following members being present : President Postier, Aldermen Allen,
Bluhm, Duffy, Powers, Solinger and Strain. Absent: None.
Strain moved, Allen second approving the minutes of the December
16, 1985 meeting. Ayes (7), Nays (0).Motion carried.

Solinger moved, Strain second to accept the following appointments
submitted by the Consolidated Planning Dept..to'serve on the Committe
on Urban Environment. Louise Hill and Steven Colebeck. Ayes (7),
Nays (0).Motion carried. Ms.Doris Folger was not approved because
she is not a resident of the City of Rochester.

Duffy moved, Powers second to approve the following appointments by
Mayor Hazama to the Library Board: Joseph McGLinch, Box 573 ( County
appointee ) and Robert Waite Of 3003 6th Avenue N. W. Mr.
McGlinch would have a term expiring on January, 1987 and replaces
Maaja Washington and Mr. Waite will fill the term of Janice Larson
who resigned and will run to January, 1989. The following persons
are eligible for an additional three year term ending in January
1989: Larry Gifford of 1415 loth Street N. E. and Marion Bagne of
2018 26th Avenue N. W. Ayes (7), Nays (0).Motion carried.

Bluhm moved, Powers second to adopt Resolution No. 1-86 initiating
the vacation of Street and Walkway -right-of-way in Homestead Trails
lst Replat. ROW was recently purchased and dedicated for use as

E-2 Solinger moved, Strain second approvirg the request for a revocable
permit at 426 2nd Avenue S.W. This is a permit to encroach into
the public ROW by placing a stairway exit into the public alley at
the above address. Ayes (5), Nays (2). Aldermen Allen and Duffy
voting nay. Motion carried. Alderman Strain indicated that he was
not in favor of this request and that he misunderstood the motion.
Powers moved, Strain second to reconsider the above request.
Ayes (7), Nays (0). Motion carried. Duffy moved, Strain second to
deny the request for a revocable permit at 426 2nd Avenue S. W.
Ayes (6), Nays (1). Alderman Solinger voting nay. Motion carried.
E-3 Powers moved, Allen second to approve the following licenses & bonds:
Request for a single dance for New Year's Eve, Dec. 31, 1985 received
from the Holiday Inn South. This was given preliminary approval by
the Council. Request received fora Master Installer's license for
Heating, Ventilating and Air -Conditioning for the period ending
Dec. 31, 1986 received from Jeffrey Overkamp, Altura. Request
received from Robert-F. Hosch of Mendota Heights for a Master
Installer's license for Heating, Ventilating and Air -Conditioning
for a period ending Dec. 31, 1986.

E-4 Solinger moved, Bluhm second to approve the change in ownership
and name of John T. Incorporated dba Rascals of Rochester. This
was formerly known as Lantern Lounge'and islocated at 6 & 8 South
Broadway. Three new partners are Geoffrey Roedrick 24.5%- Mark
Fulton 12.5% and Roger Fulton 12.5%. Mary Tigner previous owner
retained 51%. Ayes (7), Nays (0).Motion carried.
E-5 Duffy moved, Strain second to approve the transfer of the Spa Tavern
Northbrook Shopping Center for On -Sale and Off -Sale Beer from
Hilmuth and Lynette Hoffmann to Polly L. Freeberg. Ayes (7), Nays (O
Motion carried.
E-6 Bluhm moved, Allen second to adopt Resolution No. 2-86 correcting the
Final Plat of Northgate Third as follows: 1. The direction
of the tenth course of the plat boundary description sould be
northeasterly instead of northwesterly. 2. The distance of the
closing (last) course of the plat boundary description should be
565.00'feet instead of 515.00 feet. The pictorial portion of the
plat should be revised accordingly. Ayes (7), Nays (0).Motion
carried.
E-7 Strain moved, Duffy second to approve the semi-monthly bills ( list
filed in the City Clerk's Office ). The amount is $1,630,878.94.

