Grimm. Those being sworn to office and accepting the duties of the office of Mayor and Councilmembers are as follows: Chuck Hazama, Mayor, Councilmembers Paul Myhrom, First Ward, Jean McConnell Third Ward, Mack Evans, Fifth Ward. A-1 President Selby called the meeting.to order at 2:05 P.M., the follow- ing members being -present: President Selby, Councilmembers Canfield, Evans,Hunziker, McConnell, Myhrom, and Senjem. Absent: None. C-1 The annual address was given by President Selby; it is located at the end of the minutes. C-2 Hunziker moved, Canfield second to adopt Resolution.265-93 approving a-c the Roberts Rule of Order for the conduct of business by the Council. with the exception of the tabling motion. The Council has included in the motion that tabling motions may be debated. Resolution No. 266-93 adopting the Rules and Regulations for Order f Business of the Council. Resolution No. 267-93 establishing committees of the Common Council prescribing their functions and duties and providing appointment to members of subcommittees. Ayes (7), Nays (0).Motion carried. It is placed at the end of these minutes. Hunziker moved, Senjem second to adopt Resolution No. 268-93 designating the Rochester Post Bulletin as the Official Paper for the City of Rochester, Mn. Ayes (7), Nays (0).Motion carried. The following Consent Items were approved upon motion by Canfield and second by McConnell. Approve the minutes of the meetings of Play 17 and May 19, 1993 with a correction of the minutes of May 3, 1993 Item B-4 1st Paragraph. The last word "not" should be removed from the record. Approve the following licenses and bonds: Auctioneer - Les Meeker of Chatfield, Mn. Master Plumber - Dakota Plumbing and Heating, Inc. of Eagan, Pin. Signs - North Signs - White Bear Lakes, Pin. H. Zone F ( 2 hr. parking ) Modify Para (13) of Sec. B, No Parking Zones - E Center St. on the north side from the west end of the Zumbro River Bridge to 6th Ave. S.E. at all times. Ayes (7), Nays (0).Motion carried. E-lA Canfield Moved, Senjem second to adopt Resolution No. 274-93 approving the wishes of the City Administrator to rescind Resolution No. 194-93 regarding his pay raise - and set the evaluation at the beginning of the year. Ayes (7), Nays (0).Motion carried. E-1 Hunziker moved, Canfield second to adopt Resolution No. 275-93 awarding the low bid of Electronic Interiors to provide programming services for the audio and visual equipment located at the City Council/County Board Chambers at the Government Center for $3,500.00. Ayes (7), Nays (0)_Motion carried. $ Resolution No. 275A-93 awarding low bid to EPA Audio Visual for $123,288.38. E-2 Senjem moved, McConnell second to cancel the hearing that was scheduled by a resolution for the removal of assessments on 0utlot B Wimbledon no Sub. Staff negotiated the necessary easements, therefore, no hearing is needed. Ayes (7), Nays (0).Motion carried. E-3 Council discussed the request for an Off -Sale Intoxicating Liquor License for the Chardonnay Wine Cellars - Mark Weimer -. Councilmemb, Jean McConnell stated that he is skeptical about this but thinks he will vote in favor of granting him this license. Stevan Kvenvold, City Administrator stated that the applicant has met all the legal requirements to have this store and the State Liquor Control has no problems with this request. Councilmember Senjem stated that he is concerned about the number of licenses left during the next 10 years. If the City only has three left, then the City should be cautious about allowing one license to be given to a person who does not really intend to be open. Councilmember Canfield stated that he was concerned about that too. He thinks a liquor license should be for someone who is in business to sell liquor. Councilmember Myhrom wondered what this was about and Mark Weimer was allowed to .be heard and explained his proposal. Councilmember Myhrom then stated that the City would still have three left and he would be in favor of granting this license. Councilmember Evans stated that if this has met all the required law then he would see no reason to deny this. Councilmember Senjem stated that he needed more information on the effect of this license on other people who are in actual business. He does not necessarily want a hearing, but would like more time for more information from other business owners affected by this action. Based on that, Senjem moved, Canfield second to table this. Upon Roll Call vote, Councilmember Evans, Hunziker, Myhrom and President Selby voted nay. Nays (4), Ayes - Canfield, McConnell and Senjem. Ayes (3). Motion does not pass. ( Play Mor Ballroom ) 2145 Hwy 14 East and 287 acres of State owned land in Sections 5 and 6 Marion Township. Ayes (7), Nays (0).Motion carried. Resolution No. 282-93 which is also part of E-14 and 15. E-14 Senjem moved, Hunziker second to set a hearing for June 21, 1993 on the Orderly Annexation Agreement 93-4 with Cascade Township including properties at 4021, 4104 and 4110 55th St. N.W. 22.95 acres of