President Postier called the meeting to order at 2:00 P.M, the
following members being present: President Postier, Aldermen Allen,
Bluhm, Duffy, Powers, and Strain. Absent: Alderman Solinger.
Allen moved,Bluhm second to approve the minutes of the March 18,
1985 meeting. Ayes (6), Nays (0).Motion carried.
Bluhm moved, Strain second to adopt Resolution No. 147-85 referring
the petition received from James and Judith Jensen for Watermain
Extension in West Frontage Road TH 63 from 25th Street to North Oak
Hills Drive, plus Watermain and Sanitary Sewer Extension in North
Oak Hills Drive to serve Lot 23 Oak Hills to the Public Services
Department for a feasibility report. Ayes (6), Nays (0).Motion
carried.
Duffy moved,Powers second to adopt Resolution No. 148-85 referring
the petition received from Donald and Elizabeth Shreve for Sanitary
Sewer and Watermain in that part of the NW quarter of Section 24,
T107N R14W as follows: Beg. at the SW Cor of the NW 1/4 of said Sec.
24; thence on an assumed bearing of due north al the West line of
said section 966.53 feet to a point in the centerline of County Road
No, 22; Thence South 67 degrees 05 minutes East along said Center-
line 932.29 feet; thence South 10 degrees 02 minutes West, 628.05 fee
to a point in the South line of the NW 1/4 of said Sec. 24; thence
North 88 degrees 52 min. West along the South line of said 1/4
section, 749.77 feet to a point of beginning. This contains 14.9
acres. This was sent to the Public Services Department for a feasibil
ity report. Ayes (6), Nays (0).Motion carried.
Powers moved, Bluhm second to adopt Resolution No. 149-85 initiating
the Eminent Domain Proceedings on the Fritz property. This property
has an area of about 142,000 square feet which approx. 113,000 square
feet are needed for the construction of the interchange and frontage
road at 55th St. N. W. and HWy 52. Ayes (6), Nays (0).Motion carries
Strain moved, Allen second to adopt Resolution No.149A-85 establish-
ing the disposal fees for treating sewage as follows:

the execution of a lease agreement between the City of Rochester

Strain moved, Bluhm second to approve the following licenses & bonds:
Request received from Impahn Trammavongsa, Rochester for a Dance
license ( Single ) to be held on April 6, 1985 at the Labor Temple
South Broadway and 4th Street S. W. Request received from Lourdes
High School for approval of an Auction to be -held at the high school
on October 19, 1985. Request received from The Lao Association
Center of Rochester for a license for 3.2 beer to celebrat the Leo
New Year at the Labor Temple at 4th Street S. W. on April 6, 1985.
Request received from Soma Construction for a license to construct
sidewalks, curb and gutters and driveways for a period ending
December 31, 1985. Request received from the Elton Hills PTA for a
single gambling.license to hold a raffle on April 16, 1985.
Request received from Thomas Burns for an Auction permit for the sale
restaurant equiment from the Gingerbread House located on Broadway.
The Auction will be held on April 17, 1985. The following are
renewal licenses which will be listed on the back of these minutes.
Bowling Centers (3). Dance Licenses (14). On Sale Sunday Liquor
(35). On Sale Intoxicating Liquor (33). On -Sale Non -Intoxicating
Malt Liquor beer (29). Off -Sale Non -Intoxicating Malt Liquor (34).