E-8 Bluhm moved, Duffy second to adopt Resolution No. 3-86 approving the
Contract agreement for the years of 1986, 1987 and 1988 with Public
Utilities IBEW Local 949 - Office & Clerical. The Mayor and the City
Clerk are authorized to sign said agreements. Ayes (7), Nays (0).
Motion carried.
E-9 Solinger moved, Strain second to table the Consideration of a proposa'
to adopt Official Street Map No. 10 for C.S.A.H. 22 ( West Circle
Drive ) from U.S. 52 North at 55th Street to 2nd Street S. W. at
County Road 122 to the evening meeting. Ayes (7), Nays (0).Motion
carried.
E-10 Duffy moved, Strain second to adopt Resolution No. 4-86 approving
a proposal made by McGhie and Betts for engineering services on
Project No. 7808-3-86 J 8932 - Grading, Base, Bituminous, paving
concrete curb and gutter, sewers, watermains lift stations and
forcemain and service connections in Parkwood Hills 3rd Sub.

the feasibility report and order a hearing on the proposed
Project No. 6107-85 J 8890 Sanitary Sewer, Watermain and Service
Connections in 20th Street S. W. from 3rd Avenue S. W. to approx.
200 feet West of West Line Hilmer's High View Acres; in 3rd Ave.
and 4th Avenue S. W., from 20th Street S. W. to approx. 250 feet
North of 19th Street S. W.; in 5th Avenue S. W. from 18th to 19th
Street S. W.; in 19th Street S. W. from 245 feet West of 5th Avenue

Strain moved, Duffy second to adopt Resolution No. 8-86 and 9-86
declaring the cost to be assessed and ordering a hearing to be held
on February 3, 1986 on Project No. 6306-3-84 J 8876 - Sanitary Sewer
and Watermain in 6th Avenue S. W. from 16th Street to the South
Line of Lot 10 Toogood Terrace Subdivision plus Sanitary Sewer and
Watermain through Toogood Terrace Subdivision from 6th Avenue S.-W.
at 17th Street S. W. to the South and East of Lot 3 Toogood Terrace

Duffy moved, Powers second to adopt Resolution No. 10-86 and 11-86
declaring the cost to be assessed and ordering a hearing to be held
on February 3, 1986 on Project No. 7101 J 8359 Sanitary Sewer
and Watermain Extension to Minnesota Bible College. This is
a Deferred assessment against a portion of Lot 2 and all Lots 3,
5,6, 8, 9 and 10 of Toogood Terrace Sub. in the amount of $1,211.10
leaving a deferred amount of $71,654.36. Ayes (7), Nays (0).

Duffy moved, Bluhm second to adopt Resolution No. 15-86 authorizing
for payment the Supplemental Agreement No. 4 Project No. 6204-3-85
4th Street S. W. -2nd Avenue to 6th Avenue S. W.. The Supplemental
agreement is in the amount of $7,038.08. Ayes (7), Nays (0).
Motion carried.
Solinger moved, Strain second to adopt the following Resolutions
approved by the Rochester Public Utility Board:
Resolution No. 16-86 - approving a purchase order agreement with
Lear Siegler, Inc. for furnishing data acquisition system upgrade.
The amount is $28,975.00.
Resolution No. 17-86 approving an engineering agreement with Ulteig
Engineers, Inc. for services for the design and construction of
the Cascade Creek Substation 115kV Bus Tie Breaker installation
in the amount of $5.5,000.
Resolution No. 18-86 approving an electric service agreement with
General Services Adm. of the United States of America for service
to the Federal Medical Center- Rochester, Minnesota.
Resolution No. 19-86 approving the designated depositories and
temporary assignment of investments _of funds of Rochester Public
Utilites for the term commencing Jan. 1, 1986 through December 31,
1986 as follows: First Bank Rochester, Marquette Bank and Trust,
Midwest Federal, Minnesota Federal Savings and Loan, Norwest Bank and
Win City Federal. Ayes (7), Nays (0). Motion carried.
Strain moved, Duffy second to approve the request received from.
the March of Dimes to sponsor an annual Snowmobile Ride-A-Thon on
January 18, 1986. This will start at Dooley's and end at Eyota and
the return trip will begin at Eyota and return to Rochester via
Hwy 14 from Eyota. Lt. Al Sisson of the Rochester Police Dept.
was present and Alderman Strain asked Lt. Sisson if a,person would
be available to help the snowmobiles get across the road from Dooley'
to head out of the City limits. Lt. Sisson stated that this is
a good idea and he would see to it that ample help was available.
Lt. Sisson also stated that some alteratives to the requested
route may be necessary to insure the safety of everyone. Aldermen
stated that the approval of this is subject to approval of the
Police Department , Safety Division: Ayes (7), Nays (0).Motion
carried.
An Ordinance Relating to Intoxicating Liquor; providing for the
Prohibition of Minors on certain premises: Amending the Rochester
Code of Ordinances, Sec. 125.26 was given its second reading.
Allen moved, Strain second to adopt the Ordinance as read. Ayes (7),
Nays (0). Motion carried.

