President Postier called the meeting to order.at:7.:30 P.M., the
following members being present: President Postier, Aldermen Allen,
Duffy, Larson, Powers, Solinger. and Strain. Absent.:.None.
A Hearing on the Proposed Assessments on Project No. 6705-1-79
J 8694 Sanitary Sewer and Watermain and Service Connectors stubbed
into the boulevard in Valkyrie Lane to serve portions of Lot 6, Block
1 and Lot 1, Block 1 Valhalla.lst Subdivision. Having no one presen-
that wished to be heard, President Postier closed the meeting. Powers
moved, Solinger second to adopt Resolution No. 573-80 approving the
assessment. Ayes (7), Nays (0)..Motion carried.
A Hearing on the Proposed Assessment of Project No. 7906 J 8691
Extension of Sanitary Sewer and Watermain from 16th Avenue N. W. to
serve the U-Haul property on Lot 9, Auditors Plat D. Having no one
present that wished to be heard, President Postier closed the hearing
Allen moved; Duffy second to adopt Resolution No. 574-80 accepting
the assessment. Ayes (7), Nays (0). Motion carried.
A Hearing on the Proposed Assessments on Project No. 7002-0-78A
J 8663 Sanitary Sewer extension in 24th Avenue S.E. from 15th Street
S.E. to a point 300 feet north and,Project No. 7002-0-79 J 8695
Extension of sanitary sewer in Melody, Mayfair and Mayhill Streets
S.E. from 24th Avenue S. E. to west line of Marvale Subdivision.
Wishing to be heard was Virgil Andrist of 1437 24th Avenue S.E.
He stated that he has a brand new sewer system and he objects to pay-
ing for this one. He stated that this was not stubbed in and in order
for him to hook up to this system if he wanted to because,t would co!
more. Roger Plumb, City Public Works Director stated that the reason
the hooking up would cost so much was because his house was set back
quite far on the lot. It'is not a practice of the department to stub
in lines where they have a dirt road. One other factor was the dept
of the line. It was put,down further in the ground because of the
location. Withing to be heard was Gerald Posthumus of 2518 Mayfair
Street S. E. He stated that he would like to have the lot which
is currently vacation and has an assessment on it in the amount of
$7,775.26 deferred. He stated that he has another lot which also
has an assessment on it and would pay for that at this time. Having
no one else present at this meeting that wished to be heard, Allen _.
moved, Strain second to table this hearing until November 3, 1980
so that more information could be,obtained. Ayes (7), Nays (0). Motic
carried.

B-6 A Hearing on the Application for a Final Plat of Hendrick's Replat
located at 32nd Avenue and 22nd Street N.W. Having no one present
that wished to heard. President Postier closed the hearing.
Solinger moved, Strain second to adopt Resolution No. 577-80
approving the plat. Ayes (7), Nays (0). Motion carried.
B-7 A Hearing on the Application for a Planned Unit Development (Final
Plan) located at 14th Street and First Avenue N.E. - Buena Vista.
Wishing to be heard was Jay Bagne of 2018 26th Avenue N.W. He
presented his modified plan which reduced the number of units from
40 in ten floors to 35 in nine floors. Mr. Bagne presented an
alternate plan to the Council for use of surface parking. This park-
ing would utilize what was originally planned an area for active
recreation. Having no one else present that wished to be heard,
President Postier closed the hearing. Allen moved, Strain second to
approve the Final Amended Plan. This would include a curb cut near
the building entrance for the convenience of the handicapped and that
the property be platted. Ayes (6) Nays (1). Alderman Duffy voting
nay. Motion carried. (Resolution No. 577A-.80).
E-1 Allen moved, Solinger second to approve the transfer of the On -Sale
Intoxicating Liquor License to 50% of the interest to Randy W.
Reynolds and Mary K. Reynolds and the remaining 50% interest to the
current owners of Michael and Kathryn Carroll for the premises
known as the Bacchus Lounge at 524 llth Avenue N.W. Ayes (7),
Nays (0). Motion carried.
E-2 Larson moved, Powers second to adopt Resolution No. 578-80.authorizinc
the contract with Great Lakes Weather Service, Inc. for winter storm
warning service in the amount of $625.00. This is with Fred Wagner
of Great Lakes Weather Service, Inc. Ayes (7), Nays (0). Motion
carried.
E-3 Duffy moved, Solinger second to authorize the City to enter into
a contract with Rochester Transportation Systems to provide for the
transportation members of the public. to and from the Rochester
Municipal Airport. Ayes (7), Nays (0). Motion carried. (Resolution
No. 579).
E-4 Allen moved, Powers second to approve the issuance of up to
$7,700,000. in grant anticipation notes for WRP construction
Ayes (7), Nays (0). Motion carried. (resolution No. 580-80).
Powers moved, Solinger second to instruct the City Attorney to
prepare an Ordinance increasing the sewer service charge from $.30/
100 C.F. to $.45/100 C.F. Ayes (7), Nays (0). Motion carried.

