Canfield, Hunziker, McConnell, Solinger and Strain. Absent: None. Canfield moved, Hunziker second to approve the minutes of the March 7 and 28, 1988 meeting. Ayes (7), Nays (0).Motion carried. C-1 Huzniker moved, McConnell second to approve the appointment by Mayor Hazama of James R. Hesse of 1837 18 1/2 St. N. W. to the Housing and Redevelopment Authority for a remaining term of and to June 1990. Ayes (7), Nays (0).Motion carried. C-2 Strain moved, Hunziker second to approve the appointment by Mayor Hazama of James Walch of 961 17 1/2 St. S. E. to the Music Board. Term to fill the unexpired term of Julie Hein to January , 1989. Ayes (7), Nays (0).Motion carried. D-1 Rick Hexum wished to be heard concerning the connection charges for water service to Viking Hills SUb. The owner contract for the installation of utilities in Viking Hlls Sub. is being withheld until Mr. Hexum pays for the connection charge. Mr. Hexum would place this connection charge in an escrow account until he has the opportunity to work our the details. Meantime, he would like to go ahead with the owner -contract. Roger Plumb, Public Services Director stated that Mr. Hexum has not paid the hook-up charges for phase I of the project and a proposed problem with reapportioning the assessment charges in the area that was brought up by Mr. Hexum at a previous meeting was a different matter entirely. Mr. Plumb is concerned about this problem. President Postier suggested that Mr. Hexum pay the hook-up charges that is ow.ed•', put the money in excrow for the connection charges in question and have a hearing on the asessment problem. Mr. Hexum was in total agreement. He was advised to work with the Public Sery Dept. on this matter. The Assessment question will also go to Comm. the Whole for further discussion. E-1 Discussion was held by the Council on the request received from Top Hat for a Taxicab Franchise. Alderman Hunziker stated that he likes to see competition and is concerned that the citizens of Rochester receive fair treatment in price as well as service. Alderman Bluhm stated that he would like to see this tried for a year - he thinks this will take care of the "What if's" and the City should. have answers in one year. Alderman McConnell agreed with Alderman Bluhm except he did not think one year had been agreed on by the Council in prior discussions. Having no further business Canfield moved, McConnell second to instruct the City Attorney to prepare an. Ordinance to allow a second franchise for Taxicabs to operate in the City of Rochester with the following included - 1. Minimum number of cabs to be 15 ( Fifteen ) and the fee be based on this minimum. 2. Restricted to owner/employee type operation. (This prohibits a leased type operation ). Ayes (6), Nays (1). Strain moved, Solinger second to adopt Resolution No. 188-88 providin, authority for the City Attorney, at the direction of the City Administrator to initiate 90 day quick take eminent domain proceeding. .for the purpose of acquiting land for State M of the Army Corps of Engineers flood control project. Bluhm moved, Hunziker second to adopt Resolution No. 189-88 authorizi the City Clerk to publish a public hearing to be held on April 18, 1988 on the creation of Development Program for Dev. Dist. No. 4 and creation of Tax Increment Financing Plan for Tax Increment Financing Plan for Tax Inc. Financing Dist. No. 4-1, City of Rochester, Mn. ( This is a request by Wilson Refrigerated Express for a proposed facility in Fred Schuster Ind. Park.) Ayes (7), Nays (0).Motion carried. Request for Cement Sidewalk licenses as follows: B.& G Masonry Route No.3, Owatonna, Mn. and McCann Concrete Company of 1929 50th Avenue S. E. Roch. Mn. Also was Lake Area Uti.lity Contracting Inc. but included was Asphalt. Request received from Dwayne Johnson of 1839 2nd Avenue S. E. for an Auction permit on April 16, 1988 at 1701 2nd Ave. S. E. and Paul G. Jordan of 909 N. Broadway for an Auctioneer's License for the period of April 4, 1988 to December 31, 1988. Request for a Single Dance license submitted by Aviary of 4320 North Highway 52 for April Fool's Day. Request received from the Rochester Art Center for a Non -Intoxicating beer license for the Festival of Arts on Sunday June 5, 1988 at Central Park. Also a Temporary Gambling License for a raffle to be held June 5, 1988 at Central Park. Request also for a yearly gambling