Adjourned Meeting No. 22 - January 4, 1989
President Selby called the meeting to order at 7:30 P.M., the
following members being present: President Selby, Aldermen Bluhm,
Canfield, Hunziker, Solinger, and Strain. Absent: Alderman McConnell
Bluhm moved, Hunziker second to approve the minutes of the December
12 and 19, 1988 meetings. Ayes (6), Nays (0).Motion carried.
A Hearing on the Planning and Zoning Commission initiated land use
plan amendment 88-5 from the Low Density Residential Designation
to the Medium Density Residential Designation. Having no one
present that wished to be heard, President Selby closed the hearing.
Solinger moved, Bluhm second to adopt Resolution No. 1-89 approving
the change. Ayes (6), Nays (0).Motion carried. This is land known a-
Glendale Subdivision.
A Hearing on the Urban Service District and Rural Service District
for Taxing purposes. Having no one present that wished to be heard,
President Selby closed the hearing. Strain moved, Canfield.second
to instruct the City Attorney to prepare an Ordinance for adoption.
Ayes (6), Nays (0).Motion carried.
A Hearing on the Proposed Assessments on Project No. 8705-J 8996 -
Ext. of San. Sewer and Watermain in 48th Street N. W., Tongen Avenue
51st Street N. W. and West Frontage Road TH No. 52 to serve Cavilima
lst Sub., Tongen 1st Sub. , Tongen 2nd Sub. and Adjacent lands.
Wishing to be heard in opposition to this assessment was the follow-
ing:

Solinger moved, Hunziker second to appove the following to the
Library Board: Diane Schwinghammer of 2228 Valkyrie Dr. N. W.: Term
will run to January, 1992. This position was created by the resignatil
of Marion Bagne. Robert Beery of 623 28th St. N. W. will run to
January 1992 and will complete the term vacated by the resignation
of Larry Gifford. Ayes-(6), Nays (0).Motion carried.
Strain moved, Bluhm second to adopt Resolution No. 5-89 referring
the following petition to the.Public Services Dept. for a feasibility
report,on Sanitary Sewer and Watermain to serve the Lincoln-Mercury
Auto dealership - on the alignment of Service Court N. E. from Third
Avenue N. E. to a point approx. 153 feet NEly of the SW Corner of
Lot 1, Blk 2, 37th Street Business Park and Ext. of Watermain from
Service Court N. E. to serve the Lincoln-Mercury dealership.

Bluhm moved, Canfield second to adopt Resolution No. 7-89 authorizing
the execution of the Gopher State One call Operator Agreement.
Compliance with the State mandate will cost $300.00 plus approx. $500
per month:= In 1990 the Public Services will need a person to fill
this position and office space. Ayes (6), Nays (0).Motion carried.
Hunziker moved, Bluhm second to adopt Resolution No. 8-89 approving
change orders 1,2 and 3 for First Street Pedestrian Plaza and
Hotel and Office Building Streetscaping. This increase is
$6,073.79 and $2,547.50. Ayes (6), Nays (0).Motion carried.

a new hearing date for February 6, 1989 on the reassessment of

on the east side of Broadway. The assessment totalled $5,997.46.

approval of their application for an Over -the Counter Cigarette

required fee has been paid and departmental approval obtained.
The Moose Lodge #2128, 915 21st Avenue SE, Rochester, Minnesota
requests approval of their annual Gambling License for the period of
April 1, 1989 through April 1, 1990. Departmental approvals have
been obtained.
Blomberg Company, 627 East 145th Street,. Burnsville, Minnesota
requests approval of their application for a Heating,.Ventilating
and Air Conditioning Contractors License for the period of January 1,
1989 through December 31, 1989. The required fee has been paid,

Solinger moved, Bluhm second to approve the request received from
Rose Harmon Davis of the NAACP for a march on Martin Luther King Day
to be held on Jan. 16, 9189. This would be held at noon starting at
the Court House. Ms. Davis of 36 Elton Ridge Ct. N. W. was present
and explained the purpose of this march. Ayes (6), Nays (0).Motion
carried.

amount of $1,505,393.66. List on file with the City Clerk.

to prepare an amendment to the Orderly Annexation of the ROW for

The following letter was presented by Alderman Canfield for the recor :
ROCHESTER COUNCILMAN'S OBSERVATIONS ON
"The Kahler Wall"
The Kahler Corporation and Mr. Milner have taken advantage of our
trust in their cooperation and have denied us the right to complete
the downtown project as planned. The Kahler took $1.2..million of
city money and they took our land and joined in what we thought was a
spirit of cooperation to make the whole downtown project successful.
They then took a legal advantage to force the city either to change
the project in an inappropriate way or to allow them to hold their
neighbor hostage for $125,000. They cut off D-5 access to the
loading platform that was built to service all the buildings on the
block.

H-1 The Kahler refuses to talk to any mediator or to listen to the
reasonable people who were present during the planning sessions and
remind them of how the plan was supposed to work. The Kahler holds
out for $125.00O or compulsory arbitration where they have much to
gain and nothing to lose.

The people of Rochester have been betrayed by a trusted friend.
The Kahler secretly built .a wall that doesn't show on the plans, and
was built without a permit, to exclude the office building from the
loading dock. They took city money under false pretenses. Who on
the council would have given the Kahler all that money and all that
retail space had we known that they would turn on us at the end of
the project?
- Whether this demand was made to maximize a business advantage or
out of spite to complicate the operations of a competitor, it has no
place in this venture. I am deeply disappointed. I am embarrassed
for the Kahler because I remember what a leader the Kahler was for
this city and I remember the great and helpful citizens who worked
for the Kahler and for Rochester.
The City of Rochester, the Mayo Clinic and D-5 agreed to several
major changes to accommodate the Kahler that made the project more
difficult. This last change was not agreed to and is the last straw.
This information comes from my personal observation and is respectful
submitted to the people of Rochester who should be told what happens
to their money and their project.
