President Postier called the meeting to order at 7:30
P.M., with the following members being present:
President Postier, Aldermen Allen, Bluhm, Duffy,
Powers, Solinger and Strain. Absent: None.
Bluhm moved, Duffy second to approve the minutes of
the May 5, 1986, meeting. Ayes (7), Nays (0).
Motion carried.
A Hearing on the Final Plat of Northern Heights East
2nd Subdivision (#86-7). Harold Payne, Petitioner,
was present to answer any questions the Council might
have. Having no one else present wishing to be
heard, President Postier closed the hearing. Bluhm
moved, Strain second to adopt Resolution No. 295-86
approving the Final Plat. Ayes (7), Nays (0).
Motion carried.
A Hearing on the Final Plat of Bel Air Fifth
Subdivision (#84-25). Stan Mohn, Petitioner was
present to answer any questions the Council might
have. Alderman Solinger stated. that he was very
pleased that the lots were larger than required.
Having no one else present wishing to be heard,
President Postier closed the hearing. Powers moved,
Solinger second to adopt Resolution No. 296-86
approving the Final Plat. Ayes (7), Nays (0).
Motion carried.
A Hearing on Amendments to Paragraphs 61.300, 61.301,
and 61.303 of the Rochester Zoning Code providing for
the approval of certain types of Conditional Uses by
the Zoning Administrator instead of the Planning
Commission. Having no one present wishing to be
heard, President Postier closed the hearing. Allen
moved, Duffy second to instruct the City Attorney to
prepare the necessary documents for approval of the
proposed amendments, including the 10 day
notification requirement. Ayes (7), Nays (0).
Motion carried.
A Hearing on Amendments to Paragraph 62.107 of the
Rochester Zoning Code eliminating the 6' separation
distance required between buildings on a residential
lot. Having no one present wishing to be heard,
President Postier closed the hearing. Bluhm moved,
Strain second to instruct the City Attorney to
prepare the necessary documents for approval of the
proposed amendment. Alderman Bluhm questioned what
type of construction this would allow.. It was

buildings within 31. Ayes (7), Nays (0). Motion
carried.
A Hearing on Amendments to Paragraph 62.209b of the
Rochester Zoning Code tto permit architectural
features to encroach a greater distance into a side
yard than is presently permitted. Having no one
present wishing to be heard, President Postier closed
the hearing. Strain moved, Allen second to instruct
the City Attorney to prepare the necessary documents
for approval of the proposed amendment. Ayes (7),
Nays (0). Motion carried.
A Hearing on the Proposed Assessments for Sanitary
Sewer, Watermain, and Street Improvements in' the
Arboretum 1st Subdivision, Project No. 8411-1-84
(J8871). Having no one present wishing to be heard,
President Postier closed the hearing. Powers moved,
Bluhm second to adopt Resolution No. 297-86 levying
the proposed assessments. Ayes (7), Nays (0).
Motion carried.
A Hearing on the Local Improvement Assessment Project
for Construction of Stage II of 41st Street N.W. and
T.H. No. 52 Interchange, Project No. _8607 (J2218).
Having no one present wishing to be heard, President
Postier closed the hearing. Duffy moved, Solinger
second to adopt Resolution No. 298=86 ordering the
project to be made. Ayes (7), Nays (0). -Motion
carried.
A Hearing on the Proposed Assessments for Sanitary
Sewer -and Watermain to Serve Kilpatrick Property and
Others Abutting 37th Street and East River Road N.E.,
Project No. 8403 (J8856). Having no one present
wishing to be heard, President Postier closed the
hearing. Powers moved, Strain second to adopt
Resolution No. 299-86 levying the proposed
assessments. Ayes (7), Nays (0). Motion carried.
A Hearing on the Proposed Assessments for Watermain
Extension in West Frontage Road T.H. 63 South from
25th -Street to North Oak Hills Drive,, and Watermain
and Sanitary Sewer in North Oak Hills Drive to Serve
Lot 23, Oak Hills, Project. No. 8101-85 (J8900).
Wishing to be heard was James Jensen, 2525 Oak -Hills
Drive S.W., who stated that this project was
completed in August of last year and interest has
been charged from that time even though they did not

