A-1 President Postier called the meeting to order at 2:00 P.M., the
following members being present! President Postier, Aldermen Allen,
Bluhm, Duffy, Powers, Solinger and Strain. Absent: None.
Duly elected members of the Common Council of the City of Rochester
Minnesota elected at an election duly held on May 18, 1982 were sworn
in by City Clerk, Carole A. Grimm. Members swearing to the oath were
Richard J. Postier, Alderman at Large, Dr. Joseph Duffy, Alderman of
the Second Ward, James Powers, Alderman of the Fourth Ward and
Peter H. Solinger , Alderman of the Sixth Ward.
Powers moved, Bluhm second to approve the minutes of the May 3, and
May 17, 1982 meeting. Ayes (7), Nays (0). Motion carried.
C-1 The following address was given by Richard J. Postier, Alderman at
Large:
Honorable Mayor, Members of the Common Council and citizens of Roches�er:
It is my honor and pleasure to congratulate Aldermen Duffy, Powers an(
Solinger on their re-election to the Common Council and to thank the
citizens of Rochester for providing me with the opportunity to serve
our community for another term as Alderman At Large.
The 1980's are proving to be a dynamic period of change for
Rochester. We kicked off the 1980's with the groundbreaking of our ne
WaterReclamation Plant and have witnessed a growing momentum of
redevelopment in the Central Business District. The City's tax
increment program has been instrumental in bringina about the Riversid
project, the new Northwestern National Bank office building and drive-
in facility, the West Center Stre�elt-.parking ramp, the Stevens office
building, the Central Tower and Fontaine Tower elderly housing project
and the undertaking of a major street and sidewalk beautification
program. In addition, we are anticipating the initiation of the
proposed Times Square project, a major marketplace/entertainment cente
along the lines of the concept as advanced by the Jefferson Company,
the construction of the Charter House retirement center and the
eventual construction of a new Civic Center.
The City of Rochester is also experiencing a considerable growth
in commercial businesses outside of the Central Business District.
Projects just completed or under construction are the new K-Mart store
Target store, two Shopko stores, Barlow's/Weber building, HyVee grocer
store and Reliance Savings and Loan building. Soon to be under
construction is a major new shopping center to be called Barclay Squar
All of this indicates that the Rochester community is healthy,
vibrant and is moving ahead to provide a rewarding environment for its
citizens.
The Common Council has played a very instrumental role in bringir
about the redevelopment in the Central Business District. It has
provided the necessary leadership, assistance and has forged a new
working relationahip between the public and private sectors -
Rochester is a very good community which is ever striving to improve

and the Common -Council has to be credited for their role in making
Rochester the great community that it is.
The City government has over the years consistently provided the
citizens of the community with quality services at a very reasonable
cost. The Common Council has manaqed the City in a very fiscally
responsible manner and we will continue this practice in the coming
years. The City government is currently experiencing the economic
difficulties that are felt throughout the nationi-.and we have had to
make substantial reductions in expenditures as a result. With the
aid of our employees, we have been able to make the required reduction,
without causing a severe impact on the delivery of necessary services
to the people. We anticipate that we will experience increasing
financial difficulties in the coming year, which may require us to
ask our employees to work for a period of time without pay or to
postpone for a time their scheduled pay increase in order to avoid the
possibilities of layoffs and reduced service to our citizens.
Rochester is very fortunate to have a highly dedicated workforce of
City employees; these employees have come through for the people in
the past and I am confident that we can count on their cooperation in
coping with the economic difficulties facing us.
I look forward to working with you in the coming year to.continue
in our efforts to provide the best possible service to this very fine
community.

Allen moved, Strain second to adopt Resolution No. 229-82 adopting
the Rules and.Regulations for Order of Business of the Council.

Solinger moved, Duffy second to adopt Resolution No. 230-82 adopting
the Resolution establishing committees of the Common Council prescrib-
ing their functions and duties and providing appointment to members
of subcommittees. Ayes (7), Nays (0).Motion carried.

