of the -City of Rochester were sworn in to office by Carole A. Grimm,
City Clerk. This was done at 2:00 P.M.
President Postier called the meeting to order at 2:00 P.M., the
following members being present: President Postier, Aldermen Bluhm,
Canfield, Hunziker, McConnell, Solinger and Strain. Absent: None.
Canfield moved, Strain second to approve the minutes of the April
20, 1987 meeting. Ayes (7), Nays (0).Motion carried.
C-1 The annual.address was presented by President Postier. ( Copy
at the back of the minutes. )
C-2 Hunziker moved, Solinger second to adopt Resolution No. 264-87
adopting the Roberts Rules of Order for the conduct of business
of the Council. Ayes (7), Nays (0).Motion carried.
Strain moved, Solinger second to adopt Resolution No. 265-87
adopting the Rules and Regulations for Order of Business of the
Council. Ayes (7), Nays (0).Motion carried.
Canfield moved, Strain second to adopt Resolution No. 266-87
establishing Committees of the Common Council prescribing their
functions and duties and providing appointment to members of
subcommittees. Ayes (7), Nays (0).Motion carried.

the minutes.
Bluhm moved Hunziker second to adopt Resolution No. 267-87
designating the Rochester Post Bulletin as the official newspaper to
publish the official printing and advertising of the City of
Rochester, for the official year commencing June 1, 1987 at the
rate established by the statutes of the State of Mn. for legal
publishing. Ayes (7), Nays (0).Motion carried.
Strain moved, Hunziker second to approve the request to advertise fo
bids for moving the former CNW Railroad Depot. Ayes (7), Nays (0).
Motion carried. Bids to be opened on June 22, 1987 at 11:00 A.M.
Solinger moved, Hunziker second to approve recommended improvements
to the Waterworks Parking lot: 1. Expand Waterworks in the area
west of the Well House and 2. Add.Health Dept. spaces to the
Waterworks lot after July 11, 1987. Ayes (7), Nays (0).Motion
carried.
Solinger moved, Hunziker second to approve the street closings
for the Rochesterfest Fifth Annual Celebration - June 20 - 28, 1987
as recommended. Ayes (7), Nays (0).Motion carried.
Hunziker moved, Canfield second to approve the closing of streets
and bagging of meters for the Rochester Festival of Arts on June
21, 1987 at Central Park. Ayes (7), Nays (0).Motion carried.
Bluhm moved, Strain second to approve the Rochesterfest Committee
working with Public Services in coordinating and scheduling vendors
and approving bagged meter spaces. Ayes (7), Nays (0).Motion carried
Solinger moved, McConnel second to approve the request for the 1987
Rochesterfest Parade to be held on June 26, 1987. Ayes (7),
Nays (0).Motion carried.
Bluhm moved, Canfield second to adopt Resolution No. 268-87 author-
izing the Mayor and City Clerk to enter into a contract with McGhie
and Bett°s for Engineering services for a Terminal Ramp.Concrete
"Panel Replace.ment Project J 6943 and; to accept the low proposal by
Rochester Plumbing and Heating to install two BTU Tubes, Gas Pipe,
Electrical Connections and Permits for $3,501.00 and to pay
Estimate No. 9 to Miller Dunwiddie for change order design work
amounting to $1,328.95. Ayes (7), Nays (0).Motion carried.
Strain moved, Bluhm second to adopt Resolution No. 269-87
authorizing the Mayor and City Clerk to execute the lease between
Northwest Airlines and the Rochester Airport Company and Resolution
No. 270-87 authorizing the Mayor and City Clerk to execute the
lease between Phil Wadkins and the Rochester Airport Company.

Bluhm moved, Canfield second to adopt Resolution No. 277-87 approving
a change in the Ordinance No. 21.01 to remove from that provision
the specific numbers of auth.orized assistant chiefs, captains,
lieutenants detectives and police officers authorized in the Police
Dept. It was noted for the record by the.Council that this change
does not mean the current numbers will be changed. The numbers of
positions will appear in the budget and the Council will have
control at that level. Ayes (7), Nays (0).Motion carried.
Canfield moved, Strain second to refer the request from the Personnel
Dept. on a Personnel Smoking policy for the City of Rochester to
the Committee of the Whole. Discussion is needed on this by the Counc.