know what the final amount they would be assessed was
and therefore could not pay. Mr. Jensen also stated
that he felt the engineering expenses were too high.
Al Toddie and Roger Plumb explained how the
assessments are based and what the engineering costs
include. Mr. Plumb also stated that if Mr. Jensen
had any further questions, he would be happy to talk
to him further. Having no one else present wishing
to be -heard, President Postier closed the hearing.
Duffy moved, Powers second to adopt Resolution No.
300-86 levying the proposed assessments. Ayes (7),
Nays (0). Motion carried.
Powers moved, Strain second to approve the.
appointment of John Sibley to fill the position of
Assistant Police Chief effective June 1, 1986. Ayes
(7), Nays (0). Motion carried.
Duffy moved, Bluhm second to approve the appointment
of Steven Johnston to fill the position of Captain in
the Police Department effective June 1, 1986.
Alderman Allen voiced his concern about maintaining
the integrity of the system since the -first person on
the eligibility roster was not appointed. Ayes (7),
Nays (0). Motion carried.
.Bluhm moved, Strain second to approve the appointment
'of Richard Dale to fill the position•of Lieutenant in
the Police Department effective June 1,. 1986. Ayes
(7). Nays (0). Motion carried.
Solinger moved, Allen second to approve the
appointment of John P. Jones to fill the position of
Detective in the Police Department' ef fective June 1,
1986. Ayes (7), Nays (0). Motion carried.
Powers moved, . Strain second to approve the
appointment of Val Stevens to the Mayor's Advisory on
Alcohol and Drug Abuse to fill the vacancy created by
the resignation of Joan Scott.' Ayes (7), Nays (0).
Motion carried.
Allen moved, Bluhm second to approve the City's
participation with the Coalition of Outstate Cities
on legislative services and appropriating $24,102
from the 1986 Contingency Account, to - _finance the
City's assessment. Ayes (7), Nays (0). Motion
carried.
Proposed Amendment to Heating and Ventilating
,License. This item was withdrawn.,until.a later date.

Powers moved, Allen second to authorize payment of
$9,260.00 to Rochester Plumbing and Heating for the
installation of domestic hot water heating system for
the Terminal Building at the Airport. Ayes (7), Nays
(0). Motion carried.
Bluhm moved, Allen second to adopt Resolution No.
301-86 authorizing the Mayor and City Clerk to
execute a lease agreement with L & S Properties to
operate a Gift Shop in the Terminal Building at the
Airport; and to approve a contract with McGhie &
Betts, Inc. for engineering services to reconstruct
the bituminous portion of the main terminal ramp.
Ayes (7), Nays (0). Motion carried.
Strain moved, Duffy second to approve the following
licenses and bonds pending the required insurance,
bonds, fees, departmental approvals, and payment of
all outstanding obligations with the City of
Rochester: Request received from the Early 'Risers
Exchange Club, Rochester, for a Temporary On -Sale,
Non -Intoxicating Malt Liquor License for June 27 and
28 in conjunction with Rochesterfest activities;
Application received from James Olson, Total Plumbing
and Heating, Rochester, for a. Master Installer
--License for Heating, -'Ventilating and Air Conditioning
for the period_ ending December 31, 1986; Application
from Modern Plumbing and Heating, LaCrosse,
Wisconsin, for a Contractor's License for -Heating,
Ventilating and Air Conditioning for the period
ending December 31, 1986. Application from the
Uptown Deli, 924 Seventh Street N.W., for a Cigarette
License to sell cigaretts over the counter at retail
in the City.of Rochester for the period ending April
1, 1987; Application received from Gerald Schaefer,
Chatfield, for a license to Construct Cement
Sidewalks, Curb & Gutters and Driveways in the City
of Rochester for the period ending December 31, 1986;
Application received from Francis Grover, Plainview,
for an Auctioneer's License for the City of Rochester
for the period ending December 31, 1986. The
following renewal licenses have been approved:
Cement Sidewalks, Curb & Gutters, and Driveways (2)
On -Sale Non -Intoxicating Malt Liquor (3'.2 Beer) (1)
Heating, Ventilating & Air Conditioning (1)

