Minutes of an adjourned regula-r meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall in
said Ci-ty on March _loth, 1943.
President Lemmon called the -meeting to order at 7:30 o'clock P.; M., the
following members being present: President Lemmon, Aldermen Fryer, Hanson, Kenne(

Mrachek, Na.ss and Yaeger. Absent: None.
Upom motion by Fryer, second by Mrachek, the minutes of- the meeting of
• March 1, 19-43 were approved.
President Lemmon stated this as being the time and place set for the
opening of bids for furnishing a car for the use of the Rochester Fire Department,

A communication from the Firemen's Civil Service Commission•appro-ving
the -temporary- appointments of John W. Lawler, R. -E. Ginther and Arthur Weber,
subject to passing a satisfactory medical examination, was read and President
Lemmon ordered that -same be placed on file.
A letter from Mr. F. W. McKellip, City Engineer, Faribault, Minnesota,
in regard to Senate Bill (SF610) providing for the abatement of the tax upon fuel
used for agricultural purposes be extended to cover municipal owned equipment usee

used exclusively for street construction and maintenance purposes
was
read and
,upon motion by Mrachek, second by Fryer, the same was referred to
the
City Attorney
,to contact the Representative from this district and notify Mr. McKellip
of the
action, taken by the Co:mmon Council.

, A notice from the League of Minnesota Municipalities of
the
Municipal

Short Courses to be held at the.University during March -was read
and
upon motion
by Fryer,_second by Kennedy, those interested in various courses
were
granted
permission to attend at City expense.

The recommendation of the Fire Committe that all men in
the
Fire Depart -
pent that enter the Armed Forces are to have their vacation prorated to the tim-e
they have served in the year, was read and upon motion by Fryer, second by
Kennedy, the same was approved.

The recommendation of the Police Civil Service Commission that the
Police Department for .the City of Rochester, consist of One Chief of Police, One
Assistant. Chief of Police, Three Captains of Police,. one of whom shall be in ®h&3rge
of the record department, Three Desk Sargents, -Two Detectives, One Juvenile
Officer and Nineteen Patrolmen, was read.
Also a communication from the Police Committee stating that the said
Committee, had met and approved the recommendation of the Police Civil Service
;Commission dated March 1.0, 1943, in regard.to the personnel of the Police Department
was read and upon motion by Mrachek, second b.y Kennedy, the actions of the Police

iCivil Service Commission and the'Police Committee were approved.

The recommendation of. the Fire Committee and the Fire Chief that the
lbid of Postier & Eggers, in the amount of $1363.'00 -for one Pontiac five passenger t

coupe be accepted, was read and upon motion by Fryer, second by• Kennedy, the same
,was approved and ordered placed on file.
i Upon motion by Yaeger, second by Hanson, the City Clerk was instructed

Ito return the certified checks of the unsuccessful bidders.
The report of the Clerk of the Municipal Court for the week ending
March 6, 1943 showing criminal fines and costs collected $360.90, civil fees
i
received, $2.35; and conciliation court fees $3.00, was read and having been

previously approved by the City Attorney, President Lemmon ordered that same be
placed on file.
The report of expenditures from the City Engineer's Payroll for the
I
month of February, 1943, was read, and President Lemmon ordered that same be placed
on file.

The City Engineer's Trial Balance for the month of February, 1943, was i
read and President Lemmon ordered that same be placed on file.

The report of receipts -and expenditures from the Park Improvement`Fund

The applications of Howard McGoon and Wayne Pew for Driver's License
were each read, and upon motion by Fryer, second by Kennedy, the licenses were
granted.
The application of Harold F. Beilke for a Journeyman Electrician's
License was read, and upon motion by Yaeger, second by Hanson, the license was
granted.
The contract bond of the Skelly Oil Company in the sum of $1664.00
with the United States Guarantee Company as surety, was read and upon motion by
Mrachek, second by Hanson, the bond was approved, the surety thereon accepted and
it was ordered that same be placed on file.
Applications for -Retailers Off, Sale Liquor License, signed by Andrew.C.
Chafoulias, Joe Wallace-, Leo A. Huey, Hazel Kitzman, R. M.- Graen, Chris Margellos
and Eugene Huey, each with a. surety bond in the -sum of $1000.00 with the.'Wester.n

Mayor of said City, at the Charter Election held March gth, 1943,.to hold office
for two years and until his successor is elected and qualified;
That Theo. H. Tollefson is hereby declared to be elected to the office
of City Treas.urer of said City, at. the Charter Election held March gth, 1943, to
hold office for one year and until his successor is elected and qualified;
That Knute Olson is hereby declared to be elected to the office of City

Alderman Fryer introduced a resolution granting a public dance permit�

to Percy Klein, which was read.
Upon motion by Hanson, second by Kennedy that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Hanson introduced a resolution appropriating $943.64 from the
Street & Alley Fund and $162.62 from the Sewer Fund and ordering payment made to
;the Street & Alley Fund for use of equipment and stock used, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
!
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted. �
Alderman Fryer introduced a resolution adopted by ,the Public Utility
Board setting up a play_ of retirement for its employees, which was read.
Upon motion by Fryer, second by Kennedy that the said resolution be i

transfer of funds t.o make same available to pay interest on S.D.P. Bonds,' which

adopted as read, and al-1 voting in favor thereof, President Lemmon declared -the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution accepting the bid of P&Stier
& Eggers for furnishing a 1942 Pontiac Six five passenger sedan coupe for the
use of the City Fire Department at $1363.00, which was read.
Upon motion by Mrachek, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
An ordinance regulating the Police Department of the City of Rochester,
• Minnesota was given its first reading.
Upon motion by Fryer, second by Yaeger and all voting in favor thereof,
the rules were suspended and the said ordinance wa,s given its second reading.
Upon motion by Hanson, second by Fryer and all voting in favor thereof,
the rules were suspended and the said ordinance was given its third and final
reading.
Upon motion by Fryer, second by Yaeger the ordinance was adox)ted as
read.
A motion was made by Fryer, second by Kennedy and all voting in favor
thereof that the various boards and committees controlling the employees of the
various departments be instructed to, work with the City Attorney for the purpose