C-4 IThe following address was given by Mayor Chuck Hazama:
The City With Character
There is something delectable about living in a City permeated by a
wholesome attitude of idealism, hope and optimism. The pendulum has
swung from an attitude of defeatism in the late 60's and now the mom-
entum is..in our favor. Momentum is a crigical quality and that force
has stimulated our atmosphere and invigorated the process of progress.
It has enabled us to grow.and productively pursue those values that
have continually contributed to the quality of life we all pursue.
Our City has character, one that is unique and known world wide. It
has been won by hard work, integrity, unselfish devotion to service
and the will to succeed. We have escaped from old ideas and patterns
and broke the barriers as we speculate, inquire and explore ways of
doing things.. We know what it is to take risks and you've heard it
said,.the-greater the risk, the greater the reward. Success has been
achieved by those.who were willing to take the risk and believe in
the doctrine of the possible. The Nation,State and City are facing
some difficult economic times but these conditions need to be challenc
ed by our ideals. Contemplating that ideal may not produce perfection
but it produces improvement with a vision and passion to be the best.
We just experienced another successful year in City government. City
elections resulted in all the incumbents winning their seats on the
Council - an indication of general voter satisfaction. We have seen
a surge in construction, increase in retail sales and we still record
the lowest percent of unemployed in the state, but we must do better.
It's going to demand the full effort and commitment of everyone in the
community. ._Let's all recognize the fact that despite the recession
and unemployment, we still live in the greatest nation on earth. We
need to remember our strengths and virtues when we engage in a critica
self analys.is...Let us strive to adopt and live by those desirable
concepts and customs of the past that were handed down. by our fore-
fathers.a...Those desirable characteristics, opportunities and freedoms
that.made .':merica the world's greatest nation. We have a proud
heritage and a promising future. Our City's future will be determined
by many factors, but the single greatest impact will be determined
by the effort and commitment made by individuals in our community.
You can make that difference. I don't know how many of you recall
you history of the Boston Massacre of 1770. The riot broke out when
a lone British soldier on duty knocked a young boy":to the ground for
shouting obscenities. A mob of Bostonians who had witnessed the
incident pelted the soldier with stones shouting "Kill Him". The
captain of the British guards rushed over from the station with severa
men. The crowd threw dirt at their faces, waved sticks, and shouted
insults and .dared the soldiers to fire `:. Without orders, some of the
soldiers in panic, did open fire, four: of the mob fell dead., seven
were wounded and of these two died. The mob dispersed - that event
was recorded by historians as one --of the most important skirmishes

that preceded the American Revolution and is looked upon with National
pride. A young lad had a hand in the course of our history. You can
make the difference in Rochester ! People need inspiration to part-
icipate in the voluntary service called government. Many things that
are right and desirable cannot be done by legislation-. They will v
never be done unless some individual is prepared to do them for no
reward except for the gratitude of its people. Momentum is in our
favor. We have that critical quality in the onward movement as we
stribe to direct and determine our City's destiny.
Solinger moved, Bluhm second to adopt Resolution No. 231-82 designati
the Rochester Post Bulletin as the official newspaper to publish
the official printing and advertising of the City of Rochester for
the official year commencing June 1, 1982 at the rate established by
the statutes of the State of Minnesota for legal publications.

Strain moved, Solinger second to adopt Resolution No. 232-82 authorizi
the acceptance and execution of the Grant Offer for Community Developer
Block. Grant Funds in the amount of $609,000.00. Ayes (7), Nays (0).
Motion carried.
Bluhm moved, Strain second to approve:..the.Change order No. 18 associa
ed with the construction of the Water Reclamation Plant. This in an
addi.tion.:of $37,463.47. Ayes (7), Nays (0). Motion carried.
Bluhm moved, Strain second to adopt Resolution No. 233-82 authorizing
the Mayor and the City Clerk'to execute a,three party agreement betwe
Newton Fuller, Francis Losinski and the City of Rochester for a
party wall and stairwell access to Kersten Furs. The agreement has
been complete and..the City of Rochester will disburse the $10,000.
withheld from Newton Fuller to Francis Losinski, owner of Kersten
Furs. Ayes (7), Nays (0). Motion carried.
Request was received from Gene Pedersen of Fargo, N.D. to trade a
parcel of .City owned property for some property owned by himself.
The property would enable Mr. Pedersen to gain access to 14th St.
N. W. If the City accepted the trade, 14 feet adjacent to 14th St.
N. W. would be retained by the City for a future right turn lane.
Mr. Pedersen stated that he would trade all the area totaling 12,490
sq feet for 27.5 ft. portion of City Property. Mr. Pedersen is
constructing a Learning Tree Day Care Center - The.Counci:l-di:scussed
this and agreed that the trade should be made with the City receiving
$2,000.00. Bluhm moved,;Strain second to approve the change of
property with the $2,000.00 difference in value going to the City of
Rochester. Upon Roll call vote, Aldermen Bluhm, Duffy, Solinger and
Strain voting Aye. Ayes (4), Aldermen Allen, Powers and President
Postier voting nay. Nays (3). Motion carried.
Duffy moved, Powers second to adopt Resolution No. 234-82 approving
a revocable permit agreement with Stan Toner.and Denise Toner to permi
encroachment by a fence in.the right-of-way of Northgate Court N.W.