It was suggested by the Council that administration look into the
possibility of fines or some method of encouraging the applicants
for building permits, fire permits, etc. who have not conformed to
the requirements as set forth by various departments in the City to
get the.things done within the building or whatever needs are to be
accomplished and if they do not, set a fine for each offense. This
seemed to be a solution rather than holding up their various licenses
for approval for a condition that is really not related to the actual
license. Aldermen agreed that this should be done.
E-5 Powers moved, Strain second to approve the issuance of a Sunday Wine
License to the Trouug & Wange Restaurant, Incorporated DBA Jade
Garden at 114 South Broadway for a period of April 1, 1985 through
March 31, 1986. Ayes (6),Nays (0).Motion carried.
E-6 Duffy moved, Bluhm second to table the request for an On -Sale
Intoxicating Liquor License for Little Caesar's Restaurant located at
Barclay Square Mall until the April 15, 1985 meeting. Ayes (6),
Nays (0).Motion carried.
E-7 Bluhm moved, Strain second to remove the item of request for a licens
of Hilmer Thompson of Thompson Mechanical, Inc. for HVAC Contractors
license from the table. Ayes (6), Nays (0).Motion carried. Bluhm
moved, Allen second to deny the request for a Master Installer
by H.C. Thompson as Master Installer. Ayes (6), Nays (0).Motion
carried. Bluhm moved, Allen second to approve the license for a
Contractor for Thompson Mechanical, Inc. 1935 North Broadway and
approve the application for Master Installer's license for Danny
Rasmussen working for Thompson Mechanical, Inc. Ayes (6), Nays (0).

Bluhm moved, Strain second to table the request received from the
Unification Church for a Sidewalk permit. The Council.wanted a
specific time period that the Unification Church would be working
on the streets of Rochester. Ayes (6), Nays (0).Motion carried.
Strain moved, Allen second to approve the use of the sidewalks in
downtown Rochester on Monday , April 8, 1985 to sell raffle tickets
to the Rochester Civic Theatre Board members. Ayes (6), Nays (0).
Motion carried.
Bluhm moved, Duffy second to approve the request of Gerald Freetly,
1985 Chairman of the Tootsie Roll Drive, Knights of Columbus for
approval of their request to hold the annual sale in Rochester
on April 26, 27 and 28, 1985. Funds will be donated to the Olmsted
County Retarded Citizens. Ayes (6), Nays (0).Motion carried.
Bluhm moved, Strain second to approve the'request from the March
of Dimes "Walk America" to be held on May 11, 1985. Ayes (6),
Nays (0).Motion carried. The Police Department has approved this walk
Allen moved, Bluhm second to approve the Accounts Payable in the amour
of $453,922.10 (list attached ). This is semi-monthly. Ayes (6),
Nays (0).Motion carried.
Powers moved, Bluhm second to adopt Resolution No. 151-85 approving
the low bid of $33,126.75 for three 4-door sedans submitted by
Adamson's Motors to be used as Police cars. This includes the AM -FM
radios and no trade in. Ayes (4), Nays (2). Alderman Duffy and
President Postier voted nay. Motion carried.
Allen moved, Strain second to adopt Resolution No. 152-85 awarding
the low bid to Ace Truck and Equipment'of Rochester for a 27,500 GVW
chassis dump box and hydraulic systenT-for the Water Reclamation
-Plant. The amount bid was $26,529.35. Ayes (6), Nays (0).Motion
carried. This bid was accepted with the various deductions applying
Bluhm moved, Duffy second to adopt Resolution No. 153-85 awarding
the low bid to Braun Engineering with alternates in the total amount
of $19,712.70 for the monitoring wells (six ) at the Rochester
Municipal Airport site. Ayes (6), Nays (0).Motion carried.
Powers moved, Strain second to adopt Resoultion No. 154-85 awarding
the low bid to Modular Computer Systems for a one year maintenance
contract on the computer system at the Water Reclamation Plant.
The cost sill be $33,156.00 annually.. Ayes (6), Nays (0).Motion
carried.
Bluhm moved, Duffy second to adopt Resolution No. 155-85 authorizing
the City Clerk to advertise for bids to be opened at 11:00 on
April 11, 1985 on two eight phase traffic signal controllers and
cabinets for Project J 6344 and J6342 at 2nd Ave. and 2nd St.
S.E. and 16th Street and Apache Mall. Ayes (6), Nays (0).Motion
carried.