license was received from VFW Post 1215 16 6th St. S. E-18 Canfield moved, Hunziker second to approve the Preliminary Plat of Baihly Heights Third Subdivision subject.to the following three provisions: 1. A 10 foot wide utility easement rather than five foot as shown should be provided on the back of all the lots which abut unplatted land._ N. W. Bell will be placing phone lines in the easement and because of the topography and trees, they do not feel they can do the trenching in a 5 foot easement without trespassing on the land outside this plat. 2. Adjacent on the west to Lot 1, on the north side of 21st Ave. is a remnant parcel called "Outlot A of Baihly Heights Sub.; This outlot should be included as part of Lot 1. 3. The Developer be required to provide a drainage study to deter- mine if storm water retention structures or downstream storm sewers are needed to insure that flooding problems do not increase because of the development. McConnell moved, Strain second to adopt Resolution No. 194-88 and 195-88 ordering a feasibility report and ordering a hearing to be held on May 2, 1988 on the proposed Street Construction to serve Wimbledon Hills and Aspen's PUD's - Project No. 8805 J 9036. Ayes (7), Nays (0).Motion carried. Discussion was held on the project. Developer stated that they are in agreement on the preferred alignment of the street and on the cost sharing between the two developments ( Wimbledon'Hills and Aspens). Mr. Roger Plumb, Public Services Director questioned the time table. Mr. Plumb stated that if eminent domain is involved, it could take longer to construct. What would they use in the mean- time. Mr. Dennis Peterson of 2705 Brier Ct. S. W. was present and is the developer of Wimbledon Hills stated that he understood that this might take some time, but meantime he wanted this project to proceed. Alderman Hunziker questioned if 4th Street S. W. would be used by the people involved in the project? Mr. Peterson stated that they would not use this street. When the 25th Avenue is constructed this would be used for any future access and development This would definitely stay away from the Hillcrest access. Solinger moved, Strain second to adopt Resolution No. 196-88 and 197-88 ordering a feasibility report and a hearing to be held on May 2, 1988 on Project No. 6212-1-88 J 9035 - Street Reconstruction Concrete Curb and Gutter on 12th St. N. Motion carried. 1 Solinger moved Canfield second to instruct the City Attorney to pre are an Ord. amending the Truck Route Ordinance to add 41st St. N. W. from 18th Avenue N W. to the East Frontage of TH 52 during the hours of 6:30 A.M. to 8:00 A.M. Refurbish the Meters - This is mainly due to the age, amt of us during the life span of the meter and failure rate which we are not experiencing. Resolution No. 211-88 approving a purchase order agreement with A.B.Chance for transformers in the amount of $19,337.00. G-1 Strain moved, Hunziker second to remove the request for a Taxicab Franchise for Top Hat Access Transit from the table. Ayes (7), Nays (0).Motion carried. SOlinger moved, Strain second to instruct the City Attorney to prepare an Ordinance making this effective. (See reading at the top of the page.). Ayes (7), Nays (0).Motion carried. McConnell moved, Hunziker second to adopt Resolution No. 214-88 approving this amendment., Ayes (7), Nays (0).Motion carried. B-2 A Hearing on the Final Plat of Baihly Woodland Seventh Sub. Having no one present that wished to be heard, President Postier closed the hearing. Solinger moved, Canfield second to adopt Res. 215=88 approving the plat. Ayes (7), Nays (0).Motion carried. B-3 A Hearing on the Final Plat of Campus Village IV Subdivision. Having no one present that wished to be heard, President Postier closed the hearing. Canfield moved, Hunziker second to adopt Resolution No. 216-88 approving the plat with the following two conditions: 1. If there are any existing fire hydrants that are not located on a common lot line with this replat then the hydrant should be rerouted at the developers expense. 