A-1 President Selby called the meeting to order at 7:30 P.M., the
following members being present: President Selby, Aldermen Canfield,
Hunziker, McConnell, Solinger. Absent: Adlermen Bluhm and Strain.
McConnell moved, Canfield second to approve the minutes of the August
20 and 30, 1990 meetings. Ayes (5), Nays (0).Motion carried.
President Selby announced to the members in the audience and the
Council that she would be deviating from the regular agenda items
and consider E-19 and 20 at this time.
President Selby asked Council for a motion to table the items
E-19 -General Development Plan for the Baihly Heights area and
E-20 Preliminary Plat of Baihly Heights Sixth Sub.
This was requested by the developer Rodney Younge.
Solinger moved, Canfield second to table the two items listed above.
Ayes (5), Nays (0).Motion carried.
The above items were taken out of order so that citizens in the
audience would not have to wait until later in the evening when thesE
items would be considered numerically.
B-1 A Hearing on the Deferred assessments on Project 7804-J 8631 -
Sani-tary Sewer Pumping Station and Force Main in Green Meadows area.
This is for Salem Sound 2nd and Salem Point PUD on 6.71 acres -
Having no one present that wished to be heard, President Selby close(
the hearing. Solinger moved, Hunziker second to adopt Resolution
No. 403-90 levying the assessments. Ayes (5), Nays (0).Motion
carried.

13=4 A Hearing on the Council Initiated Vacation on the platted alley
in Block 2 of the West Zumbro Addition. Having no one present that
wished to be heard, President Selby closed the hearing. Solinger
moved, Canfield second to adopt Resolution No. 406-90 approving the
vacation but retaining the easement in the alley for maintenance
of an existing cable line. Ayes (5), Nays (0).Motion carried.

B-5 A Hearing on the Street Right -of - Way vacation of a portion of the
old Hwy 52 ( Bandel Road N. W.). Having no one present that wished
to be heard,President Selby closed the hearing. McConnell moved,
Hunziker second to adopt Resolution No. 407-90 approving the vacatio

B-6 A Hearing on the Amendment to the Final Planned Development Plan for
Virgil's Auto Clinic. Wishing to be heard was Ron Bailey of Yaggy
Colby and represents the petitioner. He stated' that the conditions
are O.K. as stated by the Planning Commission and they are working
to complete them. Having no one else present that wished to be hear
President Selby closed the hearing. Canfield moved, McConnell secon
to adopt Resolution No. 408-90 approving the Amendment subject to th
following conditions:
1. All signage on the site be controlled according to the standards
of the B-lb Dist. This is,in the commercial dist. est. along 2nd St.S
2. A.complete timetable for the project be provided. The order in
which improvements will be made is important. T-he rebuilding of the
to lst St. S. W. should be done before the alley to llth Ave. S. W.
is closed due to the construction of the new addition.
3. Full scale floor plans be prov.ided.
4. Identify on the plan where the company tow trucks/emergency
vehicles will be parked. These vehicles are taller than usual autos
and should have better screening around them or be parked in the
least visible spaces.
5. A detailed plan sheet showing the design and dimensions of the
screening fence be provided. To screen -._autos the fence should
be at least 4 ft in height and provide a solid appearance.
6. Provide some type of safety rail or fence along the
existing east side of the parking lot adjacent to the overflow
parking area where there is a retaining wall. Cars presently are
parked up to this retaining wall and the cars hang over the public
sidewalk on llth Avenue.
7. Demolition of the homes should include the coincidental removal
of-,thesteps to the homes from the sidewalk along lst St.S. W.
8. The plans should clearly show'the landscaped area - what is black
and what is grass. The frontage alg 1st St. S. W. should, in
addition to the fence, be landscaped with canopy trees, bushes or
shrubs. The landscaping should be done at a rate suggested by the
proposed Land Development Manual for scree-ni,ng 'of accessory
parking lots in residential districts. The plantings should include
at least 4.5 canopy trees, 9 understory plantings and 13.5 shrubs
per 100 feet of frontage of lst St. S. W.
9. A boulevard with plantings should be provided along llth Ave. S.
W. from lst St. S. W. across the frontage of the parking lot to
the retaining wall. The only screening provided on the plan is the
present treated timber planter which provides no visual relief.
10. The driveway approach at the present alley entrance onto llth
Avenue should be removed by the owner if the alley is vacated.
11. The parking lot spaces should be striped.

