HomeMy WebLinkAbout10-10-19883186 RECORD -OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA Adjourned Meeting No. 15 - October 10, 1988 Agenda Item A-1 E-1 G-1 President Selby called the meeting to order at 4:30 P.M. the same being held in Room 4 of City Hall. Present: President Selby, Aldermen Bluhm, Canfield, Hunziker, McConnell, and Solinger. Absent: Alderman Strain. Solinger moved, Hunziker second to adopt Resolution No. 614-88 adopting the 1989 Annual Budget and Resolution No. 615-88 Cert.ifying the 1989 tax levy. The City Clerk,;i;s directed to certify a copy of this resolution to the County Auditor. After discussion by the Council, Bluhm_moved, Canfield second to amend the original motion approving the budget to include $25,000.00 to the Mayor's contingency account for one year only for the National Tae Kwon Do convention which will be held in Rochester in June, 1989. Ayes (6), Nays (0). The amended motion was carried. The original motion was voted on at this time. Ayes (6), Nays (0).Motion carried. Canfield moved, Hunziker second to remove the request for Metes and Bounds No. 88-14 of unplatted land along Bandel Road from the table. Ayes (6), Nays (0).Motion carried. Discussion was held by the Council and they asked Roger Plumb, Public Services Director if he was satisfied that all the problems with this request had been solved. Mr. Plumb stated that he was happy with the alignment of the road and presented a map of the property with the road area shown where it would be built. Mr. Plumb stated that he was concerned about the utility and street work to be done. This is usually paid for by the developer and he said that if this is not platted, and the road /utility work.is done in the future, then he would not be sure of the developer paying for the improvements. The City would then have to provide this and would end up paying for most or all of the improvements. Mr.Fred Schmidt was present and stated that he would pay for the street extension and the paving of it. Alderman Hunziker questioned if a legal covenant could be made assuring the City that Mr. Schmidt would put in the street and utilities necessary. Fred Suhler stated that this becomes a legal question as no one knows what would be put on the property as a development - Alderman Hunziker stated that in his estimation you either need a road or not. Fred Suhler stated that a new buyer of this property may be nervous if an agreement is in existence prior to the sale. Mr. Plumb stated that a plat would take care of all the above questions, but Metes and Bounds just doesn't govern the items the Council is concerned with. n RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL 3JL87 CITY OF ROCHESTER, MINNESOTA Adjourned Meetinq No. 15 - October 10. 1988 Agenda Item G-1 Mr. Fred Schmidt stated that he is platting Bandel I,II, and III and IV and when V is platted as the 5th Sub. if he hasn't got the street in and paid for,. then he will pay at that time of the 5th Sub. being platted. He said that he needs this road and it should be no problem. Council questioned why this wasn't brought in as a plat in the first place. Fred Suhler stated that platting process would take to long for this sale this fall. It was noted that U.S. West also requires an -easement for the telephone lines. Having no further discussion Canfield moved, Bluhm second to adopt Resolution No. 616-88 approving the Metes and Bounds des. This was subject to the following conditions: 1. --Payment of the assessments 2. Dedicate an easement for the Roadway 3. Include the easement as required by U.S. West 4. That at the time of platting Bandel V he would agree to put in the street to Bandel Road. Ayes (6), Nays (0).Motion carried. H-1 Alderman Canfield brought up the subject of changing the zoning district in the Kutzky Park area making this from R-2 to R-1 zone. He would like a hearing on this matter and it has to be Council initiated. Alderman Solinger stated that he did not know anything about this matter and would like more information first. He stated that he would like to have this information especially in this case as the Planning and Zoning Commission voted this request down and left the zone at R-2. Council will consider the request for a hearing. Having no further business, Solinger moved, Hunziker second to adjourn the meeting until 7:30 Oct. 17, 1988. Ayes (6), Nays (0).Motion carried. y Cler
