A-1 President Postier called the meeting to order at 7:30 P.M., the
following members being present: President Postier, Aldermen Allen,
(arrived at 7:35 P.M.) Duffy, Larson, Powers,Solinger,-.and Strain.
Absent: None.
Strain moved; Duffy secondk::to approve the minutes of the April 7,1980
meeting. Ayes (6), Nays (0). Motion carried.
Alderman Allen arrived- 7:35 P.M.
B-1 A Hearing -on the Appeal from the decision of the Zoning Board of
Appeals to deny the application to vary provisions of Paragraph 56.40(
of the Rochester Zoning Code to create 54 lots from 27 lots for lots 1
Western's 2nd and proposed 3rd Subdivisions. Wishing to be heard was
Bob DeWitz, Developer and builder of Western Second and Third. He
stated that the lots should be split in order to provide cheaper
housing and urged the Council to approve.the establishing of the
smaller lots. Wishing to be heard was Bob Maise of 401 42nd St. N W.
was in favor of the project. Alderman Duffy asked Mr. DeWitz why he
did not apply for a PUD. Mr. DeWitz stated that it would cost more
money for lots and architects fees, plus you are locked in with what
you can do with a PUD. After discussion by the Council Mr. Fred
Suhler, Jr. City Attorney stated that a variance of this nature should
have legislation and not be brought before the Zoning Board of Appeals
for consideration. He stated that at least 4 variances could be neede
for each lot. Alderman Allen stated that he had assumed that the
Planning and Zoning Department would take care of the legislative
action on this type of problem and change the laws accordingly. Mr.
Thomas Moore, Planning Director stated that this Wednesday evening
this would be brought before the Planning and Zoning Commission for
consideration. Bill Voelker, Rochester, Minnesota was in favor of
the request of Mr. DeWitz. Having no one else present that wished
to be heard, President Postier closed the hearing. After discussion
by the Council, Solinger moved, Allen second to deny the decision
of the Zoning Board of Appeals to deny the application to vary provisi
of Paragraph 56.400 of the Rochester Zoning Code to create 54 lots fro
27 lots for lots in Western's 2nd and proposed 3rd Subdivisions.
Upon Ro11.Call vote, Aldermen Allen, Powers, Solinger and President
Postier voted aye. Ayes (4), Aldermen Duffy, Larson and Strain voted
nay. Nays (3). Motion carried. Allen moved, Powers second to approve
the varianceslas requested. Upon Roll Call vote, Aldermen Allen,
Powers, Solinger and President Postier voted aye. Ayes (4), Aldermen
Duffy, Larson and Strain voted nay. Nays (3). Motion carried.
Resolution No. 184-80 was adopted.
B-2 A Hearing on the Downtown Development District Conditional Use Permit
for Normandale Properties, Inc. (Rauenhorst/Northwestern Bank).
Wishing to be heard was John Cochran, President of Northwestern Bank
816 Merrihills Dr. S.W. Mr. Cochran gave a brief description of the
concept statement. He urged the Council to approve the permit.

her concerns about the quality of the air if a large facility was
built in the downtown area as well as a drive-in structure. She
stated that she had not seen the official plans,nor.':had she contacted
any City Departments regarding this project prior to this evening.
Roger Plumb, Public Services Director stated that 12.0 carbon monoxide
reading that Rochester had in January was the lowest last year in
five cities tested. Yet, Rochester seems to be the City the MPCA
monitors most. The five cities noted were St. Cloud, Minneapolis,
St. Paul, Duluth and Rochester. He noted that development is going
on in all of those cities. Wishing to be heard was Correy Landgren
of the Regional office of the Region Control Agency and is from
Rochester, Minnesota. He stated that he i.s-.concerned about the air
control and expressed concerns about the project regarding the air.
President Postier inquired if Mr. Lofgren was aware of the scrubbers
put in the project that will be used to dispurse the carbon monoxide.
He also stated that we will have less cars going to,the d the -in
in the project. He also stated that our City staff should have been
given a chance to review the remarks made by Ms. Sparks and Mr. Land-
gren. Mark Triplet of 1020 24th St. N. W. questioned the City Attorne,
on the legality of taking the Chateau Theatre down. The Chateau Theatr
is part of the project in question. Mrs. Diane Hilerly of 2205 18th
St. N. W. is opposed to this project.Donna Meline of 826 19th St. N.E.
is also opposed. Mayor Hazama stated that we are looking at potential
downtown development and even though it is not an easy decision, we
have to move forward. After discussion by the Council, andshav Ag
no one else present that wished to be heard, President Postier closed
the hearing. Powers moved, Larson second to approve the Conditional
Use Permit with.favorable addressing of the following: A. The
proposed use will not be detrimental to or endanger the public health
safety, convenience, or general welfare. B. The proposed use will 'not
be injurious to the use and enjoyment of other property in the neigh-
borhood and will not significantly diminish or impair the values of su
property. C. The proposed use will not impede the normal and orderly
development and improvement of the surrounding property. D. Adequate
utilities, parking, drainage, and other necessary facilities will be
provided. E. Adequate ingress and egress will be provided to minimize
traffic congestion in the public streets. F. The traffic generated by
the proposed use can be safely accomodated on existing or planned
street systems. G. Adequate measures have been taken or proposed to p
vent or control offensive odor, fumes, dust, noise, vibration, or ligh
which would otherwise distrub the use of neighboring property: H.
The applicant for the conditional use will agree to such limitations
or conditions as may be deemed appropriate by the approving body, in-
cluding but not limits to such matters as location, construction, main
enance, landscaping, operation and duration. Ayes (5), Nays (,2).Alder