E=18 Duffy moved, Allen second to adopt Resolution No. 156-85 authorizing
the City Clerk to advertise for bids on a single drum vibratory
compactor for the Street and Alley Dept. Bids to be opened at
11:00 A.M. on April 24, 1985. Ayes (6), Nays (0).Motion carried.
E-19 Bluhm moved, Strain second to approve the Planned Unit Development
(Preliminary Plan) to be known as Cascade Manor; Lots 1-9, Block 3
Radichel 1st Sub. subject that sidewalks are required on the 37th St.
and 9th Street sides. Storm Shelters are also required. Ayes (6),
Nays (0).Motion carried.
E-20 Bluhm moved, Powers second to adopt Resolution No. 157-85 approving
the General Devel'opment Plan and Preliminary Plat to be known as
Viking Hills located north of Whiting's Nursery along Highway 63
subject to the following 8 conditions. 1. Rename Nordic Place and
Nordic Lane; 2. Show controlled access along US 63. 3. Dedicate
Outlot A as right-of-way. 4. Verify access to US 63 via adjacent
property. 5. Submit drainage study prior to final plat; 6. Provide
6 foot wide bituminous shoulder along west side of frontage road;
7. Extend B624 curb and gutter in Alberta Drive to Whiting Lane on soi
side and to Nordic Place on the north side. 8. Parking should be
restricted on one side of Alberta Drive from Frontage road to east
limit of plat. Ayes (6), Nays (0).Motion carried.
E-21 Bob DeWitz, developer on the Cimarron and Western Subdivision areas
was present and urged the Council to approve the Revised General
Development Plan of those named subdivisions. He asked that this be
tabled until he can talk with the Park Department on the purchase of
some land in the area for a park. Curt Taylor, Park and Recreation
Director was present and stated that he is concerned about the cost
of the Park land, and that the Park Board would be discussing this
at their next meeting. Roger Plumb, Public Works Director stated
that grading on Cimarron I and II should be settled and other proble
they have had in the area before any other action is taken . Mr.
DeWitz stated that he could use dirt from Cimarron III and IV to
fix the problems in I and II. Council discussion was held.
Allen moved, Bluhm second to table this until the problems with
other departments have been solved. Ayes (6),Nays (0).Motion
carried.
E-22 Allen moved, Bluhm second to approve the Preliminary Plat of
Cimarron Four subject to the fact that NO grading is done in the
area and that the City Clerk receive a letter from Mr. Bob DeWitz
of 2726 17th Avenue N. W. stating that they are taking care of the
problems in Cimarron I and II ( grading at Resurrection Lutheran
church site ). Alderman Bluhm directed staff to look into the
possibility of checking to see that the grading is being done when
a person applies for a Grading permit. Ayes (6), Nays (0).Motin
carried.
E-23 Allen moved, Strain second to table the request for a preliminary

the setting of a hearing date for May 6, 1985 on the vacation of the
140 foot of 19th Street S. W. right-of-way located on the west side of

E-25 Bluhm moved, Powers second to approve the continuation of the
Minnesota- Housing Finance Agency Rental Rehab Program Phase II
including all number of units to be eligible. Ayes (6), Nays (0).

E-26 Strain moved, Bluhm second to adopt Resolution No. 159-85 approving
an Engineering proposal for Project No. 8401-4 & 5 - 85 J 8884
Grading, Base, Bituminous , Surfacing, Concrete Curb and gutter,
Sanitary and Storm Sewer, Waterman and Service Connections in Cimarror
i4th and 5th Sub. This is with McGhie and Betts, Inc., Rochester,
Minnesota. Ayes (6), Nays (0).Motion carried.
E-27 Duffy moved, Bluhm second to instruct the City Attorney to prepare
an Ordinance to add the recently purchased Custom Communications
Lot and a portion of the Clements lot to the already existing
Brown Lot (No. 15) Ayes (6), Nays (0).Motion carried.
E-28 Bluhm moved, Duffy second to adopt Resolution No. 160-85 authorizing
the Minneso.a,Drivers License Bureau to temporarily close 2nd St.
N. W. from 19th Avenue to the west dead-end for three hours per day
between 9 A.M. to 3 P.M. Monday thru Friday April 1st thru Oct. for
the purpose of motorcycle drivers testing. Residents on the street
will be permitted to use the street. Ayes (6), Nays (0).Motion carriec
E-29 Duffy moved, Allen second to adopt Resolution No. 161-85 amending
paragraphs (104) (105.5) and (106) of Sec. B No Parking Zones to read;
(105) 4th St. S. W. on both sides between 2nd Avenue and a point
150 feet , more or less, west of Fourth Avenue at all times excepting
a recessed loading zone in front of the premises known as Soldiers