moved, Allen second to adopt the Ordinance as read. Ayes (7),
Nays (0).Motion carried.

An Ordinance Relating to Annexation; amending an erroneous legal
description in Ord. 2441 - amending Ordinance No. 2441 ( 0.5 acre
parcel of City owned land east of Zumbro River and south of Foster
Arend Park ) was given its first reading. Allen moved, Solinger
second to suspend the rules and give this Ordinance as second
reading. Upon Roll Call vote, Aldermen Allen, Bluhm, Duffy,
Powers ,Solinger and Strain and President Postier voted aye.
Ayes (7), Nays (0).Motion carried. The Ordinance was given its
second reading. Duffy moved, Powers second to adopt the Ordinance
as read. Ayes (7), Nays (0).Motion carried.,
Having.no further business, Bluhm moved, Strain second to adjourn
the meeting until 7:30 P.M. Ayes (7), Nays (0). Motion carried.

Zoning Board of Appeals which approved an Appeal to the Decision
of the Planning and Zoning Commission which denied Conditional
Use Permit for an Automotive Service Station in the B-lb (Neighbor-
hood Business ) Zoning Districts. Having no one present that wished
to be heard, Solinger moved, Bluhm second to continue the hearing
until the January 21, 1986 meeting. Ayes (7), Nays (0).Motion
carried.

Development ( Concept Statement ) for Virgil's Auto Clinic.

A Hearing on the Zoning Commission No. 85-25 & Anx. 85-15, Petition
to annex 22.8 acres of land including the Libby's Warehouse on the
300 block of 20th Street S. W. and to rezone the property to the
M-2 district at the time of annexation. Having no one present
that wished to be heard, President Postier closed the hearing.

B-5 A Hearing on the Zone Change # 85-26, Petition to Change the
zoning district on the property at 612 llth Avenue N. W. from M-1
to B-4. Wishing to be heard was Don Orke of 204 14th Street N.-E.
and was present for any questions the Council may have. Having
no one else present that wished to be heard, President Postier
closed the hearing. Allen moved, Powers second to instruct the
City Attorney to prepare an Ordinance for adoption. Ayes (7),
Nays (0).Motion carried.
B-6 A Hearing on the Amended Final Plan for Meadow Park Apartments
Planned Unit Development. Having no one present that wished to
be heard, President Postier closed the hearing. Duffy moved,
Solinger second to adopt Resolution No. 21-86 approving the
Amended Final Plan. Ayes (7), Nays (0).Motion carried.
The legal description of the area is Lots 1,2,3, 17 and 18 Meadow
Park Sixth Sub. and previously designated PUD-R-34. Ayes (7),
Nays (0).Motion carried.
B-7 A Hearing on the Zone Change 85-24 Golden Hill Area ( Forest Hills
1-5 and Schulz lst Subdivision to RSA Residential) (property
at 2811 2843 and 2849 South Highway 63-to B-4 Commerical ) and
(the vacant property west of Hanson Tire and Auto Service Center
located at 2811 South Highway 63 to R-2 Residential.) Wishing to
be heard was Gordon Lundscow of 1110 Westchester Court S. W.
and is in favor of this request. Wishing to be heard was
Bill Soderbert of 214 28th Street S. W. and is opposed. He would
like this remain as R-1. Wishing to be heard was Roland Anderson
owner of the property. He stated that the upper part of the
property would be used to have a 4 plex built. He would live in
one of the units and rent the rest. He stated that this area
was commercial when it was not in the City. The lower part of
the lot could be zoned to R-2. Mr. Anderson stated that he could
live with that zone. Having no one else present that wished to
be heard, President Postier closed the hearing. Duffy moved,
Strain second to instruct the City Attorney to prepare an Ordinance
approving this request. Ayes (7), Nays (0).Motion carried.
E-9 Allen moved, Powers second to remove the Consideration of a Propoaa
to adopt Official Street Map 10 for C.S.A.H. 22 ( West Circle.
Drive ), from U.S. 52 North at 55th Street to 2nd Street S. W. at
County Road 122 from the table. Ayes (7), Nays (0).Motion carried.
Alderman Allen stated that he voted against this because it doesn't
align up correct in the area of Country Club Manor. He stated that
schools and residential areas are too close to the proposed drive.
With that in mind, Alderman Allen moved to deny the Official
Street Map 10 and take this back to the Olmsted County Board for
more study or consider a plan to move the drive further to the
west. Having no second to the motion, the motion was dropped.
Solinger moved, Strain second to approve the route with some
possible variances relating to behind the Harriet Bishop School
moving this roadway to the East and including the berming of the
school yard. Alderman Duffy stated that if this project was