suggested that this item be tabled and reviewed with

the car people in light of the concerns raised by the
Calvary Episcopal Church. Ken Keefe, Valley Street
Machines, stated that they are working under time
constraints and would like action taken on this
request at this time. Mr. Keefe stated that this
will be a controlled parade. They are working with
the Police Department and have hired security to
prevent any crowd control problems that might arise.
Lt.- Al Sisson, Rochester- ._Police Department suggested
that possibly a- snow fence could be erected to
barricade the\ Church Courtyard. Mr. Keefe also
_ stated ,that there will be a get-together at the
Holiday Inn South after the parade so that should
prevent some of the problems of people hanging around
long after the parade is finished. Solinger moved,
Strain secondto approve the June 29th Car Review and
Parade along the approved route. Ayes (7), Nays (0).
Motion carried.
Duffy moved, Powers second to approve payment of the
Accounts Payable. Ayes (7), Nays (0). Motion
carried.
E-8 Powers moved, Allen second to adopt Resolution No.
302-86 approving the bid of $36,963.00 from IBM fora
magnetic tape unit for the data processing system at
City Hall. Alderman Bluhm questioned why only one
bid was received. It was°pointed out that this item
was bid after the Council accepted bids on the other
equipment. Ayes (7), Nays (0). Motion carried.
E-9 Powers moved, Bluhm second to adopt Resolution No.
303-86 authorizing the Director of Employee Relations
to sign 'a Work -Study Agreement with Rochester
Community. College for Summer, 1986, and School Year
1986/87. Ayes (7), Nays (0). Motion carried.
E-10 Strain moved, Allen second to instruct the City
Attorney to prepare an ordinance annexing 37 acres of
City -owned land north of 37th Street N.W. and east of
East, River Road and rezoning the property to an
industrial district. Ayes (7), Nays (0). Motion
carried.
E-11 Preliminary Plat of Baihly Woodland Fifth
Subdivision. The preliminary plat shows Woodland
Drive ending in a cul-de-sac instead of extending
thru as proposed in the General Development Plan.
The Council discussed whether Woodland Drive should
be extended to the property boundary as originally

of access to the north and the west. Allen moved,
Bluhm second to approve the preliminary plat of
Baihly Woodland Fifth Subdivision with the conditions
listed by the Planning Commission and the street name
change from Woodland Drive to Woodland Lane. Ayes
(7), Nays (0). Motion carried. Solinger moved,
Strain second to instruct the Planning Department to
come up 'with a General Development Plan for that
area. Ayes (7), Nays (0). motion carried.
Duffy moved, Allen second to adopt Resolution No.
304=86 ordering a hearing on the petition to vacate
various utility easements located in the
Resubdivision No. 2 of West Park of Block 1, Silver
Acres Subdivision (Village .Green & Winchester
Apartments). Ayes (7), Nays (0). Motion carried.
Duffy moved, Allen second to adopt Resolution No.
305-86 ordering a feasibility report on Project No.
6304=3-86 (J8928) Replacement of Sanitary Sewer in
4th Avenue S.W. from West Center Street to 1st
Street S.W. and Resolution No. 306-86 ordering a
public hearing on this project. Ayes (7), Nays (0).
Motion carried.

307-86 accepting a cproposal from Yaggy Associates,
Inc. to perform engineering services for Project No.
5903-86 08950) Public improvements in Rolling
Meadows Subdivision. Ayes (7), Nays (0)-. Motion
carried.
Strain moved, Allen second to adopt Resolution No.
308-86 accepting a proposal from McGhie & Betts, Inc.
to perform engineering services for Project No.
8606-1-86 (J8955) Sanitary sewer and watermain in
Riverview West - Phase II. Ayes (7), Nays (0).

309-86 accepting a proposal from Yaggy Associates,

313-86 declaring costs to be assessed for Project No.

