Minutes of a regular meeting of the Common Council of the City of
'Rochester, Minnesota,.held in the Council Chambers, in the City Hall, in said

City, on July,, 6, 1943•
President Lemmon called the meetingIto order -at 2:00 o'clock P. M.,
;the following members being present: Lemmon, :Fryer, Kennedy, Kjerner, Mrachek,
Wass, and Yaeger. Absent: none. -
Upon motion by Yaeger, second by Mrachek, the minutes of the meeting

June 7, 194-3, were approved. i

Mr -.'William Buss appeared at the Council meeting and urged that the

liamendment to the present dog ordinance be passed.
r A petition protesting the passage of the proposed amendment to the
present dog• ordinance signed by 255 residents of the City of Rochester, was read
land President Lemmon ordered that the same be placed on file.
A letter from the State of Minnesota, Department of Highways, trans-
mitting a fully executed copy of an agreement between the State of Minnesota and
the City of Rochester relative to the completion of the•balance of the sidewalk,

!,curb and gutter provided for under Agreement No. 282 was read and'President
;,Lemmon ordered that same be placed on file.
The Mayor's appointment of Paul Schmidt as Special School Policeman

'for duty at the public schools was read and upon motion by Mracheck, second by I;
Kjerner, the a
( ppointment was approved.

The - request of th-e Rochester Fire Department Relief Association for

approval of first -mortgage loans to C. B. Kittlekamp in the sum of $2200.00 and
Carl W. Ranf ranz in the sum of $2000.00 was read and the same was referred to
;the Finance Committee. I.
I' A notice of injury to Mrs. Ophelia B. Plemling and claim-6f damage in
Lthe sum of $3000.00 was read and upon motion by Mrachek, second by Kennedy, the I

same was referred to the City Attorney.

The request of Gordon S. Benson for leave of absence from the Rochester,
Fire Department while in the armed forces of the United States was read and upon
motion by Fryer, second by Naas, the request was granted.
The Mayor's emergency order given to the City Clerk for the purchase
i,
;,of approximately 8000 gallons of gasoline was read and upon motion by Mrachek,
second by Kjerner, the same was approved and President Lemmon ordered same
j placed on file. II
A copy of a resolution adopted by the Board of Park Commissioners
awarding a contract to Alvin Benike for the removing and relaying of a stage

