creek Area Impts. $35,000. 6. Golden Hill Addn St. Impts: Phase I $359,000.; 7. Architectural Barrier Removal $26,000.00; 8::;:Program Administration $30,000.; and 9. Contingency $30,000. Ayes (7), Nays (0). Motion carried. E-3- Strain moved, Allen second to approve the reprogramming of an addition, $5,957 from the Year V Community Development Funds for the Longfellow School area improvements. Ayes (7), Nays (0). Motion carried. E-4 Solinger moved, Powers second to approve the following licenses and bonds: Cigarette Licenses for Pizza Hut at 28 9th St. S. E.; Heating Contractor,4Master Intaller and Master Plumbers for Kenneth H. Gilbert ethorpolitan Mechanical Constractors, Inc., Eden Prairie, Mn. - ambling License for Rochester Repeater Society to Conduct a raffle n April 12, 1980 at St. John's Grade School Gym. and Rochester Jaycee! 1980. Waiver of the $10,000. bond was requested. Auctioneer's License or Rebecca Cappel of 930 12th Avenue N. E.; Master Plumber's License or Joseph Cozik Jr. and On -Sale Beer Licenses for St. Pius for Mardi ras on February 16, 1980 and St. Patrick's Dinner on March 17, 1980. Motion carried E-8 Strain moved, Solinger second to adopt Resolution No. 39-79 requestinc the City Clerk to advertise for'.:bids for furnishing three sub -compact sedans for the Engineering Div. and one mid -size sedan;„f-or the Street and Alley div. of the Public Services Dept. Bids to be opened at 11:00 A.M. on January 31, 1980. Ayes (7), Nays (0). Motion carried. E-9 Solinger moved, Allen second to adopt Resolution No. 40-80 approving the transfer of the contingency funds (1979 ) appropriation of $175,000.00. Ayes (7), Nays (0). Motion carried. E-10 Powers moved, Solinger second to approve the Wages and benefits for City Employees not covered by any labor contract or Meet and Confer Agreements granting them 9% cost of loving increase and $.35 per hr. for School Crossing Guards. Ayes (7), Nays (0). Motion carried.. E-11 Powers moved, Allen second to adopt Resolution No. 41-80 and 42-80 approving the Meet and Confer Agreements reached with the Painters and Police Captains for the years 1980 and 1981. E-12 Solinger moved, Strain second to adopt Resolution No. 43-80 approving the advertising for bids on City Project No. 7952 J 6325 Traffic Signal Construction @ Marion Road S.E. and Longfellow School. E-13 Duffy moved, Powers second to adopt Resolution No. 44-80 approving the Parking amendment as follows: (207) of Sec. B No Parking Zones 14th Avenue S. W. on,the East side from Second St. to T.H. 52-14 East Frontage Road and on the West side from Second St. to a point 250 feet more or less South of Second St at all times. Ayes (7), Nays (0). Motion carried. E-17 Larson moved, Allen second to approve the Accounts Payble in the Amount of $280,331.37 ( Semi Monthly ) list attached. Ayes (7), Nays (0). Motion carried. F-1 An Ordinance Rezoning certain property to B-3 General Commercial on Lots 9,10,11 and 12, Block 51, Original Plat of the City of Rochester (Rochester Methodist Hospital Property ) was given its first reading. Solinger moved, Strain second to suspend the rules and give this a second reading. Ayes (5). Nays (2). Larson and Allen voted nay. Motion carried. Roll Call vote Alderman Allen voted Nay. Because a suspension) of rules needs unaminous approval. The Ordinance was not given its second reading. F-1 An Ordinance Rezoning Certain Property creating a Planned Unit Development known as PUD-R-45 Samaritan Bethany Nursing Home in Sec. 27, T107 R14 was given its first reading. F-1 Powers moved, Solinger second to adopt Resolution No. 47-80 approving a resolution of the Public Utility Board approving the contract with the Rochester Public Utility Exempt Emloyee salary schedule by 9% effective Jan. 1, 1980 and to increase salaries of all utility exempt employees but not including general manager, by 9% and to grant utilit, exempt employees the same fringe benefits for 1980. Ayes (7), Nays (0) Motion carried. F-1 Strain moved, Powers second to adopt Resolution No. 48-80 approving a resolution of the Public Utility Board for authorization to increase the Public Utility Salary Schedule for employees who are neither members of the established bargaining unit nor exempt employees by 9% effective Jan. 1, 1980 and to increase the grid systems for those empl. oyees by 9%. F-1 Solinger moved, Powers second to adopt Resolution No. 49-80 approving the 1980-1981 Labor Contract between the City of Rochester and the Engineer Technicians. Ayes (7), Nays (0). Motion carried. F-1 An Ordinance Relating to limousine franchises granting a limousing franchise to Rochester Transportation Systems, Inc. was given its first reading. Powers moved, Strain second:to suspend the rules and give the Ordinance a second reading. Ayes (6), Nays (1). Alderman Duffy voting nay. Motion carried. Upon Roll call vote, Alderman Duffy voted nay. Because the Ordinance needed a unaminous Roll call vote, the Ordinance was not given its second reading. F-1 An Ordinance annexing 22.6 acres of vacant land along the south side of 33rd St. N.E. east of Northern Slopes First and Rocky Creek First was given its first reading. F-1 Strain moved, Powers second to adopt Resolution No. 52-80 setting a date for hearing on the issuance of Industrial Revenue bonds for Gateway Foods. Date of hearing will be February 19, 1980.
