President Selby called the meeting to order at 2:00 P.M., the
following members being present: President Selby, Aldermen Bluhm,
Canfield, Hunziker, McConnell, Solinger and Strain. Absent: None.
Canfield moved, Bluhm second to approve the minutes -of the March
18, 1991 meeting. Ayes (7), Nays (0).Motion carried.
Deb Foley of the Corps of Engineers and Dave Pillatzke of the engin-
eering firm of Elliott Hendrickson, Inc. of St. Paul and Jeff
Johnson, Civil Engineer presented the City of Rochester with the
Engineering Award for the Silver Lake Dam Rehabilitation. This
award is the highest award "Grand Award" and accepting this on behal
of the City was Darrell Strain and Peter Solinger. Both Aldermen
stated their appreciation for this award and thanked the Corps of
Engineers especially Deb Foley for the cooperation and excellent
reports that was given to the City during this project. They hope
that this award can win in the National Competition.
Request to Reconsider the action taken at the March 18, 1991
meeting regarding the approval of the Sewer Usage Fees was brought,
before the Council. McConnell moved, Bluhm second to reconsider the
action. Upon Roll call vote, Aldermen Bluhm, McConnell, Solinger
and.Strain voted aye . Ayes (4), Aldermen Canfield, Hunziker and
President Selby voted nay. Nays (3). Motion carried.
Bluhm moved, Strain second to approve recommendation No. 5 - which
allows for no connection fee to be charged and a 20% subsidy.
Alderman Strain stated that his support for this motion was because
last meeting they did not get a good vote - he was not happy with
the alternate and stated that new home buyers should not have to pay
for the system. Alderman Solinger stated that he supported "0"
subsidy. He doesn't want to add this charge to new homebuyers and
he does not believe this will jeopardize our triple A bond rating.
The reason for that is because it was one of the alternatives as
given by the consultant.
Alderman Hunziker stated that the industries should have to pay for
some of the charges. He stated that they should have an incentive
to work toward better control of their waste products, this way
they are not given much encouragement from the City. He prefers no
subsidy.
Alderman Canfield stated that he thinks the rate charge is fair
as a new plant will have to be built and they will be using
it ( new homebuyers ) and they should pay for it. He quoted from
Paul Utesch's letter - figures that to him, made sense in the
financing of this future project.
Steve Kvenvold, City Adm. stated that he favors the rate increase
as well as the subsidy and he urged the Council to accept his
recommendation.
After further Council and Staff discussions, Roll call vote was
taken, Aldermen Bluhm, McConnell, Solinger, Strain voted aye.
Ayes (4), Aldermen Canfield, Hunziker and President Selby voted nay.
Nays (3). Motion carried.

approving the membership in Flood Control Organizations such as
National Watershed Coalition and NAFSMA. The total dues is $500.00.

supporting the Minnesota Right to Housing Campaign. Ayes (6), Nays

Strain moved, Solinger second to adopt the following Resolutions
as approved by the Rochester Public Utility Board:
Resolution No. 134-91 approving a purchase order agreement with C.
Reiss Coal Company for a fuel supply at $27.90 per ton-$600,000.
Resolution No. 135-91 approving a purchase order with Sahara Coal Co.
for coal at $35.66 per ton at a total of $400,000.00.
Resolution 136-91 approving a purchase -order with River Trading Co.
for coal at $42.70 per ton for a total of $250,000.00
Resolution No. 137-91 approving a cooperative agreement between
City of Rochester and Olmsted Co. for abandoned well sealing.

Intoxicating .On -Sale and Off -Sale 3.2 Beer licenses for the East
Side Inn from Herman R. Smude to Herman Jerome Smude. This is

as listed at the end of the minutes - this is for renewal and

Strain moved, Bluhm second to adopt Resolution No. 138-91-and 138A-
91 rescinding the awarding of the contract for two 36,000 GVW dump
trucks to Dave Syverson Truck Center and rebidding the trucks to
be opened at 11:00 A.M. on April 21, 1991. Ayes (7), Nays (0). Motion
carried.

authorizing the City Clerk to advertise for bids on a (1) 6,000
gallon tank trailer for the Water Reclamation Plant. Bids will be
opened at 11:00 A.M. on April 25, 1991. Ayes (7), Nays (0). Motion
carried.
Strain moved, Bluhm second to adopt Resolution No. 140-91 authorizi
the City Clerk to advertise for bids on a high speed copier/
duplicator. Bids to be opened at 11:00 A.M. on April 25, 1991.