F-1 An Ordinance Providing for Amendments to the Ordinance Relating to tie
Sales and Use Tax Imposed by -the City of Rochester was given its
first reading.. Alderman Canfield moved, Hunziker seconded to suspen
the rules and given the ordinance its second reading. Upon roll cal
vote, Alderman Bluhm, Canfield, Hunziker, McConnell, Solinger, Strai ,
And President Postier voted Aye. Ayes (7), Nays- (0). Motion Carri d.

F-1 An Ordinance relating to the Police Department providing for the
appointment of certain personnel, was given its.first reading. Bluh
moved, Canfield seconded to suspend the rules and give the ordinance

Council was concerned about the vacation of the alley, Hunziker aske
what if the Council says no use of the alley. Doug Knott, Downtown
Development Administrator stated that we can't cut the use off
entirely. Canfield asked if this could be a one way alley. Mr.
Knott stated that 18'foot wide alley is not enough room for two
vehicles.
Solinger moved, Canfield seconded to adopt Resolution No.290-87
approving the vacation with the necessary easements retained and
subject to a turn -around being allowed. Ayes .(7), Nayes (0),
Motion Carried.

President Postier called the meeting to order at 7:30 P.M., the
following members being present: President Postier Aldermen Bluhm,
Canfield, Hunziker, McConnell, Solinger and Strain. Absent: None.
A Hearing on the Conditional Use Permit - Centerplace Hotel. Having
no one present wishing to be heard, President Postier closed the
hearing. Solinger moved, B'.uhm second to adopt Resolution No. 293-f
approving the permit. Ayes (7), Nays (0).Motion carried.
A Hearing on the Conditional Use Permit - Centerplace Office Buildi
Having no one present that wished to be heard, President Postier
closed the hearing. Canfield moved, McConnell second to adopt Res.
294-87 approving the permit. Ayes (7), Nays (0).Motion carried.
A Hearing on the Conditional Use Permit - Parking Ramp on the
Bus Depot Site. Having no one wishing to be heard, President Postier
closed the hearing. Hunziker moved, Canfield second to adopt
Resolution No. 295-87 approving the permit. Ayes (7), Nays (0).
Motion carried.
A Hearing on the Application for Planned Unit Development ( Amended
Final Plan ) No. 87-5 of Rolling Meadows. Wishing to be';heard was
Clare Mulmann of 1853 33rd St. N. W. and objects to alleys that
run thru back yards. He stated that what is called a "road" is
more like an alley in a cul-de-sac.
Wishing to be heard was Don Borcherding of Yaggy Colby and stated
that there is a large drainageway on 33rd St. with a 50' easement.
The cost lies in this drainageway. Having no one else wishing to
be heard, President Postier closed the hearing. Mr. Plumb, Public
Services Dir. stated that a walkway will be put between the houses
and the drainageway. Mr. Borcherding also stated that trees, etc.
will be in the width of 30 feet between the houses and drainageway.

Having no further discussion, Canfield moved, Solinger second to
Adopt Resolution No. 296-87 approving the final plans and zone Chang
with an additional 10 foot setback from the drainage ditch in the
event that a bike path is constructed on either side of the ditch.
This will allow this path to be made. This also includes the follow-
ing 12 conditions:
1. Provide for sidewalk construction at the time of development fro
18th Ave. Wly alg 33rd St. adjacent to this proejct and Allendale
Park.
2. Submit to, -City Public Services Dept. a detailed grading, drainag
and erosion control plan.
3. Access off of 18th Avenue N. W. to Lots 1 and 2 , Blk 6 will be
permitted only by a common drive and the driveways shall be designat d
so that backing onto 18th Avenue N. W. will be avoided.
4. Submit an addressing plan acceptable to the Public Services Dept.
5. All housing units shall have clearly displayed house numbers and
visible from the abutting street.

