President Postier called the meeting to order at 2:00 P.M., the
following members being present: President Postier, Aldermen Allen,
Bluhm, C,a.nfield, Hunziker, Solinger and Strain. Absent: None.
Allen moved, Canfield second to approve the minutes of the March
9, 1987 meeting. Ayes (7),Nays (0).Motion carried.
Bluhm moved, Allen second to approve the split of the assessments
requested by Donald L. Soderberg on his property which fronts along
East River Road. 300 feet will be going commercial property and the
remaining 319.24 feet against the residential portion being divided
equally between Lots 1 thru 8, Block 1 and Lots 1 thru 8, Block 2,
River Court. This was referred to the Public Services Dept.for
calcu'Vation. Ayes (7), Nays (0).Motion carried.
Strain moved, Bluhm second to approve the split of assessments reques.
ed by Weis Development Co. for levied assessments of Approx.
$2,900.00 per parcel. This assessment should be removed from the
current parcels of 700 and 800 and spread evenly on parcels 1300
through 2400 on plat; 3807. This should amount to approx. $483.00 per
parcel of 1300 through 2400. This was referred to the Public Service'.

Solinger moved, Strain second to retain the firm of Powell , Goldstei
Frazer and Murphy for 1987 for $5,000.00. This firm will be the
monitors of flood control legislation and to lobby on the City's
behalf in the 1987 session .This-is$5,000.00 retainer. They will work
on a per hour basis when their services are requested. Ayes (7),
Nays (0).Motion carried.
Hunziker moved, Canfield second to instruct the City Attorney to pre-
pare an Ordinance amending the current ordinance requirement for
retaining unclaimed bicycles from a six month period to a sixty day
period. Ayes (7),Nays (0).Motion carried.
Bluhm moved, Strain second to adopt Resolution No. 153-87 declaring
April as Registration Awareness Month. This is requested by the
Selective Service System.- Registration is open to male citizens
and registration is at any Post Office. Ayes (7), Nays (0).Motion
carried.
Strain moved, Canfield second to approve the request for authorizati
to use the Zumbro Market Parking lot by the Downtown Farmers Market
on Saturdays, May 9 thru October 31, 1987, 7:00 A.M. to 1:00 P.M.
Also permission to use only those spaces in the lot needed to
accommodate growers if a decision is made to hold a mid -week market.

Allen moved, Solinger second to adopt Resolution No. 154-87 setting
a hearing to be held on May 4, 1987 on the proposed vacation of
First Street between Broadway and the Public alley which lies in the
Blocks 23 and 32 of the Original Plat. Ayes (7),Nays (0).Motion
carried.

E-6 Canfield moved, Strain second to approve the following licenses and
bonds: Renewal Licenses - Auctioneer Ernest A. Roeber of Oronoco,Mn.
Gambling License - Lourdes High School Band Club and F.O.E. 2228
located at 409 lst Avenue S. W.
Request received from St. John's Church of Rochester for their
application for a temporary gambling license for May 15, 1987. Ayes
(7), Nays (0).Motion carried.
E-7 Discussion was held by the Council on the renewal of the On -Sale
Liquor Licensesfor the City. Alderman Hunziker questioned the
interpretation of the Ordinance -which seems to allow a couple of
establishments in the City to obtain one liquor license and pay
for an additional bar to be used - yet a person has to enter that
second "additional bar" from an outside door. He was wondering if
this was proper. Alderman Hunziker was informed that administration
is working out the language defining what constitutes a contiguous
bar - it may be connected by a hallway, etc. Council has the right
to set the definitions on license space for a bar and a second bar.
Alderman Strain stated that if a hallway is used for a connecting
point, then technically a shopping mall with a bar on one end and
the "second bar" at the other end of the mall could be considered
"one" license.
Alderman Hunziker stated that the two establishments in question
could be utilized with the opening of a door and opening a stairway
and that action connects the room that is licensed with the second
bar.
Council and administration is working on the proper definition- and
will be bringing a revised Liquor ordinance to the Council soon.
Alderman Hunziker also questioned the fact that some of the holders
of the liquor licenses have various problems every year. Some for
non-payment of taxes, others for violations of building codes, et:c.
Alderman Hunziker stated that they are setting a bad example for the
other liquor license holders and he would like to see this resolved.
Fred Suhler, City Attorney, stated that the Council has three choices
at this point. 1. Renew the licenses. 2. Take away the licenses tha
do not meet the standards of the Council and the codes or 3. Not
renew them. However, in any case, if the license, if renewed and the
owner is given fair warning on the violations and they do not have
them corrected, the Council can always revoke the license at that tim
Alderman Hunziker wondered who would hear the case of the revoking
of a liquor license. Fred S'uhler stated that the State would send out
a hearing examiner. A person hears evidence and the Council acts
on that evidence. Alderman Hunziker wondered who would pay for the
hearing. Fred Shuler stated the City of Rochester would and it would
probably be hundreds of dollars. Alderman Hunziker asked "What shoulc

