Minutes of a regular meeting of•the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall in said City
n February 1, 1943-
President Lemmon called the meeting to order at 2:00 o'clock P. M., the
ollowing members being present: President Lemmon, Aldermen Fryer, Hanson,
ennedy, Mrachek, Nass and Yeager. Absent: None.
Upon motion by Hanson, second by Yeager, the minutes of the meeting of
January 4, 1943, were approved.
The request of the City Engineer that $5,000.00 be appropriated for use
of the Street and Alley Committee was read and ordered placed on file.
Lease No. 49612 giver_ by the Chicago and Northwestern Railway Company
to the City of Rochester, Minnesota for 500 square feet of storage space in their
Engine House was read, and upon motion by Fryer, second by Mrachek, the said lease)
was approved and the Mayor and City Clerk were authorized to sign same.
A communication from the City Engineer stating that he had obtained a
Priority Certificate for 40,000 gallons of Cutback Asphalt for maintenance of City
streets and. recommending that the Common Council advertise forbids to be opened
!arch 1, 1943 was read, and President Lemmon ordered that same be placed on file.
The following copies of resolutions adopted by the Commissioners of the
Sinking Fund on January 15, 19Y3 were read:
"That the sum of $44,400.00' be and the said sum is hereby
appropriated from the Sinking Fund; Code 36 and ordered paid
to the Union National Bank of Rochester for the purchase of
$60,000.00 United States Savings Bonds, Series F, the same
being purchased for the Electric Department Extensions
Reserve."
"That the sum of $599.64 be -and the said sum is hereby
appropriated from the Sinking Fund, Code 24 and.ordered paid
to the Sinking Fund Code 23, for th-e transfer of funds to -
make same available for investment for the Electric Light
Depreciation- Reserve.!'
Upon motion by Mrachek, second by Fryer, the action of the Sinking Fund
commissioners was approved.
The requests of Edward J. Costello and Carl W. Ranfranz for leave of
bsence from their duties as firemen while in the armed forces of the United Statei
ere each read, and upon motion by Fryer, second by Nass the same were approved. .I
A copy of the Constitution adopted by the Recreation-Commi'ttee for the
ity of Rochester was read and upon motion.by Mrachek, second by Fryer, the same
as ordered placed on file.
A communication from the Firemen's Civil Service Commission in regard tol
,6ranting leaves of absence to members of the Fire Department was read and upon

motion by Fryer, second by Kennedy, the Common Council went on record as -being in
favor of granting leaves of absence to City Employees while serving in the armed
forces of the United States for the duration of the war but not when they leave
the employemnt of the City to accept positions in defense work.
A notice of a hearing on the petition of Walter E. Dodge and Arthur C.
Gooding, trustees of the Walter Hurlbut Book Fund to sell the Southeast quarter
of Section twenty-six in Township 109.North, Range 49 West of the Fifth Principal
Meridian,- .situated in Brookings County., South Dakota, to Raymond Suhr of Aurora,
uth Dakota and also an order by the District Court that.said petition.be granted
were. each read and ordered .placed on file.
A recommendation by Alderman Hanson, Chairman.of the Fire Committee,
and Des,mor%d B., ,Hunt, City Attorney, that .the Firemen's Relief Association had.
determined to show no indebtedness either against the Firemen's Relief Associatioor
or the. Asso•cia.tion .to show no claim against .the City of Rochester from thi.s date,
was read, and' upon .motion by -Fryer, second by Kennedy the recommandat,i.on was
accepted and ordered placed on file..
The reports of the Clerk of .the Municipal Court for, the week e.nding
January 9, 1943, showing c.rimin.al fines and costs collected $299.20, civil .fees
received $`13.65, and conciliation court ,fees $3.50; for the .week .ending' January lE
1943, showing criminal fines and costs collected, $244.4g., c.ivi•l fees received.
$5.35., and conciliation, court fees 4.50; fox the week, ending January. 23., 1.943,,
showing criminal fines and -cos,ts collected $75.60, civil fees ,received $.70-, and
conciliation court fees _$2.00; and for the week ending January 30, 194.3, showing
criminal fines an,d costs collected $1-39.40, civil fees received $1.70, and
conciliation court fees $4..25,, were, each read, and having been. previously approved
by the City Attorney, President Lemmon ordered that .same be placed on file.
The reports of the Building In-spe.ctor and the Electrical Inspector for
the month, of- JaAua.ry,. 1943, showing fees for building permits issued $6.00,, and
fees for- electrical permits issued $3.25, and fees for plumbing p.ermit.s. issued
$7.50,, were each read and. President Lemmon. referred same to .the Finance Committee.
The report of the Fire Department Relief Association of Rochester'',
Minnesota, showing •rec.eip.ts of�,2�314.2.4 and exp end i tur e s cf 608.68 for the year•
ending December 31, 1942, was -read and upon motion by Kennedy, second by.Mr°achek,
the - same was ordered placed on file.
The report of the Trustees of • the Walter. Hurlbut. Book Fund for the year
nding.December 31, 1943, was read and upon motion by Kennedy, second by Fryer,
the same was accepted and ordered placed on file.