E-30 Bluhm moved, Strain second to adopt Resolution No. 162-85 adding para-
graph (255) to Section B No Parking Zones as follows: (255) 41st

on the south side from vacated 19th A✓.e:nue N. W. to 41st Avenue at

the contract to H & H Electric of Rochester, Minnesota (low bid)
for the installation of traffic signals at 16th Street S. W. at

E-32 Strain moved, Allen second to adopt Resolution No. 164-85 authorizing
the City Clerk to advertise for bids on Pojrect No. 8501-J 8895

E-33 (Duffy moved, Bluhm second to adopt the following.resolutions of
the Public Utility Board:
Resolution No. 165-85 approving a purchase order agreement with
Case Powers and Equipment for a Tractor-Trencher-Backhoe with trade-i
The amount is $25,861.00.
Resolution No.166-85 approving a purchase order with Clark Equipment
Company for a forklift truck in the amount of $33,323.00.
Resolution No. 167-85 approving a purchase order with Burroughs Corp.
for remittance processor. The amount to be $68,008.00.
Resolution No. 168-85 approving a contract amendment to the consultan,
services agreement with Dames and Moore for air quality modeling of
sulfur dioxide emissions from the Silver Lake Plant and North
Broadway plants. The amendment increases the agreement by $4,000.
making the total amended contract to read $44,000.00
Resolution No. 169-85 approving a purchase order agreement with
Cretex Companies, Inc. for 5 concrete transmission line poles. The
amount to be $22,969.50.

E-34 Strain moved, Allen second to adopt Resolution No. 170-85 authorizing
the City Clerk to advertise for bids on furnishing and installing
pumps on the digester overflow and centrate lines at the Water

F-1 An Ordinance Rezoning certain property and amending Ordinance No.
1659 to R-1 Lots 1,2,3,4 and 5 and Outlot B of Harborage Sub.
was given its second reading. Bluhm moved, Strain second to adopt
the Ordinance as read. Ayse (6), Nays (0).Motion carried.
F-1 An Ordinance Relating to Sewers; providing for Special Metering in
certain'instances; amending the Rochester Code of Ordinances
Section 77.04 Subdivision 2 was given its second reading. Powers
moved, Bluhm second to adopt the Ordinance as read. Ayes (6),
Nays (0).Motion carried.
G-1 Duffy moved, Powers second to remove the request received from
the Rochesterfest '85 to waive the fee for carnival license at
Apache Mall from the table. Ayes (6), Nays (0).Motion carried.
Wishing to be heard was Karen Weyandt of Apache Mall and she urged
the Council to waive the fee for May 8-12 and June 26 and 27. She
stated that the only way the carnival would come in June was to
grant them permission in May also. The rides would be 10� for kids
and would promote Rochesterfest. Having discussion by the Council,
Allen moved, Strain second to grant this request, but only during
this Rochesterfest celebration. Ayes (6), Nays (0).Motion carried.

H-1 Wishing to be heard was Steven Barlow of 2330 18th.Avenue S. W.
representing Barlow Foods. He stated that Ray Brown, owner of
Brown's Liquor Barn in Barlow Square has given Mr. Barlow permission
to purchase his liquor - Off -Sale - to himself. Mr. Barlow is
requesting the Council to transfer this license from Mr. Brown to
Barlow. It was noted that the application has not been received in
the City Clerk's office with the official transfer signature.
Mr. Doug Gregor, Assistant City Attorney also stated that their
office has not had a chance to review this. Alderman Bluhm
stated that this matter should be taken before full Council.
Allen moved, Strain second to bring this matter before Council
on April 15, 1985 and talk about it at the Committee of the Whole
on April 8, 1985. Ayes (6), Nays (0).Motion carried.

