Minutes of an adjourned regular meeting of the Common Council of the City;
lof Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said

President Lemmon called the meeting to order.at.7:30 o'clock P.M., the
following -members being present: President Lemmon, Alderman Fryer, Kennedy,
!Kjerner, Mrachek, Nass, and Yaeger. Absent: None.
Upon motion by Fryer, second by Kennedy, the minutes of the meeting of
October 4, 1943 were approved.
President Lemmor_ stated this as being the time and place set for a
hearing on the levying of special assessments for the construction of a curb and
,gutter and sidewalk on 12th Street Southeast between 3rd Avenue and llth Avenue
Southeast. There was no one present wishing to be heard.
An agreement. between the Rochester Airport Company and the City of
!Rochester, Mirnesota.which gives title to the recently constructed water main
I
extension through the Rochester Airport as described in the said agreement and
it
'conveys an easement to the City for the maintenance of the said water main and
h the request of the Public Utility Board that the Common Council -authorize the
3:ayor and City Clerk to execute same for the City of Rochester, r..!ere each read

land upon motion by Fryer, second by Kennedy, the Mayor and City Clerk were
authorized to execute the said agreement.
The Mayor's emergency order given to the City Clerk for the purchase of
approximately 8000 gallons of gasoline was read and upon motion by IIrachek, second!
'by Kennedy, the same was approved.
A communication from Frances L. Underleak, County Auditor, stating that
at a meeting of the County Board held on September 29, 1943 the fc11ovinE persons

Lemmon ordered that same be placed on file.

The Mayor's appointment of Oscar P. Frogner as special policeman for the
Waters Conley Company, Plant Protection Department, was read and upon motion by �
Idrachek, second by Kjerner, the appointment was approved,

A notice of the dates and places of regional meetings to be held by the
I
League of Minnesota Municipalities was read, and the same was ordered placed on I,
file.

A request by the Rochester Fire Department Relief Association that the
Common Council approve loans to Gordon Tupper in the amount of $3, 300.00 and to
deorge Moore for $1,700.00 was read and the same was ordered placed on file.

The Mayor's emergency order given to the Purchasing Committee and the
Chief of Police for'the purchase of one Four Door Mercury,automobile for use in
the Police Department was read, and upon motion by Fryer, second by Kennedy, the
same was approved.
The following, budgets were read and ordered placed on file: Street and
Alley Fund, $45,000.00; Sewer Fund, $32,500.00; Bria ge'Fund, $13,000.00; Fire
Department, $9.9,464.Oo; :Board of Park Commissioners,-$47,800.00; Police Departmen
salaries, $56,520.00;' and Police Department miscellaneous expense, $13,553.70.
The recommendation of the Sewer Committee and the City Engineer that a
sanitary sewer in 9 th Avenue S. E. from 5th Street S. - E. to 6th Street S. E. be
not constructed, was read and at the request of two of the petitioners, the
Sewer Committee and tkae City Engineer were requested to meet with them and decide
from 9th Ave, to 6th St. S. E.

A statement of receipts and disbursements by the Board of Park Commissioi

The report of the Street and -Alley -Committee and the City Engineer that
Cascade Creek will be widened in the near future, as soon as equipment is availab

The reports of the Clerk of the Municipal Court 'for the week ending
October 9, 1943, showing criminal fines and costs collected $230.20, civil fees
received, $12.90, and conciliation court fees, $1.75; and for the week ending
October 16, 1943, showing criminal fines and costs collected $297.60, civil fees
received, $9.65, and conciliation court fees, $.50, were each read, and having
previously been approved by the City Attorney, President Lemmon ordered that same
be placed on file.
The City Engineer's recommendation that oiling and flushing of streets
and alleys be paid for from the General Fund and that any new streets when oiled
be charged for, for a period of six years at the regular rate of six cents per
front foot was read and ordered placed on file.
The following list of Post War Projects as recommended by the Street and
Alley Department and the City Engineer was read and ordered placed on file:
Bridges
New bridge at Mayo Park from 2 St. & 2 Ave. S. E. diagonally to 3 St.
and 3 Ave. S. E. across Zumbro River.
Replace East Center Street Bridge across Zumbro River.
Replace Bridge on S Ave. N. W. & 4 St. N. W. across Cascade Creek.
Replace Bridge at 10 St. S. E. & Slatterly Park.
New Bridge over Cascade Creek to connect with 14 St. N. W.
Underpass 2 Ave. N. E. & C.N. W.R.R. tracks, extension of Silver Lake Drive.

