RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL
CITY OF ROCHESTER, MINNESOTA
Adjourned Meeting No. 4 - June 22, 1987
President Postier called the meeting to order at 4:30 P.M. with the
following members being present: President Postier, Aldermen Bluhm,
Canfield, Hunziker, McConnell, Solinger and Strain. Absent: None.
Alderman Strain moved, Solinger second to award to bids for the
moving of the former CNW Railroad Depot to the low bidder, Spencer
Movers of Wells, Minnesota, for $24,500.00. Ayes (7), Nays (0).
Motion carried.
Bluhm moved, Strain second to approve the draft Skyway
Agreement subject to the changes identified below and authorizing
City Officials to sign the agreement on behalf of the City:
Due to timing consideration and Kahler's desire to become involved
in the negotiations, the Marquette Skyway should be deleted from this
agrement and a separate set of negotiations should be initiated for
this bridge.
The cost -sharing agreement on the north bridge from the Center Place
Hotel to the new ramp should be:revised to indicate that the east/
west portion of this bridge will be a 25% BGD5/75% City cost similar
to the south ramp connection and the north/south portion of the
bridge will be a 100% City cost.
The length of the skyway easements grated to the City should be
extended from 40 years to 50 years.
Article III, Access to Skyway System from Adjacent Properties,should
be amended to clarify that property owned by the Mayo Foundation is
not subject to the terms of this section of the agreement.
Article VIII of the agreement, General Skyway System Rules, should
be amended to clarify the process for the extension of skyway system
hours. Essentially, the Council may approve an extension of hours
provided the party requesting the extension pays operation, main-
tenance, repair and surveillance costs during the extended period.
Language providing for the automatic extension of hours, if Council
has not acted on the request within 15 days, is deleted.
Article VIII of the agreement should be amended to clarify that no
projecting store signage will be allowed in the easement areas of thi
privately -owned skyway and subway corridors except as expressly
authorized in writing by the City. Surface_mounted wall signs in a
plane parallel to the face of the wall will be allowed.
The agreement should be amended to make minor changes suggested by
the City Attorney to clean up the contract languare and format and
to make the agreement consistent with applicable state and local
statutes.
Discussion. Concern was expreseed that in regard to the formulation
of some sort of skyway connection charge the word "shall" be replaces
with the word "may". After further discussion, it was felt that
the issue could be addressed and the agreement changed as needed.
The word "may" would remain in the agreement.

E-3 Discussion on the petition of Super America for Public Improvements
on Second Street S. W. The Public Services Department submitted
additional alternative alignments of Second Street S. W. intersectic
with 15th and 16th Avenues and additional information on the install-
ation of a traffic signal at the Second Street S. W. and 16th Avenue
S. W. intersection.
Bluhm moved, Canfield second to table the request from
Super America and refer the matter back to the June 24, 1987
meeting of the Planning Commission for further recommendation.
Ayes (7), Nays (0).Motion carried.
E-4 IHunziker moved, Strain second to approve the Rochester Jaycees
Kiddie Parade on July 4, 1987. Ayes (7); Nays (0):Motion carried.
E-5 Hunziker moved, McConnell second to approve the issuance of a
Consumption and Display, Annual Dance, On -Sale Non -Intoxicating
Malt Liquor , and Cigarette license to the Knights of Columbus
Assocation located at Highway 14 East. This property was recently
annexed to the City. Ayes (7), Nays (0).Motion carried.
E-6 Solinger moved, Bluhm second to instruct the City Attorney to
prepare an amendment to Chapter 93 of the Public Transportation
Ordinance and to prepare.aniordinance awarding a Public Transportati
Franchise to Ambassador Limousine Service of Rochester for a one
year period to'operate a tour service within the city limits of
Rochester. Ayes (7), Nays (0).Motion carried.
G-1 Strain moved, Canfield second to remove the Personnel -Policy on
Smoking Policy, effective August 1, 1987 from the table. Ayes (7),
Nays (0).Motion carried.
Bluhm moved, Solinger second to adopt Resolution No. 331-87
Workplace Smoking Policy , effective AugustIl, 1987. Ayes (5),
Nays (2). Motion carried. Alderman Strain and Hunziker voted nay.
They felt that the City policy should be stronger.
Having no further business, Hunziker moved, McConnell second to
adjourn the meeting. Ayes (7), Nays (0). Motion carried.
