President Selby called the meeting to order
following members being present: President
Canfield, Hunziker, McConnell, Solinger and

Strain. Absent: None.
A Hearing on the Home Rule Charter Amendment Proposed by the Charter
Commission regarding Board and Commission Members. Wishing to be
heard was Amy Caucutt, Chairperson of the'Charter_Commission. She
lives at 716 28th St. N. W. Ms. Caucutt stated that the Charter
Commission recommended the a "cap" be added to the charter regarding
terms of Board and Commission members. The question as recommended
by the Charter Commission would be as follows:
"Shall the Home Rule Charter of the City of Rochester be
amended to provide that no appointed city board or
commission member may serve on the same board or commission
for longer than six consecutive years or two consecutive
terms, whichever period of time is longer and to require.
such members to attend at least 80% of the regular meetings
each year?
She stated that they received support of placing this question on the
official ballot November 6, 1990 from the League of Women Voters
and the Futurescan 2000. Ms. Caucutt stated that this is not a
condemnation of the current members of boards and commissions.They
just feel that this would allow other citizens to become involved
and educated in various functions of the City operation. Wishing
to be heard was Jane Callahan of 3400 Chalet View Lane N. W.
She stated that a survey was taken and 58 cities responded to their
question - How many cities have a cap on the terms of boards and
commissions? 27 cities have a cap and 31 operate like Rochester.
In regard to the 80% attendance requirement. She stated that the
Chairman has the right to excuse an absence. She urged the Council
to approve the question. Mayor Hazama stated that the method of
selection members of boards and commissions have been successful in
the past. He has 475 volunteers and when we find people that are
interested in serving and know the functions of the committees, we
would like to be able to keep them active for as long as they wish
to serve. The Mayor would like to see the term be set at least
to 12 years. After Council discussion it was the consensus that
they would like to see the term extended to 12 years instead of
six as recommended by the Charter Commission. Ms. Caucutt stated
that the last time the Charter Commission met it was pretty much
unanimous that they would keep the number to six. The Council
suggested that this question could be tabled and taken back to the
Charter Commission and maybe put on the ballot in the spring, 1991.
Discusion was held on the change of wording of the question and
Doug Gregor, City Attorney asked for a few minutes to get the
official law. Solinger moved, Hunziker second to table this.

E-2 Hunziker moved, Canfield second to approve the appointment of
Phil Wheeler to the position of Consolidated Planning Director.
Ayes (7), Nays (0).Motion carried.
E-3 Bluhm moved, McConnell second to adopt Resolution No. 455-90 authoriz
ing the Mayor and City Clerk to execute the Change Order No. 4
accepting the roofing warranty tendered by the Contractor for
construction of the Chemical Feed and Storage Building addition to th,
Water Reclamation Plant. The amount of deduct is $35,000.00 payable
to the City. Ayes (7), Nays (0).Motion carried.
E-4 Solinger moved, Hunziker second to approve the request by the
SouthEastern Minnesota Center for Independent Living Amended Dev.
Contract. The change involved the City_subordinat tng certain'
financial interests in .the project; to HUD, who is th` pririiary.:lender:

E-5 McC0nne 1' moved, unziker second to adopt Resolution No. 456-90
awarding the low bid of H & H Electric Co. for $49,988.00 -City
Project 9054 "Modify Traffic Signal at llth Ave. and 14th St. N. W.
Ayes (7), Nays (0).Motion carried.
E-1 Discussion was held on the awarding of a bid for the Recreation
Center Roofing project. Dick Stanley, apparent low bidder from
Merit Contracting was present and stated that his company had to
comp.ete with a company that wrote the bids specifications. He did
not think this was fair competition. Mr. Hollman of Hickman Company
who furnished the roof for Merit stated that their bid is competitive
to the roof (Tremco) as would be used in the bid furnished by
Schwikert. Mr. Hollman stated that this roof has been tested and
would match Tremco quality, etc. The City had an engineer - TSP
test the different quality and they recommended Schwikert with a
Tremco roof to be the best roof. Mr. Hollman stated that they did
not conduct a fair test. After Council discussion, Bluhm moved,
Strain second to table this until October 1, 1990 in order for Mr.
Hollman ( Merit ) to contact TSP Eng. Firm and do a proper comparison
Ayes (7), Nays (0).Motion carried.

G-1 Solinger moved, Bluhm second to remove the Hearing on the Charter
amendment regarding the Board and Commission question from the table.
Ayes (7), Nays (0).Motion carried.
Mr. Gregor explain the legal methods of adopting the question or
holding it over until the spring election. It was noted that the
Council could adopt the proposal with a simple majority vote.
Mr. Gregor also quoted the Mn,. Statute regarding various other
methods of either adopting the question or sending it back to the
Charter Commission for further consideration and when, if that happen
it could be placed on the ballot if the Council and Charter Commissio
could not agree on language.
Hunziker moved, McConnell second to adopt an Ordinance amending
the Home Rule Charter adding the terms of Boards and Commissions to
six years and 80% attendance by all members of said committees.

Upon Roll call vote, Aldermen Hunziker,McConnell and President Selby
voted aye. Ayes (3), Aldermen Bluhm, Canfield, Solinger and Strain
voted nay. Nays (4). Motion did not carry. Canfield moved, Bluhm
second to instruct the City Attorney to prepare an Ordinance
approving the 80% attendance at all meetings of the boards and
commissions as approved by the Charter Commission. Ayes (7), Nays (0
Motion carried.
Canfield moved, Solinger second to instruct the City Attorney to prep
an Ordinance limiting the terms of the members of Boards and Commissi
to 12 consecutive years or two terms. This is changed from the
Charter Recommended 6 years. Upon Roll call vote, Aldermen Bluhm,
Canfield, Solinger and Strain voted aye. Ayes (4), Aldermen Hunziker
McConnell and President Selby voted nay. Nays (3). Motion carried.
Canfield moved, Strain second to place the following question on the
ballot to be voted on by the voters of Rochester November 6, 1990.
" Shall the Home Rule Charter of the City of Rochester be
amended to provide that unless otherwise permitted under state
law no apointed city board or commission member may serve
longer than six consecutive years or two consecutive terms,
whichever period of time is longer? "
Resolution No.4.56A-90 and 457-90 was adopted.
Ayes (7), Nays (0).Motion carried.
Note: The 80% attendance part of the question was removed because
the Common Council approved an ordinance making this a law.
Because the unanimous vote of the council did not occur on the
first part of the question based on Charter Commission recommendation
that will have to go before the voters for approval or denial.
Having no further business, Strain moved, Solinger second to adjourn
the meeting. Ayes (7), Nays (0).Motion carried.
