Minutes regular meeting of the Common Council of the
of an adjourned
City of Rochester, Minnesota,.,held in the Council Chambers in the City Hall, in
said City on May 19, 1943.

.President Lemmon called the meeting to order at 7:30 o'clock P. M., their
following members being -present:' -President Lemmon, Aldermen Fryer, Kennedy,

Kjerner, Mrachek,, Nass and Yaeger. Absent: None.

Upon. motion by Fryer, second by Yaeger,- the minutes of the meeting of !I

President Lemmon stated this as geing the time and place set for receiv;

ing and opening bids for the furnishing of all labor and materials for the I,
jicompletion of State Project No. 5502-02, Trunk Highway No. 14 on 12th Street S. EII'
!'The bids of C. M. Boutelle in the amount of $4, 04g. 72; L. M. Filler Company in
the amount of $4,154.94; and John F. Hansen Construction Co. in the amount of
I„ $4, 321, 50, were each read and President Lemmon referred the same to the City
, Engineer for tabulation and recommendation.
Yr. J. F. Sheppard extended an invitation to the Mayor and members of I
I I
the Common Council to attend an open meeting to be held in their Union Hall on
,,May 27, 1943 at which time Senator Richardson will be the speaker.

Mrs. Louis Rentz, representing the Ladies Auxiliary of the American �I
Legion and Mrs. John Lawler, representing the Ladies Auxiliary of the Veterans of
I' Foreign Wars, requested permission to sell poppies on the streets on May 29, 1943I
,and upon motion by Fryer, second by Nass the request was granted.

Ibefore the Common Council and protested the passage of an amendment to the present

(dog ordinance and Mrs. 0. W. Schroeder, Mr. Ed Capelle and Mr. James Feller spoke;
in favor of passing the amendment to the ordinance as -read on May 3, 1943. Mayor
iGrassle recommended that a committee be appointed to make a further study of the

�1'ordinance and President Lemmon referred the matter to City Attorney Hunt and the
I,
License Committee.

A resolution adopted by the Rochester and Olmsted County Public Safety
Council requesting that low flying of airplanes over the City and noise caused by'�
same be reduced to the minimum and upon motion'by,Fryer, second by Kennedy, the

Imatter was referred to the City Attorney.to request the authorities in charge of
the flying school to cooperate in reducing the noise and low flying over. the City
if possible.
The porposa.l of the Union National Bank of Rochester, Minnesota to be
Idesignated as a depository for an additional'$50,000.00 of the Public Funds was
read and ordered placed on file.
A protest against the -oiling of a part of Eleventh Avenue, Northeast by
(August A.. Fratzke was read and upon motion by Nass, second by Yaeger the matter
lwas referred to the City Attorney.
The request of the Christy Obrecht Show to play in Rochester on June 3,
�4, 5 and 6, 1943 was read and upon motion by Nass, second by.Yaeger the request
was approved.
A communication from Carl J. Munkholm relative to the decision that his
property is considered a corner lot and requesting the removal of a fence and
(curbing with shrubbery, was read and President Lemmon referred same to the Street
and Alley Committee and the City.EnIgineer.
The Mayor's emergency order given to the City Clerk for the purchase of
approximately 9,000 gallons of gasoline wa.s.read and upon_ motion by Mrachek,
second by Kjerner the same was approved.
A communication from the Department of Taxation regarding payment of
penalty on gasoline tax was read and upon motion by Nass, second by Mrachek the
City Clerk was instructed to furnish an affidavit to the effect that the
remittance could not be made on -an' earl-ier date due to the fact that a Council
meeting was not held until May 19, 1943.
A copy of a letter addressed to Mr. C. L. Methven, Cons.tructi.on Engineer
of- the Minnesota Highway Department, written by the District Engineer in regard
to the completion of the work on 12th Street Southeast was read and upon motion b3
Mrachek, second by Nass, the Mayor and City Clerk were authorized to sign a
contract with the State of Minnesota covering the said project, when same is
received.
A notice of the following appointments by the Bolice Civil Commission
of William P. Bennyhoff, assistant to the Chief in Charge of Records and Carlton
Anderson as Captain, was read and upon.motion by Fryer, second by Yaeger, the
appointments were ap_roved. -
A -notice from the League of Minnesota Municipalities that the Annual
Convention will be held at the Lowry Hotel, St. Paul from June 10 to 12; 1943 was
read and ordered placed on -file. -

The appointments by J. T. Lemmon as acting Mayor, of Lewis Lebeck,
Joseph A. Carroll and -Jesse Jay Roderick as special policeman for duty at the
Waters Conley _Company was read and upon motion by Mra.chek, second by Fryer the
appointments were approved.
The statement of receipts and disbursements by the Park Board during
the month of April, 1943 was read, and President -Lemmon ordered that same be
-ola.ced on f i'le.
The City Engineer's Trial Balance fo`r the month of April, 1943� was read

and President Lemmon ordered that same be placed on file.
The recommendation of the Street and Alley Committee and the City
,Engineer that no City trucks be used for the spring cleanup and that 75% of this
work has been taken care of,was read and upon motion by Nass, second -by Kjerner,
the recommendation was approved.

