Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City on March 29, 1943• President Lemmon called the meeting to order at 7:30 o'clock P— M., the following members being present: President Lemmon, Aldermen Fryer, Hanson, Kennedy, Mrachek, Nass and Yeager. Absent: None. Upon motion by Hanson, second by Fryer, the minutes of the meeting of • March 10, 1943 were approved. Mrs. Theo. Farak appeared at the meeting and presented a protest to oiling the alley running North and South between Fourth and Fifth Avenues, in Head -and McMahons Addition, the protest was signed by Mrs. Theo. Farak, Miss �9 Katherine Fogarty, Edward G.. Schartau, Charlotte Hanson and A. C. DIZiggel, which r was read and President Lemmon ordered that same be placed on file. Mr. James Adams of the Town Taxi Company appeared at the Council meeting and suggested that the speed of all taxi cabs be limited to thirty miles per hour by placing governors on all taxi cabs. Alderman Mrachek asked that the Common Council be given further time to consider the matter. The specifications and estimate of cost of a new roof far the Fire Hall as submitted by the Building Inspector were read and President Lemmon ordered that same be placed on file. A communication from the Firemen's Civil Service Commission stating t_na.t the temporary appointment of Arthur A. Brown as fireman had been approved, was read and upon motion by Kennedy, second by Yeager, the action of the Firemen's Civil Service Commission was approved by the Common Council. A communication from Mr. F. W. McKellip, City .Engineer of Faribault, Minnesota, regarding legislation for the abatement of the four cent tax on gasoline and liquid fuels used by municipalities, was read a;nd upon motion by Nass, • second by Fryer, the Mayor, the City Attorney and.the City Clerk were instructed to cpntact representatives from this locality on the matter. I, The petition of Boyd S. Gardner and Fay D. Gardner to have the following described realestate,, commencing at a point. 33 ft. North of the Southwest corner of,Section 35, Township 107, North of Range 14 West, thence North 1og775 ft. thence East 132 ft. thence South 109. 75 ft thence West to place of beginning, in' the County of Olmsted and State of Minnesota, annexed to the City of Rochester was read and President Lemmon ordered that same be placed on file. Mr_ A. J.. Lentfer, Secretary of the Public Utility Board, presented a 1,resolution setting forth new electric, water and steam rates -as passed by the I said Board on March 29, 1943. President Lemmon ordered that same be placed on i, file.. i I The report of the Public Grounds Committee that the repairs at the Cityl'l ,Weighmaster's building had been completed and that the building has been put in a satisfactory condition, was read -and upon motion by Fryer, second by Kennedy, ;,the report was accepted and ordered placed on file. - • The reports of the Clerk of the Municipal Court for -the week ending ,March 13, 1943, showing criminal fines and costs collected $55.00, civil fees I j ,received $1.95, and conciliation court fees $4- 50; for -the week ending March 20, 1g43, showing criminal fines and costs collected $160:00, civil fees received I,$2.35, and conciliation court fees $1.50; and for the week ending March 27, 1943, showing criminal fines and costs collected $192.50, civil fees received $3.05, j'and conciliation court fees $.50 were each read, and having previously been ap- I ,proved by the City Attorney, President Lemmon ordered that same be placed on file.'! I' The applications for Driver's License of Kenneth Hagen, Richard A. j ,Lewis and Roy C. Lovejoy, were each read and upon motion by Nass, second by i,Kennedy the same were granted subject to the approval of the Chief of Police. � a jThe application of the Foster Electric Company fo•r an Electrical Contractor's License was read, and upon motion by Hanson, second by Nass, the f ;,license was granted. The application of John H. Engle for a Master Electrician's License ,was read and upon motion by Nass, second by Fryer, the license was granted. I. I,. The applications of Leo Nietz and Paul Plantz for a Journeyman Electric' 'ian's License were each read and upon motion by Hanson, second by Mrachek, the 6 . ,licenses were granted. - ! • i i I The license bond of J. P. Huyber in the sum of $1,000.00 with the Aetna ,Casualty & Surety Company as surety and of John H. Engle in the sum of $1,000.00 iwith the Employer's Liability Assurance Corporation Limited as surety and the (Contract bond of Postier & Eggers, Inc., in the sum of $1,463.00 with the Hartford s Accident & Indemnity Company as surety, were each read, and upon motion by Nass, second by Yaeger, the said bonds were each approved and the surety thereon n . accepted and it was ordered that same be placed on file. Alderman Fryer introduced a resolution granting a public dance permit to ,the Whitlock Sonnenberg Post n1215, which was read.. Alderman Hanson introduced a resoluti-on appropriating $454.00 from th-e Park Improvement .Fund and ordering payment made to the City- of Rochester,. Public !Utilities for steam heat, which was -read. Upon motion by Fryer, second by Kennedy that the said resolution be i ,adopted as read, and all voting in favor thereof, President Lemm,on declared the said resolution duly passed and adopted. Alderman. Hanson introduced a resolution appropriating $34.2. g0 from the I .F. E. Williams Es t.F,und and ordering payment, made, to the Park Impr.ovement Fund for cost, of providing skating f.or children,, which was read. I. Upon motion by Nass., second by Fryer that the sadd resolution be adopted' las, read„ and all voting. in favor thereof, President Lemmon declared the ,said Irezolution duly passed and adopted. Ald.erman Nass introduced a. resolution appropriating $244.. g0 from the' l�General Fund and ordering payment made