B-4 6. Lots 1 and 8, Blk 4 adj. to the walkway should provide a wider
space for the walkway from 10 to 15 feet - such that the setback
line on each lot is moved five feet further to the south.
7. Lots 4 and 5 Blk 4 should provide 8 foot setbacks from the south
PUD boundary consistent with the ordinance for two story residences:
8. Locate common mailboxes on Outlots B and C for Blocks 1-5 and in
an approved lcoation for Block 6.
9. Provide street signs for the two cul-de-sacs that meet the requii
ments of the Roches,er Public Utilities.
10. Locate street lights alg each cul-de-sac that meets the normal
requirements of the R-1 District will apply for each lot.
11. Submit bulk requirements for accessory buildings, otherwise
the requirements of the R-1 district will apply for each lot.
12. Provide two off-street parking spaces per lot as its required
by the parking provisions of the ordinance and mark the common
parking areas on the site plan.

B-5 A Hearing on the Final Plat No. 87-9 Bluegrass Townhomes. Wishing
to be heard was Don Borcherding of Yaggy-Colby Assoc. He urged the
Council to approve this with Lots 12-15 with a six foot setback
and 14 112 foot units. He stated since most of the building is
in the ground, the height should be no problem. Having no one
else present that wished to be heard, President Postier closed the
hearing. Bluhm moved, Hunziker second to adopt Resolution 297-87
approving the plat with the following conditions:
1. Maintaining the 8' setback and 2. that -the developer provide
all respective homeowners association documents to the City as they
can be reconsidered with this plat.

B-6 A Hearing on the Proposed project No. 8416- J 8887 Alley Resurfacing
behind the Holiday Inn Downtown from 2nd Street S. E. to 3rd St.
S. E. Wishing to be heard was Dandy Woodman , Mdnager of Holiday
Inn Downtown and was concerned about delivery trucks being able to
use this when the resurfacing is done. She was assured by Public
Services that only resurfacing should not be a problem. Having no
one else present that wished to be heard, President Postier closed
the:,,hearing. Hunziker moved, Solinger second to adopt Resolution No.
298-87 ordering the project to be made. Ayes (7), Nays (0).Motion
carried.
B-7 A Hearing on the proposed project No. 8705 J 8996 - Watermain Ext.
along the West Frontage Rd. 51st St. N. W. and Tongen Avenue to
serve Lot 6 Tongen lst Sub. and Others. Wishing to be heard was
Martin Keech of 5030 Tongen the petitioner and urged the Council to
approve this as he needs the service. Wishing to be heard was
Joseph M. Graupmann of Tongen and questioned if he would be billed
for a sewer hook-up if he does not use the service. Mr. Plumb,
Public Services Dir. stated that unless he hooked up to the service
he would not be charged for the hook-up.

Wishing to be heard was Erwin Lederbuhm of Tongen and wondered if the

B-7 if the chloride in the water would hurt his septic tank. Mr. Plumb
stated that he was not aware of any damage, but to be sure, call the
Public Health office.
Wishing to be heard was Roger Darrell would like to have the sewer
put in all the way..
Wishing to be heard was Don Johnson of Hwy 52 N. and would like to
have the project extended to include him too.
Wishing to be heard was Dr. Jay Lucas and owns a vacant lot and
is opposed to this project as he will not be getting any benefit to
his lot.
Having no one else present that wished to be heard, President Postie
closed the hearing. No action will be taken on this as this is
referred to the Committee of the Whole for more discussion.
E-1 Darrell Prouty requested to be heard but was not at this meeting.
E-2 Bluhm moved, Strain second to deny the application to the FCC for
LPTV stations and to retain consultant services for the
application process. Upon roll call vote, Aldermen Bluhm, McConnell
Solinger, Strain and President Postier voted aye. Ayes (5), Aldermen
Canfield and Hunziker voted nay. Nays (2). Motion carried.
G-2 Hunziker moved, McConnell second to remove the Space Study Contract
from the table. Ayes (7), Nays (0).Motion carried. Solinger moved,
Strain second to authrize the execution of the contract with Hammel,
Green and Abrahamson for the purpose of conducting a space
needs analysis for City Hall , the Public Services Dept. and the
Park and Recreation Dept. and the Rochester Public Library. .
This should be done in two phases with the first only being the
space analysis and phase two to be considered when the site selection
is needed. Ayes (7), Nays (0).Motion carried.