Strain moved, Bluhm second to adopt Resolution No. 141-91 setting
a hearing date for May 6, 1991 on a vacation of Lot 1, Blk 2, No.
Slopes - ( this is for a 5 foot wide utility easement.) Ayes (7),
Nays (0).Motion carried.
Solinger moved, Canfield second to deny the request for a vacation
of a 10 foot wide utility easement on the N. Side of Lot 2, Blk 5,
Villa Meadows Sub. Ayes (7), Nays (0).Motion carried.
Denial was based on the need for the easements as stated by City
Departments.
After Council discussion,•.Terry Adkins, City Attorney stated that
this request was only to set a hearing and he would advise that
this be approved and take public input at that time. Strain moved,
Bluhm second to reconsider the motion. Upon Roll Call vote,
Aldermen Bluhm, Hunziker, McConnell, Solinger and Strain voted aye.
Ayes (5), Alderman Canfield and President Selby voted nay. Nays (2).
Motion to reconsider approved. Strain moved, Solinger second to
adopt Resolution No. 142-91 setting a hearing on the above for
May 6, 1991. Ayes (6), Nays (1). Alderman Canfield voted nay. Motion
carried.
Strain moved, Solinger second to adopt Resolution No. 143-91
approving the Variance 91-1 Conway-Dashow Sub.Glendale Sub.
This allows a final plat to be heard after the expiration of a one
year approval period for the preliminary plat. Ayes (7), Nays (0).
Motion carried.
Strain moved, Solinger second to instruct the City Attorney to
prepare an Ordinance annexing 58.3 acres of vacant land located
on the norhtwest side of Salem Road S. W. across from Barclay Sq.
and Nly of Baihly Hills Dr. S. W. Ron --Bailey of Yaggy Colby, Assoc.
was present and requested that if Council desired , a second reading
of this Ordinance would be appreciated. Ayes (7), Nays (0).Motion
carried.
Solinger moved, McConnell second to adopt Resolution No. 144-91
authorizing the City Clerk to advertise for bids on CBD Signal
System - Phase III - new traffic controllers and interconnect for
8 CDB Intersections all west of 2nd Ave. Ayes (7), Nays (0).Motion

An Ordinance Annexing to th City of Rochester 53.8 acres of land in
Conway-Dashow / Glendale Sub. was given its first reading. Strain
moved, Bluhm second to give this ordinance a second reading(Suspend R1
Upon Roll call vote, Aldermen Bluhm, Canfield, Hunziker,
McConnell, Solinger , Strain and President Selby voted aye. Ayes (7),
Nays (0).Motion carried. The Ordinance was read a second time. Straii
moved, Bluhm second to adopt the Ordinance as read. Ayes (7), Nays (0
Motion carried.
The Ordinance approving the Limousine. Franchise for John O'Bryan was
considered for a second reading. Strain moved, Hunziker second to
suspend the rules and give this a second reading. Upon Roll Call vote
Aldermen Bluhm, Canfield, and McConnell and Hunziker voted,aye. Ayes
Aldermen Solinger, Strain and President Selby voted nay. Nays (3).
Having one nay among the Council, the Ordinance is automatically
held over until the official second reading. Motion not carried.
Bluhm moved-, Canfield second to adopt Resolution No. 156-91
approving an Owner Contract for Basic Construction in Essex
Estates, Schedule A-1 to serve Lots l.thru 10 Blk 1,. Lots
1 thru 13, Blk 2 and Lots 1 thru 19, Blk 3 Essex Estates;.N.A. Realty
Inc. and Road Constructors, Inc. Ayes (7), Nays (0).Motion carried.
Bluhm moved, Solinger second to remove the Petition to vacate
90-21 by Weber an'd"Barlow Stores to vacate the westerly end of 6th St.
N. W. located in the 5th St. N. W. ROW just easterly of the
Barlow's entrance from the table. Ayes (7), Nays (0).Motion
carried.
Wishing to be heard was Steve Barlow. He urged the City to begin
the acquisition on an area of land which abuts the 5th St. ROW
and serves as the westerly entrance to Barlow's , Roch. Fertilizer
NAPA and the other businesses to the west of NAPA. and to proceed
with the vacation of the portion of the 5th St. ROW adjacent to
the entrance area. Roger Plumb, Public Services Dir. stated that
he had concerns on the triangle piece of land and if this could be
considered a street, since it has been used as a street for years -
Mr. Plumb would like to get a clarification on this before he could
approve this action. Gary Neumann, Assist. City Adm.. also added
that if'the City was to administer the acquisition, Barlows would pay
all costs. He also recommended the following occur at this time.
1. Authorize staff to begin proceedings for acquisition 2. Authorizinc
the appraisal of the property and submit an offer to acquire the
property from the affected owners. 3. If condition 1 and 2 are not
possible, then proceed with condemnation. Mr. Neumann stated that
a written agreement will be received and the conditions will be
spelled out and who will be paid what will be known. Canfield
moved, Strain second to authorize staff to go ahead with the
acquisition ( written agreement will be secured stating that Barlows
will pay all costs ) Ayes (7), Nays (0).Motion carried.

