A-1 President Postier called the meeting to order at 7:30 P.M., the
following members being present: President Postier, Aldermen Allen,
Duffy, Powers, Solinger. Absent: Alderman Strain. Alderman Larson
arrived at 8:00 P.M.
Duffy moved, Powers second to approve the minutes of the March 9,
1981 meeting. Ayes (5),-Nays (0). Motion carried.
B-1 A Hearing on the Petition to Change the Zoning District from B-lb to
B-4 on one acre of vacant land.on the south side of Eastwood Road
(Grandview. Memorial Gardens Property ) Wishing to be heard was Rudy
Bjorklund of .1300 Marion Rd. S. E. and is the petiti-66er.He urged
the Council to approve the petition. He wants to use the site as a
funeral home. Wishing to be heard was Clayton Craig of 1250 Marion
Rd. and is opposed to this change. Having no one else wishing to
be heard, President Postier closed the hearing. Solinger moved,
Duffy second to deny this change. Ayes.(5), Nays (0). Motion
carried.
B-2 A Hearing on the Consolidated Planning and Zoning Commission initiates
rezoning to B.-4 ( General Business ) of.Property located at 9 Fifth
Street N. E.; 506, 516, 530, 538 North Broadway. Having no one presen-
that wished to be heard, President Postier closed the heaMing.
Solinger moved,.Duffy second to instruct the City Attorney to prepare
an Ordinance making the change. Ayes (5), Nays (0). Motion carried.
B-3 A Hearing on the Petition:.to Amend the Urban Service Area Land Use
Plan from "Medium Density Residential" to "Commercial" and Rezone
from R-3 ( Medium Density Residential ) to B-4 .( General Business)
on vacant property located on the North Side of loth Street S. E. and
17th Avenue S. L. Wishing to be heard was Mrs. Wayne Laursen of
249 17th Avenue S. W. and is opposed to this change. Rick Hexum of
El.cor, was.present and urged the Council to approve this. He stated
that B-.lb.would be acceptable.. Having no one else.present that wishec
to be heard, President Postier closed the hea-tng. Powers moved,
Solinger second to amend the Land Use Plan to Commercial (Resolution
No. 135-81 ) Ayes (5), Nays (0). Motion carried. Powers moved,
Solinger second to change the Zone to B-lb. Ayes (4), Nays (1).
Alderman Duffy voted nay. Motion carried.
B-4 A Hearing on the Amendments to Paragraph 61.401 of the Rochester
Zoning Code. Having no one present that wished to be heard, Presiden
Postier closed the hearing. Allen moved, Duffy second to instruct
the City Attorney;to prepare the necessary documents approving the
amendments. Ayes (5), Nays (0). Motion carried.
B-5 A.Hearing on the Consolidated Planning and Zoning Commission initiates
amendment to the Zoning Code to allow Funeral Homes in the B-lb
(Neighborhood Business ) District as an Outright Permitted Use.
Having no one present that wished to be heard, President Postier
closed -the hearing. Duffy -moved, Powers second to A nstruct the
City Attorney to prepare the necessary documents for adoption.

Suefacing, Concrete curb and gutter, and Storm Sewer in that part
of Golden Hill and Golden.Acres Subdivision lying.south of 19th
Street S. E. and east of Trunk Highway 63. Having no one present,
that wished to be heard, President Postier closed the hearing.
Duffy moved, Allen second to adopt Resolution No. 136-81 approving
the project and ordering it to be made. Ayes (5), Nays (0). Motion
carried.
;;B-7 A Hearing on the Proposed Project 6306-4-80 J 8728 Street Reconstruc-
ion on 6th Avenue S. W.-N W. from 2nd Street S. W. to 7th Street
N. W.. Wishing to be heard in opposition are: John H. Hanlon of 603
4th Street N. W. Roger Plumb, Public Services Director presented
a slide program on the project and answered questions that the
audience may have. Also wishing to speak in opposition was Don:
Nelson of.523 4th Street N. W., John Krudwig of 6th Avenue and 3rd
St. S. W. Tom Ostien of 619 6th Avenue N. W. mgr. of Culligan
Soft. Water. Alderman Larson arrived at.8:00 P.M. Clarence Schroeder
of 6th Avenue N. W. is opposed, Elmer Riege of 615 6th Avenue N W.
Chuck Guthrie Owner of Cascade Animal Hospital on 6th Ave. N. W.,

