HomeMy WebLinkAbout10-30-1989RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA N? 3419 Special Meeting No. 13 - October 30, 1989 Agenda The call of the s ecial meetingwas read by Pro-Tem Strain, the same Item being called for he purpose of considering the Preliminary Plat of Baihly Heights 6th Sub. and any other business the Council may deem proper. A-1 President Pro-Tem Strain called the special meeting to order at 4:30 P.M., the following members being present: President Pro-Tem Strains Aldermen Bluhm, Canfield, Hunziker,McConnell and Solinger. Absent: President Nancy Selby. E=1 Jay:Bagne, Edina, Mn: Developer for the Civic Square Associates project located on the northeast corner of the Dev. Dist. and is bounded by First Street N. E., First Avenue N. E., the Fifth St. Extension and 2nd Avenue N. E. and is approx. 112,500 sq. ft. Mr. Bagne presented the Phase II Agreement to the Council and had pictures of the building which showed types of apartments and a general price range. Mr. Bagne explained the methods of financing. The Agreement attempts to limit financial risk to the City by not obligating the City to start property acquisition until the Dev. has satisfied conditions as set forth by the City. The Agreement enumerates the Developers obligations and those of the City. At the conclusion, the Phase II agreement requires the Dev. to provide the City with a $200,000 letter of credit and the Dev. would like to only furnish a $50,000 Letter of Credit at the signing and an additional $150,000 when he receives his firm mortgage insurance, committment from HUD. Risk to the City would be that the Dev. would not be able to furnish the $150,000. when the City needs it. The Dev. would like the City to start acquiring property as soon as he receives his firm commitment from HUD. Staff has chosen to wait until the Dev. has his bond allocation in hand. Phase II leaves this an either/or situation. Mr. Paul Utesch, Finance Director explained parts of the financing to the Council No action was taken on this request. This will be presented at the regular Council meeting on Nov. 6, 1989. E-2 Hunziker moved, Bluhm second to reconsider the Preliminary Plat of Baihly Heights Sixth,, Sub. Ayes (6), Nays (0).Motion carried. This is now open for Council discussion. Alderman Hunziker stated that this plat has so many things that are not answered yet that based on that fact, Hunziker moved, Canfield second to table this until the Committee of Whole can meet and iron out all the things Council may have questions on. McConnell stated that he would like to see an amendment put on the motion to bring this back after the first of the year. Reasons are that the Council has a full agenda from now to the end of the year and more time will be needed to work out the problems with Baihly Heights Sixth. Also he would like to have considered by the Council that all 7 members be present when this is voted on. Alderman Solinger stated that he doesn't mind having all 7 Council members present, but why wait until after,the first of the year. Alderman McConnell stated that the Council needs time to solve some of the questions that have arisen on this plat. Alderman Solinger stated that a hearing will be held on Nov. 20 on the Sewer and Water and we could go ahead with that portion of this project. Alderman Canfield included this amended motion in his second. The amended motion is now discussed by the Council. Planning the route of traffic without a connector road was of major concern of the Council. Discussion on whether Baihly Heights and Foxcroft should be connected is of concern of the neighborhood. Wishing to be heard from the neighborhood was Carla Nelson of 931 22nd Avenue S. W. Sh-eis opposed to this because of safety and they do not want the connector road. She did not think this should have been brought back for Council consideration when lots of problems in the area are not solved. Wishing to be heard was Don Borcherding of Yaggy Assoc. and he present ed a plan of the area and stated that they are willing to cooperate in getting this area platted. He stated that timing is important to them to get this area developed as the market is good at this time. Wishing to be heard was Robert Stellhaug of Baihly Heights and stated that when the people bought homes in the area, no connector street was even thought of. He is opposed as well as many people in attendance at this Council meeting. Alderman Solinger stated that he does not favor temporary connector roads but to be considered is safety - Fire, Police, School Buses are some of his concerns. Alderman Bluhm stated that the general public did not want No. Height connected to Viola Road. This was done and has turned out to be a very good traffic route. Vote was taken at this time on the amended motion as made by Alderman Hunziker and second by Canfield. Ayes (6), Nays (0).Motion carried, and no action was taken at this meeting. Having no further business, Hunziker moved, McConnell second to adjou the meeting. Ayes (6), Nays (0).Motion carried. ty Clerk 1