A-1 President Selby called the meeting to order at 7:30 P.M. the follow-

B-1 A Hearing on the Community Development Block Grant - Re -programming
of Fund Balance. Having no one present that wished to be heard,
President Selby closed the hearing. Bluhm moved, Canfield second
to adopt Resolution No. 157-91 approving the re -programming funds.
Ayes (7), Nays (0).Motion carried.
B-2 A Hearing on the 1991 Community Dev. Block Grant Program - HUD
award of $442,000.00 and approving the revised CDBG appropriations
for 1991. This is $39,000. more then originally programmed.
This would allow for the additional $39,000 to be placed in Conting-
ency Account. Ayes (7), Nays (0).Motion carried. Res.158-91 was app
B-3 A Hearing on the Proposed Project 9101- J 9176 - San. Sewer Trunklini
East of the East ROW of W Circle Dr. from the inplace Co. Club
Manor Tkln at 3rd St. N. W. to the South side of 2nd St. S.W. to
serve the Rochester Golf and Country Club and Others. Wishing to
be heard was Steve Schuler of 2312 Lenwood Dr. S.W. and is in
favor of this project. He would like to see the project deferred
(Postponed).to 'the property that is not developed. After Council
Discussion, Mr. Roger Plumb, Public Services Dir. stated that in
come cases the assessments have been deferred (postponed) for five
years or until developed, whichever comes first. Stevan Kvenvold,
City Adm. stated that if this was done, then he would prefer this
only be delayed until two years. Having no one else present wished
to be heard, President Selby closed the hearing Hunziker moved,
McConnell second to adopt Resolution No.159-91 approving the projec

request for the Postponed assessments at this time.
B-4 A Hearing on the Proposed Assessment on Sidewalk Replacement_ Project
No. 1-1989 J 9095 - Having no one present that wished to be heard,
President Selby closed the hearing. Bluhm moved, Hunziker second
to adopt Resolution No. 160-91 accepting the assessments. Ayes
(7), Nays (0).Motion carried.
B-5 A Hearing on the Final Plat of Diamond Ridge Three. Wishing to be
heard was Joan DeWitz of 3316 Lake St. N. W. and urged the Council
to approve this. Having no one else present that wished to be heard
President Selby closed the hearing. Solinger moved, Strain second
to adopt Resolution No. 161 -91 approving the plat subject to the
following conditions:
1. 8th St. Lane N. W. east of 44th Ave. should be named rather
than numbered unless it can be shown that it will align with
8th St. N. W. to the west of 44th Avenue N. W.
2. A unit mailbox be placed in front of Lot 12, Blk 2, providing
mail service to Lots 12-32.

3. The applicant provide a cash dedication of $6,970. to meet
parkland dedication ordinance requirements.
4. The easement in steep terrain as indicated between Lots 22-23
Blk 2 should be 30 feet wide.
5. Sidewalk be constructed along the north side of 7th St. N. W.
6. Dev. must provide a description of the residual lands,
owned by the applicant but not included in this plat.

A Hearing on the Final Plat of Kid's Come 1st Sub. Wishing to be
heard was Jeff Brown of 1310 Folwell Dr. S. W. and is.one of the
owners of the property. He urged the Council to approve this,and
is present for any questions the Council may have. Having no one
else present that wished to be heard, President Selby closed the
hearing. Canfield moved, Bluhm second to adopt Resolution No.
162-91 approving the plat subject to the four conditions.
1. Access control be platted along a small portion of the north line
of Lot 1,Blk 1 of.this plat abutting No . Hills Dr. N. E. The portion
of the north line of said lot where access control should be
dedicated is that part lying within the west line of current
driveway to TH 63 ( No. Broadway ). This should bring access control
up to the western edge of the existing private driveway onto No.
Hills Dr.
2. A private roadway easement wide enough to encompass all the
area presently used for the existing private frontage rd. across the
west side of the property be recorded prior to this final plat being
recorded. This recorded easement should then be shown on this
final plat as an easement of record. This easement will insure
that L 2,13 1 of this plat has access to the public road system:
Without such easement L 2,131 would have no legal access to a public
road. Such an easement was also a condition of approval on the
conditional use permit for the proposed office building on L 1
B 1 of this plat.
3. The applicant provide.a written confirmation from the Dept. of
Transportation that this plat can be recorded. Since this plat
abuts a state highway ROW state law restricts the Co. Recorder
from accepting a plat for recording without evidence that MN
DOT has had an opportunity to review it.
4. Any easements necessary for public sewer mains to serve the
lots in this plat be provided. The Public Services Dept. was going
to investigate this.

