A-1 President Postier called the meeting to order at 7:30 P.M. with the
following members being present: President Postier, Aldermen Allen,
Bluhm, Duffy, Powers, Strain and Solinger. Absent: None
B-1 A Hearing on the Petition to Change the Zoning District on Property
Located At 2626 Highway 52 North.
Wishing to be heard was Dana Eisenman, one of the.petitioners for the
zone change. Mr. Eisenman is currently selling a portion of the pro-
perty to Steve Lewis; Mr. Lewis is planning on starting a small engin
repair and used car sales business. Mr. Eisenman noted that it is
difficult to sell the land without the possible zoning change. Cur-
rently, there are a number of business along the frontage road and
the proposed business would fit along with those. He also made re-
ference to the street being used as a buffer and stated that there is
no easement as was told at the Planning -Commission meeting.
Alderman Solinger asked about the drainage problem. There is the
question of where the water will go when Cascade Street is finished.
°President Postier noted a letter from -Mr. Lewis asking that the
zone change be considered in a different manner. He asked that the
front of the property be zoned B-4 and that the rear portion of the
property be zoned R-3 instead of R-1
Wishing to be heard was Tom Thomson, 1919 20th Avenue N.W. Mr. Thom-
son is with Merrill -Lynch Realty in town and working with Mr. Eisenma
on the selling of his property. Mr. Thomson noted that they now have
a buyer for the property and unless it is rezoned, it will continue
to remain standing and vacant. He also stated that it is conforming
with the -rest of the businesses in this area.
Alderman Powers noted that the owner and/or buyer have no intention
of putting a road in the rear of the lot; thus landlocking it.
Wishing to be heard was Dave Dean, Schmidt Volkswagen, 2720 East
Frontage Road. Mr. Dean stated that the Volkswagen ownership has
invested a lot of time and effort in maintaining the quality of the
area and not having it look like a "used car lot". He noted that the
cars stored in the rear of his business are fenced in so that no
eyesore is presented to the neighborhood. Mr. Dean felt that a used
car lot, as 'is being_proposed, would decrease the value of the pro-
perty and his dealership. He further stated that he felt it was not
what was needed in the area.
Wishing to be heard was Fred Benning, 1808 Cascade Street N.W. Mr.
Benning expressed.concern about the six -food culvert, presently exist
ing, would be able to contain the runoff. fie noted that many years
ago, and again four years ago, the neighborhood, and particularly his
back yard, was full of water.

Wishing to be heard once again, Mr. Eisenman stated that the problem
with the water backing up was that when the sewer/watermain was run
through the southeast corner of his property, it did not then allow
for the dammed up water to escape to the culvert.
Having no one further wishing to be heard, President Postier closed
the hearing.
Alderman Powers stated that he had no real problems with the B-4 zone
in the front of the lot.but was concerned with the rear portion and
that there were no firm plans; the possibility of becoming a junk lot
was very real. The remaining aldermen agreed with Alderman Powers;
Alderman Bluhm asked if a conditional use permit could not be asked
for each year to provide a control that the rear portion did not be-
come what was feared. He also asked if a fence could perhaps held th
problem. Alderman Strain stated that a road to Cascade Street really
needed to be added to serve as a better buffer.
Aldermen Allen moved, Solinger seconded to deny the petition for zone
change from R-1 to B-4. Ayes (6), Nays (1). Motion carried. Alder-
man Bluhm voted nay.
A Hearing To Consider a Local Improvement: Watermain and Sewer Ext-
ension to Serve Lot 23 Oak Hills Subdivison.
Wishing to be heard was Dale Vandal, 2526 Oak Hills Drive S.W. Mr.
Vandal was wondering why this lot had to be hooked up to the sewer
at this time; why couldn't they wait until the entire section came
into the City in the future. Mr. Vandal stated that he thought the
cost would be less when there were more to share it.
Wishing to be heard was Jim Jensen, 2525 Oak Hills Drive S.W. Mr.
Jensen noted that he doesn't want the assessment either but his well
doesn't test out. He noted that his property is under contract for
deed with the seller paying a portion of the cost and the contract is
up in one year; therefore, he wants it done now.
Having no one further wishing to be heard, President Postier closed
the hearing.
Aldermen Powers moved,.Duffy seconded, to adopt Resolution #247-85
ordering Project No. 8101-85 (J-8900) Waterman and Sewer Extension
to Serve Lot 23 Oak Hills Subdivision to be made. Ayes (7), Nays (0)
Motion carried.