to the City of Rochester, Public -Utilities, 'for steam heat for City Hall, which was read. Upon -motion by Hanson, second by Yaeger that the said resolution be I _ ;adopted as read, and all voting in favor thereof, President Lemmon declared the I said resolution duly passed and adopted, Alderman Yaeger introduced a resolution appropriating $5,365.99 from !General Fund, Code 20 and ordering payment made to General.Fund, Code lg for profit on 1942 sprinkling, which was read. Alderman Yaeger introduced a resolution appropriating $660.72 from the General Fund and ordering payment made to the Standard Oil Company for 2 transport of gasoline, which was read. Upon motion by Fryer, second by Hanson that the said resolution be (adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a.resolution appropriating $66.03 from the General Fund, $2.00 from the S & A Fund and $3,934.15 from the Lighting Fund and ordering payment made to the City of Rochester, Pub. Utilities for electricity used, which was read. Upon motion by Hanson, second by Kennedy that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declar''ed the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating 4 ,363.00 from the Fire Protection Fund and ordering payment made to Postier & Eggers Co'., Inc. for 1942 Pontiac Coupe for Fire Department, which was read._ Upon motion by Hanson, second_by Yaeger that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution appropriating $549.54 from the Fire Protection Fund and ordering payment made to Fred Jorgenson for (work lat the Fire Hall, which was read. Upon motion by Hanson, second -by Nass that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. _ Alderman Yaeger introduced a resolution adopting specifications and astima.ted cost for the construction of a new roof on the fire station, which was read. Upon motion_by Hanson, second by Fryer that the said resolution be adopted as read, and all voting in_favor thereof, President Lemmon declared the ,said resolution duly passed and adopted. _Alderman Fryer introduced the following resolution which was adopted byl, the Public Utility Board:. "Be it and it is hereby resolved by the Public Utility e Board of the City of Rochester, Minnesota, that the existing rates on Electricity, Water, and Steam Heat be changed from ten per -cent discount for payment within ten days from date of bill to TWENTY PER -CENT DISCOUNT for payment within ten is Z Record:. of, Official Procpedia s of, the Common.., Council; of .theiCity, of Rochester, Minnesota, . Mar ch'.: -29 : 19 days from date -of bill and that said additional discount shall apply to all billings with the exception of: (1) The "Wholesale Rate" to the Peoples Co- operative Association and the Olmsted County Power Company. I, (2) Minimum bills for Electricity and Water. (3) The present 3¢ per KWH rate on Street j Lighting and Public Buildings. (4) The present lzi¢ per KWH rate to the City Water Works. And be it and it is hereby further resolved' that the present 3¢ I per KWH rate for Street Lighting and Public Buildings and the i; present 110 uer KWH Power rate to the City Water Works be subject to a 33 173 per -cent discount and that• the present rate for I' Hydrant' 'Rental to the City be discounted 10 per -cent. • ! And be it and it is hereby further resolved that one-half of the twenty -oer-cent discount be forfeited on all bills not , paid within ten days thereof. �! ' And be it and it is hereby resolved that additional discounts herein stipulated be known as WARTIME DISCOUNTS to go into effect { on all billings after June 1, 1943, and that same be subject to ? cancellation or renewal by the Public Utility Board one year from , that date. And be it and it is hereby further resolved that the Hon. Common Council be and is hereby requested to authorize the II !' change in discounts stipulated in this resolution." I Upon motion by Fryer, second by Hanson that'the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared said resolution duly passed and adopted. An Ordinance annexing to the City of Rochester, Minnesota, Lots 1 and i i2 of Gardner's First Addition to the City of Rochester, Minnesota was given its ;first reading. Upon motion by Mrachek, second by Fryer, and all voting in favor thereof ,the rules were suspended and the said ordinance was given its second reading. 0 Upon motion by Hanson, second by Kennedy, and all voting in favor thereof I 'the rules were suspended and the said ordinance was given its third and final :'reading. i Upon motion by Mrachek, second by Nass that the said ordinance be adopted as read, and upon roll call all voting in favor thereof, President Lemmon`' I i declared the said ordinance duly passed and adopted. An Ordinance providing for the formation and government of the Fire (Department of the City of Rochester, Minnesota was given its first reading. 5 °3 March 29•, 1943 Upon motion by Fryer, second by Kennedy, and all voting in- favor,, thereof he rules were suspended and the said ordinance was- given its second reading. Upon 'notion by Hanson, second by Kennedy, and all voting in favo°r thereo. he rules were suspended and. the said ordinance was given its third and final eading. Upon motion by Mrachek, second by Rass.that the said ordinance be dopted as read, and upon roll call all voting in favor thereof, President Lemmon eclared the said ordinance duly passed and adopted. Mayor Grassle stated that the telephone equipment in the police and ire departments is not adequate for receiving and transmitting telephone calls egarding 'civilian warnings and upon motion by Fryer, second by Hanson the dditional telephone equipment necessary was authorized. The installation of same o be supervised by the Chief of Police and the Chief of the Fire Department. Upon motion by Yaeger, second by Fryer the meeting was ad-journed until :00 o' clock P. M.