vacant land in Sec. 25 in No. Heights East and 4.13 acres of vacant land owned by Olmsted County for Circle Drive ROW in Sec. 17. This is Resolution No. 282-93. E-15 Hunziker moved, Senjem second to set a hearing for June 21, 1993 on the Orderly Annexation with Cascade Township 93-8. Resolution 282-93 included this also. E-16 Canfield moved, McConnell second to instruct the City Attorney to prepare an Ordinance annexing 4.1 acres of vacant land in a part of the NE 114 of the NW 114 of Sec. 30, Haverhill Township. E-17 Senjem moved, Myhrom second to adopt Resolution No. 283-93 which indicates Rochester's support for the bicycle trail construct. ion along Marion Rd. from US 14 to 20th St. and on the west side of facility from US 14 to Bear Creek. E-18 Hunziker moved, Senjem second to adopt Resolution No. 284-93 authorizing the City to hire DPE, Inc. to remove asbestos from four houses in the Flood Control Project. The total is $7,375.00. E-20 McConnell moved, Myhrom second to adopt Resolution No. 287-93 authorizing the City Clerk to advertise for bids on Project 6701-93 J 2162 Reconstruct Sanitary Sewer on the East Side of Bear Creek from 10th.St. S.E. to 12th St. S.E. and Along the South Side of 12th St. S.E. to the Inplace 33 inch Trunk Sewer at 15th Avenue S.E. Traffic and Parking Res. as follows: 1. Add Para Q Sec. I - Lot 20, Government Center Lot consists of the main lot at the City/Co. Govt. Center. 2. Amend Para. 14 to Sec II B (Rates) to read: 14 - Lot 2, Govt. Center Lot - 30 minute meters at 60 cents/hr. listed as Rate C in the rate table; 2 hr. meters at 25 cents/hr. listed as Rate F in the rate table and $2.00 per event for evenings and weekends. Absent: None. B-1 A Hearing on the City Council Initiated Amendment to the Floodway Overlay District. Having no one present that wished to be heard, President Selbyclosed the hearing. B-2 A Hearing on the Proposed project - New Sidewalk 4-1993 J 9275 Various Locations throughout the City. Ayes (7), Nays (0).Motion carried. . B-3 A Hearing on the Sidewalk Replacement Project 5-1993 J 9276 - Sidewal Replacement Work in the SE area. Wishing to be heard was Nancy Warre of 1207 '10th Avenue S.E. and wanted to have this project explained to her. Mike Cox, Public Services, Sidewalk Div. explained the project and the policy of the City. President Selby also assured Ms. Warren that a staff member of the City would look into this for her. Having no one else present that wished to be heard, President Selby closed the hearing. Hunziker moved, Canfield second to adopt Resolution No. 294-93 apprvoing the project and ordering the project to be made and'bids to be opeend on June 30, 1993. Ayes (7), Nays (0).Motion carried. B-4 A Hearing on the proposed Sidewalk Replacement Project No. 6-1993 J 9284 Sidewalk Replacement and Streetscaping Downtown Area at Various locations. Wishing to be heard was Darwin Olson of 300 South Broadway and wanted to know where these replacement blocks would be. Mike Cox of the Public Services Dept. showed Mr. Olson the location of the blocks. Having no one else present that wished to be heard, President Selby closed the hearing. Hunziker moved, Senjem second to adopt Resolution No. 295-93 approving the project and ordering the bids. Ayes (7), Nays (0).Motion carried. B-5 A Hearing on the Proposed Assessment on Project 6220-3-92 J 9204 Street Reconstruction adn Widening of 20th St. S.W. from South Broadway to 1st Avenue S. W. Having no one present that wished to be heard, President Selby closed the hearing. McConnell moved, Myhrom second to adopt Resolution No. 296-93 approving the project and ordering the bids. Ayes (7), Nays (0).Motion carried. B-6 A Hearing on the Reconstruction of Alleys at seven locations in the City. Wishing to be heard was Ann Leary of 1430 West Center Street and was in favor of this project. Wishing to be heard was Allen Lane of 4011 Carol Lane N.W. and wanted to know when the project will be completed. Ron Pa,fne of the Public Services Dept. stated tha the project should begin approx. July 1, 1993. President Selby informed Mr. Lane to call Public Services Dept. and find out further time information. Wishing to be heard was Patrick McCaffrey of 1914 West Center St. was concerned about the one alley location. He said they did not have an Alley there now. Al Toddie, Public Services Dept. stated that this was a mistake and no alley is planned. Wishing to be heard was James Speaker of 1911 1st St. S.W. and wanted more information. This was provided by the Public Services Dept. Wishing to be heard was David Heller of 121 7th Ave. S. E. He wanted to know how the alley was divided. He was given this information by the Public Service Dept. Having no one else present that wished to be.heard, President Selby closed the hearing. Canfield moved, Hunziker second to adopt Resolution No. 297-93 approving the project and eliminating location No. 2 - that being E-W Alley in Blk 7, West Zumbro Addn. Ayes (7), Nays (0).Motion carried -This is Project 9304 J 