RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL

Regular Meeting No. 33 - April 4. I QR3
President Postier called the meeting to order at 2:00 P.M., the
following members being present: President Postier, Aldermen Allen,
Bluhm, Powers, Solinger and Strain. Absent: A+ derman Duffy.
Powers moved, Allen second to approve the minutes of the March 14
and 21st meetings. Ayes (6), Nays (0). Motion carried.
Allen moved, Strain second to adopt Resolution No. 145-83 referring
the petition for Sanitary Sewer Service to the North 350' of the
Rochester Sand and Gravel property on T.H. 63 North to the Public
Services Department for a feasibility report. Ayes (6), Nays (0).
Motion carried.
The Community Development Block Grant Funding allocations / Year IX
in the amount of $550,000. was considered by the Common Council.
Each Council member.,turned in the individual allocations to the
City Administrator to arrive at a project allocation. The results
will be made available later in this meeting. The formula used was
to total each allocation and. divide by 7 ( each Councilman ) to
arrive at the project allocation. This will be toward the end of the
evening session.
The Cable TV Rate Increase and Franchise Renewal was brought before
the Council. Bob Loos, 531 26th St N.E. General manager of the
Group W cable TV was present and urged the Council to extend the
franchise from 1988 to 1998 & t hat the basic service charge be
increased from $6.95 a month to $7.95 a month as the increased
service becomes available. Mr. Loos feels very strong that additioral
channels will be ah"adv.antage to the City of Rochester. Part of the
renewal of the franchise will be a franchise fee.Mr'.L6os i;s r.ecoMmeridi'
that ;fee to be- i ncre'ased froon l- to 3% of the.. gross revenues of the
Copmany. This fee would be passed on the the customers in the amount
of approximately $.16. Aldermen expressed concern over the increase
in fees. Alderman Strain asked Mr. Loos how this systems would be
up -graded. Mr. Loos stated that it would increase its capacity to
accomodate 54 channels. This would cost approx. 3.5 million dollars.
Alderman Solinger stated that he would like to see a sunset with
the increased rates. Mr. Loos stated that this cost would be absorbed
in the company and the yearly reports would show the profit or loss
of the company. Mr. Loos stated that the City of Rochester is actuall,
getting a brand new system. Alderman Powers stated th&t i.f he were
to vote on this today he would have to Grote against it. He needs more
time to gather more information and talk with hi.s constituents.
4l dermen Strain and Allen agree with Alderman Powers.- Fred Suhler,
,ity Attorney stated that the franchise could be extended 15 years
and that an extension of this kind is appropriate. Aldermen will be
iiscussion this further at a Committe of the Whole. Having no further
iiscussion, Solinger moved, Powers second to set a public hearing
to be held at 7:30 on May 2, 1983. Ayes (6), Nays (0). Motion carrieda

E-4 Bluhm moved, Strain second to table the Replacing of the traffic light
at llth Avenue and West Center Street until the alderman from that

E-5 Powers moved, Bluhm second to instruct the City Attorney to prepare
an Ordinance amendment clarifying the definition of "Additional Bar"
f R.C.O. Sections 125.18, Subd. 1, Subd. l(b) which requires a bar
owner to pay an additional fee. Ayes (6), Nays (0). Motion carried.

Applications were considered for the following licenses:
On -Sale Intoxicating Liquor. Discussion was held on the following
holders of this license: Pfaff's Bar located at 315 1st Ave. N. W.;
They did not have a building permit for the interior finishing of thi
building. Mr. Pfaff of 2851 24th St. N. W. was present and stated
that he would get a letter from the manufacturer within 30 days
stating that his carpeting ( which was put on the walls ) was fire-
proof. This information is what the Building and Safety Department
needs in order to satisfy their regulations. Don Wees, Director of
Building and Safety Dept. was present and stated that this would be
O.K. Chief Orville Mettz of the Fire Department was present and
stated that the carpet had to be fla me proof and have a rating of
25 or less. Mr. Pfaff stated that the letter from the manufacturer
would have this included. Wishing to be heard was Robert Jordon
of 22 9th Avenue N. W. owner of LeBistro located at 416 South Broad-
way. Mr. Jordon stated that he too over the restaurant in November
1982 and had no knowlege of violation until January, 1983. LeBistro
did not comply to the floodproofing regulation of the lower level
of the building. This involves evacuating everything in the lower
level in case of a flood. Mr. Jordon stated that this would mean
taking the bars apart in order to completely evacuate. Mr. Wees
stated that this would not necessarily be the case. The floodproofir
has to be approved by a certified engineer and what they require a
business to do would vary. But, he would have to comply and get thi!
prodedure certified. Mr. Jordon stated that an additional 30 days
should give him time to comply. Wishing to be heard was Jim Johannir
owner of Max's Restaurant, Apache Mall. They were in violation of a
final electrical inspec ion. Mr. Johanning took over this establish-
ment January 1, 1983 and was not aware of this violation. Mr. Jack
Lane of the Building and Safety Department, Electrical Inspector
stated that Adair Electric did the work for Max's and would fix the
problem. Mr. Lane stated that this was originally designed for a
sandwich shop and they made it into a full scale restaurant. This
caused the circuits to become overloaded and danger of starting a
fire. Aldermen were concerned about this potential fire hazard.
Alderman Powers questioned Mr. Lane on the amount of time it would
take to correct the situation. Mr. Lane stated that it should take
about a week. Alderman Allen stated that this should be done
within 30 days or the license could be pulled. The Council gave
Max's two weeks to correct the situation. Riverside Garden Restaurar
of 400 South Broadway was in violation of Fire Protection; handicappE
permit fees not paid. They are closed at this time. Council stated
that if they were to open they would have to apply for a license and
the above would have to be corrected. Gullivers on 1915 Highway
52 North was in violation of an elevator for handicapped accessibilit
This was being taken care of as of this Council meeting.
The rest of the On -Sale Liquor licenses were in conformance.

Wishing to be heard was Bruce Clark of 3421 16th Avenue N. W. He

Upon discussion by Aldermen, Alderman Solinger questioned the
areas of land that abutts this plat. It was learned that another
owner was involved in the larger area that abutts this plat.
Having.no further discussion, Solinger moved, Strain second to
adopt Resolution No. 158-83 approving the plat with the deletion
of Outlot A: Upon further discussion both the second and the motion
were withdrawn. The original motion made by Powers and second by
Strain to approve the plat was voted upon. Ayes (6), Nays (0).

half of the utility and paving costs. Mr. Chuck DeWitz stated that
he could not answer for Mr. Bob DeWitz in this matter. Having no
