President Pos.tier called the meeting to order at 7:30 P.M., the follo -
ing members being present: President Postier, Aldermen Allen,
Bluhm, Duffy, Powers, Solinger and Strain . Absent : None.
Powers moved, Duffy second to approve the minutes of the April 2, 1
meeting. Ayes (7), Nays (0). Motion carried.
A Hearing on the Council initiated amendment to change portions of
the (FW) Floodway District to (FF) Flood Fringe District in the
vicinity of Mayo Civic Auditorium. Having no one present that wished
to be heard, President Postier closed the hearing. Bluhm moved,
Duffy second to instruct the City Attorney to prepare an Ordinance
approving the change. Ayes (7), Nays (0).Motion carried.
I Hearing on the Petition to Change the Zoning District from R-1
(single family ) to R-2 ( Low Density ) on Lot 1, Block 1 and Lot 1
Block 2, Cimarron Two. Having no one present that wished to be heard
President Postier closed the hearing. Bluhm moved, Allen second to
instruct the City Attorney to prepare an ordinance making the change.

A Hearing on the proposed project No. 6106-84 J 8853 - Sanitary Sewer
Watermain and service connections in 21st Street S. W. from 3rd Ave.
to the West line lot 3, Neill's Subdivision through:Block 3, Knollwooc
Addition in West Frontage Road T.H. 63 from 21st Street to 1st Avenue
S. W. at 22nd Street S. W. In 22nd Street S. W. from 1st Avenue to 5V
Avenue S. W. Along the easterly line of Block 1 South Addition to
Knollwood Acres from 22nd Street to approximately 320 feet South in 1!
and 2nd Avenue S. W. from 22nd Street S. W. to the North line of Shad(
Run 2nd Subdivision in 3rd, 4th , and 5th Avenue S. W. from 22nd to

Having no one present that wished to be heard, President Postier

adopt Resolution No. 188-84 accepttsig the project and ordering it to
be made. Ayes (7), Nays (0). Motion carried.
A Hearing on the Application for a Planned Unit Development ( Concept
Statement ) to be known as Stevens Court, located in Allendale.
Wishing to be heard was Randy Reynolds representing the applicant. Mr.
Reynolds stated that the changes have been made according to
the recommendations in the Concept Statement. Having no one else
present that wished to be heard, President Posti:er closed the hearing.
Bluhm,moved, Solinger second to approve the application ( concept
plan ) with the recommendations with the understanding that the site
plan is to be revised to provide adequate setbacks, a more usable
recreation area, and sufficient parking. Ayes (7), Nays (0). Motion
carried.

A Hearing on the Application for approval of a Planned Unit Developi
(Amended Final Plan ) for Rochester Methodist Hospital. Having no. -
one present that wished to be heard, President Postier.closed the
hearing. Bluhm moved, Allen second to approve the application and
adopt Resolution No., 189-84. Ayes (6), Nays (0). Alderman Duffy
abstained. Motion carried.
A Hearing on the Petition to Annex by Ordinance Lot 2, Block 1,
Domaille - Postier Subdivision as B-4 ( General Business ) Zoned
property. Wishing to be heard was Clark Kilpatrick of Rochester
Minnesota. He represented the petitioner - Diversified Inc. and
stated that he is caught in the middle of this. He has to pay taxes
and really does not care which governmental body. He wants to develop:
this land and needs sewer and water. He urged the Council to approve
this annexation. Wishing to be heard was Alan Leins , Supervisor
of the Cascade Board. He stated that the Cascade Board is concerned
about losing any more land as their tax base is going down. He asked
that the City give the township compensation for approx. 6 years for
loss of .this tax base. He stated that they signed the application
but with this condition. Alderman Strain asked_hoW_.much tax revenues
this land brought to the township. Mr. Leins stated that he did not
know. Alderman Strain also asked the County if they would maintain
the roads during the 6 years of expenses. Mr. Leins stated "No".
Mr. Leins stated that the City gained blacktopped streets tho by
annexation. Alderman Bluhm asked if they want the taxes from the bare
land or after this has been built.':•Mr. Leins stated that the present
condition is what they are opposed to which would mean the current
taxes. President Postier stated that we can't negotiate the taxes
and that this would go before the Minnesota Municipal Commission and
they would settle this. Having no one present that wished to be
heard, President Postier closed the hearing. Solinger moved, Powers
second to proceed and instruct the City Attorney to prepare an Ordinan
for adoption. Ayes (7), Nays (0). Motion carried. Alderman Strain
requested a meeting to be set up with the township to discuss this
problem.
A Hearing on the Petition to vacate a portion of the Right -of -Way for
the Frontage Road of T.H. 52 as platted in Cascade Ridge Subdivision.
Wishing to be heard was Don Beed of Rochester, Minnesota representing
the petitioner and urged the Council to approve this. Alderman Strain
questioned Mr. Beed on what the zone is now. Mr. Beed stated B-4.
Wishing to be heard was Steve Spahn, Rochester, Minnesota, Attorney
representing Dashow Realty and supports this petition. Wishing to be
heard was Walter Castle of 3623 Vista View S. W. and urged the Council
to approve this. Having no one else.:present that wished to be heard,
President Postier closed the hearing. Duffy moved, Bluhm second to
approve this and adopt Resolution No. 190-84 approving the vacation
with the following : The right-of-way be vacated as proposed to reduce
the total width to 66 feet:-.:1. Developer construct the west side
of the existing frontage road as an urban section with curb and gutter