(floor in the Mayo Civic Auditorium was read and President Lemmon ordered that
same be placed on file..
The following resolutions_ adopted by the Commissioners of the Sinking
Fund of the City of Rochester, Minnesota during the month of June, 1943 were
read:
"That the following transfers be made in the Sinking Fund
to make funds available for July 1, 1943 Light and Water ,Bond
interest maturities: $23.75 from Code 23 to Code 11; $547.50
from Dode: 9 to Code 3; and $66. 30 from Code 5 to Code 23. "
"That the following transfers of balances of interest
received on investments in the Sinking Fund be made 'to make
same available for investment: $5909.94 from Code 9 (Interest
on L ght Depreciation -Reserve) to Code 9 (Funds for Investment,
Light Depreciation Reserve); $2167.19 from Code 11 (Interest
on Waterworks Depreciation. Reserve) to Code 10 (Funds for
Investment, Waterworks Depreciation Reserve); $1082.63 from
Code 20 (Interest on -Investments, Electric Department
Extensions Reserve) to Code 19 (Funds for Investment,
Elec. Department Extensions):"
"That the sum of $3497.50 be and the said sum is hereby
appropriated from the Sinking Fund and ordered paid to the
Interest Fund, (3375.00 from Code 3 Sinking Fund to Code 2,
Interest Fund, and $112.50 from Code 23 Sinking Fund `to
Code .3, Interest Fund) for transfer of funds to make same
available for payment of July 1, 1943 maturity of City of
Rochester Light_and Water Bond Interest."
"That the sum of $20,000.00 be and the said sum is
hereby appropriated from•the.Sinking Fund and ordered paid
to the First National Bank of Rochester, Minnesota, for the
July 1st, 1943 maturity of City of Rochester, Light Bonds,
$15,000.00 (Code 4) and for the July 1st, 1943 maturity of
City of Rochester, Water• Bonds, $5,000.00 (Code 5). n
"That the sum of $49, 590.00 be and the said sum is
hereby appropriated from the .Sinking Fund and ordered paid
to the First National Bank of Rochester. Minnesota, for
the purchase of six United States Savings Bonds, Series
F, (issue price $7400.00 each), one United States Savings
Bond, Series F, (issue price $3700.00)-and two United
States Savings Bonds; Series F, (issue price $740.00 each)
for Sinking Fund investments,.•the same being purchased
for the Electric Light Depreciation Reserve investments."
"That the sum of $77,000.00 be and.the same is hereby
appropriated from the Sinking Fund and ordered paid to
the Federal Reserve Bank of Minneapolis, Minnesota, for
the purchase of $77,000.O0 United States 1 % Treasury
Notes of Series A-1947, for Sinking Fund investments, the
same being purchased for the following sinking fund
reserves: Electric Light•Depreciation Reserve, $11,000.00;
Waterworks Depreciation Reserve- $10,000.00; Electric
Department Extensions Reserve, �51,060.00; Steam
Department Depreciation Reserve, $3,000.00; and City
Warehouse Reserve, $2,060.00."
Upon motion by Fryer, second by Kennedy, the action of the Sinking Fund
Commissioners was approved.
A petition for the vacation of the public alley now lying and being
between Lots 18 and 19 and -Lots 17 and 20, in Block 6, in A. W. Kutzky's Addition
was read•and the same was referred to the'Street and Alley Committee.
The reports of expenditures from the City Engineer's payroll for the
months of,May and June, 1943, were read, and the same were ordered placed on file.

showing 279 loads weighed and receipts of $27.90, were each read, and President
Lemmon referred same to the Finance Committee.

June 5, 1943, showing criminal fines and costs collected $342.60, civil fees I;
Ilreceived $3.55, and conciliation court fees $1.50; for the week ending June 12,
11943, showing criminal fines and costs collected $352.20, civil fees received
$13.65, and conciliation court fees $3.00; for the -week ending June 19, 1943,
showing criminal fines and costs collected $179.40, civil fees received $2.95,
'and conciliation court fees $.50; and.for the week ending June 26, .1943, showing

The contract bond of C. M. Boutell.e for $4,048.72 with the Fidelity
and Casualty Company of New York as surety and the official bond of Ruel E.

Gatewood in the sum of $500.00 with the Western Casualty and Surety Company as
!'surety, were each read, and upon motion by Mrachek, second by Kennedy, the bonds
;were approved, the surety thereon accepted and it was ordered that same be placedli
on file.

read and upon•motion by Hass, second by Mrachek,.the license was granted.
The application of the.U. S. Fire Works Company for a Fireworks permit
was read and -upon motion by Mrachek, second -by Fryer, the.permit was granted.
The application of Harold A. Witzke for, a license to sell non -intoxicate
malt liquors "Off Sale", was read, and upon motion by Kass, second-by.Kjerner,
the license was.granted.

Alderman Fryer introduced•a resolution granting two -public dance
,,permits to Perky Klein, which was read.

said resolution duly passed' and adopted. j
Alderman Fryer introduced a' resolution appropriating $542.57 from the
General Fund and ordering payment made to the -Chicago Great Western Railway Co.
(for freight on petroleum asphalt, which was read.