9283. RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON _COUNCIL - CITY OF ROCHESTER, MINNESOTA _4 1 U 6 Annual Meeting No. 1 - June 7, 1993 Agenda Item B-7 A Hearing on the Proposed Project 6219-4-93 J 9269 - Grading, Base Bit. Surfacing, Con. Curb and Gutter, San. Sewer, St. Sewer and Watermain in 19th St. N.W. from Co. State Aid Hwy No. 4 to West of 32nd Avenue N. W. Wishing to be heard was Jim Till of 2715 19th St. N.W. and urged the Council to have as many trees as could be saved. Al Toddie, Public Services Dept. stated that they will do the staking of the project soon and will talk with Mr. Till about saving the trees. Having no one else present that wished to be heard, President Selby closed the hearing. Councilmember Hunzikei asked how the City would be assured that this is followed thru on. Gary Neumann, Ass't. City Administrator said that typically the City tries to save as many trees as we can. The City can have Denny Stotz, Park and Rec. ( Forest Dir. ) look at this too and report bacl to the City Adm. Senjem moved, Hunziker second to adopt Resolution No. 299-93 approving the project. Ayes (7), Nays (0).Motion carried. B-8 A Hearing on the Zone Change from the R-1 District to the M-1 District on Approx. 200 acres located directly North of the Airport. Wishing to be heard was Leon DeCook, property owner in the area being considered. He is opposed to this as he intends to develop the area into housing. Mayor Hazama responded to Mr. DeCook and stated that there may be a future need to expand the runways to accommodate larger planes and more traffic could be generated if the Twin Cities airport was left in the present area and some of the business is conducted out of the Rochester Airport. With this in mind, the more the area is developed in the path of potential planes, the more complaints the City / Airport gets from noise, pollution, etc. Mr. DeCook asked the Council to table this or continue this until his attorney can be present. He would like to have this hearing left open for comments by his attorney. Having no-one else present that wished to be heard, Myhrom moved, Canfield second to continue this hearing until July 19, 1993. Ayes (7), Nays (0).Motion carried. B-9 A hearing on the Appeal 93-10 - Kwik Trip, Inc. Wishing to be heard was Ken Meyer of 1102 34th St. N.W. He stated that this appeal was filed by himself, neighbors; and the 7th Day Adventist Church. They are not against the Kwik-Trip, Inc. store, they just do not want this type of business with the generated traffic in the neighborhood. He presented a petition with over 100 names against this. This land only has access to llth Avenue also. Wishing to be heard was Ruth -Stoeckel -p.f 1410 34th Street N. W. She is opposed., Wishing to be heard was Glen Faith of 1206 34th St. N. W. and is opposed and urged the Council to deny the appeal. Traffic was his main concern. Wishing to be heard was Jim Kelzenbert of 1117 Knoll Ct. N.W. and is opposed. Wishing to be heard was Paul Hanson of LaCrosse Wisconsin. He represents Kwik-Trip, Inc. and he urged the Council to approve his business in the area. He stated that 37th St. has limited access and he agrees that traffic is still a problem, but it should not be that much generated traffic from his business. 1 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA 4 7 Annual Meeting No. 1 - June 7, 1993 Agenda Item B-9 He stated that Kwik-Trip would not be a 24 hour operation in this location. Some areas are, but not` this one.He stated that no matter what the business that may be allowed in the area would be apt to generate traffic. Kwik-Trip does not allow loitering so the area would be safe and noise free. He urged the Council to allow them to put KwiK-Trip in. Councilmember Senjem asked them if they would ever consider a 24 hr. operation. Mr. Hanson stated.that they would not ever have this a 24 hr. operation. Wishing to be heard was Edward Thompson of 113 Knoll Ct. N.W. and was worried about the crime levels generated by this business. His is opposed. Wishing to be heard was John Matrom of 1211 34th St. N. W. and is opposed.: Having no one else present that wished to be heard, President Selby closed the hearing. After Council discussion, Councilmember Senjem stated that he is opposed to Kwik-Trip being located in the area. Senjem moved, McConnell second to override the appeal of the Zoning Board and instri the City Attorney to prepare "Facts of Findings" overturning the decision of Zoning Board of Appeals. Mr. DeWitz stated that a park will be built next year but it will probably be built in Diamond Ridge 8th. Having no one else present that wished to be heard, President Selby closed the hearing. She presented a petition containing 500 signatures demanding Councilmember Paul Myhrom to refrain from using language demeaning women or any member of the community, which demean women. The petitioi further demands that Councilmember Myhrom retract his statement as follows: "We're so tired of these house spouses who don't work who've got nothing better.46-do_than dabb1 e in politics". President Selby asked Councilmember Myhrom if he cared to make a statement and he stated that he would. Councilmember Myhrom stated that he would not apologize and he would not retract any statement that he made. He was elected fair and square and people would have to live with that. He gave people 15 minutes to ask him questions and other than that time, he was going to drop the subject. Having no further comments, Senjem moved, Canfield second to adjourn the meeting. I look forward to working with you. Please call on me or any council member or staff for advice and counsel. You come into office at the busiest.