and continue this design when the frontage road is extended northerly
of where it dead -ends now. 2. When the vacant property on either

C-1 Powers moved, Allen second to approve the following appointments
to the Fire Department: James Leedham as .Firefighter', effective
March 3, 1984. This was due to the retirement of Bernard Drier, thus
promoting a firefighter to the position vacated by Mr. Drier. This
position fills the vacancy by the firefighter. Ayes (7), Nays (0).
Motion carried.
C-2 Duffy moved, Allen second to approve the appointment of Bruce Novotne
to the position of Firefighter effective May 1, 1984. This is a new
unfilled position due to budget restraints. Ayes (7),Nays (0).
Motion carried.
D-1 Strain moved, Duffy second to adopt Resolution No. 191-84 referring
the said petition for Basic Construction in Manor Woods West First
Subdivision extension of necessary public streets to 7th Street and
extension of sewer and water to annexed areas to the Public Services
Department for a feasibility report. Ayes (7), Nays (0). Motion
carried.
E-1 Duffy moved, Strain second to approve the establishment of a Litigati
Management Committee to oversee the pending lawsuit associated -with
the Federal Prison Environmental Impact Statement and to provide
guidance as the lawsuit, may -proceed'., Ayes ( 6) Nags (1).-Alderman
Solinger voting nay. Motion carried.
Duffy moved, Powers second to approve the appointments by President
Postier to serve on the Committee as the Council's representatives
as follows: President Postier and Alderman Strain. Ayes (6), Nays (1.
Alderman Solinger voting nay. Motion carried.
E-2 Strain moved, Bluhm second to adopt Resolution No. 192-84 authorizing
the execution of a:.Consulting Agreement with Barton-Aschman regarding
the Rochester State Hospital Reuse Alternatives evaluation. Upon
Roll call vote, Alldermen Bluhm, Duffy, Powers and Strain and Presiden
Postier voted aye. Ayes (5), Aldermen Allen and Solinger voted.nay.
Nays (2). Motion carried 5/2.
E73 Powers moved,.Allen second to adopt Resolution No. 193-84 approving
a "Plan I, Agreement " toovern the terms and conditions of neg-
otiations to develop the D development.project site with Olympus Ltd.

E-4 Request for a variance from State Fire Marshall's order - Maxwell
Guest House. The order was to provide steps for the east exit of
the first floor to eliminate the five foot drop off. These steps

