Minutes of a regular meeting of the Common Council of. the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,
on September j, 1943.
President Lemmon called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Lemmon, Alderman Fryer, Kennedy,
Kjerner, Mrachek, Nass, and Yaeger. Absent: None..
Upon motion by Fryer, second by Kjerner, the minutes of the meeting of
August 2, 1943 were approved.
President Lemmon stated this as being the time and place set for a
hearing on the vacation of the public alley between Lots 18 and 19 and'Lots lj and
21 in Block Six, in A. W. Kutzky's Addition to the City of Rochester, Minnesota.
There was no one present wishing to be heard on the vacation of the said alley.
The request of F. M. Feldman, M. D., City Health Officer, that the
Common Council approve an.agreement between the Public Health and Welfare Departme
and the Board of Education, that the said Public Health and Welfare Boar.d.reimbur
the School Board for one half of the salary of a clerk in the nurse's office
instead of setting up a payroll for one-half of the above mentioned clerk's salar
on the city books as previously agreed, was read and upon motion by Mrachek, seco
by Fryer,, the full amount of the City' s share of the salary of a clerk trd : be

employed in the Public Health Office at the school, was appropriated/, the school
reimbursed
to be = &a:& for same when billed to the City.
A request by the Board of Public -Health and Welfare that the Common
Council approve the action of said Board in the appointment of Mr. Walter Zierath
to fill the vacancy caused by the resignation of Mr. Richard Towey,, Assistant
Sanitary Inspector, was read and President Lemmon ordered that same be -placed on
file.
An acceptance by the Peoples Natural Gas Company of the Franchise as set
forth in Ordinance No. 609 was read.and President Lemmon ordered that same be
placed on file.
The requests of Donald S. Crowe and Robert F. Laack for leave of absence
from their duties as patrolman and fireman while serving in the armed forces of
the United States were each read and upon motion by Fryer, second by Kennedy, the
same were granted.
A copy of a resolution adopted by the.Rochester Rotary Club approving
the appointment of a Rochester and Olmsted County Planning Commission by the Count!
Commissioners and the Common Council was read and the same was ordered placed on
file.

endum on Fall Regional Meetings, Post -War Planning School, and Committee Work was;
read, and the -Council went on record as being in favor of regional meetings, the
City Clerk attending committee meetings on current problems,'but uncertain as to
whether a delegate would attend the post-war planning school.
Th-e matter of using a motion picture film in the local theaters during
Fire Prevention Week as prepared by the National Board of Fire Underwriters was

discussed and upon motion by Fryer, second by Kjerner, the purchase of one film
for each theater in the City was authorized and the City Clerk was instructed to

notify Mr. B. P. Caldwell, Jr., Assistant Secretary, of the action of the Common
;,Council.
A copy of a resolution adopted by the Board of'Park Commissioners renting
'the vacant space in the F. E. Williams Business Building at 310 First Avenue S. WI
at $40.00 per month to, the Home Fedetal'Savings and 'LoAn Association, the expense I�
of remodeling the space to be paid by the said Association, was read and the samell

.was referred to the Public Grounds Committee.
A copy of a resolution adopted by the Board of Park Commissioners
'requesting the Common Council to appoint a committee to appraise a parcel of land'
between Sixth and Seventh Streets, Northeast, which the Kruse Lumber Company is
from the Park Board w
,interested in purchasing, was read and the same was referred to the Public Grounds
Commi"tt ee.

DEPARTMENT to the SINKING FUND FOR WATER DEPARTMENT EXTENSIONS -and
Be it and it is, hereby further resolved by the said Board that
the Sinking Fund Commission be and is hereby requested to invest
FIVE THOUSAND DOLLARS($5, 000.00) now available in the SINKING FUND
FOR WATER DEPARTMENT DEPRECIATION RESERVE -and
Be it and it is hereby further resolved by the said Board that
they recommend to the Sinking Fund Commission that the funds

