Hunziker, McConnell, Solinger and Strain. Absent: Alderman Bluhm B-1 A Hearing on the Proposed Zone Change initiated by the Council on property located on the s. side of 7th St. N. W. and on the north side of the RR tracks, immed. w. of 1704 7th St. N. W. to M=2 to M-l. ( Roch. Rent All warehouse and fuel depot.). Having no one present that wished to be heard, President Selby closed the hearing. Strain -moved, McConnell second to approve the.change and instruct the City Attorney to prepare an ordinance for adoption. Ayes (6), Nays (0).Motion carried. B-2 A Hearing on the Proposed Assessment on Project 8306-88 J 9073 - San. Sewer and Watermain in Baihly Hills Drive S. W. Having no one present that wished to be heard, President Selby closed the hearing. McConnell moved, Strain second to adopt Resolution No. 1-90 acceptinc the assessments. Ayes (6), Nays (0).Motion carried. B-3 A Hearing on the Proposed Assessment on Project 8910-J 9108 - Reconstruct Residential Alleys in three locations - S.W., N. W. and N.E. Wishing to be heard was Frank Chybowski of 1220 West Center. He is opposed to this. His property does not even have access to the alley and his bushes were removed. He stated this this project has no benefit to his property. Having no one else present that wished to be heard, President Selby closed the hearing. Canfield moved, Strain second to adopt Resolution No. 2-90 accepting the assessments. Ayes (6), Nays (0). Motion carried. B-4 A Hearing on the Proposed Council initiated amendment to the Rocheste Zoning Code - Child Day Care Centers in M-1 and M-2 District. Wishinc to be heard was Elain Schmidt of 2518 18th Avenue N. W. and represent Children's Home Society. She urged the Council to approve this. She stated the need for this type of facility. -Aldermen discussed the fact that this zone might be O.K. in one part of town but if this was approved, a day care center might be located in an area that would be near hazardous things such as gas tanks, other types of chemical storage devices and traffic could be bad. Alderman Strain also mentioned that he would like to see a further set -back than 300 feet from any heavy or primary industrial uses. Alderman Solinger had specific questions such as drop off points for the children should their be a large volume of traffic. Jane Kansier, Planning Department stated that these questions would be addressed in the application for a conditional use request. Having no further discussion, Solinger moved, McConnell second to approve this with the following three conditions: 1. The day care center must be situated on the same lot as an operat- ing , functioning or working permitted land use in the district in which the center is located. 2. Any required outdoor open space must be situated on the same lot as the day care center. 3. Alderman Strain, again, stated his concern for the safety of the children - if this land use zone change was approved. He wondered if the day care centers would provide proper fences so the children would not be exposed to heavy industries and traffic and again emphasized that the distance be further than 300 feet from any sort of chemical storage facility and industries that carry a heavy traffi volume. Ayes (6), Nays (0).Motion carried. A Hearing on the Proposed assessments on Project No. 6107-88 J 8993 - Construction of San. Sewer, Watermain and Service Connectioi into Oak Hills and Kleist's Replat. Roger Plumb, Public Services Director presented the figures in the area and stated that the bids came in much less than originally estimated. He stated that the wells in the area are bad and when the Public Services Dept. had appraisals done in the area, these assessments were right in line with the property improvements. Mr. Fred Suhler, City Attorney explained the process of having appraisals done on properties that may end up in court. He stated that the City would have an appraiser and the People would have an appraisal done on each individual property that is taken in to court The court would decided what and or who is correct. This is a different method of calculating property than an assessor may use. Wishing to be heard was Dale Valentine of 2629 Oak Hills Dr. He stated that he would have liked to have the notice at some other time then just before Christmas. He stated that some of the people did not get the notices or have time to act on them. Fred Suhler City Attorney reminded the Council that 47 people received notices and 43 of them are opposed. He thinks that is a tremendous response. Wishing to be heard was Ron Halling , Right Away Agent for the City He stated that a couple of properties were appraised and they were correct in the price asked for in selling the property. Having no one else present that wished to be heard, President Selby closed the hearing. Alderman Canfield wondered how many wells are capped if there is a danger to the water supply. Roger Plumb, Public Services Director stated that they have a number of hook- ups to this project and a couple of wells have been capped. He has received complaints from people down the hill from