A Hearing on the Amendments .to the Rochester Zoning Code regarding
the Flood Plain Provisions. Having no one present that wished to
be heard, President Selby closed the hearing. Bluhm moved,
Solinger second to instruct the City Attorney to prepare an Ordina
for the text changes that can be adopted. Ayes (7), Nays (0).

B-8 A Hearing on the Property located at 1017 and 1027 West Center St.
in the City of Rochester. The City Attorney conducted this
public hearing and administered an Oath of Office to each person
that was called on to be heard.
The first person to be asked to testify was Bob Hague,_ Building
Inspector for the City of Rochester -2122 Campus Drive S. E.
Mr. Hague, upon being administered the Oath stated that 1017 West
Center Street fell under Roch. Code of Ordinances 37.01 and lacked
all the requirements of this section. It has been vandalized,
objects are in the yards, porch is torn off, debris laying in the
back yard and is in poor condition.
The property at 1027 West Center Street has the stucco falling off,
the roof leak-s_, windows are broken and the frames are in poor
condition. Both structures have been vacated since Dec. 1988.
Wishing to be heard was Catherine Aldrich of 19 llth Avenue N. W.
She brought pictures of the dilapidated structures and stated that
it is unsafe for the kids in the area. There is also bugs that have
congregated in the houses and lots of lumber with nails sticking
out. They want these houses out of the neighborhood.
Wishing to be heard was Mike Podulke of 1 llth Ave. N. W. and he
lives across the road from these homes. He stated that they have
been bought and sold a few times with the new owners having -a
"dream" of fixing these up but it is much to expensive and it never
gets done. He stated a permanent solution has to be found. In his
mind they are not fixable.
Alderman Canfield stated that in his years of observing these homes
he has never seen them in worse:condition as now. Alderman Strain
questioned Mr. Podulke if the County was helping rent these
structures with low income housing, etc. Mr. Podulke stated that
Social Services was helping the person with rent, but not these
particular two structures. Wishing to be heard was Bob Reynolds
of 2600 Westridge Lane and.is involved with the two houses in
question. He stated that this area is in a mess and they did
have high expectations when they bought this land. One of his
partners is in bankruptcy now and he simply can't afford to fix
up the property. He maintains that this is fixable, but that
he can't:do it himself. If the Council was to grant him a little
more time, he will be able to tell the results from his partners
bankruptcy and this may be cleaned up.
Mr. Reynol_dsalso* stated that because this was not rented since
Dec. 1988, the old City Ordinance code lapsed and a new Ordinance
took effect. The old Ord. allowed 10 apts. in this dwelling and the
new one only allows three. Alderman Solinger asked when this was
purchased. Mr. Reynolds stated November, 1989. Alderman Solinger
asked if Mr. Reynolds was aware_ of the use at that time. He stated
that he was not aware that this would ever change from 10 to 3 units
Alderman Solinger asked Mr. Reynolds if he was a realtor and Mr.
Reynolds stated that he is.
After Council discussion, Alderman Hunziker questioned Mr. Reynolds
if someone was going to fix this up if they were given another
chance. Mr. Reynolds stated that he did not know, his partner was
involved in this bankruptcy and he could not afford to put any more
money in these homes.

Ron Livingston, Planning Dept. 2122 Campus Dr. S. W. was present
and wished to be heard, He will respond to any questions the Council
may have. Alderman Bluhm asked when the applicant applied for the
use permit and did this give him a year'to complete repairs. Mr.
Livingston stated that he was not aware of Mr. Reynolds coming to
the Planning Dept. on a clarification of the use in the area. If a
place is vacant for 365 days, then it is a non -conforming use and
subject to the new laws.After Council questioned Mr. Livingston
Mr. Hague stated that this was originally -used as a hospice for
St Mary's and later turned into apartments.
Mike Podulke stated that this really is a three plex used as a 10
plex. Catherine Aldrich stated that traffic is bad also, there are
.too many cars around the place.
Having no more public testimony, 'the public hearing was closed.

execute an agreement with the Dept. of Natural Resources
to construct the fishing pier for a cost of $2,500 to $3,000.

Rochester establishing Flood Plain provisions_was given its first