B-1 A Hearing on the Application for a Planned Unit Development ( Final
Plan by Weis Development Corp. for a development known as Tealstone.
at 6th Avenue S. W. east side of street, 1700 block.) Having no
one present that wished to be heard, President Postier closed the
hearing. Strain moved, Allen second to approve this and adopt
Resolution No. 171-85 approving the plan. Ayes (6), Nays (0).
Motion carried.
B-2 A Hearing on the PUD ( Concept Plan ) for "Fox Trails" at the'1400
Block, west side of Marion Road S. E. Wishing to be heard was
Bill Tointon of McGhi.e and Betts and is appearing on behalf of Mr.
Carl Schroeder the applicant. Mr. Tointon stated that they agree
with the staff recommendations and urges the Council to approve
this. Alderman Strain was concerned about the fill and where it
would come from. Mr. Tointon stated that they would use as much
fill as they could from areas in the Flood Fringe, but sometimes it
is not feasible as they need a different kind of soil. Alderman
Duffy was also concerned about the fill in the Flood Fringe area.
He was assured that they would use as much as they could from
the flood fringe property. Having no one else present that wished
to be heard, President Postier closed the hearing. Powers moved,
Bluhm second to approve the PUD subject to the following five
conditions: I.' Reclamation of the integrity of the floodway across
this property by removal of any illegally deposited fill and
verification of fill material in any building areas. 2. Completion
of discussions with the Park and Rec. Dept. concerning the western
floodway portion of this property as possible public open space
since it is adjacent to other City owned floodway lands. 3. Provide
for the termination of 19th Avenue S. E. at the South end of this
project. 4. The provision of storm shelter facilities which will
have to be specially designed since they will not be permitted as
structures below the flood protection elevation. 5. Platting of this
property to dedicate necessary easements and right-of-way.

B-3 A Hearing on the Petition to Change the Zoning District from R-1
to B-lb on the home at 2 16 1/4 Street N. E. Wishing to be
heard was Wesley Mross of 1619 lst Avenue N. E. He is opposed.
Wishing to be heard was Ken ANderson and is also opposed.Wishing to
be heard was Rick Gentling, Real Estate agent and stated that he
cannot sell this as a residence and plans to put in 6 barber shop
chairs - he will furnish parking stalls for the patrons and the
employees can park in an area which will be provided. He thinks
Broadway is commercial and this would be an ideal place for this
type of business. Having no one else present that wished to be
heard , President Postier closed the hearing. Duffy moved, Strain
second to deny the request. Ayes (6), Nays (0).Motion carried.
It was noted that a letter in opposition was received from Nathan Co
Mr. Cook lives at 1628 1st Ave. N.E.
B-4 A'Hearing on the County Planning and Zoning Initiated Rezoning
from R-2 to R-3 to R-1, The Harborage SubUivision. Wishing to be
heard in favor of the zoning change was Wayne Barrett of 5522 Silas
Bent Road and a resident of Longboat Road. Having no one else
present that wished to be heard, President Postier closed the hearing

an Ordinance rezoning the property. Ayes (6), Nays (0).Motion
carried.
B-5 A Hearing on the Petition to Change the Zoning District from R-1
(Single Family Residential ) to B-4 ( General Business ) on the
North 130 feet of Lot 16, Grahams 2nd Addition. Wishing to be
heard" -was Harry Smith representing Farm and Home. He urged the
Council to approve this change. Having no one else present that
wished to be heard, President Postier closed the hearing. Duffy
moved, Bluhm second to instruct the City Attorney to prepare an
Ordinance approving the change. Ayes (6), Nays (0).Motion carried.
B-6 A Hearing on the Proposed project No. 6201-4-85 J 8885 - Street
Reconstruction on 1st St. N. W. from 7th Avenue N. W. to llth Avenue
N. W. Having no one present that wished to be heard, President Posti
closed the hearing. Powers moved, Duffy second to adopt Resoution
No. 172-85 approving the project. Ayes (6), Nays (0).Motion carried.
B-7 A Hearing on the Proposed project No. 6206-3-85 J 8888 Grading and
Surfacing, Concrete Curb and Gutter and Storm Sewer in 6th Street
S. W. from 14th Avenue S. W. to the East Frontage Road Trunk Highway
No. 52. Wishing to be heard was Jerry Katzmann of 1517 6th St. S.W.
and is opposed. Luther Boye of 1527 6th St. S. W. prefers the 32'
width for the reconstruction. Harold Moe of 1416 6th St. S.W.
also is in favor of the 32 foot street. Roger Plumb, Public Services
Director stated that 32 foot can be constructed, however the State
will not allow parking on -either side of the street. Mr. Plumb
did state that he could write to the State and see if he can get
them to reconsider. Pete Jones of 1531 6th St. S. W. wants 32' for
a street.