we do".. Fred Suh.ler questioned Alderman Hunziker "What is troubling
you?" Alderman Hunziker stated that in one instance a liquor owner
has 22 police calls for disorderly conduct and numerous other calls
for other violations and thinks this should be addressed.
Alderman Solinger stated that now is a poor time to settle this
particular problem. The Council can always revoke a license if
it is deemed necessary.
Alderman Strain stated that Alderman Hunziker is correct.
Alderman Canfield stated that if a cour.t.is called when can a problem
such as this be heard? He was told probably wi,phin a month. ..
Alderman Allen does not like the fact that code Violations are being
broken: The other areas are more touchy to deal with. Alderman Alle
also stated that the.most violations occured in the one particular
establishment had a change in atmosphere and this might help them
in correcting a lot of police calls. The establishment has a second
bar in the south part of the area and this caused most of the comdain

E-8 Allen moved, Hunziker second to approve the requests for Parades and
Races as follows:
The Volunteer Connection to hold a mini -parade on April 27, 1987 to
promote volunteer recognitiion activities. This will be held from
3:30 to 4:00 P.M.
The Rochester Track Club to hold a running race on May 16, 1987 from
9:00 to 11:OO A.M. in the Essex Park area.

E-9 Solinger moved, Strain second to approve the Accounts Payable in
the amount of $1,351,779.92 - list is on file with the City Clerk.

E-10 Bluhm moved, Allen second to adopt Resolution No. 155-87 authorizing
the transfer of the contingency funds in the total amount of
$64,016.34 as of December 31, 1986 and the Director of Finance is
authorized and directed to put into effect the provisions of said

E-11 Canfield moved, Solinger second to adopt Resolution No. 156-87
awarding the low bid of $22,500.00 submitted by Johnson Controls
for a one year contract computer maintenance at the Water Reclamatioi
Plant. Ayes (7), Nays (0).Motion carried.
E-12 Strain moved, Canfield second to adopt Resolution No.. 157-87 authoriz•
ing the Salary Range and Wage Adjustements for those female employee!
whose classifications are to be adjusted to the 7% corridor. This
is using the 1/3 1/3 1/3 formula in salary adjustment. Alderman
Solinger questioned the rate of pay for the clerical workers. He
stated that the salaries are higher then the job market in the
entire City. He was told that the positions were rated within the
City of Rochester and that a clerical worker may be comparable to
a tree trimmer as an example. The wages were set on that basis.
Comparable Worth was a program as set forth by the State of Mn.
Having no further discussion, vote was taken - Ayes (7), Nays (0).

E-13 Solinger moved, Allen second to adopt Resolution No. 158-87
approving the agreement between City and County for Law Enforcement
Tes.ting. The County shall reimburse the City for the County's
pro rata share of the expenses to purchase and provide the exams.