al ternati ves can be -had �,i n order to. pr.ovi de a .second exit but Mr.
Elliott of the Maxwell House would have to entail some expense or
loss of revenue to do so. Wishing to be heard was Mr. Jim
Elliott owner of the Maxwell House and he stated that there was no
room in the alley to put steps and he needed his rooms for people
to live in. He stated that all the windows on the first floor can
be used for fire escape and it is completely sprinkled plus the Fire
Dept. is only 112 block away. He urges the Council to grant him this
variance. It was noted that the alley is 18 feet wide. Duffy moved,
Powers second to continue this discussion at the Committee of the
Whole where the alternatives could be discussed. Ayes (7), Nays (0).
Motion carried.
E-5 Strain moved, Duffy second to adopt Resolution No. 194-84 opposing
Senate Fire 2069 and House File 2164 pertaining to annexations.
This would give discretion to the Minn. Mun. Board to require cities
in some instances to pay to the township an amt.'equivalent to six
years of tax revenue for annexed territory. Ayes (7), Nays (0).
Motion carried.
E-6 Strain moved, Bluhm second to adopt Resolution No. 195-84 authorizing
the Mayor and the City..Clerk to execute the lease agreement with the
Rochester Airport Company and the City of Rochester -for leasing 938.75
acres of airport farmland at $95.00 annually per acre for the disposal
of sludge. The terms of the lease is April 15, 1984 and ending on the
last day of December, 1986. Ayes (7), Nays (0)t. Motion carried.
E-7 Strain moved, Solinger second to approve the following street closings
for the "Rochesterfest '84" as follows: 1. ENTERTAINMENT PLAZA IN
FRONT OF CITY HALL - Monday , June 18 through Saturday, June 23 -
section of First Avenue S. W. from the corner of 2nd Street to the cor
ner of 3rd Street S. W. The band shell will be in place in front of
City Hall to serve as an entertainment plaza each day during the noon-
time period from 11:00 A.M. until 1:30 P.M. 2. ICE..CREAM SOCIAL -

E-11 Bluhm moved, Allen second to approve the request for a Parade for
Rochesterfest '84 as follows: Starting at Silver Lake at 7th St. N.E.
and proceeding on Broadway south to Soldier's Field Park. This is
for June 22, 1984 starting at 7:00 P.M. Ayes (7), Nays (0). Motion
carried.
E-12 Discussion was held by the Council on the application for the renewal
of the On -Sale (3.2) Non - Intoxicating beer license submitted by
East Side Inn. Since problems were reported, Council was concerned.
Also present for questions was Tom Mickelson Manager of John
Barley Corn. He had problems with the type of sprinkler. He wished to
remain open until this could be fixed. He stated that it should be
taken care of by June 3, 1984. Having no further discussion, Powers
moved, Duffy second to approve the following renewal licenses excludin_
the East Side .Inn: Off -Sale Non -Intoxicating 3.2 beer (30).

application to the City Attorney and staff to research further.

Bluhm moved, Powers second.to approve the request received from
Patterson-Restovich Law Offices , Ltd. for an assessment split
on that portion of Outlot "A" Westway Manor First Subdivision on
8th Street N. W. The conveyance of this portion to the Housing
and Redevelopment Authority requires that the assessments to be paid.
The remainder of these assessments which are for basic construction
in the amount of $73,547.41 would be applicable to the remaining

E-23 Bluhm moved, Solinger second to adopt Resolution No. 212-84 approving
an agreement with the Mayo Foundation for Pedestrian Tunnel - 1st
St. S. W. and 3rd Avenue :S. W. T;he Mayor and the Cityl�,,Clerk are
authorized to sign said agreement. The underground tunnel and
encroachments into the ROW are associated with the new parking ramp
to be constructed by the Mayo Foundation. The agreement specifies
that such encroachments will be removed at the Foundation's expense
if they impair in the future the right of public to use the street
ROW. Ayes (5), Nays (0). Aldermen Duffy and Powers abstained. Motion
carried.
E-24 Bluhm moved, Duffy second to adopt Resolution No. 213-84 amending
the Parking Ordinance as follows: Paragraph.41.8 is added to Section
B " No Parking Zones" as follows : First Avenue S. E. on the east
side, from 11 112 Street to 12th Street, at all times. Ayes (7),
Nays (0). Motion carried.
E-25 Duffy moved, Strain second to adopt Resolution No. 214-84 awarding
the low bid of $719,752.68 to Doyle Conner Co. Rochester, Minnesota
for P rgject No. 6200-W-84 J 8539 S.A.P. 159-105-05. This is for
Street Reconstruction on West Center Street from 4th Avenue West

Public Utility Board:
Resolution No. 221-84 approving a pubchase order agreement with
Horizon Steel Fabricators for furnishing Cascade Creek Byron Line
Terminal Structural Steel in the amount.,of $22,674.00.
Resolution,No..,222-84 approving.-a.,pu,rchas,e order agreement with
General Electric Co. for repair of rotor including transportation.
etc. The amount:not to exceed $100,000.00.
Resolution No. 223-84 approving a contract amendment No. 2 with
General Electric Co. for the Lake Zumbro Turbine Generator.Rehabil-
itation contract. The amount is $10,000. with the total amended
contract to be $879,300.00.
Resolution No. 224-84 approving a professional service agreement
with Smith Barney, Harris Upham and Co. for financial planning
(consultation. The amount not to exceed $22,500.00.
