President Lemmon called the meeting to order at 7:30 o'clock P. M. the following members being present: President Lemmon, Alderman Fryer, Kennedy, I'. Kjerner, Mrachek, Nass and Yaeger.- Absent: None. II Upon motion by Fryer, second by Kennedy, the minutes.of the meeting of iApril 12, 1943 were approved. i' Mr. Harry Michaels appeared at the meeting and stated that he had arranged for a location in the commercial district to handle his paper business Viand expected to move by the 1st of June. He requested permission to operate at .his residence until that date and upon motion by Fryer, second by Kennedy, Mr. Michaels request was granted. i Mr. Russell Sanders and Mr. Wm. Schacht representing the Junior Chamber of Commerce appeared at the Council meeting and requested that the Common Council ,make an appropriation -for the purpose of.furnishing music on the streets and in public buildings during the date of the gypsy frolic. Upon -motion by Mrachek, second by Yaeger the amount of $199..00 was appropriated to the Junior Chamber 'of Commerce for the furnishing of music at the gypsy frolic. A petition to close the dump between Fourth and Fifth Avenues and Fifth �and Sixth -Street Southeast was read and the matter was referred to the Building ,and Plumbing Inspector-, the City Attorney and the Public Health and Welfare Dept. to be investigated. A communication from the League of Municipalities requesting a poll of I:the sentiment of the Municipalities as to whether or not the 1943 convention should ibe held was read and upon motion by Mrachek,- second by Kennedy, the City Clerk wa.s instructed to report that the Common Council was in favor of the convention .being held in St. Paul on June 14, 15, and 16. A notice from the Police Civil Service Commission that the position on I I the Rochester Police force held by Eugene M. Bronson has been declared vacant effective as of March 31, 1943 was read and President Lemmon ordered that same � be placed on file. A copy of a resolution adopted by the Public Utility Board on April 14, , ,1943 requesting the approval of the salary of Relief Operator and Guard at the Hydro Plant in the amount of $1620.00 per year was read and the same was ordered 'placed on file. A complaint signed by Mrs. (Herbert) Edith G. Frost that a street intersection in the Northwest part of Rochester had been torn up and left unfixed,) that various low spots near Cascade Creek had not been filled, that the channel of Cascade Creek was not excavated to proper depth or width, and that dogs were beco-ming a nuisance, was read and upon moti.on by Fryer, second by Mrachek the matter was referred to the Street and Alley Committee and Alderman Nass for investigation. Upon motion by Fryer, second by Mrachek the City Attorney was instructe to draw an amendment to the present dog ordinance which would make owners keep their dogs shut up or on leashes during the months of April, May and June. The resignation of Harold A. Hoffman. from the Rochester Police De-partmeAt effective as of May 6th, 1943 was read and upon motion by Mrachek, second by Fryer the same was accepted. The City Engineer's estimate of.cost of completing the curb and gutter and side walks on Twelfth Street Southeast along Trunk Highway No. 14,.was read and the same. was ordered placed. on file. The report of the Street and Alley Committee, the'City Engineer, and the City Attorney that they had interviewed Mrs. Robert Bluhm in regard to widening Cascade Creek was read and upon motion by Nass, second by Kjerner the report was accepted and ordered placed on file. The report of the Street and Alley Committee, stating that they had requested the City Attorney to give a ruling as to whether or not Lot 16, Block `3, Sunnysid-e Addition is a corner lot or not was read and ordered placed or.. file. The following opinion as submitted by the City Attorney- regarding Lot if Block 3' Sunnyside Addition was read: "Pursuant to your request concerning the status -of Lot No. 16 in Block No. 3 Sunny Side Addition to the City of Rochester, Minnesota, may I advise that some time ago the City of Rochester acquired Lot No. 15 lying directly west of Lot No. 16 and Lot No. 14 lying directly West of Lot No. 13, in said Block for street purpo s es, said Lots No. 14 and 15 being each fifty feet in width. 'This widened First Avenue Southeast, making it seventy feet in width. The question is as to whether or not Lot No. 16 became a. corner lot and was subject to such assessments as the City might make upon the property for sprinkling taxes, etc. By the acquiring of Lots No. 14 and 15 by the City, Lot No. 16 became a corner tot with First Avenue Southeast bordering it on the west and Ten and one-fourth Street Southeast bordering it on the south." The report was accepted and the City Clerk was instructed to send a cope of the.City Attorney's opinion to Mr. Carl J. Alderman Kjerner introduced a resolution appropriating $360.56 from the Street &.Alley.Fund and ordering payment -made to the General -Fund, Code 29 for gas used by Street & Alley Department, which was read. Upon motion by Fryer, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof,' President Lemmon declared the said resolution duly passed and adopted. .Alderman Nass introduced a resolution appropriating $100.69 from the General Fund, $18.00 from the Street & Alley Fund and $3525.31 from the Lighting Fund and ordering payment made to the City of Rochester, Public Utilities, which was read. Upon motion by Yaeger, second by Nass, that the said resolution be ddopted.as read, and all voting in favor thereof, President Lemmon declared the_ said resolution duly passed and adopted. Alderman Yaeger introduced a resolution approving a resolution adopted by_ the Public Utility Board setting the salary of the Relief Operator and Guard at the Hydro Plant at the sum of $1620.00 per year, which was read. Upon motion by Mrachek, second by Fryer, that_the said resolution be adopted as read, and all voting in_fa.vor thereof, President Lemmon declared the said resolution dimly passed and adopted. Alderman. Yaeger introduced a_ resolution granting two public dance permits to Percy Klein, which was read. Upon motion by Yaeger, second by Kjerner, that the said resolution be adopted as read, and all voting in_ favor thereof, President Lemmon_ declared the said resolution d-,uly passed and adopted._ Mayor Grassle presented a communication from the Waters Conley Company requesting permission to construct a barrier from their building to.within 4 feet of the curb at the Northeast and Southeast corner of the building,_this barrier would close off pedestrian traffic on the side walk on the east side of the building. Upon motion by Fryer, second by Yaeger the report i:*as accepted and the matter was left in thehands of the Fire Committee with power to act. I j Alderman Nass reported that the Public Grounds Committee recommended j that the Building Inspector be in charge of the office occupied by himself and the Electrical Inspector and that he be in charge of all records, including those of the Electrical Inspector after electrical inspections have been completed and I j,reported. Upon motion by Fryer, second by Mrachek, the recommendation was j approved. Upon motion by Mrachek, second by Fryer, the meeting was adjourned untie 2. 30 o'clock P.