Jim Ballard of 209 5th Avenue S. W. Speaking is favor of the project
was Mrs. Thomas Sherlock of 420 6th Avenue S. W. Roger Plumb, Public
Works Director answered the questions presented by the citizens
wishing to be heard. Having no-one else wishing to be heard,
Discussion was held by the Council. Larson moved, Solinger second
to proceed with the project and adopt Resolution No. 137-80.

E-1 Powers moved, Duffy second to approve the fee for preparing Post
Construction Elevation Certification/Flood Proofing Certificates
in the amount of $20.00 for a certificate which requires a
survey and $10.00 for a certificate not requiring a -survey'.,._
Ayes (6), Nays (0). Motion carried.
E-2 Powers moved, Larson second.to approve _ increasing the landfill
fees for demolition materials from the present $.80 per cubic yard
to $2.00 per cubic yard and the City Attorney is'instructed to prepay
an Ordinance making this effective. Ayes (6), Nays (0). Motion
carried.
E-3 Duffy moved, Allen second to table the Richards -Stevens Project
for further information. This item requested the Council to enter
into a Phase II Agreement._ Ayes (6), Nays (0). Motion carried.
E-4 Duffy moved, Solinger-second to approve the designation of Olympus
Ltd. as the developer for the Fontaine Square Project site for the
next 120 days. Ayes (6), Nays (0). Motion carried. This site is
on the corner of Broadway and Third Street S. W.

weight limit on Truck Routes. Ayes (6),Nays (0). Motion carried.

Solinger moved, Duffy second to approve the request received from the
Midwest Association for the Education of Young Children of Rochester
to allow them to paint rainbow stripes on the sidewalk between the
Kahler and Downtown Holiday Inn to reinforce their conference theme
of "Follow the Rainbow" This is going to be held the week -end of
April 23-26. They will be responsible to remove the paint after the '
conference.in no longer then 2 weeks. Upon -,Roll Call vote, Aldermen

.the Rochester City Council's support for licensing of precious metal
dealers as provided by Senate File No. 93 and House File 79

Duffy -moved, Powers second to approve :the;-,trans'ferr.ing: of the Hiawai
Childrens Home - Community Development Block Grant Project No. 2018.
Community:Development Biock'Grant No. 4023..was given $19,000.00.
By action above, the $19,000.00 is being given to 4023 and the
Project No. 2018 eliminated. Ayes (6), Nays (0). Motion carried.

the Hiawatha Childrens Home to the Department of Housing and Urban

through the Housing and Redevelopment Authority pursue additional 30
units of Low Rent Public Housing . Ayes (6), Nays (0). Motion carriec
E-11 Solinger moved, Duffy second to adopt Resolution No. 139-81 setting
a public hearing to be held on April 6, 1981 on Charter amendments.
Amendments to the text be made to Sections 1,8,9,20,21,28,29,32,
36,39,43,87,89,92,103,106,107, and 162 and that Sections 4,5,6,7,10
11, 12, 13, 34, 37,38 and 44 are repealed. Ayes (6). Nays (0).

Greene Iowa. Bond in the amount'of $500.00 has been received.

imposes certain restrictions on development in the "flood prone"

an owner contract by McGhie and.Betts, Inc. For Engineering Services

Rochester is not responsible to do whatever the Audit recommends.

declaring the cost to be assessed and ordering a hearing to be held o
April 20, 1981 on.Project No. 6311-2-80 J 8737 on Construction of a
concrete sidewalk on the West Side of llth Avenue S. E. from 16th

Committee on Urban Environment and instruct the Planning Commission ti