12. The applicant should be prepared to adequately show that there
will be enough room to account for turning radius for large trucks.
This information should be available at the time of the public

B-7 A Hearing on the Petition to vacate the alley next to Virgil's Auto
Clinic at 1101 2nd St. S.W. Wishing to be heard was Ron Bailey of
Yaggy Colby and stated that they were in favor of the three -con-
ditions that was attached by the Planning and Zoning Commission.
Having no one else present that wished to be heard, President Selby
closed the hearing. Canfield moved, Solinger second to adopt
Resolution No. 409-90 approving the vacation subject to the followini
conditions:
1. A complete legal desc. of the alley be provided. No more of an
alley ROW than,is needed for the construction of the building addn:
should be vacated. The dimension of 140 Ft. used in the petition
vacates more than needed and also as graphically represented on the
PUD plans. The more that is vacated, the less alley frontage
the property just west of Virgil's will have. The property
to the west should have as much frontage as possible unless they,,
want to provide something in writing saying they prefer some
specific amount.
2. The petitioner provide to the City an easement for the new alley
to 1st St. S. W. as shown on the amended PUD plans. This alley shoul
be built to 1st St. S. W. before the alley to llth Avenue S. W. is
closed due to construction.
3. The applicant provide signed construction agreements with RPU,
US West and People's Natural Gas for any required impts. or
easements necessary because of :this vacation.

B-8 A Hearing on the Reconstruction of,the Residential Alley.in the
Block bounded by 13th Avenue S. W., 16th Avenue S. W., West Center
Street and 1st St. S.W. Wishing to be heard was Kevin Duerson of*
1418 West Center Street. He wanted a definition of what reconstructi
meant. Roger Plumb, Public Services Dir. gave him that definition.
Mr. Duerson stated that he, as well as some of his neighbors are
still opposed to this alley and does not want blacktop at all.
He would like to see it graded with gravel or crushed rock and
the "pooling" situation taken care of.
President Selby reminded the people.,that it would take 6/7 vote of
the Council in order to adopt this --reconstruction. Since only 5 are
present, this would have to be tabled until at least 6 are present.
Wishing to be heard was Dawn Daehn of 1414 West Center Street. She
just moved in a couple of weeks ago and is not in favor of the
mess that is created by the alley.She would like to see the "lake"
taken care of no matter how it is done, but she, too, would rather
not see the alley be made of asphalt.Ms. Daehn also represents
"Marlene" who owns the other half of the lake in the alley. She
just wants this situation taken care of.
Wishing to be heard was Irene Lilyeander of 1411 1st St. S. W.
and is in favor of this being reconstructed, "ths is a mess".
Roger Plumb, Public Services Dir. also stated again that he would
recommend reconstruction for this alley in lieu of anything else.
Wishing to be heard was Diana Dixon and she stated that she had
19 signatures on a petition in favor of this reconstruction and
now she obtained 3 more. 18 of these are homeowners in the area and
4 are renters. She stated that the opposition does not have.

McConnell second to table this hearing until they have a represent-
ation of 6 members or more of the Council present as it takes 6/7

B-9 A Hearing on the Proposed Agricultural District Boundary. Wishing t
be heard was Kevin Truax of Route No. 2 Box 149 Roch.Mn. He wanted
to have the zoning explained to him. He owns acres in the area.
Terry Spaeth of the Planning Dept. explained the zoning procedure
to him. Wishing to be heard was Jo Russell of 5900 llth Avenue
S.W. and urged the Council to zone this agricultural so that they
will be conforming to the'code now that they were annexed into the
City.
Having no one else present that wished to be heard,President Selby
closed the hearing. A letter was received urging the Council to
adopt the "Agricultural zone" from DeWayne Mattson 5700 llth Ave.
S.W. Terry Spaeth also mentioned that he received a phone call from
Mike Braun who owns a 10 acre piece of land to the north of this
zone and he would like to have this remain R-1 as he wants to sell
lots for development. Solinger moved, McConnell second to approve
this proposal minus the 10 acres as requested by Mr. Braun and
instruct the City Attorney to prepare an Ordinance for adoption.

B-10 A Hearing on the Proposed\ariance by Jeff Loge on the Aldrich
Nursery Property. Wishing to be heard was Terry Richardson of
1325 2nd Avenue N. W. and is concerned about the traffic in the
area should this property be used for anything that might create
traffic. Such uses as halfway houses would generate more traffic.
He is opposed. Wishing to be heard was Jeff Loge of Route
1 Frost Mn. and is the applicant. He operates halfway houses in
Mankato and stated that these establishments are run with strict
rules and would - cause a problem in the neighborhood. It is a
permitted use and they need the variance for access and make this
flood free. President Selby questioned Mr. Loge - " Is there any
reason why this is in a single family neighborhood"? Mr. Loge stated
that the Aldrich Nursery is being vacated and this is a perfect
place for a halfway house. Wishing to be heard was Ann Gastenau
is 9 Skyline Lane S. W. and urged the Council to approve this.
Aldrich moved and they would like to see this halfway house in
the building. It is not totally in a single family area. It is
bordered by the Silver Lake Motel and other businesses nearby.
W'shing to be heard was Paul Frank of 1314 2nd Avenue N. W. and
is not in favor of this change. Fast traffic for pre-schoolers in
the area is not a good situation. Wishing to be heard was Ken Wohl
of 1321 2nd Avenue N. W. and is also opposed. He said the traffic
from the nursery school was not bad as they came and went on certain
times each day, this halfway house would create traffic all the time.
Wishing to be heard was Ed Pompein of 952 Skyline Dr. S.W. He stated
that the concerns about approval from FEMA was no problem. They
allowed the DNR to make recommendations and the DNR have no problem
with this change. Wishing to be heard was Clayton Lund of 1335 2nd
Avenue N. W. and is opposed.

