CITY OF ROCHESTER, MINNESOTA Adjourned Meeting No. 37. - May 18:, 1987 President Postier called the meeting to order at 7:30 P.M., the following members being present: President Postier, Aldermen Allen, Bluhm, Canfield, Hunziker, Solinger and Strain. Absent: None. A Hearing on the Final Plat No. 87-7 for Baihly Woodland Sixth Sub. Having no one present that wished to be heard, President Postier closed th hearing. Allen moved, Bluhm second to adopt Resolution No. 244-87 approving the plat. Ayes (7), Nays (0).Motion carried. A Hearing on the APplication for Planned Unit Development (Final Plan ) No. 87-4 for Fiksdal Motel Properties. Having no one present that 0 shed to be heard, President-Postier closed the hearing. Solinger moved, Canfield second to adopt Resolution No. 245-87 approving the Plan with the two conditions as follows: 1. The handicap parking as required by the Building Code be clearly shown on the plan and 2. The resolution accepting the final plan clearly state that the underlying B-lb zoning standards will continue to be in force as they apply to sturctures on Lot 17, Block 5, of Kutzky Addition ( the Fiksdal Motel Lot ) and the R-3 standards will cont- inue to control the use bulk, density and placement of structures on Lot 2-5, Block 5 ( the properties fronting 1st St. S. W. ). Ayes (7), Nays (0).Motion carried. A Hearing on the Final Plat No. 87-3 of Pennington Business Park Sixth. Having no one present that wished to be heard, President Postier closed the hearing. Bluhm moved, Allen second to adopt Resolution No. 246-87 approving the plat. Ayes (7), Nays (0).Motion carried. The Reconstruction and Widening of 14th Avenue S. W. from 2nd Street to 6th Street S. W. was a tabled item. Allen moved, Canfield second to remove the item from the table. Ayes (7), Nays (0).Motion carried. Wishing to be heard was Barb Achor of 534 14th Avenue S. W, and represented the neighbors also had a,signed petition in oppositic She stated that they met with Alderman Canfield and Ms::. Myers and St. Mary's representatives and they do not want the trees removed, plus they understand heavy power:.poles will be insalled and they do not want them in the area. They had 25 residents stand in opposition. Public Services Dept .are planning a 32' wide street or with 28' with no parking on the street. Mr. Plumb, Public Service! Dir. recommends that this item be taken back to the Committee so that he -can look at the alternatives on the different street widths. Denny,Stoltz of*the. Park Dept. stated that many trees can be saved, but that Some of them would have to be removed. Alderman: Canfield also mentioned that some of them are elms and would probably be gone within the next 3 to 5 �years anyway;. Having no further discussion, President Postier closed the hearing. No vote was taken and this item went back to the Public Services Dept. to check on the width of the road. A Letter was received from K. Krueger requesting water and sewer service to that part of the West the NE 1/2 of the NE 1/4 of Section 26, Township Olmsted County. A Petition was received from William L.Lesmeister, Lesmeister Truck Center of 4120 South Broadway , Highway 63 South, to extend Sanitary Sewer and water service to his property. Bluhm moved, Allen second to adopt Resolution No. 248-87 referring the petition to the Public Services Dept. for a feasibility report. Ayes (7), Nays (0). Motion carried. Solinger moved, Allen second to approve the proposed Ordinance for motorized mobile ice cream vending operations as presented. Ayes (7), Nays (0).Motion carried. Strain moved, Bluhm second to adopt Resolution No. 249-87 accepting a proposal from Hammel Green and Abrahamson Architects and Engineers to provide for certain professional services, including a space needs analysis, site selection study, a master facilities plan for city offices and public library. Aldermen were concerned about the site alternatives, etc. inv6lved. They were informed that this was only a needs analysis and that it would provide input toward further sites, etc. Ayes (7), Nays (0).Motion carried. Hunziker moved, Allen second to table the recommended approval of house number changes on 22nd Avenue N. E. Parkwood Hills and refer this to the June 1, 1987 Committee of the Whole. Ayes (7), Nays (0). Motion carried. Solinger moved, Hunziker second to approve the assessment split for Lots 7 and 8 of Plat 3807 ( Tealstone ) as proposed by the Publi Services Dept. Ayes (7), Nays (0).Motion carried. Bluhm moved, Allen second to adopt Resolution No. 250-87 approving the following changes in the Phase II agreement with OLM Joint Venture as follows: 1. approval of a change in the developer to BGD limited Partnership and 2. Additional language permitting substitution of financial institutions issuing the construction letter of credit. Ayes (7), Nays (0).Motion carried. Foster pending all departmental approvals and payment of all taxes. Ayes (7), Nays .(0). Motion Carried. Hunziker moved, Canfield seconded, to approve the issuance of an On Sale.Non-Intoxicating Malt,Liquor License for Waldo's Pizza at:Nort pointe Plaza. Ayes (7), Nays (0). Motion Carried. Alderman Bluhri moved, Hunziker seconded to suspend the rules,and give the ordinance a second -reading. Upon roll call vote, Alderman Allen, Bluhm, Canfield, Hunziker, Solinger, President Postier voted Aye. Ayes(7) Nays (0). Motion Carried. The Ordinance was given a second readin . An Ordinance Rezoning Certain Property Creating a Planned Unit Development District known as PUD-R-90 and Amending Ordinance NO. li (Fiksdal M atel) was given its first readidng.
