Adjourned Meeting No. 23 - March.16, 1992
President Selby called the meeting to order at 7:30 P.M., the
ing members being present:.President Selby, Aldermen Canfield,
Crawford, Hunziker, McConnell, and-Petersson. Absent: Alderman
fol low -
Sol ingdr.
Canfield moved, Crawford,second to approve the minutes of the March
2, 1992 meeting with the correction as stated by Alderman Petersson
to change the wording of E-4 to " prior to noon on Sunday" on
the third line of the minutes. This replaces "until 1:00 A.M.
Ayes (6), Nays (0).Motion carried.
A Hearing on the Zone Change by Harold Priebe to rezone property
from R=1 Mex. Single Fam. Res. to B-4 Gen Business on 4420 Hwy 63
South. Wishing 'to be heard was Mr. Harold Priebe of 4420 Hwy 63
South. He urged the Council to approve this. He stated that it is
a natural flow of land use to have this changed. Having no one else
present that wished to be heard, President Selby closed the hearing.
Petersson moved, Crawford second to instruct the City Attorney to
prepare an Ordinance making this change. Ayes (6), Nays (0).Motion
carried.
A Hearing on the Land Subdivision Type III Phase II Application -
Preliminary Plat for Bamber Corners 3rd Sub. Wishing to be heard
was Arnold Bumgaars of 820 10 112 St. S. W. and stated that they
agreed with the conditions by the Planning Dept. In condition No.
2 - drainage - he is working with the various governmental bodies
to secure a good drainage plan. He is hoping to have the sidewalk
requirement dropped and use the planned bikepath instead.
Alderman. Canfield wondered if the bikepath was scheduled to be put
in at this time. He was told that it was. If a sidewalk was required
to be put in, then it would have to be put inside the Mayowood wall
because there would not be room to be put on the outside.
Roger Plumb, Public Services Dir. stated that he has seen the
drainage plan and is satisfied. He would also recommend the bikepath
instead of a sidewalk and the planned side of.the street is correct
in his opinion .
Al-derman Crawford wondered where the sidewalk would be put if one
was required. She was told it would run along the bikepath on the
south side of the street.
Wishing to be heard was Pam Quandt of 2629 Bamber Lane S.W. and is
concerned about the children crossing the street and walking down the
bikepath. She stated that it is snow filled during the winter and
it would take some time for the City to maintain this- meantime the
children would be walking in the street. Mr. Plumb stated that the
City would get to the path as soon as they can -that the City has 19
miles of walks to take care of but they plow it as soon as they can.
Wishing to be heard was Craig Woxland of 2718 Bamber Lane S.W. and
wondered if one of the bridges that is torn up at Soldiers Field
could be used in this area and save money. He was told that the
contractor has the purchase rights of the bridges and they have uses
ifor them.
After further discussion about the drainage problem. Mr. Plumb stated
that developers have to be more careful with grades of land that they
build houses on. He stated that they don't take into consideration
walk out basements that houses have. This.is something a developer

After further discussion, Alderman Crawford stated that she thinks
putting in both -the bikepath and the sidewalk would be safer for
the children. Alderman..Hunziker stated that the bikepath would
be wider then a sidewalk.and deeper and longer:
Craig Woxland wondered when and if the road would be widened.
Jane Kansier of the Planning Dept. stated that it would be widened
by the County but no plans were made for that yet.
Ms. Pam Quandt returnedand stillwondered how the children would
get to school safe.
Having no one else present that wished to be heard, President Selby
closed the hearing. McConnell moved, Canfield second to approve
this plan and approve the Findings of Fact that is on file with the
City Clerk. Ayes (6), Nays (0).Motion carried.
B-3 A Hearing on the Land Sub. Permit Type III Phase II Preliinary Plat
application of Foxcroft No. Second Sub.
.Wishing to be heard was Mike Nigbuhr of. McGhie and Betts,-Eng. firm
Rochester, Mn. and.is stated that the conditions were accepted by
them and urged the Council to approve this. Alderman Crawford
questioned Mr. Nigbuhr on the bus turnaround and if this is sufficiei

to be heard, President Selby closed the hearing. Petersson moved,
McConnell second to approve the Preliminary Plat with the conditions
as listed in the Findings of Fact on file with the City Clerk.

B-4 A Hearing on the Land Sub. Permit Type III - Phase II Preliminary Ply
for Cimarron 15th Sub. Wishing to be heard was Chuck DeWitz of
602 llth Avenue N..W. and stated that they approved the conditions
and No. 3 the ROW width of 24th Ave. and 52nd St. is O.K. for 56'
with 32' wide surface and they agree with that.
Wishing to be heard was Joan Hacker of 2303 52nd St. N..W. and
urged the developers to leave as many trees as possible.
Having no one else, present that wished to be heard, President Selby
closed the hearing. McConnell moved, Hunziker second to approve
the Findings of Fact on file with the City Clerk agreeing to the
conditions, etc. Ayes (6), Nays (0).Motion carried.
E-1 No action was taken on the request to use Mayo Civic Auditorium
free of charge/for the Volunteer Connection. They are going to
talk to the patrons of the area of Mayo Civic Aud. and work it
out with them.
E-2 Petersson moved, Canfield second.to approve the request received
from the Am. Legion Aux. Unit 92 to sell poppies on the streets of
Rochester and shopping centers on May 1 and 2, 1992. Ayes (6),
Nays ('0).M6tion carried.
E-3 McConnell moved, Hunziker_second to adopt Resolution No. 134-92
extending the billboard moratorium by 6 months commencing from
April 15, 1992. Ayes (6), Nays (0).Motion carried.