was past President of Aldrich Nursery. She urged the Council to
approve this. Having no one else present that wished to be heard,
President Selby closed the hearing. After lengthy Council discussio
McConnell moved, Hunziker second to table this until a response
has been received from FEMA directly that they will not care if
access is given in this area. Alderman Hunziker stated that he would
feel much better about this situation if that approval is received
in writing. Ayes (4), Nays (1).Motion carried. Alderman Solinger vo
Hunziker moved, McConnell second that the Council initiate a letter
to FEMA. Ayes (5), Nays (0).Motion carried. For the record, Alderma
Solinger stated that he was comfortable with what had been said
about FEMA giving DNR the authority to approve this change.
A Hearing on the Planned Unit Dev. Final Plan Stage on Essex
Estates. Wishing to be heard was Frank Kottschade Dev., and
introduced Bill Tointon of McGhie and Betts Eng. " was present
for any questions the Council may have. Having no one else present
that wished to be heard, President Selby closed the hearing.
After Council discussion, it was noted that the development agreemen
had not been completed. Having no further discussion, Hunziker
moved, McConnell second to table this until September 10, 1990
at 4:30 P.M. Ayes (5), Nays (0).Motion carried.
A Hearing on the Final Plat of Essex Estates. Wishing to be heard
was Frank Kottschade , Dev. and was present for any questions.
Having no one else present that wished to be heard, President Selby
closed the hearing. Hunziker moved, McConnell second to table this
until 4:30 P.M. on Sept. 10, 1990. Ayes (5), Nays (0).Motion carri
Wishing to be heard was Nick Tretinyak, Jr. and spoke on the
non -partisan volunteer group opposing the extension of the 1% sales
tax. His group is opposed to the use of City funds to pay former
City employees fpr public persuasion. He stated that the City should
be able to build the buildings that we need without sales tax, then
something is wrong. He presented a letter to the City Attorney
is opposition but wanted to have a legal opinion as to the use of
public money - he referred this same letter to the Attorney General
of Mn. and the Mn. Auditor. He stated that he would be back every
two weeks to state the groups opposition.
Solinger moved, Hunziker second to adopt Resolution No. 410-90
referring the petition for Sewer and Water for Lots 13 and 14
Christenson-Sehl Sub. to the Public Services Dept. This was received
from Tom and Leslie Hall and Dennis and Karen Rickert of Riverview
Heights N. E. Ayes (5), Nays (0).Motion carried.
Solinger moved, Hunziker second to approve the membership in Greate
Mn. Cities Economic Dev.-. Assoc for $1,000. Ayes (5), Nays (0).

suppporting the purchase of recycled and recyclable materials where
the cost, performance and availability meet.acceptable standards of

Canfield moved, Solinger second to approve the change order No. 1
for Nietz Electric Inc. AIP 3-27-0084-02 Mn/DOT SP 5501-66 J 6901
for the Rochester Airport in the amount of $47,976.00. This amount
is due to some safety standards that the FAA set forth.Ayes (5),
Nays (0). Motion carried.
Solinger moved, Hunziker second to adopt Resoltuion No. 412-90
approving a purchase order agreement with Dis-Tran Products, Inc.
for support structures in the amount of $41,056.17. This was approved
by the Rochester Public Utility Board. Ayes (5), Nays (0).Motion
carried.
Canfield moved, McConnell second to adopt a Resolution No. 413-90
setting a hearing on the new assessment for properties in Toogood
Plaza, Hilmer's Highview Acres and Golden Hill Addition - Projects
8729 and 8752. The names of the affected properties are listed on
the Resolution. The date of hearing is October 15, 1990. Ayes (5),
Nays (0).Motion carried.
Hunziker moved, McConnell second to adopt Resolution No. 414-90
authorizing the initiation of legal proceedings against William
D. Bowman relative to the partially demolished Home -violation of
Rochester Code of Ord. 35.02 . Ayes (5), Nays (0).Motion carried.
Solinger moved, Hunziker second to approve the following licenses
and bonds:
Request for a 3.2 malt -liquor license_J rom Rochester Barbershop
Chorus for October 13, 1990. This will be held at St. Pius Church.

authorizing the Civilian Evidence Coordinator position in the Police

approving the Metes and Bounds Conveyance of unplatted land -

St. S. W. This is with the condition that a drainage swale on the