The reportsof the Clerk of the Municipal Court for the week ending.
�'!May g 1943> showing criminal fines and costs collected $474,40, civil fees
received $.75, and conciliation court fees $6.25; and for the week ending May-15,
1943, showing criminal fines and costs collected $124.00, civil fees received
$5.35, and conailiation..court_fees $4-.75, were each read, and having been previously
approved by the City Attorney, President Lemmon ordered that same be placed on
file.
The contract bond of Woodhouse Bros. in the amount of $789.45 with the
!American Surety Company of New York as surety, the official bonds of Lewis Lebeck
jJesse Jay Roderick, and Joseph A. Carroll for $1,000.00 each and of Ivan B. Boyd
,for $500.00 with the Fidelity and Casualty Company as surety,. and the license
bonds of Bemel Bros. in the sum of $1,000.00 with the Standard Accident Insurancei'

with the,Employers' Liability Assurance Corporation, Limited as surety, were each
read, and upon motion by Mrachek, second by Kennedy, the bonds were approved, thei

The application of Leonard Broich for a license to operate a vending
machine was read and upon motion by Kennedy, second by Fryer, -the license was
granted.
The application of George Barbes for 3.2 beer license "On Sale"'was read,
and upon motion by .Kennedy, second by,Kjerner, the license was granted.
The applications of K.. E. Christopherson, George Barbes. and Henry G.
Smith for 3.2 "Off Sale" Beer license were each read and upon motion by Kjerner,
(second by Mrachek, the licenses were granted..
The applications of Herbert H. Fordham, .George E. Fordham, and Louis C.
Fordham for Journeyman Electrician's License were each read and upon motion by
Fryer, second by Kjerner, the licenses. were granted.
The applications for license to.sell cigarettes of Quality Food Store(2

Swarts Grocery,_ were each read, and upon motion by Nass, second by Kjerner, the

Alderman Fryer introduced a resolution accepting the bid of C. M.
Boutelle fox completing contract for improvement on Trunk-Hi ghway No. 14, S. P.
do. 550?-02, which was read.
Upon motion by Fryer, second by -Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution accepting the collateral
assignment of the.First National Bank and author.izing.the City Treasurer to
execute the proper -papers accepting the said collateral, which was read.
Upon motion by Fryer, second by.Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution accepting the collateral
assignment of the Union National Bank and authorizing the City Treasurer to
execute the proper papers accepting the said collateral, which was .read.
Upon motion by Mrachek, second by Kjerner., that the said resolution be
adopted as read, and all voting in favor- thereof, President Lemmon .declared the
said resolution digly_passed and adopted.

Alderman Kennedy introduced a resolution accepting the collateral

to execute the proper papers accepting the said collateral, which was

Alderman Kjerner introduced a resolution appropriating $400.00 from the)
Park Improvement Fund and ordering payment made to M. L. Bloom for concession

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $1, 425.00 from

Rochester Bonds, which was read.
Upon motion by Mrachek, second by Na.ss, that the said resolution be
adop.t.ed .as read, and :all voting in favor thereof-, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Nass introduced-alresolution appropriating $12,000.00 from -the
Sinking Fund and ordering payment made to the First National Bank of Rochester,
Minnesota for the June lst, 1943, maturity of the City. of Rochester 21 Trunk LinE
Surface Dxainage Sewer Bonds, Numbers 25 to 36 inclusive, ;which was read.
Upon motion by Fryer, second. by K jerner, that the said- res.olution be
adopted as read, and all voting in favor thereof, P-resident Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a. resolution appropriating $347.35 from the
General Fund and ordering payment made to the.Rochester Post Bulletin for officia
printing, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution_ be
adopted as read, and all voting in favor thereof, President Lemmon decla.r.ed 'the
said resolution duly passed and adopted.
Mayor Grassle stated that a fire works display had been planned, to be
held in Silver Lake Park on July 5, 1943, as in previous years and recommended
that the City make an appropriation to defray part of the expense of the display
and upon motion by Fryer, second by Kennedy, the amount of $499.00 was appropriatE
in payment of part of the said display.
Upon motion by Kennedy, second by Fryer, the meeting was adjourned.