E-4 Canfield moved, Petersson second to adopt Resolution No. 135-92
amending the Centerplace Assessment Agreement reducing the minimum
market value on the Galleria from.$5,914,200 to $4,800,000. and in-
creasing the minimum market value on the hotel from $5,063,500. to
$6,177,700.00. The Mayor and City Clerk are to execute the amendment.
The overall min. value of the project would be unchanged it is
just shifted to reflect the market values of the properties.

E-5 McConnell moved, Crawford second to adopt Resolution No. 136-92
setting a public hearing for April 6, 1992 on the proposed issuance
of revenue bonds under the Mun. Ind. Dev. Act on bbhalf of the Mayo
Foundation. The bonds will be.in the amount of $150,000,000.00.
Ayes (6), Nays (0).Motion carried.
E-6 Hunziker moved, Crawford second to grant the request that the
approval. from Child Care Resources and Referral use the skyway
bridges to help celebrate the week of the young child from April 5,
1992 to April 9th, 1992. This is upon the condition that they obtain
permission from the abutting building owners and agreeing to clean V
windows.when the display.is taken down. Ayes (6), Nays (0).Motion
carried.
E-7 McConnell moved, Hunziker second to adopt Resolution No. 137-92
instructing the City Clerk to adveritse for bids on Federal Runway
13-31 and Security Project AIP 1-3-27-0084-7 J 6929 and J 6904.
Bids to be opened at 11:00 A.M. on April 14, 1992. Ayes (6),
Nays (0).Motion carried.
E-8 Petersson moved, Crawford second to adopt Resolution No. 138-92
approving a Resolution approved by the Public Utility Board as
follows: Contract Agreement with Moorhead Mach. and Boiler Co.
in the amount of $46,700.00 Ayes (6), Nays (0).Motion carried.
E-9 Crawford moved, Hunziker second to approve the revisions to
Rochester Code of Ordinances 32.07,38.04, 38.11 and 38.12 of the
Housing code. The City Attorney is to prepare the Ordinance.
reflecting this change. Ayes (6), Nays(0).Motion carried.
E-10 Petersson moved, Hunziker second to approve the following licenses
and bonds:
Gambling - all from Rochester - Circus -World Bingo ,Rochester
Lourdes -High School and Lourdes Dev. Fund, Rochester Area Fam. Y
and Ducks Unliminted Sponsors 232. The last two were for Raffles.
Heating Contractor - Roger Einck Plumbing and Heating.
Master Install.er - Roger Einck
Master Plumber - Midwest Mechanical Corp.
Sidewalks - Cement - Allan Clement,DBA A.L.C.Concrete of Chatfield
and Bill McCann Concrete , Rochester, Mn.

E-11 Petersson moved, Crawford second to adopt the Accounts Payable
in the amount of $1,131,690.78 - List filed with the City Clerk.

McConnell moved, Petersson second to adopt Resolution No. 139-92
awarding the low bid submitted by MacQueen of Mpls. for.a snow castii
rotary blower in the amount of $62,798.00. Ayes (6), Nays (0).
Motion carried.
Canfield moved, Petersson second to adopt Resolution No. 140.-92
approving the Employee Benefit Plan - Medical and Dental. The
Mayor and City Clerk are to execute the agreement on behalf of the
City. Ayes (6), Nays (0).Motion carried.
Crawford moved, Petersson second to adopt Resolution No. 141-92
approving the 1992-1993 Labor Agreement of IUOE 70 with the
Water Reclamation Plant. The Mayor and City Clerk are authorized
to execute the agreement on behalf of the City. Ayes (6), Nays (0).
Motion carried.
Petersson moved, Canfield second to adopt Resolution No. 142-92
approving the Labor Agreement with IUOE 49 - Street and Alley
for the years 1992-1993. The Mayor and City Clerk are authorized
to execute the agreement on behalf of the City : Ayes (6), Nays (0).
Motion carried.
No action is needed on the Variance filed by Leslie Nelson allowing
for an addition to the Reynolds Warehouse Bldg. This report is
accepted by the Council.
No action was taken on the Varience Request filed by Robert and Dawn
Callier for construction of an addition of an existing single fam.

setting a hearing to be -,held on April 20, 1992 on the ROW for the

Petersson moved, McConnell second to instruct the City Attorney to
prepare an -Ordinance annexing 5.08 acres in Marion Township by
Harvey Ratzloff and Joel Bigelow and Don Dallman in Pinewood Rd.

Hunziker moved, Crawford second to adopt Resolution No. 144-92
approving the purchase of property located at 36 -38 4th St. S.E.
for $298,750.. This is for the Flood Control. Project. Ayes (6), Nays

Hunziker moved, Crawford second to Adopt Resolution No. 145-92
approving the purchase of property located at 332 23rd St. N. E.
in the amount of $345,00. Ayes (6), Nays (0).Motion carried.

approving the purchase of part of Outlot "E" Westway Manor First

authorizing the City Clerk to advertise for bids on Project No.

their representation for the Mayo Medical Center 1992 Bond Issue.

An Ordinance Rezoning property to B-4 of Sec. 26-T106N_R14W
(Harold Priebe Property ) was given its first reading.
An Ordinance Amending Sec. 63.511 of RCO relating to the regulation
of Outdoor Commercial Adv. signs and providing- an extension of six
months to the period of.the moratorium. This was -given its first rea
ing.
An Ordinance Amending the Sub. 24 of Sec. 32.07 and Sec. 38.04 ,38.11
and 38.12 of the RCO relating to Housing Registration Certificate
requirements and Penalties. This was given its first reading.
An Ordinance Relating to the annexation of 5.08 acres of land in West