315-86 authorizing the City Clerk to advertise for
bids for Project No. 6241-84 02219) Street
construction of 31st Avenue N.W. from the north line
of Plaza 41 Second Subdivision to 41st Street N.W.
and on 41st Street N.W. from 31st Avenue N.W. to 509
.feet east.' Ayes (7), Nays (0). Motion carried.

316-86 authorizing Project No. 6304-86 (J2146)
Construction of storm sewer in 4th Avenue west, 1st

to be made and' authorizing the City Clerk to

agreement not to exceed $66,756.00; Resolution No.
320-86 entering into a purchase order agreement with
Sherman &.Reilly, Inc. for furnishing one underground
cable puller, the amount of the purchase agreement

authorizing a leave of absence/maternity leave from
April 25, 1986 through June 30, 1986 for Teresa

E-25 Allen moved, Bluhm second to adopt Resolution No.
322-86 awarding the bid for Project.No. 8608 (J8951)
Trunkline watermain extension plus watermain and.
sanitary sewer to serve Baihly Heights Subdivision to
S.J. Louis Construction Company with the low
.alternate bid of $180,070.00 contingent on the
property owner providing the easement for the
alternate alignment and an assessment agreement.

F-1 An ordinance annexing to the City of Rochester 37
acres of City -owned land north -of 37th- Street- N.W.
and east of East River Road was given -i'ts first
reading.
F-1 An Ordinance amending paragraphs 61.300, 61:301,
61.303, 62.107, and .62.209b of the Rochester Zoning
Code was given its first reading.
F-1 An Ordinance prohibiting the use of skateboards or
rollerskates on sidewalks in the Central Business
District was given its first reading.
F-1 An Ordinance amending Chapter 85 and Section 45.22 of
the Rochester Code of Ordinances prohibiting
trespassing and forbidding persons to do certain acts
in conjunction with the consumption of alcohol or
controlled substances was given its first reading.
F-2 An Ordinance establishing the salaries of the Mayor,
Alderman -At -Large, and Alderman was given its second
reading. Allen moved, Bluhm second to adopt the
Ordinance as read. Ayes (7), Nays (0). Motion
carried.

give an Ordinance prohibiting the use of skateboards

give an Ordinance prohibiting trespassing and
forbidding persons to do certain acts in conjunction

Strain, and President Postier voted aye. Ayes (7),
Nays ,(0). Motion carried. Strain moved, Duffy
second to adopt the Ordinance as read. Ayes (7),

Powers moved, Allen second to adopt Resolution No.
323-86 approving the plans —,and specifications
prepared by McGhie & Betts, Inc. for the project
entitled "37th Street Business Park Phase I,
Construction of Frontage Road and Service Court N.E.
from ' 37th Street N.W. to Frontage Road" and
authorizing the Mayor and City Clerk to execute an
owner agreement with Don L. Shreve and Austin P.
Keller Construction to provide"'for construction of
said project. Ayes (7), Nays (0)'._ Motion carried.
Solinger moved, Strain second to remove from the
table consideration of the Limousine Franchise
Renewal for 3 Vee's Limousine Service. Bluhm moved,
Duffy second to�deny the application. Ayes (7), Nays
(0). Motion carried.
Alderman Solinger requested that the Public Services
Department work with MNDOT regarding the feasibility
of a traffic signal in the exit ramp at the. 19th
Street bridge.
Having no further business, Allen moved, Bluhm second
to adjourn the meeting to Wednesday, May 21, 1986, at
12':00 Noon. Ayes (7), Nays (0). Motion carried'.

E-1 Aldermen Powers moved, Bluhm seconded, to adopt Resolution No. 324-
86 approving the results of the Canvas Board as verified by the above
Aldermen. The results of the May 20, 1986 City Charter/School Distri
election were: Alderman -At -Large Richard Postier, Alderman of the
Second Ward Chuck Canfield, Alderman of the Fourth Ward John
Hunziker, and Alderman of the Sixth Ward Peter Solinger. Ayes (5),
Nays (0)".Motion carried.
Having no further business, Aldermen Powers moved, Bluhm seconded,