=time in the city's history, and, after reading your first agenda and packet, your lifestyle will change: --particularly on weekends between Friday and Mondays --when all your friends are relaxing. I commend- Mack and Paul for your interest in city issues --and for your immedate attempts to familiarize yourself with city staff and city functions.and the physical city sites. I also want to.recognize our two outgoing council members: Ruth Crawford and Mary Petersson, who, in their two years on the Council represented their wards well and also made decisions on what represented the interests and concerns for the betterment of the total city. Every former council member has made a significant contribution to the city.. The biggest issue facing Rochester residents today is --the school situation. Until we resolve to work together to resolve our divergent issues and thoughts, we will continue to divide ourselves into splinter groups, pitting neighbor against neighbor, friend -against friend. We have to agree on something--and--perhaps the decision -makers of the three governments can assist. Therefore, I am asking that the first and chief agenda item at the next intergovernmental meeting, which would be in July, be where do we go from here --and how can city and county decision -makers help. There was a loud and clear message in May --residents don't want their taxes raised. I will concede that there were other reasons behind the school bond defeat. Managing resources to the optimum and maximizing the most efficient use of the citizens' tax dollars are top priorities. We run the city on 20Q of our property tax dollar --a figure that constantly amazes me! Therefore, I am going to ask the Strategic Planning Committee, assisted by members of the Finance Committee, to look at the pay and fringe benefit structure of the city Council --elected officials only, with the charge that all options are open --from freezing salaries to taking pay cuts, paying for our benefits, etc. No one runs for public office for the money. There is no amount of money that can pay me for my sometimes 70-hour, 7-day week --which includes Saturday night. I love what I'm doing. This is not a volunteer job --and expenses should be compensated. There are several of you on the council who have previously complained of pay raises at budget and election times. The option of voluntarily returning your pay and fringe benefits has always been available to you. I ask my colleagues --County and school boards --to do the same. Will we get better government--NO--but this does respond to citizen's concerns --the pocketbook. I'd like to talk about government cooperation. There seems to be this myth out there that government bodies aren't cooperating. Let me dispel that myth. We are probably Number 1 in the state in government cooperation. We can do more. By keeping the options open with creative and visionary thinking and planning ahead. But let's focus on ideas that are do -able --with the least amount of fracturing of systems and people's lives: and with the end result that the delivered product is cost-effective. Cooperation is a two-way street; cooperation is alevel playing field; cooperation is communication. Let's seize the moment. As I read, listen, and learn about what's happening to business and governments all over the county --I note that the trend is towards more responsive and responsible to customers and constituents. I do notice that thinking is focused on delivery of services where there is a direct line of accountability--i.e., the distance between business/government and client is getting closer. In closing, I would like to colleagues, staff, citizens remarkable city of ours. C-4 I Address by Mayor Hazama: take this opportunity to thank the for their truly caring about this "From Maui to Mayor and the American Dream" With the media reporting daily about the conflict of the Serbs and Moslems, the demise of the Branch Davidians, the beating of a white truck driver in Los Angeles, the murder of a Minneapolis police officer, and all that depicts the history of violence and justice -- we must ask ourselves, "Have we built a nation that is a sham to the rest of the world?" Listen to the news on the radio., watch the sequence of horror on television and read in the printed page about what's wrong with our nation and you can't help but have some questions