referred to in this resolution be invested in United States 7/9th
percent Treasury Certificates of Indebtedness."
"Be it and it is hereby resolved by the Public Utility Board of
the City of Rochester that the amoB.nt of TEN THOUSAND DOLLARS
($10,000.00) be and is hereby transferred from CASH IN BANKS -
ELECTRIC DEPARTMENT to the SINKING FUND FOR EMPLOYEE'S COMPEN-
SATION RESERVE and that FIFTY FIVE THOUSAND DOLLARS ($55,000.00)
be and is hereby transferred from CASH IN BANKS -ELECTRIC DEPT.
to the SINKING FUND FOR ELECTRIC DEPARTMENT EXTENSIONS with a
request that the Sinking Fund Commission invest said funds and
with the recommendation that same be invested in United States
2% Treasury Bonds of 1951-53; and
Be it and it is hereby further resolved that the Sinking
Fund Commission be requested to invest the amount of THIRTY
THOUSAND DOLLARS ($30,000.00) now available in the SINKING

FUND FOR ELECTRIC DEPARTMENT DEPRECIATION RESERVE and the
recommendation that said funds be invested in United States .

"Be it and it is hereby resolved by the Public Utility Board of
the City of Rochester that the amount of TWENTY THOUSAND DOLLARS
($20,000.00) be and is hereby transferred from CASH IN BANKS -
STEAM DEPARTMENT to the SINKING FUND FOR STEAM DEPARTMENT
DEPRECIATION RESERVE - and
Be it and it is hereby further resolved by the said Board that
the Sinking Fund Commission be and is hereby requested to invest
said funds with the recommendation that same be invested in U.S.
2% Treasury Bonds of 1951-53• "
"Be it and it is hereby Tesolved by the Public Utility Board of
the City of Rochester, Minnesota that "A SINKING FUND FOR WATER
DEPARTMENT EXTENSIONS" be and is hereby established in order that
funds may be available for the improvement to Water Works properties
or _extensions to existing mains at the time, after the present
emergency, when such improvements or extensions are deemed advisable
by the Public Utility Board; and
Be it and it is hereby further resolved by the said Board that
funds be transferred to the said Sinking Fund at the pleasure of
the Public Utility Board and that withdrawals be made from the
said Sinking Fudd by action of the Public Utility Board with the
approval'of the Honorable Common Council; and
Be it and it is hereby further resolved by the'said Board that
the Honorable Common Council be and is hereby requested to
authorize the establishment of the -said Sinking -Fund and to
authorize the Sinking Fund Commission to invest funds which are
transferred to the. said .Fund by the Public Utility Board."
The following copies of resolutions adopted by the Commissioners of the
Sinking Fund were read:
"That the sum of $95,000.00 be and the said sum is hereby
appropriated from the Sinking Fund and ordered.paid to the Union
National Bank of Rochester, Minnesota for the purchase of
$s5,000.0o United States 2% Treasury Bonds of 1951-53, the same
being puuchased for the following, Sinking Fund Investment accounts:
Employees' Compensation Reserve(Code 16) $10,000.00
Electric Department Extensions Reserve(Code 19) 55,000.00
Steam Department Depreciation Reserve (Code 21) 20,000.00"
!'That the sum of $50,000.00 be and the said sum is hereby
appropriated from the Sinking Fund and ordered paid to the
Union National Bank of Rochester, Minnesota for the purchase of
$50, 000.00 United •States '7/Sth % Treasury Certificates of
Indebtedness, Series #E-19 4, the same being purchased for the
following Sinking Fund Investment accounts:
Electric Department Depreciation Reserve (Code $30,000.00
Water Department Extensions Reserve (Code 24).. 15,000.00
Water Department Depreciation Reserve (Code 10) 5 000.00"
'That the sum of $6,000.00 be and the said sum is hereby
appropriated.fra;m the Sinking Fund and ordered paid to the Union
National Bank of Rochester, Minnesota for the purchase of
$6,000e00 United -States 2% Treasury Bonds of 1951-53, the same
being purchased for the City Warehouse Reserve."
Upon motion by Fryer, second by -Kennedy, the foregoing resolutions were
approved and ordered placed on file.
The City Attorney's opinion on the straightening of Cascade Creek was
read and the same was ordered placed on file.
A letter of appreciation from Miss Flora Anderson thanking the Mayor an
Common Council for the kind consideration shown during her absence from work durin
a recent illness, was read and same was ordered placed on file.
The certification of Lavern C. Lind as a patrolman for, regular duty on
the Rochester Police Force effective August 16, 1943 to fill the vacancy created
by Ralph Books, who left the department on October 15, 1942, was read and upon