B-3 A Hearing on the Application For A Planned Unit Development (Amended
Final Plan) For Homestead Trails At 8 112 Street and 15th Avenue SE
Wishing to be heard was Merle Dunn, 718 Neville Court S.E. Mr. Dunn
filed the PUD amendment to permit screened enclosures of attached
decks in the rearyards of.dwellings. He indicated that they have a
lot of wildlife in the area, which includes many bugs; hence, the
need for the screened -in decks.
Having no one further wishing to -be heard, President Postier closed
the hearing.
Aldermen Powers moved, Bluhm seconded, to adopt Resolution #248-85
approving the amendment to PUD-R-38 (Homestead Trails) to permit
screened -in rearyards. Ayes (7), Nays (0). Motion carried.
C-1 Aldermen Solinger moved, Duffy seconded, to approve the appointment
of Kirk W. Otto to the Music Board. Ayes (7), Nays (0). Motion
carried.
C-2 Alderman.Powers moved, Solinger seconded, to approve the appointment
and re -appointment of Alta H. Mitchell, Michael Lorsung, Sister
Manett Tisdale and James Weygand to the. Citizens Advisory Committee
On Transit. Ayes (7), Nays (0). Motion carried.
E-1 Rresident Postier noted that this is an item he had asked to be
brought up.and considered. He felt that the present single dance
fee and the 'recommendation for the $15.00 single dance fee came nowh(
near the $750.00 annual for other organizations. Therefore, lie
recommended.that the single dance fee be raised to $25.00 to cover
the costs.
Aldermen Powers moved, Duffy seconded, to amend the present dance
ordinance to allow for the following changes: (1) The present $750
annual dance fee be retained, (2) Allow payment. of the pro-rata share
of the annual fee where a license is applied for a remaining portion
of a year. (3) Establish. a separate class of dance license for clubs
and establishments for weddings, receptions, parties, etc. for an
annual fee of.$350.00. (4) Raise the single dance license fee from
$3.00 to $25.00. (5) Restrict the number of single dance licenses to
an organization or specific location to -.five per year.
Discussion. Alderman Solinger questioned raising the single dance
fee to $25.00. He noted that a lot of groups, especially non-profit
organizations, have a difficult time making money without having to
pay a large fee. He also noted that the five restrictions would
also limit organizations having a lot of dances from getting single
permits.
Ayes (6), Nays.(1).. Motion carried. Alderman Solinger voted nay.