Builders in Green Meadows Fifth Subdivision to be known as Greenview.
Wishing to be heard was Don Borcherding of Yaggy Associates,,
Rochester, Minnesota and urged the Council to approve this. He stated

B-3 Having no one else present that wished to be heard, President Postier
closed the hearing. Duffy moved, Powers- second to approve the applica�
for the concept and preliminary statement. This permits the 40 foot
wide curb cuts. Ayes (7), Nays (0). Motion carried.
�B-4 A Hearing on the Grant Application to the Urban Mass Transportation
Administration for the purchase of 11 transit buses and 6 bus
shelters. Wishing to be heard was Gary Meline of 826 19th St. N. E.
and would like to see the project studied more before approving
it. Sister Victorine, St. Mary's Hospital wished to be heard and
is in favor of -ZIPS, but not purchasing the buses. George Holter
owner of the Rochester City Lines stated that he is in favor of
purchasing the buses. He stated that he needs the buses. Tony
Knauer of the Public Services Department stated that by 1989 half of
the city buses will have to be equiped for the handicapped. Sister
Victorene then stated that this plan should have more study. Wishing
to be heard was Peter Vederko and asked that the City Attorney invest-
igate the purchase of the buses to see if the purchase is legal.
Having no one else wishing to be heard, President Postier closed the
hearing. Powers moved, Strain second to table this so that the
Council can obtain more information. Ayes (7), Nays (0). Motion
carried.
B-5 A Hearing on the Pr6ject 8003 J 8718 - Watermain Extension in 6th
Ave. N E. from the inplace main 360 feet North of 31st St. N. E. to
and through the SE 1/4 NW 1/4 of Sec. 24 Cascade Township ( Benike-
Soderberg Property ) to the East of Trunk Highway No. 63 and along the
East side of Trunk Highway 63 to a point approximately 200 feet South
the North line Section 24 Cascade Township ( Banfield,Seventh Day
Adventist Church Property ). Having no one wishing to be heard,
President Postier closed the hearing. Solinger moved, Duffy second
to adopt Resolution No. 186-80 ordering the project to be made.

B-6 A Hearing on the Petition to vacate the Unimproved portion of 21st
Avenue N. W. between the north line of Rolling Greens Second
Addition and 41st St. N. W. Wishing to be heard was Terry Maus,
Attorney for the petitioner and urged the Council to approve this
vacation. Wishing to be heard was Wayne Rothchild of 21st Avenue
and 38th St. N. W. and urged the Council to approve ':the vacation.
Also wishing to be heard Was Ruth Rothchild of 21st Avenue and 38th
St. N. W. and also urged the Council to approve the vacation. Having
no�_one else wishing to be heard, President Postier closed the hearing.
Powers moved, Duffy second to adopt Resolution No. 187-80 approving
-the vacation. This is subject to the retention of a utility easement
the applicants are to provide a legal description of the utility
easement that is satisfactory to the Utility department. Ayes (7),
Nays (0). Motion carried.