motion by Kennedy, second by Mrachek, the action of the Police Civil Service
Commission was approved.
The report of the Street and Alley Committee and the City Engineer
'that they have investigated the matter pertaining to the cleaning and opening

The applications of Don Foster for a Driver's License and a Taxicab
License were each read and upon motion by Mrachek, second by Nass, the same were
referred to the License Committee, Chief of Police and City Attorney.
The applications of Mrs. Mae A. Herber, Ray Stevens and August Blazing
for License to sell cigarettes were.each read and upon motion by Fryer, second by
Kjerner,.the.licenses were granted.
The application of Mrs. Mae A. Herber for license to -sell non-intoxicati
malt liquors "Off Sale" was read and upon -motion by Nass, second by Frrer,-the
license was. granted.
The -applications of L. F. Milostan, Herman Dornack, and T. H. Johanson
for Plumbers.License, were each read and upon motion by Mrachek, second by Kennedy
the licenses were granted.
The applications of Mrs. Mae A. Herber, Kenneth Vail and Ray Stevens,.
and August Blazing for license to sell soft.drinks were each read and upon -motion
by Fryer, second by, Mrachek, the licenses were granted..
The applications of Sherman Poole and John J. Dubbels for Driver's

The request of the Town Taxi Company for the transfer of 2 taxicab
licenses was read, and upon motion by Nass, second by Yaeger, the request was -
granted.
The request of .the. Yellow Cab Company for- the transfer of two cab
licenses was read, and upon motion

granted.
.The official bonds of Harry Stanley St•ai and Erick_A. Fitting, each in
the amount of-$5.00.00 with the Fidelity & Casualty Company. of New York as surety,
the license bonds of L. F. Milostan and J.-A. Daly each in the amount of• $1,000.00
with the National Surety Corporation as surety, the license bond of -the Sanitary
Company in the amount of $1,000.00 with the Aetna Casualty & Surety Company as
surety, and the license bond of Herman Dornack in the amount of $1,000.'00 with the
American Surety Company of New York as surety, were each read,' and upon motion by
Mrachek, second by Kennedy, the bonds were approved, the surety thereon -accepted
and it was ordered that same.be.placed on file.
The automobile combination insurance policy of The Rochester Bus Line,
Inc. with limits of liability for bodily injury of $25,000.00 for each person,
$100,000.00 for each accident and $5,000.00'property damage was read, and upon
motion by Nass, second by Fryer, the same -was approved and ordered placed on file.

An Ordinance repealing an Ordinance entitled"An Ordinance Annexing to
the City of Rochester, Minnesota, Lots 1 and 2, Gardner's First Addition to the
City of Rochester, Minnesota," was given its first reading.
Upon motion by Fryer, second by Yaeger, and upon roll call and.all
voting in.f.avor thereof the rules were suspended and the ordinance was given its
(second reading.
Upon motion by Yaeger, second by Mrachek, and upon roll call and all
I.voting in favor thereof the rules were suspended and the ordinance was given its
third and final reading.
Upon motion by Mrachek, second by Nass, that the said ordinance be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
(said ordinance duly passed and adopted.
An Ordinance Annexing to the City of Rochester, Minnesota, Lots 1 and
2, Gardner's First Addition to the City of Rochester, Minnesota, was given its
first reading.

(refilling of fire extinguishers be taken over from the Fire kotection Fund by the
Rochester Firemen's Relief Association as of October 1, 1943, the Firemen's Relief
Association to furnish all labor and materials for the refilling of fire
extinguishers and to collect all fees for refills.