Having no one else present that wished to be heard, President
Postier closed the hearing. -Duffy moved, Powers second to adopt
Resolution No. 173-85 approving the project with the 32 foot street
and instructing Mr. Plumb, Public Services Director to write to the
State of Minnesota asking them to let us park on one side of the
street. Ayes (6), Nays (0).Motion carried.
A Hearing on the Petition to vacate that portion of 3rd Street S. W.
lying between 3rd Avenue S. W. and 4th Avenue S. W. Wishing to be
heard was Gary Hayden of representing the Mayo Clinic. He presented
the plans showing the green space and urged the Council to approve
this. He stated that it would add to the campus and give both
patients and the clinic workers a park like place to sit.
President Postier stated that he would be in favor of this if the
necessary utilityeasements are retained. Having no one else
present that wished to be heard, President Postier closed the hearing
Bluhm moved, Allen second to approve this vacation subject to the
easements being retained. Ayes (4), Nays (0). Alderman Duffy and
Powers abstained. Since 5 affirmative votes were needed, this
will be considered at the Council meeting April 15, 1985. Motion
did not carry.

Wilson's Addition. Having no one present that wished to be heard,
President Postier closed the hearing. Duffy moved, Bluhm second to
adopt Resolution No. 174-85 approving the vacation. Ayes (6), Nays
(0).Motion carried.
A Hearing on .the Petition to vacate 340' of Apache Mall Drive as
platted in Apache Mall Shopping Center Resubdivision No. 2.
Having no one present that wished to be heard, President Postier
closed the hearing. Powers moved, Bluhm second to approve this
and adopt Resolution No. 175-85 providing that the necessary
easements are dedicated and that the plat of Apache Mall Shopping
Resubdivision No. 3 is approved. Also an easement is needed for.
the continued use of Apache Drive concurrent with the vacation.
Ayes (6), Nays (0).Motion carried.
Bluhm moved, Strain second to remove the request for use of sidewalks
received from the Unification Church from the table. Ayes (6),
Nays (0).Motion carried. Bluhm moved, Strain second to grant them
a permit beginning May.l, 1985 and ending May 31, 1985. Ayes
(6), Nays (0).Motion carried.
Strain moved, Duffy second to reconsider the action taken earlier
on the Expansion of the Brown Parking Lot. Ayes (6), Nays (0).
Motion carried. Strain moved, Powers second to table this until
the April 15, 1985 Council meeting. The Downtown Development
District wanted to review this matter. Ayes (6), Nays (0).

Regular Meeting No. 29 - April 1, 1985
An Ordinance Rezoning :prop'erty-creating a Planned Unit Development
District known as PUD-R-80 Residential in Lot 2,Excp.N 68 feet
-Lots 3,5,6,8,9, and 10 and all of the vacated. ROWVin 17th Street S.
in Toogood Terrace Sub. was given its first -reading.
An Ordinance Rezoning property in the Harborage Subdivision to R-1
Single Family Residential was given its first reading.
An Ordinance Rezoning certain property in Grahams Second Subdivison
to B-4 General Business was given its first reading.
Powers moved, Bluhm second to adopt Resolution No. 176-85 supporting
the construction of East Circle Drive by the County of Olmsted.
Ayes (6), Nays (0).Motion carried.
Having no further business, Bluhm moved, Duffy second to adjourn
the meeting. Ayes (6), Nays (0). Motion carried.