The statement by the Board of Park Commissioners of receipts and
expenditures in the Park Improvement Fund for the month of December, 1942, was
read and ordered placed on file.
The following claims were read, and upon motion by Yeager, second by
Mrachek, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants upon the City Treasurer and make payments accordingly:

Joe Endrizzi were each read,•anci u-pon motion by Fryer, second by Nass, the
licenses were granted.
The applications of Chas. M. Dorniden and Guy Capriotti•for a•license
to sell cigarettes were each read, and upon motion by Mrachek, second by Nass,-
the licenses were granted.
The license bonds of Maass & McAndrew Co. and Frederick A. Roepke,
each in the sum of $1,000.00 with the National Surety Corporation as surety, and
the performance bond of the Burroughs Adding Machine Co. in the sum of $1,•363.30
with the Hartford Accident &-Indemnity _Co. as surety, -were each read, and upon
motion by Mrachek, second by Nass, the said bonds'-were•approved, the surety
thereon accepted and it was ordered that same be placed on file.
Alderman Fryer introduced a resolution granting four Public Dance'
permits to the Whitlock Sonnenberg Post V. F. W., which was read.
Upon motion by Mrachek, second by Fryer that the said resolution'be-
adopted as read, and all,voting in favor thereof, President Lemmon declared the
+ said resolution duly passed and adopted.
Alderman Fryer -introduced a resolution granting•a Public Dance Permit
to the Townsend Club No. ' 1, which was read.
Upon motion by Hanson, second -by Nass, that the said -resolution be
ad•opt•ed as read, and all voting in favor thereof, -President Lemmon 'declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution authorizing the City Clerk to
make, Victory Tax deductions from City employees salaries under the schedule as
authorized by Section 466 of the Internal Revenue
Code, which was read.
Upon motion by Hanson, second by Yeager,
that the said resolution be
adopted as read, and all voting in favor thereof,
President Lemmon declared the
said resolution duly passed and adopted.

Alderman Fryer introduced a resolution fixing the distribution of 10%
Gross Income Tax received from the Public Utility
Department, which was read.
Upon motion by Mrachek, second by Fryer,
that the said resolution be
.adopted as read, and all voting in favor thereof,
President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a -resolution
requesting the State Public
Examindr to make an examination of the'books and records
of the City of Rochester,
for the fiscal year ending March 31, 1.94

Upon motion by Yeager,- second by Kennedy, that the said resolution be
adopted as read, and all voting -in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution designating the polling places
for 1943, which was read.

