A-1 I President Selby called the meeting to order at 7:00 P.M., the follow-
ing members being present: President Selby, Councilmembers Canfield
Evans, Hunziker, McConnell, Myhrom and Senjem. Absent: None.
B-1.
A Hearing on the Proposed Assessments - Previously Postponed on
Project No. 6251- J 8569 High Level Water Tower to serve S.W.
High Level Dist. N. of Salem Rd. and E of CSAH No. 122. Having no
one present that wished to be heard, President Selby closed the hear'
ing. Hunziker moved, Myhrom second to adopt Resolution No. 1-94
accepting the asessment - this was levied to Plat 151 Parcel 100.
Ayes (7), Nays (0).Motion carried.

A Hearing on the New Sidewalk Assessment No. 1-1992 J 9234.
Having no one present that wished to be heard, President Selby
closed the hearing. Canfield moved, McConnell second to adopt
Resolution No. 2-1994 accepting the assessment. Ayes (7),.Nays (0).
Motion carried.

A Hearing on the Sidewalk Replacement No. 4-1992 J 9241 -
Wishing to be heard was Robert Fox of 3917 16th Avenue N. W. and
was not happy with the work that was done by the contractor. They
left a mess, did not level off the area that was under construction.
He stated that he cleaned up a lot of this mess himself, but the
fence that he constucted was sprayed with sealer that was meant
for the sidewalk and ended up on his fence. He presented pictures
with the damage shown clearly. Council directed Richard Freese
Public Works Director to check into this. Having no one else
present that wished to be heard, President Selby closed the hearing.
Senjem moved, Canfield second to adopt Resolution No. 3-1994
accepting the assessment and instruct Richard Freese to speak
with Mr. Fox about the problems that he had. Ayes (7), Nays (0)..
Motion carried.

A Hearing on the Previously Postponed Assessments for Project
No. 6255-1-70 J 9341 - San. Sewer and Watermain on East River
Road N.E. Plat 3312 Parcels 5200, 5100 and 5000. Having no one
present that wished to be heard, President Selby closed the hearing.
Evans moved, Canfield second to adopt Resolution No. 4-1994
approving the assessments. Ayes (7), Nays (0).Motion carried.

A Hearing on the Previously Postponed Assessments on Project 6252
J 8055 - Construction of Trunkline San. Sewer. Having no one present
that wished to be heard, President Selby closed the hearing.
Canfield moved, Senjem second to adopt Resolution No. 5-1994
accepting the assessments. Ayes (7), Nays (0).Motion carried.

A Hearing on proposed Assessments on Projoct`6311-4-92 J 9242 -
St. Construction on llth Avenue N.W. from South of 34th St. N.W.
to 37th St. N.W. Wishing to be heard was Clarence Horst of
2821 26th St. N.W. and is representing the 7th Day Adventist
Church on 37th St. N.W. and llth Avenue —He was inquiring about
how he pays the assessment and if pre -payments are accepted.
Carole Grimm, City Clerk explained the method of payment to him.

Resolution No. 6-1994 accepting the assessments. Ayes (7), Nays
(0).Motion carried.
B-7 A Hearing on the City Planning and Zoning Commission initiated Zoning
Ordinance Text Amendment to increase the permitted height of area
Accessory Land Uses to 35 feet in RSa, R-1 and R-2 Districts.
Having no one present that wished to be heard, President Selby closed
the hearing. Senjem moved, Hunziker second to instruct the City
Attorney to prepare an Ordinance approving this amendment. Included
in the motion is supported by establishing the public need for the
amendment and if the amendment would accomplish one or more goals
of the purposes of this ordinance, the Comp. Plan or other adopted
plans or policies of the City of Rochester. Ayes (7), Nays (0).
Motion carried.
B-8 A Hearing on the Amendment of the 1992 Final Statement - CDBG
Program. Having no one present that wished to be heard, President
Selby closed the hearing. Hunziker moved, Myhrom second to approve -
the change. Ayes (7), Nays (0).Motion carried.
C-1-8 Hunziker moved, Senjem second to approve the following Consent Items:

C-4 Adopt Resolutions-7-94,8-94,9-94,10-94 and 11-94 approving the vaious
banking items, designating various banks and approving facsimile
signatures required for bank purposes by the bank and assignment of
securities. These are needed by the City Finance Dept. and the
various banks for operation in 1994.