A Hearing on the Final Plat of Homestead Acres Subdivision. Having
no one present that wished to be heard, President Postier closed the
hearing. Solinger moved, Powers second to adopt Resolution No. 188-
approving the plat. Ayes (7), Nays (0). Motion carried.
Strain moved, Allen second to approve the change of status for
Richard Lovett from temporary to permanent and appoint Kenneth Midden
to the.position of firefighter. This appointment is effective May 1,
1980. Ayes (7), Nays (0). Motion carried.
Duffy moved, Solinger second to approve the advertising of bids
for the purchase and installation of bus shelters. Funds are appro-
priated in the Year V Community Development Block Grant. Bids will.
be opened at 11:00 A.M. on May 28, 1980. Ayes (7), Nays (0). Motion
carried.
Powers moved, Allen second to adopt Resolution No. 189-80 approving
the agreements with T.S.P. Engineers and Mass and Associates for
completion of an Energy Mini -audit.. Ayes (7), Nays (0). Motion Carri
Maximum allowable charge for T.S.P. is $7,800. and Mass is $8,600.
Larson moved, Solinger second to approve the request for an On -Sale
Wine License for the Cask and Cleaver - Fondas Pappas. The:location
is 1107 North Broadway. Ayes (7), Nays (0). Motion carried.
Allen moved, Strain second to approve the request from the Rochester
Division of the American Heart Association to hold their annual Run
for Life around Silver Lake from 1.:00 - 3:00 P.M. on Saturday April
26, 1980. Ayes (7), Nays (0). Motion carried.
Powers moved, Strain second to.adopt Resolution No. 190-80, 191-80
and 192-80. These resolutions -grant the United States Department of
Army Corps of Engineers a Right of Entry for survey and exploration
for borings on lands adjacent to the Zumbro River, North of Silver La
to the Zumbro River, upstream of Silver Lake and adjacent to Bear
Creek. Ayes (7), Nays (0). Motion carried.
Duffy moved, Strain second to authorize the solicitation of bids to r
move the structure at 103 Third Street S. E. or the solicitation of
quotations to demolish the structure if efforts to have it removed
by other means are unsuccessful. If, it should be;necessary to demolis
the building appropriation from the Parking Meter Fund will be used.

Powers moved, Duffy second to instruct City staff to institute the ad-
ministrative'procedures set forth in the Final Draft dated March
26, 1980 of the proposed "Guidelines and Procedures for Financing Unde
Minnesota Industrial Development Act." and that in general terms, the
Council approves of the proposed staff guidelines contained therein.
These would be used in evaluating Industrial Revenue Bond requests.

evelopment District to terminate the Development Control Project as
it is presently proposed based on their financial analysis of the
roject. Ayes (7), Nays (0). Motion carried. Powers moved, Duffy
econd to approve the recommendation of the Downtown Development Dist=
ict Advisory Board that the Developers enter into a working relation -
hip with staff, prior to the next Advisory Board Meeting. This is to
ring forth a restructured project which will have lowered public cost!
o the.lowest extent possible and raised the Developer's contribution
o the highest feasible level. ( This is the Development Control

196-80 authorizing the City of Rochester to enter into a Cooperation
Agreement with the Housing and Redevelopment Authority and Approving
application for Preliminary Loan for Low -Rent Public Housing and
An application by the Rochester Housing and Redevelopment Authority
to provide for -an additional thirty units of Low -Rent Public Housing.

lishing parking, truck loading, passenger loading, parking meter re-

pursuant to Rochester Code of Ordinances, Section 134.38 as amended.

E-24, Duffy moved, Allen second to adopt Resolution No. 203-80 deleting pari
graph 34 of Section E ( Passenger Loading Zone ) of the Comprehensive

ates loading zone on the north side of 2nd St. S. W. in the 300 block
which serves the Calvary Episcopal Church. Ayes (7), Nays (0). Motion

E-25 Solinger moved, Strain second to adopt Resolution No. 204-80 acceptin(
the feasibility report and order a hearing for=June 2, 1980 on
Project No. 6300-N-80A J 8719. Watermain extension along the east sidf
of Trunk Highway No. 63 from a point 100 feet north of the centerline
Northern Hills Drive N. E. to a point 210 feet south of the extension
the centerline of 27th Street N. E. '.Ayes (7), Nays (0). Motion
carried.
F-1 Duffy moved, Strain second to adopt Resolution No. 204A-80 approving
the City to enter into a "Hold Harmless Agreement" with Gus A. Chafou'
Ann C. Chafoulias, Peter M. Boosalis, and Bert M. Gross to guarantee
the repayment of tax increment bonds to be issued to finance con-
struction of the Central Towers Project. Ayes (7), Nays (0). Motion
carried.
F-1 Strain moved, Powers second to adopt Resolution No. 205-80 approving
a resolution of the Public Utility Board approving a supplement to
a contract with Layne Minnesota Company for construction of City Well