E-2 Aldermen Bluhm moved, Allen seconded, to approve the subway agreement
with the Mayo Foundation and the Franklin Heating Station for the new
Mayo Clinic Parking Ramp. Ayes (5), Nays (0), Abstain (2). Motion
carried. Aldermen Duffy and Powers abstained.
E-3 Alderman Duffy questioned whether or not the management fee on the
Water Works, Mayo Field and Post Bulletin parking lots should be
raised when the Civic Center begins operation.
Aldermen Solinger moved, Bluhm seconded, to increase the management
fee on the Water Works, Mayo Field and Post Bulletin -parking lots
from 5% to 10% to APCOA;'for a period of one year. Ayes (7), Nays (0)
Motion carried. Resolution # 243-85A.
E-4 -Aldermen Duffy moved, Allen seconded, to approve the lease agreement
with David Brodland for the home at 817 Sixth Street S.E. acquired
for the Corps of Engineers Flood Control Project. The lease agreemen
is for one year at $500 per month plus utilities. Ayes (7), Nays (0)I
Motion carried.
President Postier brought up the subject of the Conditional Use Permi
granted one year ago on a piece of property (residential) across from
the Auditorium. The property was to be developed into a parking lot
but, to date, no progress has been made. The land is becoming an
eyesore. Aldermen Bluhm moved, Duffy seconded, to remove the con-
ditional use permit previously approved and ask staff to look into
the problem. Ayes (7), Nays (0). Motion carried.
E-5 Aldermen Powers moved, Solinger seconded, to adopt Resolution #248-85
approving the purchase of parkland in the Cimarron area from Robert
DeWitz for $6000. Ayes (7), Nays (0). Motion --carried.
E-6 Aldermen Bluhm moved, Powers seconded, to approve a loan agreement in
the amount of $18,000 for the installation of hockey dasher boards at
Graham Arena. Ayes (7), Nays (0). Motion carried.
E-7 Aldermen Duffy moved, Allen seconded, to adopt Resolution #249-85
executing the amendment to the agreement with Northwest, Republic and
Ozark Airlines for increased landing fees -effective April 1, 1985
(from 25� per 1000 pounds to 37� per 1000 pounds). Ayes (7), Nays
(0). Motion carried.
E-8 Aldermen Strain moved, Solinger seconded, to adopt Resolution #250-85
executing agreements with L.V. Crum and Charles Paulsen for use of
airport property for raising crops during the 1985 year. Ayes (7),
Nays (0). Motion carried.
E-9 Aldermen Bluhm moved, Duffy seconded, to adopt Resolution #251-85 ex-
ecuting the amendment to the Common Carrier's Passenger Agreement
increasing the rate for fare to the Airport and Resolution #252-85
increasing the percentage paid per fare by RTS to Rochester Municipal
Airport. Ayes (7), Nays (0). Motion carried.

E-14 Aldermen Duffy moved, Powers seconded, to approve the transfer of the
On -Sale and Sunday Intoxicating Liquor License from the Sante Fe
Station, Incorporated to Horse Tree Foods, Incorporated DBA Ruscian 's

E-15 Aldermen Powers moved, Bluhm seconded, to approve the issuance of
an On -Sale Wine and Sunday License to Ron's Red Owl.at 1605 North
Broadway. Ayes (7), Nays (0). Motion carried.
E-16 Aldermen Strain moved, Allen seconded, to approve the Rochesterfest
'85 Parade on Friday, June 28th, and free parking on the streets
during that evening. Ayes (7), Nays (0). Motion carried.
E-17 Aldermen Allen moved, Bluhm seconded, to approve the semi-monthly
payment of bills in the amount of $1,031.,689.03. Ayes (7), Nays (0).

E-18 Aldermen Powers moved.,.Solinger seconded, to adopt Resolution #254-8E
awarding the bid for.furnishing and installing pumps on'the digester
overflow and centrate lines at the Water Reclamation Plant to Kirckol
Plumbing and Heating in the.amount of $42,640. Ayes (7), Nays (0).

E-19 Aldermen Duffy moved, Allen seconded; to adopt Resolution #255-85
authorizing the Mayorand City Clerk to execute the release and hold
harmless agreement between the City and Rochester Methodist Hospital
to permit the Rochester Fire Department to use the Colonial Building
for the purpose of training firefighters. Ayes (7), Nays (0).

initiating the orderly annexation agreement between the City of Roch
ester.and the Township of Cascade for the annexation of 17.57 acres
along Country Club Road S.W. northeasterly of the Rochester Golf and

adding paragraph (90) to Section E of .the Comprehensive Parking

Aldermen Allen noted that some of the homes in his area have communi
education classes.in them and asked staff to look into the problems
such classes might present.