about how we are doing. In America we turn our happiest holidays into an argument about whether we should allow children to celebrate it in schools. We have travelled through a recent concept of diversity, when ethnic cleansing is waging a war in Yugoslavia. I've lived through major wars following the Depression of the 30's and have seen a marked revolution of society in my 60 years. In my formative years it was okay and acceptable to speak of unity, the unifying concept of freedom and national patriotism. Immigrants who came to America in the 30's and 40's were heard repeatedly to say: "We are in America now and must speak English." True, we still witnessed hatred and discrimination in our society, but it was no reason to abdicate our loyalty to our country. �'ogD RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA Annual Meeting No. 1 - June 7, 1993 Agenda Item C-4 The "Me" generation has changed all that. We started looking to ourselves and adapted to issues that would bring ultimate success in this authentic land of opportunity --this movement is often referred to as the period of "navel contemplation". This era brought to us the rights movement --rights for everyone, women and oppressed minorities, ethnic pride took precedence over national patriotism. In fact, some of the old destructive tendencies of tribalism crept into the process in the name of diversity. History has a way of repeating itself. All the great civilizations of the world crumbled from within. People who lost sight of a common goal with a unifying concept of freedom, responsibility, and the aspiration to achieve a most open, united and equal society have the greatest potential to survive. This doesn't mean that we all have to agree about everything We do. Our check and balance system in our democratic form of government still finds no equal anywhere in the.world. But growing up has always been a challenge. As a nation, we are fairly young--200 plus years. We've made an impact in the 20th century and today are looked at as the nation the rest of the world would love to emulate. What we have gone through as a nation has been experienced by the great societies of the past. What we need to learn, however, is not to make the same mistakes from the history of those past societies. All of us -are entitled to our dreams and sometimes reality sets in and we find ourself denying opportunities to others. The confrontations within- our nation need to focus more on the central belief that differences -and the wondrously different heritages need not separate us from a:desire to give us a blueprint for a common culture in which we can come together and rejoice in our progress. In Rochester, we can speak of the extraordinary eighties as a period unprecedented in our 135 year history. The Mayo Clinic announcing 750-million dollars in development and growth-- the birth of Rochesterfest, our economic arm-RAEDI,. the achievement of Star City and All America City status, along with many other national ratings, passage of our sales taxes that ensures us the construction of the Civic Center and flood control projects, our Two plus Two program, Water Reclamation Plant, Waste to Energy Incinerator, Federal Medical Center ... and the list goes on.... We can honestly say that we have completely turned the tide of negativism that prevailed following the defeat of urban renewal in 1969. We"re on our way to dedicate GRAUC (Greater Rochester Area University Center) on September 18. As a city we contributed a quarter of a million dollars to assist in leveraging seventeen million, seven hundred thousand dollars from the Legislature, an investment that will reap benefits for generations to come. We're on our way to constructing a new City Hall, Library, fire station, parking ramp and skyway --by 1995 we hope to have our 110 million dollar flood control project completed. In our concern -for the youth of our community we have organized CYVIC (Community Youth Violence Intervention Committee), REACH, the mentorship program for this summer, an ongoing youth commission that meets regularly and giving input on the ocncerns youth have in our community,,.plus we have just applied for a $400,000 grant from the Pew Foundation, as we coordinate activities among youth serving organizations. RAEDI (Rochester Area Economic Development Inc.) has moved forward in responding to the AdStar transition at IBM, and the effort made by the Economic Diversity Council should meet with positive results. We have some exciting and challenging times facing us in the nineties You and I have this challenge --to pursue the American dream of freedom, equality and the responsibility to be able to pass on a legacy of being part of the greatest nation in the worls, as we try to do our share to have one of the greatest cities in the world. Coming from the small and distant islands of Hawaii, I am honored to be a part of this process of governance and I would like to thank all of you who made it possible for me to come from Maui to Mayor.