Strain moved, Duffy second to approve the request for an Intoxicating
On -Sale Liquor License for restaurant in Riverside Building/Leko
Corporation subject to the receipt of a satisfactory character/
financial investigation report. Ayes (7), Nays (0). Motion carried.
Duffy moved, Powers second to instruct the City Attorney to prepare
an Ordinance incorporating the 1980 State Building Code and Amend-
ment of Building Permit Fees. Ayes (7), Nays (0). Motion carried.
Larson moved, Allen second to refer the Rate schedule of Rochester
City Lines to the Committee of the whole for review. A Public
hearing is set for December 1, 1980 on this matter. Ayes (7), Nays
(0).. Motion carried.
Powers moved, Solinger second to adopt Resolution 581-80 approving
the Metes and Bounds Conveyance -by the developer to the City of the
right-of-way in the vicinity of 37th Street N.W. and proposed West
River Road as described in Sec. 23, Township 107N, Range 14 West.
This is for Elcor Enterprises. Ayes (7), Nays (0). Motion carried.
Allen moved, Powers second to approve the following licenses and bonds:
Request for a moving permit for a building located at 936 2nd St.
S.W. to 19 and 21 7th Avenue S.E. John C. Stephenson of Southampton,
Pennsylvania requests an Auctioneer License and Auction Permit for a
one -day sale on November 13, 1980 at the Ramada Inn Bonds have been
submitted. Donald D. Roosemalen, requests a sign erector license
This is for Roosmalen Signs of Faribault, Minnesota. A Bond in the
amount of $1,000. has been received. Rochester Art Center requested
permission for temporary Gambling License to be held at the Ramada
Inn on November 22, 1980. Bond requirement is waived by the Council.
Request from Ray Schmitz of Wasioja Group Sierra Club for a Temporary
On -Sale 3.2 beer license for Unitarian Church on November 14, 1980.

Solinger moved, Allen second to adopt Resolution No. 582-80 authorizing
the advertisement for the demolition and removal of the Old Recreation
Lanes building (Reid Property at 9 North Broadway) Bids to be
opened at 2:00 P.M. on November 3, 1980. Ayes (7), Nays(0). Motion
carried:
Allen moved, Solinger second to adopt Resolution No. 583-80 awarding
the low bid to Alpek Sheet Metal for both roofs at City Hall and the
Rochester Art Center. Price for both roofs including the insulation
for City Hall was $54,525.00. Ayes (7), Nays (0). Motion carried.
Solinger moved, Duffy second to adopt Resolution No. 584-80 authorizing
the City Clerk to advertise for bids on a tandem vibratory steel
drum roller for the Street and Alley Division. Bids will be
opened at 11:00 A.M. November 12, 1980. Ayes (7),,Nays (0). Motion
carried.

to the establishment of Rural and Urban Service Districts within the

E-18 Allen moved, Strain second to adopt Resolution No. 588-80 approving
the Variance No..80-3 by Metro Development and the Salvation Army
to allow a Metes and Bounds Conveyance of property in Block 59 of

E-19 Solinger moved, Allen second to adopt Resolution -No. 589-80 approving
a Metes and Bounds Conveyance of.P•roperty located at 2415 and 2417

approving the petition to vacate the Utility Easements - ( Settinq
a Hearing .) on Lot 1, Block 1 Leitzen's Fifth Addition. -The hearing

80 approving the Ordering of a hearing to be held on January 5, 1981

West Frontage T.H. 52 was considered by the Council Justin Michalski

heard and opposed this restriction. He stated he received 25 sign
