A-1 President Postier called the meeting to order at 2:00 P.M., the
following members being present: President Postier, Aldermen Allen,

Larson moved, Allen second to approve the rhtnutes of the March 24,
1980 meeting. Ayes (6), Nays (0). Motion carried.
E-1 Allen moved, Powers second to adopt Resolution No. 169-80 allowing
for the reapportionment of Section 5 Transit Funds..:ThesCity of
Duluth has requested that they be allowed to utilize $158,558.of
Section 5 Transit funds available to the City of Rochester, Minnesota.
The funds being necessary for them to complete a new transit
facility presently under construction in Duluth. The funds represent
the State's past funding of the Rochester system. In lieu of reimbur-
sement, the State is requesting the City of Rochester allow Duluth
to utilize these funds. The City of Rochester will be reimbursed
from Section 5 funds allocated to Duluth for the year 1981-1982.

E-2 Larson moved, Allen second to adopt Resolution No. 170-80 approving
the agreement with the Army Corps of Engineers for right -of -entry
on City property for the purpose of test boring. Borings to take
place as follows: Kutzky Park - 8th Ave..N. W.; Lot 1, Block 5 of
Maley's Sub. llth St. N. W.; Right of way for Willow Street -
Outlot No. 2 of Cook Sub. ; Property near the junction of the Chicago
Northwestern and Chicago Great Western Railroad right -=of -way and
property in the right-of=way of the Chicago Great Western Railroad
near 6th Avenue N.W. Ayes (6), Nays (0). Motion carried.
E-3 Duffy moved, Powers second to approve the request from the Rochester
Methodist Hospital to conduct its first annual "Life Run & Clinic"
This is cosponsored by the Rochester Track Club and endorsed by the
YMCA and the Rochester Coronary Club. The event will take place on
Saturday, May 10, 1980 beginning at 1:30 P.M. Ayes (6), Nays (0).
Motion carried. This is subject to the 'approval,of the Police Dept.
E-5 The request for Tax Exempt Financing for the Stevens Project was
withdrawn at this time. No application was submitted. Allen moved,
Duffy second to table this item. Ayes (6), Nays (0). Motion carried.
E-6 Larson moved, Allen second to approve the payment to Miller-Dunwiddie
rchitects, Minneapolis, Minnsota for work done on the Terminal
uilding Baggage Claim in the amourit of $5,098.13 and approval
f the firm of McGhie and Betts to be the consulting engineers on
he 1980 Taxiway Overlay. Total I compen-sAtion shall not exceed
44,000.00. Total project is estimated to be $475,000.00.

Larson moved, Allen second to adopt Resolution No. 172-80 accepting
the low bid of Rochester Sand and Gravel on the 1980 seasons supply
of plant mixed bituminous for the Street and Alley Dept. Total cost
$110,523.00. Council discussed the problems onc.the streets. Condition
are not -good, and our streets have many potholes. Roger Plumb,
Public Works Director stated that they do the best they can with what
money is available. The Council asked Mr. Plumb if he could submit
a listing of the project and a time table on said projects to the
City.Administrator and they will review this schedule at that time.

Powers moved, Allen second to adopt Resolution No. 176-80 authorizing
the City Clerk to advertise for bids on a Vacuum Street and Basin
Cleaner: Bids to be opened at 11:00 A.M. on April 29, 1980. Ayes (6)
Nays (0). Motion carried.
Powers moved, Duffy second to approve the agreement with the Center
for Effective Living to provide services as a diagnostic and
referral agent to the City's Employee Assistance Program. Upon Roll
call vote, Aldermen Duffy, Larson and Powers voted aye. Ayes (3).
Aldermen Allen, Strain and President Postier voted nay. Nays (3).
Because of a -,.tie vote, this will be voted on again when full Council
is present. Motion. did not carry.
Allen moved, Strain second to approve the following requests for
Leave of Absence: Sherry Wood, Public Library from May 12, 1980 thru
July 12, 1980 and Anita'Pomerenke, Public Library from April 1,
1980 to July 1, 1980. Ayes (6), Nays (0). Motion carried.
The Proposal for Engineering Services on Project 8002 J 8717 Waterman
extension to serve Samaritan Bethany II was approved on the March
24, 1980 meeting. No action was taken at this time.
Duffy moved, Larson second to adopt Resolution No. 177-80 authorizing
the City Clerk to advertise for bids on Project No. 6320-2-79 J 8705
Basic Construction in 20th Avenue S. E. abutting that part of Villa
Meadows Sub. lying north of 17th St. S. E. Bids to be open -on April
30, 1980 at 1.1`00 A.M. Ayes (6), Nays (0). Motion carried.
Duffy moved, Larson second to adopt Resolution No. 178-80-accepting
the Engineer's report and order a hearing to be held on May 5,' 1980
at 7:30 P.M. on the following project- 6300-S-80 J 8721 Watermain
trunkline extension from'the southwest corner Lot 6, Block 2,
of the 12 Seas Subdivision to proposed WoodLake Park Subdivision and
through Wood Lake Park Subdivision to the east line of Trunk Highway
No. 63. Ayes (6), Nays (0). Motion carried.
Strain moved, Allen second to adopt Resolution No. 1:79-80 accepting
the Engineer's Report and order a hearing for May 5, 1980 at 7:30
P.M. on Project No. 6107-79 J 8674 Grading and Surfacing, Concrete
Curb and Gutter, and Storm Sewer in that part of Golden'Hill Addition
lying north of 19th Street S. E. and east of Trunk Highway No. 63."