Resolution No. 170-87 - approving pay adjustments be made to the wage!
of Utility female employeees in each of the years 1987, 1988 and 1989
That these pay adjustments are made to comply with the 1984 Mn.
State pay equity bill and that these pay adjustments be made to
Utility female employees wages in the Public Utility Dept.
Resolution No. 171-87 approving a contract amendment agreement with
Instrument Control Systems, Inc. for Water Division SCADA System
upgrade in the amount of $11,813.45 making the total amended
contract to read: $252,624.45.
Resolution No. 172-87 approving a purchase order agreement with RTE

Having no further busines, Allen moved, Strain second to adjourn
the meeting until 7:30 P.M. Ayes (7), Nays (0).Motion carried.
President Postier called the meeting to order at 7:30 P.M., the
following members being present: President Postier, Aldermen Allen,
Bluhm , Canfield, Hunziker, Solinger and Strain. Absent: None.
A Hearing on the Vacation request No. 87-3 to vacate the five foot
utility easement along the southern boundary except for the east
five feet of Lot 15, Block 4, Northgate Second Addition. Having
no one present that wished to be heard, President Postier closed
the hearing. Allen moved, Bluhm second to adopt Resolution No. 175
87 approving the vacation. Ayes (7), Nays (0).Motion carried. This
resolution stated that the vacation included everything except the
East 5 feet of Block 4.
A Hearing on the Federal Transit Assistance Grant Application/CY87
Operating and Capital. Having no one present that wished to be
heard, Presidnet Postier closed the hearing. Bluhm moved, Strain
second to adopt Resolution No. 176-87 authorizing the submission of
the grant application to the Urban Mass Transportation Administratic
Ayes (7), Nays (0).Motion carried.
A Hearing on the Application for Planned Unit Development ( Amended)
Final Plan ) PUD-R-68 located at southwest corner of 15 Avenue N. W.
and 37th Street N. W. Having no one present that wished to be heard
President Postier closed the hearing. Alderman Hunziker questioned
Planning on the number of parking spaces and if they would be
constructed. Planning Dept. stated that they would indeed have
30 spaces constructed which gives them three extra spaces then is
required. Having no further comments, Solinger moved, Canfield
second to adopt Resolution No. 177-87 approving the PUD with the
following conditions:
1. Submit at final plan stage a complete grading plan for the proje

and from the residential area to points away from the adjacent

2. Keep the parking lot for the day care center at least 12 1/2 feel

3. Increase the width of the pavement on the private street from

way driveway to parking areas.
4. The house on Lot 4 should have its. garage to the north side of
the house or take its access from the common private drive to
eliminate the undesir•a<.ble situation of the two curb openings so

5. Provide with the final plan a sign package. The amount of bu.sl*inass
signage should be limited to a total of 48 square feet. Signs
should be spot lit, back lit, or nonilluminated. Directional
signs should be provided at the day care entrance and exits.
6. The entire play area for the day care center should be enclosed
by solid walls or fences. The location of playground facilities
and .
structures within the play area shall be identified on the final
plan.
7. The typical buildi.ble area for the principle single family:shome
.;s: should be identified on each lot. Twenty-five foot setbacks fro
the public street right-of-way should be a standard and the home
should be kept at least six feet off interior lot lines. Garage

The single family house plan provided must be built or if alternative
styles are desired it should be,so indicated. The alternative styles
should have two car attached garages and a portion of the living

responsibilities for maintenance of any shared facility.

A Hearing on the Final Plat No. 87-5 Viking Hills Second Subdivision
Having no one present that wished to be heard, President Postier
closed the hearing. Mr. Hexum informed the Council via letter that
he would like this taken to the Committee of Whole for further
discussion. Bluhm moved, Hunziker second to close this hearing
but to take this to the Committee of Whole for Council discussion.
Ayes (7), Nays (0).Motion carried and the hearing is closed as
stated above. Canfield moved, Bluhm second to take no action on
this hearing at this meeting and refer this to the Committee of
Whole. Ayes (7), Nays (0).Motion carried.
A Hearing on the Zone Change No. 87-1 from the R-1 ( Low Density
Residential ) District to the B-4 ( General Business ) Zoning on
23.9 acres located at 1920, 2004, 2020, and 2030 Highway 14 East.
No one present wished to be heard, President Postier closed the hear-

