HomeMy WebLinkAbout10-07-19821844 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA Agenda Item A-1 E-1 E-2 E-3 E-4 F-1 Adjourned Meeting No. 15 - October 7,' 1982 President Postier called the meeting to order at 4:45 P.M., the following members being present: President Postier, Aldermen Allen, Powers, Solinger and Strain. Absent: Aldermen Bluhm and Duffy. Powers moved, Solinger second to adopt Resolution No. 470-82 and 471 82 adopting the Annual 1983 budget and to certify the tax levy of $8,698,848.00. The City Clerk is instructed to certify this tax levy to the County Auditor. Ayes (5), Nays (0). Motion carried. Powers moved, Strain second to instruct the City Attorney to draft an Ordinance relating to Intoxicating Liquor; defining the term "Exclusive Liquor Store"; Defining the term "Restaurant"; Amending the Rochester Code of Ordinances, Sections 125.01, Subd. 5; 125.01, Sub. 15; 125.08. Wishing to be heard was Joe Dingle, Attorney for the Kahler Corporation and he was speaking on behalf of an additional item recommended by the Mayor's Advisory Committee on Alcohol and Drug Abuse and that was in regard to the Multiple ownership of on sale licenses. Mr. Dingle stated that the Kahler now owns the Clinic View Motel and they currently have a liquor licenses. Under this law, the Kahler would have to add some rooms in order to maintain the license and he thought that this section should be studied further before any official action is taken. The Council agreed and they would study this further at the Committe of the Whole. Dr. Hurt, Member of the MACADA committee questioned ,the Council asking them " Why they did not adopt the recommendations in full that the committee suggested?" The Council stated that they would be looking into the rest of the recommendations at the Committ of the Whole. Vote was taken on the drafting of the Ordinance. Ayes (5), Nays (0).Motion carried. The Council did not take action on the request received from Ben Sahr, Regional Circulation Manager for USA Today ( newspaper) They desired permission from the Council to put newsstands in the City of Rochester on public property. They stated that they would seek permission from any City department that may be involved in order to do so. Council advised them to have specific locations outlined and bring this to the Committee of the Whole for further discussion. Powers moved, Allen second to adopt Resolution No. 472-82 recommendi to the State Fire Marshall that the owner of the Fifth Avenue Motel in the City of Rochester be granted a variance from the miniimum re- quirements of the Uniform Fire Code with regard to items 1,3,5 of the Order dated March 22, 1982, if the owner elects in lieu thereof to provide an automatic sprinkler system for the premises. Ayes (5) Nays (0). Motion carried. An Ordinance Relating to Intoxicating Liquor; Defining the term Exclusive Liquor Store, Defining the Term Restaurant; Amending the Rochester Code of Ordinances, Sections 125.01, Subd. 5; 125.01 Sub. 15; 125.08 was given its first reading. Having no further business, Allen moved, Solinger seq�d to adjourn the meeting. Ayes (5), Nays (0). Mon carried. City Clerk. I
