Home My WebLink About01-03-19831884 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA Regular Meeting No 25 - January 3, 1983 Agenda Item A-1 President Postier called the meeting -to order at 2:00 P.M., the following members being present: President Postier, Aldermen Allen, B1uhm;.Duffy, Powers, Solinger and Strain. Absent: None. D-1 Betty Buick of 106 21st St. S. E., Manager of the Road Star Inn Rochester was present and spoke regarding her petition to revoke a non -intoxicating liquor license of the Point After Bar located at 2116 South Broadway. Ms. Buick stated that the.customers of the Point After Bar run thru the motel parking lot, tear up the fence that is between the motel and the bar. The patrons of the bar are not very clean and scatter.rubbish in the motel lot etc. Cars have been known to run through the fence and break through to the motel rooms. President Postier stated that this is the first time, he had any complaints of the Point After Bar and asked Chief of Police James Macken if the Police Department has had a lot of calls on the bar. Chief Macken responded that he received a call to furnish this information shortly before the Council meeting -and he had no':formal record available for this meeting. He did recall a call from the Road Star- Inn on several different dates. The.complaint was for noise, fights, etc. No court cases or convictions have been made for the Point After Bar. Alderman Solinger questioned Chief Macken if a number of 6 to 8 complaints would be accurate in a period°'of two years. Chief Macken indicated that he thought it would be accurate. Wishing to be heard was Brian Hervey, manager 'ofthe,fti nt After Bar. Mr. Hervey stated that the fence was damaged, but his parking is limited and the fence is really not in the proper place. If this fence was moved back a foot it would help the situation. He indicated that he offered to put in protection '(steel posts ) to protect the fence from further damage. Mr. Hervey also stated that later in this Council meeting a transfer of the Non -Intoxicating license will be requested. A new manager is taking over this establishment. Alderman Strain asked if this area is well lighted. Mr. Hervey stated that it was adequate but if more powerful lighting was used the motel people would complain because of more lights. Mayor Haza,ma questioned who was on the property first the bar or the motel. Mr: Hervey stated the bar was built first. Aldermen questioned the parking spaces and wondered if they had adequate spaces. The.Planning Department stated that they had adequate parking for the zone. Having no further discussion, no motion was made on the matter and no action was taken. E-1 Duffy moved, Strain second to approve the application for On -Sale, Intoxicating Liquor License for Estaban's Mexican Restaurant which will be located on the main floor of the Zumbro Market Place ( yet to be built). This included special Sunday Liquor. Ayes (6), Nays (1) Alderman Allen voted nay. Motion carried. E-2 Allen moved, Duffy second to approve the following licenses and bonds: Request recieved for a Cigarette'License from David Schilling, owner of Jiffy Mart at 82 36th Avenue N. W. Application requested from Shamrock Enterprises, 1202 1/2.7th St. N. W. for the Sewer and Drain icense. Bond has been received. A Hearing.on the Riverview West PUD- ( Continued hearing ). Wishing to be heard was Joe Dingle, Attorney - 1908 Mayowood Rod. S. W. and stated that Pat Dargis was no longer employed with Builders Land Company and :introduced Jim Fullerton of 3350 Fox St.1ong Lakey;� Minn.! who is taking the place of Mr. Dargis. Mr. Fullerton stated that he enjoyed working with the Common Council and appreciated their support in the projects presented by Fullerton .and Builders Land Co. Wishing to be heard was Linda.Dumich of 2916 4th Avenue N. W. She wanted to oppose the placement of an 8 plex on the south side. She stated that the elimination of this 8 plex would decrease the density. Having no no one else present that wished to be heard, President Postier closed the hearing. Ron Bailey of the Consolidated Planning Department explained the present PUD. Concerning the density of the PUD,as he understands it, the 8 plex in question on.*the south end.of the propel will be converted into a 4 plex unit. This is the one that would be placed next to the residential area. The other deletion as far as density would be the conversion of what is known as the granny flats. In the original motion by the Council there was an 8 plex on .the north side of Zumbro Drive deleted, this will be allowed to remain Concerning -the Right of Way, the City will agree to vacate its interest in the easement granted over the former Geselle property in return for the dedication by the developer of the ROW needed to construct West River Parkway. This ROW to be dedicated and platted within a 4 month period. Regarding the dedication of land East of West River Parkway as a public park. This is in the floodway. This is subject to working out an agreement with the City on extraction of the sand and gravel materials - the time period is two years. The City would agree to pay the developer $50,000. to compensate the developer for the supplying of the granular material for West River Parkway and for the dedication of th 20 acres east of the Parkway ROW to the City for Parkland purposes. If the developer is unable to obtain an excavation agreement during the six month period, the parkland property would immediately be dedicated to the City for $1.00. The developer and builder would however, reserve the mineral rights to enable them to obtain a 213 share of the proceeds in the event that the City negotiates an ex- cavation agreement subsequent to the dedication of the parkland to th City. The developer also would be allowed to utilize the material from the property east of the West River Parkway for site preparation for the housing units to be built on the -West side of the Parkway. It was discussed that one walkway would be required on Westview Lane and the requirement for a walkway on West Ridge Lane be 'de l_eti:' The developer agreed that Westview Lane would be 28' in width instead of the proposed 26'. It was agreed that the landscaped islands in the entries to the home clusters would be allowed as proposed by the developer in the final plan. Alderman Solinger questioned the developer that if the granny units did not sell, would they be deleted'from the plan? Answering Alderman Solinger was Mark Putnam of 3028 17th Avenue N. E. He stated that they are bound by .the PUD plan which authorizes 196 units and if anything else were to occur the plan would have to be revised. So the answer was "yes". He had assessment questions - he stated that the area served by this ditch involves more then the area that is going to be assessed. Alderman Solinger stated that they had problems with sink holes in the area and wondered why the entire area was not considered for the assessment. Roger Plumb, Public Services Director stated that the homeowners in the area petitioned for this project. He also stated that they did have sink holes in the area. He stated. that this was a project that normally is assessed to the people who.:front the project. Wishing to be heard was Adrian Tobin of 1710 34th Street N. W. and is opposed to the project. Wishing to be heard was Gerald Jasko of 1506 34th St. N.W. and is opposed. He wonders why he is at this hearing considering. -that the ditch is already built. He was told that some of the property owners were not notified when the project was initiated. An incomplete list was given to the department that notifies the property owners and according to the law we have to hold a hearing. He also was wondering about the replacement sod in the ditch. He said that a bad job was made in thi!s-t.area. He stated that only seed was scattered and he wanted this checked out. Alderman Solinger stated that he walked the ditch and some sod was put back. He also did stated that sink holes occurred and the citizens were worried. Mr. Jasko stated that in the 4 years he lived in the area he never had a mosquito problem from standing water. He stated that water does appear to be moving. Roger.Plumb , Public Works Director stated that six petitioners ask for this project. They abutted the property. He also felt that because of the sink holes in the area this would be safer. Mr. Plumb stated that the project is finished except for a little seeding. Having no one else present that wished to be heard President Postier closed the hearing. Powers moved, Bluhm second to adopt Resolution No. 9-83 approving the project. Ayes (7), Nays (0). Motion carried. A Hearing on the Application for Final Plat of Northern Slopes Second Subdivision located at 30th treet N.E. and Wilshire Drive N. E. Wishing to be heard was H.E. Payne, applicant and urged the Council to approve the plat. Having no one else present that wished to be heard, President Postier closed the hearing.