A Hearing on the Proposed Sewer and Water Ext. alg E side (J 8989 )
of TH No. 63 Carlton Street to 600 Feet South of North Line Sec.
26-106-14. Wishing to be heard was Mike Dovonhoe of 208 1st Ave.
N. W. Kasson, Mn. He represents B & F Truck Stop and he stated
that they have a bad septic system and they.really need this project
He stated that they have to pump it twice a day and it costs $1200.
a month to maintain this system in this manner. He urges the Counci'
to approve this. Wishing to be heard was Ford Anderson, and he
represents the property to the north of this project. He is opposed.
He stated that this project would cost $98,000. to. property owners
on six acres of land. He suggested an alternate route and by using
this route to get these services ( across the highway ) it would
cost the petitioner $30-$35,000. This would eliminate the cost
to the property that Mr. Ford is representing.
Mr. Plumb, Public Services Director presented slides of the area
and stated that crossing the highway could be a possibility, but
he had not had time to study the ramification of doing so.
Having no one else present that wished to be-heard,President Postier
closed the hearing. Solinger moved, Allen second to table this
and take it to the Committee of the Whole so that costs can be
figured on the alternatives, etc. Ayes (7), Nays (0).Motion carried

B-8 A..Hearing on the Proposed Assessment project No. No. 6453-86 J 8957
Watermain and Sanitary Sewer extensions to serve Lots 48-54 North
Sunny Slopes. Wishing to be heard was Dennis Gastineau of 997 Skylin(
Lane S. W. He is opposed to this assessment cost. He stated that the
estimate was low according to the assessment that is charged. The
assessment almost doubled and he thinks something is wrong if there
is so much cost differential. He also stated that the project had
lasted longer then the 10 working days and wondered who would pay
for that. Public Services stated that the contractor paid for the
time that they worked over the contract stated dates. He also state(
that the condition of the roads i's in poor condition.
Mr. Roger Plumb, Public Services Director stated that the cost
was higher in the final assessment because of the fact that the
City bids out a project and accepts the low bidder. In the estimate
costs are just what it says " estimates". In a smaller project
such as this, equipment costs said $ amount to haul in place and
that sometimes makes a project cost most - due to the size.
He noted that the City had four bidders on this project and accepted
the low bidder.
Mr. Gastineau stated that he still thinks that when a project is
estimated low and the bids come in so much higher, the property
owner should be notified so that the assessment is not such a
surprise. He also stated that the contract should spell out over-

he did talk to the neighbors about puting in this project. He
stated that for the money as quoted in the estimate, they were all
willing to have to project made. However, he had no idea that it
would cost so much.

Wishing to be heard was Mark Tasler of 2407 East River Road.
He stated that he does not have any frontage on this project and
he would not be able to use it. Wishing to be heard was Norma
Iverson of 2426 East River Road and asked how the frontage was
measured. Public Services explained how they assessed the property.
President Postier stated that the length of the property varies and
that makes a difference in assessments. Having no one else
present that wished to be heard, President Postier closed the hearinc
Alderman Solinger questioned.the lateral into Mr. Tasler's property.
Mr. Plumb stated that one stub was assessed but the one stub that
was not put in at this time was not assessed against his property.
Having no more discussion by the Council, Solinger moved, Allen
second to table this assessment until Public Services could look
into the question raised by Mr. Tasler. Ayes (7),Nays (0).
Motion carried.
Letters received in opposition were from Mark and Sheryl Tasler,
Lowell and Lillian Dosdall of 2433 E. River Road and Owen Olson.
An Ordinance Rezoning certain property and Amending Ordinance No.
1659 of the Zoning Ordinance on property to the B-4 General Business -
Knights of Columbus Club. This was given its first reading.
An Ordinance Relating to Bicycles; Relating to the sale of
unclaimed bicycles; amending the Rochester Code of Ordinances,
Section 131.04 was given its first reading.
Having no further business, Allen moved, Hunziker second to
adjourn the meeting. This was adjourned until 2:30 P.M. on
April 8, 1987. Ayes (7), Nays (0).Motion carried.