After Council discussion, it was decided that the numbers should not
left as they are assigned but to correct the problem and change them
this time. Some further discussion led the motion'.by Hunziker and
second by.Canfield to leave the four affected houses as they are at
the present and change future houses to conform with the numbering
system. Upon roll call vote, Aldermen Canfield and Hunziker voted
aye. Ayes (2), Aldermen Bluhm, McConnell , Solinger, Strain and
President Postier voted nay. Nays (5).Motion did not carry.
Solinger moved, Strain second to change the numbers on the four affec
houses. Upon Roll call vote, Aldermen Bluhm, McConnell, Solinger,
Strain and President Postier voted aye. Ayes (5), Nays (2). Aldermen

C-1 (The annual address by President Postier):
Honorable Mayor and Common Council:
It is my pleasure to congratulate Mayor Hazama on his re-election to
another term, and Aldermen Bluhm and Strain -on their re-election to
the Common Council. I would also like to welcome Jean McConnell to
the City Council, and congratulate him on his successful election.
I wish to thank Paul Allen for his twelve years of service on
the City Council. It has been my pleasure to have had the privilege
to work with Paul, who is an outstanding individual and was an
excellent elected representative. I am certain that this good
tradition will be carried on, as it has so many times in the past.
The past year was another tremendous movement forward.toward our
goals of protecting our city from flooding, revitalizing our downtown,
improving our roadways and streets, -providing quality services to the
residents of our wonderful city, etc. I realize that some of these
things do not happen without pain and discomfort, and it is a part of
progress that I wish we could do without. I would like to mention a
few of the major projects completed in 1986, or are underway in 1987.
(1) FLOOD CONTROL
Construction continues on the first reservoir for the SCS portion
of our $72 million flood control effort. Design plans are being
reviewed for the Corp. of Engineers portion of the project. Land
cquisition has proceeded at a rapid pace by our Joint Powers Board,
which includes our Mayor and Aldermen. If only the Federal governmen
could move as smoothly and rapidly. I am hopeful that a fairly large
mount of turn back funds will be made available to our city in the
near future, so that we can more closely keep on schedule. Initial
construction efforts within the northwest area are scheduled to
start this year, 1987.
(2) CITY FACILITIES
The new Mayo Civic Center opened in September and is proving morE
successful than projections. I certainly do not wish to put a hex on
this wonderful facility, by overstating the success we have had so
far, but the proof is in the pudding. Up till now it has been
excellent, and this month of June will be our largest convention
use month to date. Another new and needed facility, the Rochester
Public Utilities Service Center is under construction and will be
ready for occupancy in the spring of 1988.
(3) DOWNTOWN DEVELOPMENT
Demolition to make way for the D5 Center Place project begins
this week. All of you are aware of the sweat, blood, and tears
spent over the past two and one half years, to finally see the start
of this project. Our new city parking ramp will begin to take shape
this fall. The Kahler Hotel has secured'.financing for a new hotel
on the site of the present Zumbro: We hope to sign a Phase Two
agreement with them in the next few months. .
(4) MAJOR STREETS
I hate to mention this because it seems as if the whole downtown
street system is torn up. Again I say, this is one of the bad parts
of progress. Broadway is in construction from Fourth south to Ninth,