E-9 going to be built tomorrow he would see some merit in moving the
route, but reality says that this will not be built for a period
of time ( years ) and by the time this is completed, houses,
etc. will be in the area that the Council sets tonight. Consequent'
citizens will be in opposing the project at that time stating
the same objections as they are today. He stated that we do need
this link and is in favor of the change in Street Map 10. Alderman
Powers stated that this link is also needed. He stated that this
area has the longest stretch of road that does not have a passagewa;
off. Alderman Solinger stated that Alderman Duffy and Powers
spoke words that he was going to say. He agreed with them totally.
Alderman Bluhm stated that he is in favor of this and stated
that he has followed many vehicles to 36th Avenue N W. and by
building this roadway, 36th Avenue traffic would be relieved.
Alderman Strain echos the concerns of the other aldermen and would
like to see the berming of the school yard. Having no further
discussion, vote was taken, Ayes (6), Nays (1). Alderman Allen votii
nay. Motion carried. The City Attorney was instructed to prepare
an Ordinance for adoption.
G-1 Request for Vac 85-25 Petition to vacate the west 3 feet of the
10 foot utility easement located at 4314 and 4316 13th Ave. N. W.
was left on the table.
G-2 Solinger moved, Powers second to remove -the request for Authorizati(
of Temporary On -Sale Liquor Licenses from the table. Ayes (7),
Nays (0).Motion carried. Powers moved, Bluhm second to deny the
request. Ayes (7), Nays (0).Motion carired.
F-1 An Ordinance relating to the Annexation and Zoning of 22.8 Acres
situated in Sec. 13 of Rochester Township and providing for
zoning of said lands ( Libby's ). This was given its first reading.

H-1 Discussion was held on the amount of time that the Building
and Safety Department spends on inspection of construction and
additions that citizens make to their property. This was promoted
recently due to citizens building on easements and no one is
catching this until the project'is.complete. Alderman Bluhm
indicated that Mr. Don Wees stated that he could inspect a project
in 5 minutes if the proper documentation was presented to him
either before or at the time of inspection. Mr. Wees also
stated that if the proper documents could be secured, he would not
need additional help to make these inspections. Aldermen was
concerned about where and who would be responsible to secure the
documents that would be needed in order for the Building and
Safety Dept. to give proper inspection. After lengthy discussion,
Duffy moved, Strain second to take this to the Committee of the
Whole for further discussion. Alderman Bluhm also requested that
the contractors be contacted of this meeting for their input.
Having no further discussion, vote was taken. Ayes (7), Nays (0).
Motion carried.
Having no further business, Strain moved, Powers second to adjourn
the meeting. Ayes (7), Nays (0).Motion carried.