adding diagonal parking along first avenue southeast in the 1000

Aldermen Allen moved, Duffy seconded, to adopt Resolution #266-85
awarding the contract for Project No. 6204-3-85 (J-8889)"Street
Reconstruction on Fourth Street S.W. from Second Avenue S.W. to
Sixth Avenue S.W."to the low bidder, Doyle Conner, for $271,321.84.

authorizing the City Clerk to advertise for bids for Project 6201-4-
85 (J-8885) "Street Reconstruction On First Street N.W. From Seventh
Avenue N.W. to llth Avenue N.W.". The bids are to be opened on June
14th and considered at the Council meeting on June 17th. Ayes (7),

Aldermen Solinger moved, Duffy seconded, to adopt Resolution #270-85
authorizing the City Clerk to advertise for bids for Project 6207-4-
85 (J-8898) "A Recessed Parking.Bay for Public Parking Abutting Lots
6., 7., 8 and 9 of the Replat of Blocks 4 and 10 Goodings Addition".
Bids are to be opened on June 12th and considered by the Council on
June 17th. Ayes (7), Nays (0). Motion carried.
Aldermen Powers moved, Allen seconded, to adopt Resolution #271-85
authorizing the payment of extra work by Supplemental Agreement No.
for Project No. 6202-1-84 (J-2142) "Storm Sewer in Second Street NE -
NW Between the Zumbro River and Third Avenue.N.W. in the amount of
$1500. Ayes (7), Nays (0). Motion carried.

Aldermen Bluhm moved, Allen seconded, to adopt.Resolution #272-85
authorizing the Public Utility Board to enter into a contract with
Aerial Contractors, Incorporated to complete the 41st Street. N.W.
161 KV line reroute, for an amount not to exceed $76,502.80. Ayes
(7), Nays (0). Motion carried.
The Council questioned the payback time on the mechanical alteration!
at the Library. Aldermen Allen moved, Duffy seconded, to table the
award of bids for. the Library alterations until more information was
received. Ayes (7), Nays (0). Motion carried.
Aldermen Strain•moved, Solinger seconded, to approve the sidewalk
permit for sidewalk sales for the merchants on Third Street S.W.
during Rochesterfest '85, June 24th.thr6ugh June 26th, 1985. Ayes

Aldermen Bluhm moved, Allen seconded, to approve the revision of the
bid opening date for the Senior Citizens Center heating conversion
to 11:00.AM, May 30, 1985. Ayes (7), Nays (0). Motion carried.
The Council cautioned the staff to make sure all bidders received
the addendum on the bid date.
Aldermen Solinger moved, Bluhm seconded, to adopt Resolution #273-85
approving the request of Rodney Younge to install private telephone
cable to serve Soldier's. Field Motel Property subject to Public
Services recommendations. Ayes (7), Nays•(0). Motion carried.
A letter was received from Mrs. M. Angelici, 2101 Second Street S.W.,
asking that she be allowed to hook up to City sewer prior to her
application for annexation be approved by the Council. Aldermen
Duffy moved, Powers seconded, to approve the early hook-up and asked

An Ordinance Relating to Parking Meter Rates: Amending the Provision
of the Rochester Code of Ordinances Section 134.55 was given a first
reading.
An Ordinance Relating to Municipal Parking Lot No. 2: Defining the
Boundaries Thereof: Establishing the Rates for Parking Therein:
Amending the Rochester Code of Ordinances Sections 133-.01, subd. 2
and 133.02, subd. 2 was given a first reading.
An Ordinance Annexing Approximately 28.57 acres of Unplatted Land
Situated in Rochester Township (T.H. 52 Right-of-way) was given a
first reading.
An Ordinance Regulating the Use of Public and Private Sewers and
Drains By Industrial Users and the Pretreatment of Industrial .

F-2 An Ordinance Relating to Salaries: Establishing the Salary of the