E-7 Duffy moved, Solinger second to adopt Resolution No. 236-82 authorizil
the City Clerk to advertise for bids on the re=roofing for .the
Airport Terminal Building and fire protection watermain project.
Bids will be opened.at 11:00 A.M. on June-30, 1982. Ayes (7), Nays
(0). Motion carried.
E-8 Solinger moved, Duffy second to adopt Resolution No.- 237-82 approving
a Lease agreement with Skyways Restaurant at the Rochester Municipal
Airport. The lease.is.for five years with an option to renew the leas(
for an additional -five years. The Mayor. and City.Clerk are authorize(
to execute the contract. Ayes (7), Nays (0). Motion carried.
E-9 Allen moved, Powers second to adopt Resolution No. 238-82 authorizin,
the Mayor and City Clerk to execute the release of.a claim agreement
on behalf of the City. The homeowners are William J. and Florence
Loftus.and Clarence and Gladys Bolduan. The Loftus and Bolduan
families claim that unacceptable levels of nitrates were found in
their private wells. The City is agreeing to dig a deeper well where
nitrates will not be found. Ayes (7), Nays (0).Motion carried.
E-10 Duffy moved, Powers second_to.approve the following licenses and bond,
Request for Single Gambl4hg license received from the Rochester
Pilots Association Inc. for a raffle to be held on July 4, 1982.
This is..connected to the Aviation Day 1982 held at the Rochester
Airport. Th.e bond in the amount of.$10,000. has.been.waived. License
request received from Chris J. Peterson, Peterson Blacktop and Concre-
Service for approval,of a Cement Sidewalk, Curb and Gutter and Drive-
way for the period ending December 31, 1982. Ins. Cert. and Dept.
approvals have been received. Request°for a .license to construct
cement sidewalks, curb and gutter and driveways have been received
from Darlo Construction Inc. 3705 Enterprise Dr. S.W. for a period
ending December 31,1982. Insurance certificates and departmental
approval have been.received. Request for an Annual Gambling License
from the A.F.L. Labor Club 4 Fourth St. S. W. The $10,000. bond has
been waived. Request received from Attracta Signs, Inc. Minneapolis
for approval of a,license to erect.and install Aigns in the City of
Rochester for a period ending December 31, 1982. This is pending

Request was received from Kennard B. McAdam.who desired to start a
business to be known as "Street Treets"-.- This would be a bicycle
vending business to be operated on.:C;ty,.;streets.He would be hiring 10
students to operate such units. Mr..McAdam requested that he be re-
,quired to purchase a peddler's permit for each unit rather then each
person as the ordinance requires. -We also have another request for
a.similar situation from Mr. Robert J. Rendernick of 168 36th Ave. N.

this matter to the Committee of the Whole for more _information and

Powers moved, Bluhm second to adopt Resolution No. 239-82 authorizing
the City Clerk to advertise for bids on 1982-1983 Seasons supply of
rock salt for the Street and Alley Division. The bids will be opened

Bluhm moved, Solinger second to -adopt Resolution No. 240-82 awarding
the low bid of $26,850.00 to Luma Sales Associates for signal control
and lighting modules at the intersection of 1st Ave. and 1st St. S.-W.

Bluhm moved, Duffy second to award the low bid of $137,620 to Alvin E.
Benike, Inc. for construction of an elevator addition and related

Solinger moved, Bluhm second to approve the purchase of 10 acres of
property adjacent to Eastwood Gold Course for the sum of $32,500.
the purchase of approximately 5.5 acres of property between the Zumbro
River and Oakwood Cemetary for the sum of $5,500. The pur6'ase of 4.12
acres of property adjacent to McQuillan Field for the sum of $10,000.
This also approves the submission of applications for federal and

the request for an unpaid Leave of Absence from June 14, 1982 to

E-22 Solinger moved, Duffy second to adopt Resolution No. 254-82 approving
a proposal for engineering services with McGhie and Betts, Inc.

E-27 Powers moved, Allen second to adopt Resolution No. 257-82 authorizing
the City Clerk to advertise for bids on Project No. 6107-82 J 8772
Sanitary Sewer and Watermain Extension, plus Service Connections on
18th Street S. W. from 2nd Avenue to 3rd Avenue S. W. and on 3rd Ave
S.W. from 18th Street S. W. to a poi'ht approximately 220 feet north.

E-28 Duffy moved, Strain second to adopt Resolution No. 258-82 authorizing
the City Clerk to advertise for bids on Project No. 8006- Part I,
8729 Watertower..Booster Station, and Connecting Trunkmains to serve
the High Level District S.W. Area, easterly of Trunk Highway No. 52
West of Trunk Highway No. 63, and south of 16th St. and Mayowood Rd.
.W. ; Part I, Trunkline Watermina in 5th Ave. S. W. from the well
nd booster site to the elevated storage site. Bids will be opened at