C-1 with a new bridge being built. The rest of the construction going
north will be in progress this summer,,working,towards completion
next summer. Work continues on the 41st St. NW interchange.
Environmental studies and preliminary designs for the new 5th Street
extension will be completed this winter, and a possible construction
start in 1988 or 1989.
(5) PROBLEM RESOLUTIONS
While I enjoy accentuating the positive, this also will be the
year to try and eliminate some -of the negative. We must give our
full attention to the treatment problems at the Water Reclamation
Center, and work to correct these problems as quickly and
economically as possible, It is -not a question of who or what caused
our problems, it must be firm leadership from this Council to make
certain these problems are corrected.
In February of this year, the City Council instructed the City
Attorney to investigate the regulation of adult entertainment services
in our city. We will continue to upgrade our ordinances to control
and improve regulation of such services.
I sincerely hope that the coming year' -will be as fruitful as
this past year. It most certainly will be challenging to.the members
of the City Council to make this happen. After giving 18 addresses
such as this, I still look forward with exciting anticipation to the
wonderful things happening in Rochester, Minnesota and being
privileged to have a minor part in making them happen.

First of all, let me express my sincere appreciation to all the
voters who made it possible for me to continue as mayor for the next
two years. My eight years as Mayor of this great city has been
eventful, exciting, challenging and memorable.
This is a great time to be involved in the deliberations of city
government. So much is going on that it is a period that will be
labeled as the decade of progress for the Rochester community . . .
and the beat goes on.
Construction start for another phase of our most important flood
control will take place this summer.
The downtown construction zone includes Mayo's Educational
Building, Mayo North, Methodist North, Centerplace'Project, Broadway
reconstruction and before year end, RochesterPlaza Hotel.
The outlying construction zone includes the 41st Street NW
construction, the Waste to Energy facility, construction of the new
Public Utility facility on 37th Street N.E. and our effort to correct
our 56 million dollar Water Reclamation Plant, and WSU-RCC facility
is in operation.
It was only Saturday that I took a delegation of visitors on a
tour of our City Hall with the showing of our eight minute video
tape on Rochester, a tour of the Mayo Civic Center, fed the geese at
Silver Lake and ended up with a tour of the Recreational Center. The
head'of the delegation came up to me and shook his head with a smile
and quipped, "You've got to be proud of your city and, as for me, I'm
jealous. '

Credit goes to you voters who were willing to take the kind of
risks we needed to, as a community. To maintain the steady growth
we have experienced does not happen automatically. It takes people
and those who are elected to serve the community to cooperatively
work together to achieve what we have been able to accomplish in our
community - a community working together has no limits to our
imagination. Let's continue to pursue excellence as we strive to
make our international community an even better place for the
generations to come.
TOP TEN GOALS - 1987 - 1988
1. We will work to continue to maintain our triple A (AAA) bond
r rating with Standard and Poors.
2. Attempt to keep,.unemployment withim,the 3.0 - 4.0 range.
3. Surpass the 200 million dol1ar_mark in development during the year
4. Surpass any previous high attendance for the annual League of
Minnesota Cities conference to be held in Rochester, June 9-12.
5. John Marshall Band will place as one of the top bands in the
annual King Kamehameha Day Parade in Honolulu, June 6.
6. Rochesterfest will be the best and most successful in five years.
7. Groundbreaking for Center Place in'the spring will be the
culmination of twenty years' effort.
8. Groundbreaki:ng'for Methodist North expansion and Rochester
Plaza Hotel.
9. Reconstruction of main street, Broadway, during the year.
10. Flood control will receive additional funding for our continuing
85 million doll.ar.project.
PERSONAL GOALS THAT I WILL BE ATTEMPTING TO ACHIEVE FOR 1987-1988
1. Organize, plan, and give leadership to the League of Minnesota
Cities conference to be held in Rochester June 9-12, by serving
on the Planning Committee and as President for 1987-1988'.
2. Escort and appear with John Marshall Band on their trip to the
annual Kamehameha Day Parade in Honolulu, June 6.
3. Represent Rochester in the National League of Cities Election '88
Task Force.
4. Serve as a member of the U. S. Conference of Mayor's Resolution
Committee.
5. Attempt to achieve All America Cities Designation and Award
along with the City Livability Award from the U. S. Conference
of Mayors.