the area in concern and they have noticed over -flow of sewage flowing thru their property. Having more questions, and wanting to give the people more time to discuss this, Canfield moved to table this. He received no second and the motion was not carried. Fred Suhler, City Attorney , again stated that 91.4% of the people in the area responded to the notice they received and he thinks that this is an over-whelming response and thinks they we were well informed. Alderman Solinger stated that the City is committed to providing better water and establishing good rates to the people for an improvement project. He stated that this came in well under the feasibility report and is in favor of this assessment. Based on that, Solinger moved, Strain second to adopt Resolution No. 3-90 accepting the assessments. Ayes (5), Nays (1). Alderman Canfiel voted nay. Motion carried. Having no one present that wished to be heard, President Selby close) the hearing. It is noted that the people in opposition listed in B-5 also opposed this assessment and they are on record as having done so. Hunziker moved, McConnell second to adopt Resolution No. 4-90 accepting the assessments. Ayes (6), Nays (0).Motion carried. B-7 A Hearing on the Previously Postoned Special Assessments from Project 8006 J 8729 - High Level S.W. Rochester Water Tower. Having no one else present that wished to be heard, President Selby closed the hearing. It• -is noted that the people in opposition listed in B-5 also opposed this assessment and they are on record as having done so. Strain moved, Solinger second to adopt Resolution No. 5-90 accepting the assessments. Ayes (6), Nays (0).Motion carries E-1 Strain moved, Canfield second to encumber $43,000. from the 1989 Contingency Account for the City Hall telephone system replacement project and authorizing the Administrator's Office to proceed with the implementation. Ayes (6), Nays (0).Motion carried. E-2 Strain moved; Hunziker�second to adopt Resolution No. 6-90 approving the increase in Towing Rate Charges for Police ordered tows. It is as follows: Impound Towing Fee $35.00; Extra Dolly Charge $20.00; Tire Change, Labor $20.00; First 24 Hours Storage $10.00. Each Add'l 24 hours of Storage $10.00. The City Attorney is also instructed to prepare an Ordinance for adoption. Ayes (6), Nays (0).Motion carried. E-3 Solinger moved, McConnell second to adopt Resolution No. 7-90 approving a purchase order with Badger Meter, Inc. for one year supple of water meters for the amount of $115,600.00. McConnell moved, Canfield second to approve the following Accounts Payable in the amount of $1,650,373.67 - list on file with the City Clerk. Ayes (6), Nays (0).Motion carried. Hunziker moved, McConnell second to adopt Resolution No.8-90 approving the Wages and Benefits for City Employees not covered by any Labor Agreement/ Meet and Confer Agreement. Ayes (6), Nays (0; Motion carried. McConnell moved, Hunziker second to adopt Resolution No. 9-90 approving the contract agreement for 1990-1991 with the Painters Local 681. This is a two year agreement and covers 4.25% in 1990 for wage increase and 4 % for 1991. Ayes (6), Nays (0).Motion carried. Strain moved,Canfield second to adopt Resolution No. 10-90 approving the contract for 1990-1991 with the IUOE-No. 49 Street and Alley. The year;. 1990 grants a 4.25% increase and year 1991 4% increase. Ayes (6), Nays (0).Motion carried. Canfield moved, Solinger second to adopt Resolution No. 11-90 approving a contract agreement 1990-1991 Engineering Technicians Assoc. This involves 1990 4.25% increase and 1991 4% increase. Ayes (6), Nays (0).Motion carried. Strain moved, McConnell scond to adopt Resolution No... 12-90 approv- ing the contract for 1990-1991 with AFSCME # 319. The year 1990 is 4.25% and 4.00% for 1991. Ayes (6), Nays (0).Motion carried. E-12 Hunziker moved, Canfield second to table the Metes and Bounds Conveyance of unplatted land -Rossi Property. More information was needed by the Council. An Ordinance Relating to.the Impounding of Vehicles; Providing for notification of owners of vehicles impounded and maximum fees to be charged; amending RCO Sec. 132.04.was given its first reading. An Ordinance Relating to a Public Utility Franchise- Repealing Ord. 2643 was given its first reading. An Ordinance Relating to Limousine Franchises; extending the terms of certain franchises already in existence; amending the RCO Sec's 97.17, 97.21 and 97.23 was given its first reading. Canfield moved, Solinger second to name this plaza "Peace Plaza" Alderman Canfield stated that this area is less then an acre and since we have the Peace Fountain, peace should be the main focus in the area. Solinger stated that he will vote for Peace Plaza because it does have the peace fountain and it is appropriate to name it that. McConnell stated that he really isn't in favor of the Peace Plaza name, but can't come up with a better name either. Hunziker stated that this name of Peace Plaza has been spoken of earlier and he thinks everyone in town is familiar with this name and he is in favor of naming it Peace Plaza.