C-5 Adopt Resolution No. 12-94 authorizing the filling of the Accounting
Personnel Technician position in the Public Utility Dept. and
(C-6) filling of the position of Painter II position in the Public
Works Dept.

C-7 Adopt Resolution No. 13-94 and 14-94 declaring the costs to be
assessed and ordering a public hearing for Feb.7, 1994 on
Sidewalk Replacement No. 5-91 J 9276 in various ares of the.City.
C-8 Adopt Resolution No. 15-94 and 16-94 declaring the costs to be
assessed and ordering a public hearing on Feb.7, 1994 on New
Sidewalk Project 4-1993 J 9275 - city wide locations.
Ayes (7), Nays (0).Motion carried.
E-1 McConnell moved, Evans second to adopt an order extending the GWC
Seventy Three, Inc. TCI rate review period for an additional 90 days
commencing Jan. 5, 1994. Ayes (7), Nays (0).Motion carried.
E-2 Discussion was held by the Council on the establishment of a public
hearing on the remaining On -Sale Exclusive Intox. Liquor license.
Councilmember Canfield would like to see this held for future use
seeing as it is the last one the city can issue for another 6-7 years
and also, IF this is approved for some business, then it would
possibly make the other licenses escalate in price for the businesses
that do have them at this time. Terry Adkins, City Attorney staled
that he would have problems with defending this reason if he would
ever have to go to court. IF after the public hearing reasons are
found to deny the issuing this license, then he would have that as
defense. After further disucssion, Senjem moved, Evans second to
adopt Resolution No. 17-94 establishing a public hearing for Jan.
19, 1994 to review the applicants for the On -Sale Exclusive Intox.
Liquor license. Ayes (6), Nays (1).Motion Carried. Councilmember
Canfield voted nay.
E-3 McConnell moved, Hunziker second to direct the City Attorney to
prepare the ballot question and Charter amendments encompassing
the elections of the City of Rochester to be held in the fall and
increasing the terms of City elected officers to four years.
This ,is subject to review by the Charter Commission. Ayes (7),
Nays (0).Motion carried.
E-4 Senjem moved, Myhrom second to eliminate the annual fee for the Con-
sumption and Display Liquor License and insturct the City Attorney
to prepare an Ordinance for adoption. Ayes (6), Nays (1), Council -
member McConnell voted nay. Motion carried.
E-5 Hunziker moved, Senjem second to adopt Resolution No. 18-94
approving an agreement with Agronomy Services Plus, Inc. to
continue consulting services in 1994 and include the recommended
changes shown on the Request for Council Action. Ayes (7), Nays (0).
Motion carried.

Hunziker moved, Senjem second to adopt Resolution No. 19-94
authorizing execution of a lease agreement for property at 1123 4th
Avenue N. W. This is for the Flood Control project . Ayes (7),
Nays (0).Motion carried.
Hunziker moved, Senjem second to adopt Resolution No. 20-94
approving the settlement of the City's claims against the Stage 1133
contractor and authorize the City Attorney to prepare the necessary
documents. This is pertaining to the Art Center Damage Claims.
Ayes (7), Nays (0).Motion carried.
An Ordinance amending Sec. 62.211, 62.221 and 62.231 of the RCO
relating to the Permitted Maximum Height for area Accessory Land Uses
in the R-Sa - R-1 and R-2 Zones. This was given a first reading.
An Ordinance Amending Sec. 125A.083 Of the RCO Relating to the
License Fee for Bottle Club Licenses was given its first reading.
An Ordinance Amending Sec. 134.47 of the RCO Relating to the
Identity of the Party Responsible for a Parking Violation in the
City of Rochester was given its second reading. Sehjem moved,
Canfield second to adopt the Ordinance as read. Ayes (7), Nays (0).
Motion carried.
An Ordinance Amending and Reenacting Chapter 23 of the RCO Relating
to a Change in the name of Rochester Public Services Dept. to
Rochester Public Works Dept. was given its second reading. Canfield
moved, Myhrom second to adopt the Ordinance as read. Ayes (7),
Nays (0).Motion carried.
President Selby announced that she will not be running for another
term as Council President. Filings open on Jan. 25, 1994 and run
until /thru Feb. 8, 1994 for Council President, Councilmembers of
the Second,Fourth and Sixth Ward.
Having no other business, Canfield moved, Senjem second.to adjourn
the meeting. Ayes (7), Nays (0).Motion carried.