Upon motion by Fryer, second by Kennedy, that --the said resolution be
('adopted as read; and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and - adopted.
Alderman Fryer introduceda resolution appropriating $902.34 from the

General Fund and ordering payment made to the Skelly Oil Company, for petroleum ;
asphalt, which was read.
Upon motion by Kennedy, second by Kjerner, that, the said resolution be

as read, and all voting in favor thereof, President Lemmon declared the

said resolution duly passed and adopted.
Alderman -Fryer introduced a resolution appropriating $313.20 from the
;General Fund and ordering payment made to the State of Minnesota, Commissioner ofl
Taxation, for inspection fee and state gas tax on a•car of gasoline, which was
,,read.
Upon motion by Kjerner, second by Kennedy, that the said resolution b•e

Alderman Fryer introduced *a resolution appropriating $3497. 50 from the
Interest, Fund and ordering payment made to the First National Bank of Rochester,

Alderman Kennedy introduced a.resolution appropriating $410.•00 from -the
Permanent Improvement Revolving Fund and ordering payment made to the First
National Bank of Rochester, Minnesota for maturity of interest on. City of-Rocheste
P. I. R. Bonds, which was read.
Upon motion by Mrachek,_ second by Kennedy, that the said resolution be
adopted, as read, and all voting in favor thereof, President Lemmon declared .the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $201.96 from the
General Fund and ordering payment made to Francisj. McGovern Agency for insurance
premium, which was read.
Upon motion by Blass, second by Fryer, . that the -said resolution be
adopted as read, and all.voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.,
Alderman Kennedy introduced.a resolution appropriating $201.90 from the
General Fund and ordering payment made to Ruth R. Bernard for payment of insurance
premium, which was read. -
Upon motion by Kjerner, second by-Mrachek,-that the said resolution be -
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted. -
Alderman Kennedy -introduced a -resolution appropriating $529.96 from the
General Fund and ordering payment made to Herbert G.,Knopp for payment of
insurance premium, which was read. -
Upon motion by Fryer, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon-declared the
said resolution duly passed and adopted. -
Alderman Kennedy introduced a resolution appropriating $201.90 from the
General Fund and ordering payment made to Mrs. J: M. Hall for payment of insurance
Premium, which was read.
Upon motion. by Kennedy, second by-Mrachek, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said.resolution duly.passed.and adopted.
Alderman Kennedy introduced a resolution opening and maintaining a
Ration Bank Account; which was read.

adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Kjerner introduced a resolution appropriating $499.00 from the
General Fund and ordering payment made to the U. S. Fireworks for the City's share

Alderman Naas introduced a resolution approving. the action of the .Board
of Park Commissioners in awarding a contract to Alvin Benike for.removing and

An Ordinance granting a franchise to the Peoples Natural Gas Company
for a period of 15 years was given its second reading.

The Mayor presented,a copy of a dog,ordinance adopted by the City of
Evanston, Illinois, and upon motion by Nass, second by Kennedy, the City Attorney'
Iwas instructed to draw a proposed amendment to the present dog ordinance similar
to the one adopted by Evanston, Illinois..

The matter of constructing a bridge across the Zumbro river to relieve
the hth Street. bridge of a part of thetraffic to Southeast Rochester was discussed
Land upon motion by Fryer,second by Kennedy, the same was referred to the Common
Council, the Mayor, and the City Engineer to meet with the Board of Park j
ICommissioners to make a preliminary survey as to the location of the new
'proposed bridge.

j, Mayor Grassle stated that at the present time there is a man shortage
at the Reid Murdoch Canning Factory and on farms in this locality and recommended''
including those
that city employees1 working under Civil Service be permitted to work during their,
spare time providing the City was relieved of any liability for prersons injured
'while such employee is employed by others. Upon motion by Mrachek, second by
Nass, permission was granted to City employees to work on essential work providing
they sign a waver, to be prepared by the City Attorney, relieving the City of
Rochester, the Policemen's Relief Association, and the Firemen's Relief Association

of any liability while so employed.
Mayor Grassle announced the reappointment Of Mrs. T. R. Lawler, Dr. G.
IIP. Sheridan, and Dr. Geo. B. Euster.man to the Library Board and upon motion by i
Fryer, second by Kennedy, the appointments were approved. '
Mr. Schmidt residing at 514 Second Street Northwest, requested that a
large elm tree be removed from the alley beside his place and upon -motion by
:Fryer, second by Mrachek, the matter was referred to the Street & Alley Committee
�-with power to act.