2. The owner come to an agreement with the City on the completion of the final lift of asphalt for this street as recommended by the Public Services Dept. Ayes (7), Nays (0).Motion carried. B-4 A Hearing on the New Sidewalk No. 3 - 1987 J 8991 - Proposed Assessments. Wishing to be heard was Denny Weestrand of 501 20th Ave. S. W. He was objecting to his assessment. He stated that the developer should not have to pay for a project that was put in be- fore it was bid out. He was told that this project was part of a road project and thus would not have to be heard first before the bid was let. Mr. Weestrand still objected. Wishing to be heard was Clarence Horst of 2821 26th St. N. W. and stated that an assessment had been put on the wrong piece of property. Public Services will look into this matter. Having no one else present that wished to be heard, Solinger moved, Canfield second to table this until the assessment matter can be cleared up. Ayes (7), Nays (0).Motion carried. RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL 3o9 CITY OF ROCHESTER, MINNESOTA Regular Meeting No. 27 - April 4, 1988 Agenda Item B-5 BE A Hearing on the Vacation of the S 3 Ft. of the N 5 Ft. of the W 20 Ft. of the Platted Utility Easement located on the Lot 5, Blk 5, Baihly's First Addition. Having no one present that wished to be heard, President Postier closed the hearing. Solinger moved, Bluhm second to deny .the vacation. Ayes (7), Nays (0).Motion carried. A Hearing on the Petition to vacate No. 88-2 that portion of a platt- ed five foot Utility Easement running along the westerly lot line o Lot 12, Block 22, Country Club Manor 5th Addition. Wishing to be heard was Paul Ohly of 1500 16th Avenue N. W. He urged the Council to table this until May 2. This would allow him to study the problem and maybe find an alternative. Having no one else present that wished to be heard, President Postier closed the hearing. Canfield moved, McConnell second to table this until May 2, 1988. Ayes (7), Nays (0).Motion carried. A Hearing on the Proposed improvement Project No. 6316-4-87 J 8973 Reconstruction of 16th Avenue N. W. from 14th St. N. W. to llth Avenue N. W. plus Construction.of Curb and Gutter from 16th St. N. W. to llth Avenue N: W. Wishing to be heard was Bob Forsyth of 1615 16th Avenue N. W. He objected to this project. He stated that the bus traffic made the street fall apart and when the street was built it was for residential traffic only. He stated that other streets in the city have similar circumstances and the streets have been repaired and not rebuilt. Out of 40 property owners, 39 signed the petition in opposition and the other 1 was on vacation. Approximately 40 people were in attendance and all stood in opposition to this project. He urged the Council to deny the project and instruct the City engineers to repair the damaged street and reroute the bus traffic permanently. Mr. Roger Plumb, Public Services Dir. presented slides on the area and stated that if they put an asphalt overlay, this would only be a matter of time before the street was in need of repair again. The poor base plus water drainage is the reason that this cannot be repaired with overlay. Mr. Plumb stated that this would be a waste of time and money. Curt Schrieber of 1621 16th Avenue N. W. was present and objected to the project. He presented three alternatives to this probl.em. 1. Overlay the street ( from City Funds ) 2. If the City approved this project, have the overweight vehicles pay for the construction. 3. Make this area an expressway or arterial street and include thi in the thoroughfare plan and get City funding for that sort of project. Having no one else present that wished to be heard, President Posti r closed the hearing. Agenda Item B-7 Jm E-29 F-1 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA &O Regular Meeting N o. 27 - April 4, 1988 t/'� Alderman McConnell stated that the property owners had presented a textbook case and thanked them for their efforts. He stated that this is the true use of a "public hearing". Alderman McConnell is in favor of one of the three suggestions as presented by Mr. Schrieber. Alderman Solinger recalled one of the streets -given as an example - and it was in worse shape as this one and it had to have the base replaced too. It is O.K. today, but it was because of the base being replaced that held the street. Alderman Strain wondered if this was an assessment project similar to other residential assessments we have done in the past. He was informed that it was. Alderman Solinger questioned Mr'. Plumb on the possiblity of the Water Dept. coming in after the project was done and install mains, etc. Mr. Plumb stated that he was told that no future work would be needed.