Upon motion by Fryer, second by Hanson,'that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said -resolution duly passed and -adopted.
Alderman Hanson introduced a resolution appointing Judges of Elections
for 1943, which was read. -
Upon motion by Fryer, Second by Mrachek, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and'adopted.
Alderman Hanson introduced a res,olution appropriating $301.50 from the
General Fund,and ordering payment made to City of Rochester, Public Utility Deptl
for steam heat for the City Hall, which was read.
Upon motion by Nass, second by Yeager, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $20>1.67 from the
General Fund and ordering payment made to the General Fund, Code 29 for gasoline
furnished the Police Department, which was read.
Upon motion by Fryer, Second by Hanson, that, the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman -Kennedy introduced a resolution appropriating $1,308.60 from
the General Fund and ordering payment made.to the Burroughs Adding Machine Co. -
for one second hand factory rebuilt Burrough Machine, which was read.
Upon motion by Yeager, second by Nass, that the said resolution be
dopted as read, and -all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $12,400.00 from
he General Fund, Code 19 and ordering payment made to the General Fund, Code S to
ake the said sum available for the Police.Dept. expense for the fiscal year
eginning April.1, 1943, which was read.
Upon motion by Yeager, second by Kennedy that the said resolution be
dopted as read,,and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $4.00 from the
eneral Fund, $1,222.17 from the Street & Alley Fund and $34.05 from the Sewer Funi
and ordering payment made to the Street and Alley -Fund for stock used and use of
equipment during January, 1943, which was read.

Alderman Mrachek introduced a resolution.appropriating $275.00 from t-he
Street & Alley Fund and ordering payment made to the' Park Improvement Fund for 1
,Dodge Truck, which was read.
Upon motion by Mrachek, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon d.eclared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $1,004- 57 from
;the Street & Alley Fund and $78.00•from the Sewer Fund and ordering payment made
to the Street & Alley Fund for use of equipment during December, 1942, which was
read.
Upon motion by Hanson, second by. Fryer, that the said resolution be
adopted as.read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass introduced a resolution appropriating $30.00 from the
General Fund, $4-50 from the Street & Alley Fund and $4,523.E+0 from the Lighting
,Fund and ordering payment made to City of Rochester, Public Utility Dept. for
Electricity used, which was read.
Upon motion by Mrachek, second by Nass, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass introduced a resolution appropriating $396.00 from the
Park Improvement Fund and ordering payment made to City of Rochester, Public
Utility Department, for steam heat for auditorium, which was read.
Upon motion by Nass, second by Yeager, that the said resolution be
,adopted as read, and all voting in favor thereof, President Lemmon declared the
said. resolution duly passed and adoLted.

Alderman Nass introduced a resolution appropriating $225.00 from the

Park Improvement Fund and ordering payment made -to D. F. Garland for 3 -30"
Worthington Fairway Units with frames, which was read.
Upon motion by Hanson, second -by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yeager introduced a resolution appropriating $1,299.65 from the
F. E. Williams Estate Fund and ordering payment made to the Park Improvement Fund
to cover expense involved in prmviding free swimming to children during the 19�+2
season, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly -passed and adopted.
Alderman Yeager introduced a resolution appropriating $5,000.00'from thel
treet & Alley Fund for use of the Street & Alley Committee, which was read.
Upon motion by Hanson, second by Na.ss, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Yeager introduced a resolution ordering bids for road oil for
he 1943 season, which was read.
Upon motion by Fryer, Second by Mrachek, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $250.00 from the
eneral Fund and ordering payment made to the Armory Board for the maintainance ofi
he Armory building in lieu of the amount paid by the State of Minnesota for the
ighting of the National Guard Armory Building, which was read.
Upon motion by Fryer, Second by Kennedy, that the said resolution be
dopted as read, and all voting in favor thereof, President 'Lemmon declared the
aid resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $1,250.00 from the
eneral Fund and ordering payment made to the Park Improvement Fund for the transfil
f funds to make same available for the purchase of all that part of Block 105,
illson's Addition lying west of the Zumbro River, which was read.
Upon motion by Fryer, second by Kennedy, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
,aid resolution duly passed and adopted.

City Attorney, Desmond B. Hunt, reported that he had been unable -to
collect any of the old accounts receivable which were referred to him for
collection some time ago. Upon motion by Fryer, second by Kennedy, the City
Clerk was instructed to cancel all such accounts receivable as had been determined
to be uncollectable.

The matter of answering emergency calls at the Rochester Airport by the
Police and Fire Departments was discussed and upon motion by Fryer, second by
Yeager the Common Council went on record as being in favor of various City
departments answering emergency calls to the said airport.
Upon motion by Mrachek, second -by Kennedy the meeting was adjourned
until 7: 30 o'clock P. M. February 24, 1943.
