A-1 President Postier called the meting to order at 4:30 P.M., the
following members being present: President Postier, Aldermen Allen,
Bluhm, Canfield;, Hunziker, Solinger and Strain. Absent: None.
E-1 The Proposed Stipulation Agrement for the Water Reclamation Plant
was discussed by the Council. Wishing to be heard was Anton Gregor3
representing AMPI,of Rochester.. He was concerned about the time
limit as set by EPA to allow corrective measures on the phosphorus -
removal from the various entities in the City of Rochester. He
urged the Council to look at the matter carefully for all concerned
in this problem.
It was stated that the phosphorus that is put into Lake Zumbro
has not changed the quality of the lake and that the standards as
set forth by the EPA might not be realistic.
The City of Rochester cannot come up with a solution to the phosphor
us problem in this given time period.
Allen moved, Bluhm second to table this decision until the City
Administrator can check to see what additional time may be granted
the City in order the implement the corrective measures.,
Alderman Strain commented that he would like to have the date
extended Jf possible for.the City to'come up with a realistic workin
date of implementation.
Having no further discussion, vote was taken. Ayes (7), Nays (0).
Motion to table was carried.
E-2 Authorization for a Phosphorus -,Variance request was discussed by
the Council. Mr. Marvin Skodje,-.Superintendent of the Water
Reclamati6h'Plant stated that he has inquired about grant money
to defray expenses on the phosphorus removal at the plant. Mr.
Skodje stated that of the 15 cities on the list 9 were eliminated
from eligibility. The City of Rochester is still on the list.
He feels hopeful that money will be allocated to the City of
Rochester thru this source. Mr. Skodje did state that the City
of Rochester would do everything they could to remain on the list.
He.a.l'so stated that if the City could prove failed technology then
we would stand a better chance of remaining on this list.
Alderman Canfield wondered how we could prove failed technology.
Mr. Skodje stated that thru tests taken all over the City and with:
reports from Brown and Caldwell.
Alderman Strain wanted to know just where the problem arose. Was it
poor design - poor system - poor operators - poor consultants or
where or who goofed up on this project. He feels that we owe the
people of the City an answer.
Alderman Solinger suggested that the City send the Joint Venture
group,our engineering consultants,a letter and ask them where or
who the problems lies with.

E-2 Alderman Bluhm thinks we need a third opinion - Since the two
reports are conflicting - we should get a third opinion.
Alderman Canfield wondered by the overload of phosphorus was not
considered when this plant was being built.
Mr. Skodje stated that the amount of phosphorus overload was far
greater then the plant was designed for.
Alderman Hunziker asked what makes the phosphorus overload greater
one day as the next? Mr. Skodje stated that the peak overloads are
being decreased. but not enough to satisfy the requirements.
Alderman Hunziker asked if the peak overloads could be spread and
lowering the phosphorus load. Mr. Skodje stated that it could if the
overloads could be idenified.
Aldermen are concerned about this problem and urged administration
to seek answers as quickly as possible.
Having no futher discussion, Solinger moved, Canfield second to
adopt Resolution No. 240-87 authorizing the submission of a
phosphorus variance request and inviting the Dairy Group and their
legal representatives to participate in the submission and
presentation of the variance request. Ayes (7), Nays (0).
Motion carried.
E-3 Allen moved, Strain second to adopt Resolution No. 241-87 amending
the Center Place Phase II Agreement as follows: 1. That the
purchase price of the development site be reduced from $685,341.
to $560,161., 2. That Exhibit D - Esti.mated•Public Improvements
and Exhibit E _ Estimated Public costs be amended to reflect
the private construction of the Concourse skyway and 3. That BGD5
agrees that in the event that actual Concourse design and constructil
costs are less than $250,360., BGD5 will refund 50% of such amount
to the City. Ayes (7), Nays (0).Motion carried.
E-4 Canfield moved, Bluhm second to adopt Resolution No. 242-87 approvini,
the Agreement with Mn/DOT and authorize the Mayor and City Clerk
to sign the agreement. This will be used for the future TH 52
55th Street N. W. Ayes (7), Nays (0).Motion carried.
F-1 An Ordinance Relating to Limousines; granting a Franchise to Top
Hat Partners; amending the Rochester Code of Ordinances Chapter 97
was given its second reading. Solinger moved, Strain second to
adopt the Ordinance as read. Ayes (7), Nays (0).Motion carried.
F-1 Canfield moved, Strain second to adopt Resolution No. 243-87
approving an owner contract with Wynwood Company for Grading
Base, Bituminous Surfacing, Concrete Curb and Gutter, Storm Sewer,
Subdrains, Watermain and Service Connections in Foxcroft, Phase I
Part "B" . Ayes (7), Nays (0).Motion carried.
Having no further business Allen moved, Hunziker second to adjourn
the meeting. Ayes (7), Nays (0).Motion carried.
