RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL
CITY OF ROCHESTER, MINNESOTA
Adjourned Meeting No. 30 - April 22, 1991
A-1 President Selby called the meeting to order at 4:30 P.M., the
following members being present: President Selby, Aldermen Bluhm,
Canfield, Hunziker, McConnell, Solinger and Strain. Absent: None.
e meeting was called to order in Room 4 of City Hall.
E-1 Solinger moved, Strain second to adopt Resolution No. 196-91 initiatin
eminent domain proceedings to acquire the entire Doris Toogood
property adjacent to 16th St. S. W. in order to facilitate construct-
ion of Stage 2B of the Flood Control Project. Ayes (7), Nays (0).
Motion carried.
E-2 Hunziker moved, McConnell second to adopt Resolution No. 197-91
that the Common Council's favorable consideration is in agreement
with the Mn. Attorney General resolving a dispute concerning the
alleged violation of Mn. Stat. Chapter 216E with RPU paying the
damages. This was approved by the Rochester Public Utility Board.
Ayes (7), Nays (0).Motion carried.
E-3 Hunziker moved, Canfield second to adopt Resolution No. 198-91
instructing the City Attorney to draft an Ordinance amending Chapter
63 of the Rochester Code of Ordinances to add a new section 63.511
regulating the Use of Outdoor Commercial Advertising. This Ordinance
regulates, restricts or prohibits any use, development, or subdivision
within the jurisdiction or a portion thereof for a period not to ex-
ceed one year from the date it is effective and may be extended to
an additional 18 months if needed. Ayes (7), Nays (0).Motion carried.
F-1 An Ordinance Creating Section 63.511 of the Rochester'Cod:e of Ordinance
Relating to The Regulation of Outdoor Commercial Advertising Signs
was given its first reading. Strain moved, Solinger second to suspend
the rules and give this Ordinance a second reading. Upon Roll call vot
Aldermen Bluhm, Canfield, Hunziker, McConnell, Solinger and Strain and
President Selby voted aye. Ayes (7), Nays (0).Moti.on carried and the
Ordinance was given its second reading. Strain moved, Hunziker second
to adopt the Ordinance as read. Ayes (7), Nays- (0).Motion carried.
E-4 Strain moved, Bluhm second to approve.the_purchase of 1130 square feet
of permanent easement and 836 sq. ft. of temporary easement from
Marjorie Danewick of 1118 7th Avenue S. W. for $2,750.00. This is
needed for the Flood Control Project. Ayes (7), Nays (0).Motion
carried.
F-1 Canfield moved, Strain second to adopt Resolution No. 199-91 approv-
ing the Owner Contract for Basic Construction in Diamond Ridge III -
Western Walls, Inc. prepared by McGhie and Betts. Ayes (7), Nays (0).
Motion carried.
F-1 Strain moved, Solinger second to adopt Resolution No. 200-91 approving
an Owner Contract for!:Basic Construction in Cimarron 14th Sub. -
Western Walls - McGhie and Betts the engineering firm. Ayes (7), -
Nays (0).Motion carried.
Mr. Roger Plumb, Public Services Dir. stated that he was satisfied
everything was in order. Having no further business, McConnell moved,