Completion of Broadway Trunk Line Sewer from South Broadway Bridge
to Sewer Lift on 11 St. & 3 Ave. S.-E., also Interceptor Sewer as
far North as 9 St. S. E, to relieve 3 Ave. S. E.
Trunk Line Sewer near Slatterly Park to develop property around
Slatterly Park which now cannot have a Sanitary Sewerage System.
The application of George Krudwig for a Plumbers' Licenst was read and
I upon motion by Klass, second by Kennedy, the license was granted.
The application of Mrs. J. N. Brand for a license to sell cigarettes
was read and upon motion by Nass, second by Kjerner, the license was granted.
The applications of Glenn Poole, Al Tilford ana John E. Gordon for
Driver's license, were each read and upon motion by Kjerner,-second by Mrachek,
the licenses were granted.
The application of i;7. L. Ryan Beverage Co. for license to sell non -

intoxicating malt liquors "Off Sale", was read and upon motion by Yaeger, second l

by Kjerner, the license was granted.
The application of the Commercial Refrigeration Company for a permit•t'
place and maintain a sign, was read and upon motion by Mrachek, second by Kennedy,
the permit was granted.

The application of Fred W. Oesterreich for a transfer of cigarette
license., bowling alley license, and soft drink license from Zac Dunlap to himself'
was read and the same were referred to the License Committee with power to act.
The official bond of Oscar P. Frogner in the amount of $1,000.00 and
�I the license bond of George E. Krudwig for $1,000.00 each with the Fidelity &
Casualty Co. of New York as surety, were each read, and upon motion by Mrachek,•.
second by Kjerner, the bonds were approved, the surety thereon accepted and it

by -Fryer, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants on the City Treasurer and make payments accordingly:

Alderman Fryer introduced a resolution granting a public dance permit to
the Veterans of Foreign Wars, which was read.
Upon motion by Nass, second by Fryer, that the said resolution be adopte
as read, and all voting in favor thereof, President Lemmon declared the said
• resolution duly passed and adopted.
Alderman Kennedy introduced a resolution granting 2 public dance permits
to Percy Klein, which was read.
Upon motion by Fryer, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly -passed and adopted.
Alderman Kennedy introduced a resolution levying special assessments for
the construction of a curb and gutter and sidewalk on 12th Street Southeast betwe n
3rd Avenue Southeast and llth Avenue Southeast, which was read.
Upon motion by Yaeger, second by Nass, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Kjerner introduced a resolution appropriating $531.02 from the
and ordering payment made to City of Rochester, P.U.'r
Sewer Fund and $2.00 from the Lighting. Fund/for power, electricity and water,
which was read.
Upon motion by -Kennedy, second by Kjerner, that the said resolution be 11
adopted as read, and all voting in favor thereof, President Lemiion declared the
said resolution' duly passed* and adopted.

the Permanent Improvement Revolving Fund and ordering payment made to the'Street
and Alley fund for reimbursement for the amount of -curb and gutter and sidewall'cs
'assessed to abutting property owners.

Resolutions levying special assessments for sprinkling, -flushing, a.nd/orij
!oiling during the'1943 season were introduced, duly adopted, and ordered placed
l'on file; and made a part hereof, reference to which for moire particulars are
;hereby made.
Upon motion by Fryer, second by Kjerner, City Engineer, Arleigr C. Smith,
iWas authorized to attend the convention of the American Public Works Association
r - to b'e held 'in Chicago, Illinois 'on October 24-27,• 194'3.
�! President Lemmon stated that Mrs. Glen Bowers* had requested that a r
!refund be made on"a water main on the North side of her property on 12th Street
Northeast, and the ma-tter was referred to the Water Committee.
Upon motion by Fryer, second by Yaeger, the meeting was adjourned until