E-4u, A Request for a Stop sign at 7th Street and 7th Avenue S. E. was
received by the Council. After discussion by the Council with the
Traffic Engineer for the City of Rochester, Minnesota.they were
informed that a pine tree on the southwest corner could be guilty
of creating a number of accidents in that intersection. The Public
Services Dept. was instructed to check out the condition and report
back to the Council on the results. Having no further discussion,
Larson moved, Powers second to deny the request. Ayes (6), Nays (0).
Motion carried.

A-1 President Postier called the meeting to order at 7:30 P:.M., the
following members being present: President Postier, Aldermen Allen,
Duffy, Larson., Powers, Strain. Absent Alderman Solinger.
B-1 A Hearing on the Application for a PUD ( Final Plan) by Windbreak,
Inc. for townhouses to be known as Westgables located in Cascade
Ridge Subdivision. Wishing to be heard was Jim % ronde, Contractor
for the project and was present for any questions the Council may
have. He presented a scale of the buildings to be constructed.
Having no questions, President Postier closed the hearing. Larson
moved, Powers second to adopt Resolution No. 185-80 approving the
project. Ayes.(6), Nays (0). Motion carried.

B-2 An Application for PUD ( Concept Statement ) by John Bass for Old
Stone,Barn located at 633 16th Street S. W.- Wishing to be heard was
John Bass, Owner of the land. He urged the Council to approve the
project. Mr. Bass stated that he was attempting to resolve his
parking problems, but urged the Council to approve this and save the
barn. Wishing to be heard was Joan Moore of 1605 6th Avenue S. W.
and gave a brief outline of her attempts to save the barn and proclai
it as a historical site, she stated that after the fire, there was
not much left to preserve, and at this time she is not in favor of
this project. Alderman Powers asked Mrs. Moore i:f,_:she were in favor
of the barn being torn down at this time, and she stated that she would
rather then see the property zoned commercial. Donna Fullerton of
Stone Barn Estates read a letter written by Robert Moore of Stone
Barn Estates, and they were opposed .to the project being proposed.
William Meschke of 647 16th Street S. W. and architect for the
project was present and stated that he was in favor of the PUD.
Mrs. Theel of Storne Barn Estates is in favor of the barn being re-
stored. Linda Hick of 620 16th Street S. W. is opposed to restoring
this building. She says that many neighbors she contacts are opposed
It to this also. Robert Hart of 601 16th Street S. W. stated that the
raffic along 16th is heavy and they would have a problem with that.
He also stated that he has not sold the 11 feet of land they need
for the project to them, and is opposed to the project. When asked,
heustated that he would rather see the barn torn down then see
commercial business go in it. Mary Ann Wilson, Chairperson of the
City Historic Preservation Committee in in favor of preserving the
building. She thinks compatible businesses could be occupants of this
building. PUD would have such control. Della Bell of 641 16th St.
S.W. is concerned about snow and drainage from this project. She
lives below it. She stated that she would like to see the barn restore
with limited use. Joe Weichselbaum of 1412 14th Street S. E. is in
favor of restoring the. barn. Priscilla White of 502 16th St. S. W.
thinks the barn should be torn down rather then rezoned. Wishing
to be heard was John Bass and stated that he did not put any pressure
on Robert Hart to sell the 11 feet needed for the project. Willard
Moore of 16th St. S. W. questioned the control of the project and
the uses that can be established in a PUD. Alderman stated that
limiting business in a PUD is within the powers of the Council.
After discussion by the Council, President Postier closed the hearing
Larson moved, Duffy second to approve the concept statement. Ayes*(6)
Nays (0). Motion carried.
E-15 Allen moved, Larson second to approve the Accounts Payable in the
amount of $499,476.54 (list attached) semi -Monthly. Ayes (6),
Nays (0). Motion carried.
